&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.En data 21 d'agost de 2023, el director general d'Atenció a la Dependència va emetre un informe justificatiu relatiu a la necessitat de convocar l'acció concertada de la prestació d'habitatge supervisat per a persones amb diagnòstic de salut mental, a Inca, per als anys 2023-2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.En data 23 d'agost de 2023, la consellera de Famílies i Afers Socials va resoldre iniciar l'expedient de concertació de la prestació d'habitatge supervisat per a persones amb diagnòstic de salut mental, a Inca, per als anys 2023-2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La Llei 4/2009, d'11 de juny, de serveis socials de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El Decret 48/2017, de 27 d'octubre, pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El Decret 32/2023, de 26 de maig, pel qual s'aprova la Cartera bàsica de serveis socials de les Illes Balears 2023-2027 i s'estableixen principis generals per a les carteres insulars i locals i es modifiquen diverses normatives de l'àmbit social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. El Decret 86/2010, de 25 de juny, pel qual s'estableixen els principis generals i les directrius de coordinació per a l'autorització i l'acreditació dels serveis socials d'atenció a persones grans i persones amb discapacitats, i es regulen els requisits d'autorització i acreditació dels serveis residencials de caràcter suprainsular per a aquests sectors de població.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El Decret 8/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual es determina la composició del Govern i s'estableix l'estructura de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. El Decret 12/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears, modificat pel Decret 16/2023, de 20 de juliol.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. L'Acord del Consell de Govern de 6 de març de 2023 pel qual s'aprova la previsió de les prestacions i els serveis que la Conselleria d'Afers Socials i Esports ha de concertar durant l'any 2023 i es declaren els serveis d'interès econòmic general (BOIB núm. 29, de 7 de març).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Resolució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Convocar l'acció concertada i establir el procediment de la convocatòria de la prestació d'habitatge supervisat per a persones amb diagnòstic de salut mental, a Inca, per als anys 2023-2027, d'acord amb l'annex.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Aprovar el Plec general de condicions tècniques per a la concertació, entre la Conselleria de Famílies i Afers Socials i entitats que gestionen la prestació d'habitatge supervisat per a persones amb diagnòstic de salut mental, que es pot consultar a la Seu Electrònica de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.Publicar aquesta Resolució en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant la consellera de Famílies i Afers Socials en el termini d'un mes comptador des de l'endemà de la publicació, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;També es pot interposar un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la publicació, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Objecte i àmbit d'aplicació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.1. S'estableix el procediment de convocatòria del concert de la prestació d'habitatge supervisat per a persones amb diagnòstic de salut mental, a Inca, per als anys 2023-2027, a l'empara de la Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears, i del Decret 48/2017, de 27 d'octubre, pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.2. Se subjecta a aquest procediment el concert de places de la prestació d'habitatge supervisat per a persones amb diagnòstic de salut mental a Inca. Aquest servei està recollit en el punt 7.5 de l'annex del Decret 32/2023, de 26 de maig, pel qual s'aprova la Cartera bàsica de serveis socials de les Illes Balears 2023-2027, s'estableixen principis generals per a les carteres insulars i locals i es modifiquen diverses normatives de l'àmbit social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.3. D'acord amb l'article 3.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;h)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; de la Llei 12/2018, també és objecte del concert assolir els objectius d'igualtat de gènere i d'innovació en la gestió de les entitats i els serveis públics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Òrgan instructor&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'òrgan instructor del procediment és la Direcció General d'Atenció a la Dependència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Lloc i termini de presentació de sol·licituds&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.1. El termini per presentar les sol·licituds és de set dies hàbils comptadors des de l'endemà que s'hagi publicat aquesta convocatòria en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears. &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Als efectes del que disposen la clàusula 7.3 i la clàusula 9.1, les entitats interessades poden fer la sol·licitud considerant que renuncien al concert anterior a partir de l'endemà de la formalització del nou concert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.2. Les sol·licituds s'han de presentar electrònicament mitjançant el tràmit telemàtic disponible a la Seu Electrònica d'aquesta Administració, al qual, de conformitat amb l'article 66.6 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, s'ha d'adjuntar la sol·licitud específica del procediment, disponible a la mateixa Seu Electrònica, signada electrònicament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. Requisits de les entitats&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.1. Els requisits que han de complir les entitats que es presentin a la convocatòria d'aquest concert social són els següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol class="lower-alpha" start="1"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Estar degudament inscrites en el Registre Unificat de Serveis Socials (RUSS).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Tenir el servei acreditat de conformitat amb el Decret 86/2010, de 25 de juny, pel qual s'estableixen els principis generals i les directrius de coordinació per a l'autorització i l'acreditació dels serveis socials d'atenció a persones grans i persones amb discapacitats, i es regulen els requisits d'autorització i acreditació dels serveis residencials de caràcter suprainsular per a aquests sectors de població, i la normativa complementària insular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;
	&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;
	&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Tenir una experiència mínima d'un any en matèria de serveis per a persones amb diagnòstic de salut mental en l'àmbit dels serveis socials de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Tenir el caràcter d'entitat del tercer sector social, de conformitat amb el que estableix l'article 5.1 de la Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.2. Així mateix, les entitats han de complir els requisits mínims establerts en desplegament del títol VII de la Llei 4/2009, d'11 de juny, de serveis socials de les Illes Balears, com també els requisits que fixen l'article 5 de la Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears, i l'article 4.2 del Decret 48/2017, de 27 d'octubre, pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5. Documentació que s'ha de presentar&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.1. Les entitats interessades que compleixin els requisits que estableix el punt 4 d'aquesta convocatòria han de formular una sol·licitud per a la prestació d'habitatge supervisat signada per la persona representant legal de l'entitat. El model de sol·licitud es troba disponible a la Seu Electrònica de la CAIB (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;https://www.caib.es/seucaib/ca/201/empreses/&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.2. En aquesta sol·licitud s'ha d'indicar el nombre de places que s'ofereixen per concertar amb l'Administració.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.3. A la sol·licitud s'ha d'adjuntar la documentació següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol class="lower-alpha" start="1"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Certificat d'acreditació del servei per concertar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Acreditació de l'experiència mínima d'un any en matèria de serveis per a persones amb diagnòstic de salut mental en l'àmbit dels serveis socials de les Illes Balears, mitjançant una resolució d'autorització o acreditació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaració responsable que l'entitat no està sotmesa a les prohibicions de contractar amb l'Administració, d'acord amb l'article 71 de la Llei 9/2017, de 8 de novembre, de contractes del sector públic, ni a cap dels supòsits de prohibició per ser beneficiària de subvencions, establerts en els apartats 1 i 2 de l'article 10 del Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions, o de la Llei 58/2003, de 17 de desembre, general tributària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaració responsable de no incórrer en cap de les prohibicions que estableix l'article 11 de la Llei 11/2016, de 28 de juliol, d'igualtat de dones i homes, i de no haver estat sancionada per resolució ferma en els darrers quatre anys per la comissió d'infraccions greus o molt greus en matèria de relacions laborals, ocupació, empreses usuàries d'empreses de treball temporal, seguretat social, emigració, moviments migratoris i treball d'estrangers.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Acreditació de solvència financera, segons el document disponible a la Seu Electrònica de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Acreditació de solvència tècnica, segons el document disponible a la Seu Electrònica de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Certificat d'estar al corrent de les obligacions tributàries i de la Seguretat Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaració del nombre total de places acreditades, signada per la direcció del servei, amb la diferenciació entre disponibles i no disponibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Acreditació de la titularitat dels habitatges o de la disponibilitat per qualsevol títol jurídic vàlid per un període no inferior a la vigència del concert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Acreditació del caràcter d'entitat del tercer sector social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaració, signada per la persona responsable de l'entitat, que el servei compleix la normativa general o específica aplicable, tant per la naturalesa jurídica de l'entitat com pel tipus de servei objecte de concertació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Acreditació de la disposició dels mitjans i els recursos suficients per garantir el compliment de les condicions previstes en l'acord d'acció concertada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Comunicació, a l'efecte de l'acreditació preceptiva, dels canvis d'accionariat o de titularitat, per preservar la identitat institucional que hagi justificat l'acord.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.4. La presentació de la sol·licitud suposa que l'entitat autoritza els tècnics de la Direcció General d'Atenció a la Dependència perquè puguin demanar a altres administracions qualsevol documentació, les dades i els informes que considerin necessaris per tramitar l'expedient.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tramitació dels concerts&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.1. Els serveis tècnics de la Direcció General d'Atenció a la Dependència han d'examinar les sol·licituds i la documentació adjunta per determinar si compleixen els requisits que estableix la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.2. En el cas que les sol·licituds no compleixin els requisits legals o els que exigeix aquesta convocatòria o no incorporin la documentació esmentada en l'apartat anterior, es requerirà l'entitat interessada perquè, en el termini de deu dies hàbils, esmeni el defecte o aporti la documentació que hi manca, amb la indicació que, si no ho fa, es considerarà que desisteix de la seva petició, amb la resolució prèvia que s'ha de dictar en els termes que disposa l'article 21 de la Llei 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.3. S'ha de resoldre el procediment de concertació d'acord amb els criteris següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Si el còmput total de places que ofereixen les entitats no supera el nombre màxim de places previstes en el servei i, per tant, hi ha disponibilitat pressupostària suficient per atendre tota l'oferta, les places s'adjudicaran directament a les entitats sol·licitants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Si el còmput total de places que ofereixen les entitats supera la disponibilitat pressupostària, s'actuarà segons els criteris de preferència que preveu la Llei 12/2018 en l'article 6.3:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— L'arrelament de la persona en l'entorn d'atenció i les condicions d'atenció que requereix.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— La implantació a la localitat on s'hagi de prestar el servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— La lliure elecció i la llista d'espera d'accés als serveis.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) En cas que alguna entitat renunciï a la concertació, les places que hagi ofert es distribuiran de la mateixa manera entre la resta d'entitats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7. Formalització dels concerts&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.1. Els concerts que s'estableixin a l'empara d'aquesta convocatòria s'han de formalitzar mitjançant un document administratiu denominat &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;acord d'acció concertada&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, en el qual es faci constar el contingut mínim previst en l'article 8 de la Llei 12/2018, com també les característiques concretes del servei i altres circumstàncies derivades de la Llei 4/2009, de la Llei 12/2018, de la normativa de desplegament i del Plec general de condicions tècniques del concert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.2. En el moment de formalitzar el concert, s'ha de presentar una declaració responsable que es continuen complint els requisits per poder concertar el servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.3. Si alguna de les entitats sol·licitants disposa d'un concert en vigor que finalitza l'any 2023, es considera que l'entitat renuncia al concert anterior a partir de l'endemà de la signatura del nou concert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8. Places del servei i distribució territorial&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8.1. La previsió del nombre màxim de places per concertar a Inca és de 10.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8.2. Aquestes places es poden ampliar d'acord amb el que preveuen la Llei 12/2018 i el Decret 48/2017, de 27 d'octubre, pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials, i tenint en compte el procediment previst en l'article 23.3 del Decret 48/2017.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9. Vigència del concert&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9.1. El concert serà vigent des de l'1 de desembre de 2023, o la data en què es formalitzi, i finalitzarà el 30 de novembre de 2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9.2. El concert es podrà renovar d'acord amb el que preveuen la Llei 12/2018 i el Decret 48/2017.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10. Pressupost i preu màxim del servei&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10.1. L'import màxim estimat per assignar és d'1.140.374,10 € (exempt d'IVA), que es distribuirà entre les anualitats de 2023, 2024, 2025, 2026 i 2027. En tot cas, aquest valor estimat té caràcter orientatiu i no vinculant. La despesa real quedarà limitada pel nombre de places que ofereixi l'entitat i pels serveis que l'Administració requereixi efectivament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10.2. Aquest import s'indica únicament a efectes de publicitat i no suposa cap compromís de despesa. Per això, no consta cap consignació pressupostària, que s'ha d'acreditar en el moment en què es materialitzi el servei de concert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10.3. El cost estipulat és de 76,41 € per plaça i dia per a l'any 2023 i de 78,09 € per plaça i dia per a l'any 2024 i següents, d'acord amb la Resolució de la consellera d'Afers Socials i Esports per la qual s'actualitzen els preus dels serveis concertats, derivada de l'acord sectorial en matèria salarial per a centres especials d'ocupació i centres d'atenció especialitzada de les Illes Balears, inclosos en el Conveni col·lectiu estatal de centres i serveis d'atenció a persones amb discapacitat, pel qual s'emparen els serveis concertats (BOIB núm. 135, de 18 d'octubre de 2022). En aquesta Resolució s' aprova l'actualització de preus dels serveis concertats de tutela judicial, atenció primerenca, suport tecnològic per a l'autonomia personal, acompanyament de sordceguesa, acompanyament de persones amb discapacitat física, habitatge supervisat, salut mental, suport a l'habitatge en les diferents intensitats i servei ocupacional per a salut mental durant els anys 2022, 2023 i 2024. D'altra banda, en l'apartat segon d'aquesta Resolució s'indica que aquests preus s'han d'aplicar des de l'1 de gener de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11. Condicions tècniques d'execució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11.1. Les condicions tècniques d'execució s'han d'ajustar al Decret 86/2010, de 25 de juny, pel qual s'estableixen els principis generals i les directrius de coordinació per a l'autorització i l'acreditació dels serveis socials d'atenció a persones grans i persones amb discapacitats, i es regulen els requisits d'autorització i acreditació dels serveis residencials de caràcter suprainsular per a aquests sectors de població; al Decret 32/2023, de 26 de maig, pel qual s'aprova la Cartera bàsica de serveis socials de les Illes Balears 2023-2027 i s'estableixen principis generals per a les carteres insulars i locals i es modifiquen diverses normatives de l'àmbit social, i a la normativa insular complementària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11.2. El Plec general de condicions tècniques detalla l'acció concertada, les característiques concretes de la població per atendre, el sistema de facturació, el règim de realització amb mitjans aliens, les penalitzacions que s'han d'aplicar en cas d'incompliment de l'entitat, els requisits de qualitat de l'activitat, els aspectes tècnics i econòmics que es poden modificar al llarg de l'execució del concert i el sistema de seguiment i control del concert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11. 3. Les aplicacions informàtiques del Servei d'Atenció a la Discapacitat són les úniques vàlides per gestionar les places del servei i per a qualsevol ús aplicable que es derivi de l'execució d'aquest concert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12. Seguiment&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12.1. Els tècnics de l'habitatge supervisat per a persones amb diagnòstic de salut mental greu són els responsables del seguiment dels casos atesos i s'han de coordinar amb el Servei d'Atenció a la Discapacitat i els serveis socials comunitaris bàsics, de salut, educatius o d'altres que es requereixin.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12.2. Els tècnics del Servei d'Atenció a la Discapacitat poden fer visites de comprovació del funcionament del servei i requerir-ne documentació quan ho considerin necessari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12.3. L'entitat concertada ha de facilitar les actuacions de seguiment i comprovació que dugui a terme la Direcció General d'Atenció a la Dependència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12.4. Així mateix, l'entitat concertada ha de facilitar tota la informació que li requereixin l'òrgan instructor, la Intervenció General de la Comunitat Autònoma de les Illes Balears, la Sindicatura de Comptes o altres òrgans de control extern.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13. Obligacions de les entitats concertades&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Mitjançant el concert social, les entitats que prestin el servei s'obliguen a complir el Plec general de condicions tècniques, que estableix les obligacions de les entitats concertades, i les normes establertes en el títol VII de la Llei 4/2009, en el capítol I de la Llei 12/2018 i en els decrets de desplegament i d'aplicació corresponents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14. Penalitats&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'incompliment de les condicions previstes per prestar el servei pot donar lloc a la imposició de penalitzacions, d'acord amb el Plec general de condicions tècniques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;15. Criteris d'accés dels usuaris i llista d'espera&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.1. El criteri d'accés dels usuaris i la llista d'espera del servei d'habitatge supervisat es regeixen d'acord amb els capítols II i III del Decret 7/2016, de 12 de febrer, pel qual es regulen l'accés al servei ocupacional per a persones amb discapacitat per trastorn mental greu i la gestió de la llista d'espera de les places d'aquest servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.2. Les persones que hagin sol·licitat l'accés a la prestació d'habitatge supervisat i que formen part de la llista d'espera per iniciar el nou servei seran valorades pels professionals del Servei d'Atenció a la Discapacitat i derivades a l'entitat prestadora del servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;16. Publicitat&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;16.1. Les entitats d'iniciativa privada acollides al concert social, juntament amb la seva denominació, han de fer constar en la documentació, en totes les comunicacions (informes, fulls, documents, tríptics de difusió, missatges electrònics, webs, insercions en premsa, articles a diaris i a revistes especialitzades) i en la publicitat l'adscripció funcional del servei a la xarxa pública de serveis socials, segons les indicacions del &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Manual d'identitat corporativa&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; que els facilitarà l'Administració, sempre amb el vistiplau de la Conselleria de Famílies i Afers Socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;16.2. Les entitats d'iniciativa privada acollides al règim de concert social han de col·locar en un lloc visible de les seves instal·lacions la indicació «Servei d'habitatge supervisat concertat amb el Govern de les Illes Balears» amb el logotip corresponent, que els proporcionarà la Conselleria de Famílies i Afers Socials. Així mateix, s'ha de fer referència a aquesta circumstància en les comunicacions i en les relacions que estableixin per escrit amb les persones usuàries del servei concertat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;16.3. Els acords d'acció concertada s'han de publicar en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, de conformitat amb el que estableix la lletra &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;f)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; de l'article 3 de la Llei 12/2018, i al Portal de Transparència, d'acord amb l'apartat &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;g)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; del mateix article.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;17. Prerrogatives de l'Administració&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;17.1. L'òrgan instructor del procediment de concertació té la prerrogativa d'interpretar-lo i resoldre'n els dubtes que sorgeixin durant el compliment. D'altra banda, l'òrgan competent per resoldre el procediment té, a més, la prerrogativa de modificar-lo per raons d'interès públic, acordar-ne la resolució i determinar-ne els efectes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;17.2. Els acords que adopti l'òrgan resolutori a partir de les prerrogatives esmentades posen fi a la via administrativa i són immediatament executius.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;18. Causes d'extinció&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Són causes d'extinció de l'acord d'acció concertada les que estableix l'article 9 de la Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;19. Jurisdicció competent&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La jurisdicció contenciosa administrativa és la competent per resoldre les qüestions litigioses relatives a la formalització d'aquesta acció concertada i també les sorgides entre les parts sobre la interpretació, la modificació, el compliment, els efectes i l'extinció&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
