    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La iniciativa parteix amb els antecedents següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. L'article 70.12 de la Llei orgànica 1/2007, de 28 de febrer de 2007, de reforma de l'Estatut d'autonomia de les Illes Balears determina, en tant que competència pròpia dels consells insulars, l'agricultura, la ramaderia i la pesca; així mateix, segons l'article 73 de la mateixa llei, correspon als consells insulars, en les matèries que aquest estatut els atribueix com a pròpies, l'exercici de l'activitat de foment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La pesca professional a Menorca es vertebra entorn de les confraries de pescadors; aquestes, que tenen com a objectiu la promoció i l'impuls dels interessos pesquers, també exerceixen, entre d'altres, la representació del ram dins del seu àmbit territorial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El Decret 61/1995, de 2 de juny, de regulació de les confraries de pescadors i de les seves federacions (BOIB núm. 80 de 24 de juny de 1995), n'estableix la seva naturalesa consultiva i en determina el seu paper col·laborador amb l'Administració en totes aquelles qüestions que afecten la pesca marítima; el Reial decret 418/2015, de 29 de maig, regula la primera venda dels productes pesquers en l'àmbit estatal (BOE núm. 149 de 23 de juny de 2015), i el Decret 22/2018, de 6 de juliol, regula el desembarcament, la primera venda, la traçabilitat i el control dels productes pesquers a les Illes Balears (BOIB núm. 84 de 7 de juliol de 2018). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Altrament, la Llei 6/2013, de 7 de novembre, de pesca marítima, marisqueig i aqüicultura a les Illes Balears (BOIB núm. 156 de 13 de novembre de 2013) regula l'activitat pesquera professional i en determina les diverses modalitats. La Federació Balear de Confraries de Pesca estima que un 13 % del peix que es comercialitza a la nostra comunitat prové de la flota autòctona. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Sota els contextos legals esmentats, l'interès del Departament d'Economia i Serveis Generals del Consell Insular de Menorca és doble: d'un costat, donar suport i col·laborar amb les confraries de pescadors de Menorca per tal de contribuir al desenvolupament sostenible del sector pesquer, tot equilibrant els recursos marins, els mitjans de producció i les captures com s'adiu en un territori reserva de biosfera, i de l'altre contribuir a millorar la competitivitat i la rendibilitat del sector pesquer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. La convocatòria de l'any 2022 va suposar les concessions dels ajuts següents: a) 38.744,14 € en total a les tres confraries de pescadors de Menorca (el 64,6 % de la quantitat prevista) que van justificar en la seva totalitat; b) 118.000,00 € en total a 42 embarcacions de pesca professional (el 96,7 % de la quantitat prevista) també justificades en la seva totalitat; c) la línia dedicada a la formació professional (10.000 €) va quedar deserta. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Incorporat al pressupost vigent del Consell Insular de Menorca, el Pla Estratègic de Subvencions canalitza i ordena el desenvolupament d'actuacions en matèria de subvencions adreçades a la consecució dels objectius de cada programa per a l'any 2023; en aquest sentit, una de les línies de subvenció del Departament d'Economia consisteix en la convocatòria d'ajuts a les confraries de pescadors de l'illa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. La guerra a Ucraïna ha agreujat la tensió en els mercats energètics, interpel·lant la recuperació econòmica iniciada després de la pitjor època de la pandèmia; tant és així, que les institucions de la Unió Europea han recomanat de mantenir en vigor les subvencions posades en marxa per alleugerir la factura energètica. Sens dubte, el combustible és un dels principals costos d'explotació per a les empreses armadores d'embarcacions professionals de pesca i Menorca és una de les zones d'Espanya on els carburants són mes cars; en aquest sentit, i segons la Confederació Espanyola de Transports de Mercaderies, el preu mitjà del gasoil durant el 2023 és un 43 % més car que el del 2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. L'article 12.3 &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;e &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;del Decret llei 4/2022, de 30 de març, pel qual s'adopten mesures extraordinàries i urgents per pal·liar la crisi econòmica i social produïda pels efectes de la dita guerra, vigeix fins al 31 de desembre de 2023 i permet la justificació de les despeses corresponents a subvencions d'import igual o inferior a dotze mil euros mitjançant una declaració responsable de la persona o entitat beneficiària, sens perjudici de les actuacions posteriors de comprovació i control. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. La convocatòria proposada es regirà per unes noves bases fruit de l'actualització de les publicades al BOIB núm. 131 de 8 d'octubre de 2022. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11. Pel que fa a la normativa europea en matèria subvencionadora, els ajuts a les confraries de pescadors de Menorca no poden considerar-se d'Estat perquè impactaran en una zona geogràficament circumscrita a una regió i els efectes sobre els mercats i els consumidors dels estats membres seran inapreciables, si més no marginals; en canvi, les subvencions a les empreses armadores d'embarcacions professionals de pesca tenen la consideració d'ajuts de minimis al sector pesquer i de l'aqüicultura i s'observa el llindar establert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12. De conformitat amb els articles 3 i 4 de la Llei orgànica 2/2012, de 27 d'abril, d'estabilitat pressupostària i sostenibilitat financera, els compromisos financers que s'assumeixen amb la proposta no repercutiran sobre la situació d‘equilibri del pressupost del Consell Insular de Menorca vigent ni tampoc sobre la capacitat financera de la corporació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tot el que s'ha exposat, de conformitat amb la normativa bàsica aplicable al Consell Insular de Menorca en matèria de subvencions i en el marc del que estableixen les Bases d'Execució del Pressupost vigent d'aquesta corporació,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Atesa la proposta de la consellera executiva del Departament d'Economia i Serveis Generals,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consell Executiu, per unanimitat i en votació ordinària, adopta els acords següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primer. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Aprovar la modificació del Pla Estratègic de Subvencions (PES) del Consell Insular de Menorca per a l'any 2023, aprovat pel Consell Executiu dia 3 de desembre de 2021, en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A la pàg. 284, &lt;strong&gt;on diu&lt;/strong&gt;: &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;«Ajuts a les confraries de pescadors&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Objectius específics: Donar suport a les confraries de pescadors en la promoció, primera venda i altres actuacions d'interès general al sector pesquer.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Efectes previstos: Millora dels punts de venda primera. Manteniment de la rendibilitat del sector pesquer.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Termini d'execució: Anual 2023&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segon. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Aprovar les Bases reguladores dels ajuts del Consell Insular de Menorca a les confraries de pescadors de Menorca i de minimis al sector pesquer menorquí annexades a aquesta proposta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercer.&lt;/span&gt;&lt;/strong&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Aprovar, de forma simultània, la convocatòria corresponent a l'any 2023, que es regirà per les bases a què fa referència el punt anterior d'acord amb les condicions essencials següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; L'objectiu és donar suport a les activitats generals i promocionals de les confraries de pescadors de Menorca i a l'activitat extractiva de recursos pesquers de les empreses armadores menorquines dutes a terme entre l'1 d'octubre de 2022 i el 30 de setembre de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; La finalitat és doble: d'un costat, donar suport i col·laborar amb les confraries de pescadors de Menorca per tal de contribuir al desenvolupament sostenible del sector pesquer, tot equilibrant els recursos marins, els mitjans de producció i les captures, com s'adiu en un territori Reserva De Biosfera, i de l'altre contribuir a millorar la competitivitat i la rendibilitat del sector pesquer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; S'estableixen tres línies d'ajuts:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

Suport a les confraries en la promoció, primera venda i d'altres actuacions d'interès general per a la sostenibilitat del sector pesquer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;B. Suport al sector pesquer per millorar la rendibilitat de les empreses armadores d'embarcacions professionals de pesca, d'arrossegament o d'arts menors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;C. Formació professional per a la millora de les competències professionals dels diferents perfils del sector o que permeti la cobertura de llocs de feina.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La línia d'ajuts C (formació professional) és compatible amb la de suport a les confraries (A) i amb la de suport al sector pesquer (B).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; La dotació pressupostària total és de 182.000 € (partida 5.41500.48900032).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;e)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Els imports globals màxims per línia són: 60.000 € per a la línia A (suport a les confraries), 120.000 € per a la línia B (suport al sector pesquer) i 2.000 € per a la línia C (formació professional).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;f)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; I les quanties màximes per a cada beneficiari són: 22.000 € per a la línia A (suport a les confraries), 12.000 € per a la línia B (suport al sector pesquer) i 500 € per a la línia C (formació professional).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;g)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Es preveu reunir la sol·licitud i la justificació al mateix temps. Els ajuts de les línies A (suport a les confraries) i C (formació professional) s'han de justificar a través d'un compte simplificat; les de la línia B (suport al sector pesquer) mitjançant una declaració responsable sobre el compromís de justificació de les despeses indirectes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;h)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; De les bases reguladores convé destacar el que segueix:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les confraries de pescadors de Menorca, en ser beneficiàries d'uns ajuts d'impacte en una zona d'acció geogràficament circumscrita a la regió i d'efectes inapreciables, si més no marginals, sobre els mercats i els consumidors dels estats membres, no compleixen totes les condicions i criteris fixats per l'art. 107.1 del Tractat de Funcionament de la Unió Europea; per tant, les subvencions que se'ls proposa no poden considerar-se ajuts d'Estat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les empreses armadores d'embarcacions professionals de pesca, d'arrossegament o d'arts menors, amb base a Menorca i dedicades a l'extracció de recursos pesquers, estan sotmeses als requisits i les exigències del Reglament (UE) núm. 717/2014 de la Comissió de 27 de juny de 2014, relatiu a l'aplicació dels articles 107 i 108 del Tractat de funcionament de la Unió Europea a les ajudes de minimis al sector pesquer i de l'aqüicultura. En aplicació d'aquest reglament, en els tres darrers exercicis fiscals no poden rebre més de 30.000 € d'ajuts públics o d'ens privats finançats amb càrrec a pressupostos públics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si l'import total demanat de la línia A (suport les confraries) entre tots els sol·licitants que compleixin els requisits no supera el crèdit de la convocatòria, les sol·licituds es resoldran individualment i es podrà concedir fins al 100% de l'ajut sol·licitat. En cas que el total sigui major al crèdit pressupostari, s'aplicarà el barem de puntuació en funció dels criteris previstos (barques, vendes i socis). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els ajuts al sector pesquer (línia B) depenen del tipus de pesca (arrossegament o arts menors) i del nombre de tripulants. Si el total d'aquests ajuts sol·licitats supera el crèdit disponible, el repartiment es farà, ponderada i proporcionalment, entre els sol·licitants. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si l'import total demanat de la línia C (formació professional) entre tots els sol·licitants que compleixin els requisits no supera el crèdit de la convocatòria, les sol·licituds es resoldran individualment i es podrà concedir fins al 100% de l'ajut sol·licitat. Si l'import global a subvencionar és superior al crèdit disponible, aquest es repartirà proporcionalment entre els sol·licitants que compleixin els requisits.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;i)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; El termini de presentació de sol·licituds serà d'un mes a comptar a partir del dia següent a la data de publicació d'aquesta convocatòria en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;(BOIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Incorporat al pressupost vigent del Consell Insular de Menorca, el Pla Estratègic de Subvencions canalitza i ordena el desenvolupament d'actuacions en matèria de subvencions adreçades a la consecució dels objectius de cada programa; en aquest sentit, una de les línies de subvenció del Departament d'Economia i Serveis Generals consisteix en la convocatòria d'ajuts a les confraries de pescadors de Menorca i de minimis al sector pesquer menorquí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. Objecte&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'objecte d'aquests ajuts és donar suport a les activitats generals i promocionals de les confraries de pescadors de Menorca i a l'activitat extractiva de recursos pesquers de les empreses armadores menorquines que es duguin a terme entre el dia 1 d'octubre de l'any anterior a la convocatòria i el dia 30 de setembre del qual es convoquin. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Finalitat&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els presents ajuts s'emmarquen en l'exercici de la competència de foment que correspon al Consell Insular de Menorca en matèria de pesca, de conformitat amb els articles 70.12 i 73 de la Llei orgànica 1/2007, de 28 de febrer, de reforma de l'Estatut d'autonomia de les Illes Balears (BOIB núm. 32, de l'1 de març de 2007; correcció d'errades BOIB núm. 29, de 28 de febrer de 2008). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Decret 61/1995, de 2 de juny, de regulació de les confraries de pescadors i de les seves federacions (BOIB núm. 80 de 24 de juny de 1995), n'estableix la seva naturalesa consultiva i en determina el seu paper col·laborador amb l'Administració en totes aquelles qüestions que afecten la pesca marítima; el Reial decret 418/2015, de 29 de maig, regula la primera venda dels productes pesquers en l'àmbit estatal (BOE núm. 149 de 23 de juny de 2015), i el Decret 22/2018, de 6 de juliol, regula el desembarcament, la primera venda, la traçabilitat i el control dels productes pesquers a les Illes Balears (BOIB núm. 84 de 7 de juliol de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Altrament, la Llei 6/2013, de 7 de novembre, de pesca marítima, marisqueig i aqüicultura a les Illes Balears (BOIB núm. 156 de 13 de novembre de 2013) regula l'activitat pesquera professional i en determina les diverses modalitats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Sota els contextos legals esmentats, l'interès del Departament d'Economia i Serveis Generals del Consell Insular de Menorca és doble: d'un costat, donar suport i col·laborar amb les confraries de pescadors de Menorca per tal de contribuir al desenvolupament sostenible del sector pesquer, tot equilibrant els recursos marins, els mitjans de producció i les captures, com s'adiu en un territori reserva de biosfera, i de l'altre contribuir a millorar la competitivitat i la rendibilitat del sector pesquer. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Finançament i import màxim&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les ajudes que s'atorguin en el marc d'aquestes bases es pagaran amb càrrec a les partides i als imports màxims que s'estableixin a la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. Activitats subvencionades i terminis &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Línia A. Suport a les confraries:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Objecte: donar suport a les confraries de pescadors en la promoció, primera venda i d'altres actuacions d'interès general per a la sostenibilitat del sector pesquer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Activitats subvencionables (despeses elegibles):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Estudis, propostes o informes (elaborats per tècnics externs qualificats o personal propi).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Qualitat i traçabilitat (despeses de gestió de la qualitat i la traçabilitat, etiquetatge, suport informàtic, millores tecnològiques i similars).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Promoció i campanyes publicitàries (disseny, anuncis, insercions i similars).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Despeses operatives i de funcionament (consums, subministraments, serveis externs i similars).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Personal directament implicat amb les activitats esmentades i fins al llindar màxim fixat a la base 12.3 (sous, salaris i cotitzacions a la Seguretat Social).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Línia B. Suport al sector pesquer:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Objecte: millorar la rendibilitat de les empreses armadores d'embarcacions professionals de pesca, d'arrossegament o d'arts menors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Activitat subvencionable (despeses elegibles): &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'explotació extractiva de recursos pesquers (despeses d'explotació: assegurances; transports; serveis externs; sous, salaris i cotitzacions empresarials del personal contractat; subministraments, excloent el combustible; comunicacions i similars).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Línia C. Formació professional:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Objecte: donar suport a la professionalització del sector pesquer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Activitats subvencionables (despeses elegibles): les confraries i les empreses armadores podran triar la formació adient per al seu personal i també organitzar aquella formació que creguin oportuna i necessària (per al personal propi o no). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Formació contínua que permeti la millora de les competències professionals dels diferents perfils del sector pesquer (matrícula, inscripció, personal docent, material, desplaçament i allotjament).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Formació professional de caràcter ocupacional que permeti la cobertura de llocs de feina del sector pesquer (matrícula, inscripció, personal docent, material, desplaçament i allotjament).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Les activitats subvencionables s'han de dur a terme entre l'1 d'octubre de l'any anterior a la convocatòria i el 30 de setembre del qual es convoquin.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5. Naturalesa dels ajuts i règim de compatibilitat amb altres subvencions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Aquestes subvencions són de caràcter voluntari i eventual i es poden anul·lar, revocar i reintegrar en tot moment per les causes previstes en la llei o en aquestes bases; no generen cap dret a l'obtenció d'altres subvencions en anys posteriors i no es poden al·legar com a precedent. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Les empreses armadores d'embarcacions professionals de pesca, d'arrossegament o d'arts menors, amb base a Menorca i dedicades a l'extracció de recursos pesquers, estan sotmeses als requisits i les exigències del Reglament (UE) núm. 717/2014 de la Comissió de 27 de juny de 2014, relatiu a l'aplicació dels articles 107 i 108 del Tractat de funcionament de la Unió Europea a les ajudes de minimis al sector pesquer i de l'aqüicultura. En aplicació d'aquest reglament, en els tres darrers exercicis fiscals no poden rebre més de 30.000 € d'ajuts públics o d'ens privats finançats amb càrrec a pressupostos públics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Per altra part, les confraries de pescadors de Menorca, en ser beneficiàries d'uns ajuts d'impacte en una zona d'acció geogràficament circumscrita a la regió i d'efectes inapreciables, si més no marginals, sobre els mercats i els consumidors dels estats membres, no compleixen totes les condicions i criteris fixats per l'art. 107.1 del Tractat de Funcionament de la Unió Europea; per tant, les subvencions que se'ls proposa no poden considerar-se ajuts d'Estat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La línia d'ajuts C (formació professional) és compatible amb la de suport a les confraries (A) i amb la de suport al sector pesquer (B).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Tots els ajuts que s'atorguin de conformitat amb aquestes bases són compatibles amb la concessió d'altres subvencions, sens perjudici de l'obligació de les entitats beneficiàries de comunicar-ho al Consell Insular de Menorca en la forma establerta en la base 13.e&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. L'import de totes les subvencions concedides, en cap cas podrà superar, de manera aïllada o amb concurrència amb altres ajuts, el cost de l'activitat subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. Requisits dels beneficiaris&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Poden ser beneficiàries dels ajuts previstos a la línia A (suport a les confraries), les confraries de pescadors de Menorca constituïdes d'acord amb el que preveu el Decret 61/1995, de 2 de juny (BOIB núm. 80 de 24 de juny de 1995).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Poden ser beneficiàries dels ajuts previstos a la línia B (suport al sector pesquer), les empreses armadores d'embarcacions professionals de pesca, d'arrossegament o d'arts menors, amb base a Menorca i dedicades, activament, a l'extracció de recursos pesquers (peixos, crustacis i mol·luscs); s'exclou el marisqueig i l'aqüicultura (art. 4 de la Llei 6/2013, de 7 de novembre, de pesca marítima, marisqueig i aqüicultura a les Illes Balears).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Poden beneficiar-se dels ajuts previstos a la línia C (formació professional), les confraries i les empreses esmentades en els dos punts anteriors. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Aquelles empreses armadores d'embarcacions professionals de pesca, d'arrossegament o d'arts menors, amb base a Menorca i dedicades, activament, a l'extracció de recursos pesquers que hagin superat el llindar d'ajuts de minimis referit a la base 5.2, no poden ser beneficiàries dels ajuts relatius a les línies B i C.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. En qualsevol de les tres línies subvencionadores, no poden ser-ne beneficiàries les persones físiques o jurídiques en les quals hi concorri alguna de les prohibicions establertes en l'art. 10 del Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions (TRLS) i l'art. 13 de la Llei 38/2003, de 17 de novembre, general de subvencions (LGS). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7. Presentació de les sol·licituds&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Les sol·licituds s'han de presentar formalitzades electrònicament mitjançant el model normalitzat adjunt a aquestes bases (versió de l'annex I que pertoqui) i que es troba a la seu electrònica (www.cime.es).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. A la sol·licitud s'ha d'adjuntar la documentació següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A. Documentació administrativa&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Si el sol·licitant és persona física, DNI o NIE en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Si el sol·licitant és persona jurídica, escriptura de constitució o modificació, estatuts o reglament intern de funcionament inscrits en el registre corresponent (si fos necessari de conformitat amb els estatuts, han d'aportar certificat de l'acord adoptat per l'òrgan de govern de l'entitat per sol·licitar l'ajuda i designar-ne representant).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Si el sol·licitant és persona jurídica, CIF del sol·licitant.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Documentació acreditativa de la vigència del càrrec de representant legal en virtut del qual actua qui presenta la sol·licitud i, si escau, acreditació de l'autorització corresponent i suficient, en cas que la presenti una persona diferent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) Si es tracta d'una agrupació de persones físiques o jurídiques, una comunitat de béns o una altra agrupació econòmica sens personalitat jurídica, han de sol·licitar l'ajut totes les persones que la integren i adjuntar-hi els DNI (en el cas de persones físiques) o la documentació acreditativa de la personalitat jurídica de cada un dels integrants. Així mateix, han de designar un únic representant i un únic domicili per a notificacions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f) Acreditació de la representació i NIF o CIF del representant, si la sol·licitud es presenta en nom d'un altre (model de representació apud acta electrònic disponible al tràmit).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;g) Declaració responsable, signada pel sol·licitant o pel seu representant legal, de no estar sotmès a cap de les circumstàncies que determinen la impossibilitat d'obtenir la condició de beneficiari o entitat col·laboradora de les subvencions públiques recollides en l'art. 10 del TRLS (annex II).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;h) Declaració responsable, signada pel sol·licitant o pel seu representant legal, relativa a les subvencions o ajudes obtingudes i sol·licitades d'altres institucions públiques o privades per realitzar la mateixa activitat (annex III).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;i) Declaració de les dades bancàries de la persona o entitat beneficiària de l'ajut (formulari model disponible al tràmit).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;j) Certificat de trobar-se al corrent de les obligacions tributàries davant de l'Administració de l'Estat i de les obligacions davant de la Seguretat Social (els sol·licitants poden autoritzar el Consell Insular de Menorca a comprovar-ho marcant la casella a l'efecte de l'annex I). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;B. Documentació específica&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Per a les línies A (suport a les confraries) i C (formació professional):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;k) Memòria indicativa de les actuacions subvencionables realitzades o per realitzar. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;l) Annex IV. Relació nominativa de les despeses realitzades i detalls d'altres ingressos i subvencions que hagin finançat l'activitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;m) Certificat emès pel secretari de la confraria, amb el vist i plau del president, sobre les dades que a continuació s'indiquen:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Volum de vendes durant l'any anterior al de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Nombre mitjà de socis durant l'any anterior al de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;n) Estudi específic de les captures dutes a terme durant l'any precedent al de la convocatòria en comparació a altres anys anteriors per poder valorar l'estat de les zones de captura. Les confraries que pesquin dins la Reserva Marina del Nord de Menorca o dins la Reserva Marina de l'Illa de l'Aire han d'especificar aquestes zones en concret.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;o) Memòria i comptes anuals relatius al darrer exercici aprovats per l'òrgan corresponent. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Per a la línia B (suport al sector pesquer):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;p) Informe de vida laboral (autònoms).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;q) Certificat de tripulació 2021 (Institut Social de la Marina o Capitania Marítima).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;r) Declaració responsable sobre ajuts minimis i compromís de justificació de despeses indirectes (annex V).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Quan ja consti en els arxius del Consell Insular de Menorca i es faci constar expressament en la sol·licitud, s'eximeix a les confraries de presentar la documentació més amunt esmentada sota els epígrafs: b); c); d); i).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. D'acord amb els art. 28.3, 28.7 i 53.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; de la Llei 39/2015, de l'1 d'octubre, de procediment administratiu comú de les administracions públiques (LPACAP), les persones interessades no tenen l'obligació de presentar documents originals, llevat que, excepcionalment, la normativa reguladora aplicable exigeixi el contrari; en qualsevol cas, en són responsables de la veracitat dels documents que presentin.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Quan la rellevància d'un document dels aportats per la persona interessada així ho exigeixi, o existeixin dubtes derivats de la qualitat de la còpia, el Consell Insular de Menorca pot sol·licitar de manera motivada l'autenticació d'aquestes còpies aportades i requerir l'exhibició del document o de la informació original (art. 28.5 de la LPACAP).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Pel fet de presentar-se a aquesta convocatòria, la persona física o jurídica interessada presta al Consell Insular de Menorca els consentiments següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) A consultar i comprovar la veracitat de la documentació i de les dades presentades per la persona interessada que tenguin en el seu poder altres administracions públiques, principalment mitjançant les plataformes d'interoperabilitat, les xarxes corporatives o altres sistemes electrònics habilitats a aquest efecte i als quals el CIM tengui accés.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) A consultar l'existència i veracitat de la documentació i de les dades que eventualment la persona interessada hagi considerat oportú no presentar acollint-se al dret de no fer-ho pel fet que hagin estat elaborades per les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els esmentats consentiments només es consideraran atorgats quan no consti en l'expedient l'oposició expressa a l'esmentada consulta o quan la llei especial que sigui aplicable al cas en requereixi el consentiment exprés, en aquest darrer cas serà obligatori que l'Administració el requereixi i que la persona interessada el presti. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. La sol·licitud i la documentació referides en les bases 7.1 i 7.2 s'han de presentar dins del termini establert en la convocatòria i d'acord amb les indicacions següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per mitjans electrònics al registre electrònic de la corporació (www.cime.es) o a qualsevol altre registre electrònic dels legalment previstos (art. 14.2 i 16.4 de la LPACAP).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si algú presenta la sol·licitud presencialment, se'l requerirà per tal que l'esmeni mitjançant la seva presentació electrònica; a aquests efectes, es considerarà com a data de presentació de la sol·licitud aquella en què hagi tingut lloc l'esmena (art. 68.4 de la LPACAP).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Si la sol·licitud o la documentació fossin incorrectes o incompletes, el Consell Insular de Menorca en requerirà la rectificació o el complement necessaris; si en el termini de deu dies hàbils, comptats des de l'endemà del dia que es rebi el requeriment d'esmena de la sol·licitud, la persona interessada no fa la rectificació reclamada o no presenta la documentació requerida, s'entendrà que ha desistit de la seva petició (art. 68 de la LPACAP).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8. Criteris que es tindran en compte per a la concessió dels ajuts i determinació de l'import de la subvenció&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Línia A. Suport a la gestió de les confraries:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si l'import global demanat entre tots els sol·licitants que compleixin els requisits no supera el crèdit de la convocatòria, les sol·licituds es resoldran individualment i es podrà concedir fins al 100 % de l'ajut sol·licitat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cas que l'import global sol·licitat sigui major al crèdit pressupostari, es tindran en compte els següents criteris per al repartiment de l'ajut:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En relació al nombre de barques: fins a 10 barques: 2 punts; d'11 a 19 barques: 4 punts; 20 barques o més: 5 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En relació al volum de vendes: 0'01 punts/tona fins a un màxim de 2 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En relació al nombre de socis: fins a 19 socis: 3 punts; 20 socis o més: 5 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aleshores, s'aplicarà la taula següent: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A partir de 5 punts i fins a 6: el 60 % del pressupost serà subvencionable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A partir de 6 punts i fins a 7: el 70 % del pressupost serà subvencionable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A partir de 7 punts i fins a 8: el 80 % del pressupost serà subvencionable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A partir de 8 punts i fins a 9: el 90% del pressupost serà subvencionable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A partir de 9 punts: el 100 % del pressupost serà subvencionable. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si l'import global a subvencionar després d'aplicar la taula anterior és superior al crèdit disponible, aquest es repartirà proporcionalment entre els sol·licitants que compleixin els requisits i segons els criteris de repartiment assenyalats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La convocatòria podrà establir una quantia màxima d'aquesta subvenció per a cada beneficiari. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Línia B. Suport al sector pesquer:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per al repartiment dels ajuts entre els beneficiaris que compleixin els requisis, es tindrà en compte el següent barem:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Barques d'arts menors amb 3 o més tripulants a bord: 4.000 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Barques d'arts menors amb 2 o menys tripulants a bord: 2.000 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una mateixa empresa pot sol·licitar tants ajuts com embarcacions tengui armades i operatives, sempre que la suma total no superi el 12.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si el total dels ajuts sol·licitats supera el crèdit disponible, aquest es repartirà, ponderada i proporcionalment, entre els sol·licitants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Línia C. Formació professional:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si l'import global demanat entre tots els sol·licitants que compleixin els requisits no supera el crèdit de la convocatòria, les sol·licituds es resoldran individualment i es podrà concedir fins al 100 % de l'ajut sol·licitat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si l'import global a subvencionar és superior al crèdit disponible, aquest es repartirà proporcionalment entre els sol·licitants que compleixin els requisits.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La convocatòria podrà establir una quantia màxima d'aquesta subvenció per a cada beneficiari. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9. Comissió avaluadora dels ajuts &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La Comissió Avaluadora examinarà les sol·licituds presentades i emetrà l'informe que ha de servir de base per elaborar la proposta de resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Aquest òrgan col·legiat estarà integrada pels membres següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;President: el/la conseller/a executiu/va competent en la matèria&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Secretari/ària: un/a funcionari/a del departament on es troba adscrita la matèria&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Vocals: el/la director/a insular competent en la matèria i tres tècnics de l'esmentat departament&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10. Procediment i òrgans competents per a la concessió dels ajuts &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Els ajuts es concediran d'acord amb els principis d'objectivitat, transparència, igualtat, no discriminació i publicitat. Acabat el termini de presentació, les sol·licituds es resoldran individualment; en el cas que els imports globals sol·licitats superin els crèdits pressupostaris, es resoldran per mitjà dels criteris o procediment prevists en la base 8.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. L'inici de l'expedient s'efectuarà per mitjà de l'aprovació de la convocatòria corresponent; una vegada conclòs el procés de tramitació de la convocatòria i immediatament abans de la seva publicació en el diari oficial, s'haurà de remetre a la Base de Dades Nacional de Subvencions (BDNS) la informació corresponent a la convocatòria (art. 20 de la LGS). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La persona a qui correspongui la instrucció es determinarà en la convocatòria i li correspondrà realitzar d'ofici totes les actuacions necessàries per a la determinació, el coneixement i la comprovació de les dades en virtut de les quals s'ha de dictar resolució sobre la concessió dels ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Les sol·licituds presentades dins el termini establert en la convocatòria se sotmetran a l'examen de la Comissió Avaluadora. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Una vegada examinades les sol·licituds per la Comissió Avaluadora, i després que aquesta hagi emès el seu informe, el conseller executiu cap del departament dictarà resolució sobre la concessió o denegació dels ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Quan la quantia de l'ajut proposat per l'òrgan instructor sigui substancialment inferior al sol·licitat, es podrà instar el beneficiari a reformular la seva sol·licitud a fi d'ajustar els compromisos i les condicions de la subvenció atorgable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. La resolució de l'expedient d'atorgament de les subvencions ha de ser expressa i motivada, i ha de fixar, amb caràcter definitiu, la quantia específica de cada una de les subvencions concedides.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. El termini màxim per dictar i notificar la resolució expressa de concessió de subvenció serà de dos mesos comptats des de la data d'acabament del termini de presentació de sol·licituds. El silenci administratiu tindrà caràcter desestimatori.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. La resolució de l'expedient de concessió o denegació dels ajuts es remetrà a la BDNS (art. 20.8 de l'LGS), i es publicarà en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; a efectes de notificació (art. 45.1b de la LPACAP).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11. Abonament dels ajuts&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Es tramitarà l'abonament dels ajuts a la vegada que se n'hagi acordat la concessió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Les subvencions es faran efectives en el termini màxim de 60 dies des del moment que es comprovi que la justificació presentada s'ajusta als requisits exigits en les bases de la convocatòria i tot d'acord amb les disponibilitats de tresoreria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. No es pot pagar la subvenció mentre l'entitat beneficiària no es trobi al corrent en el compliment de les seves obligacions tributàries amb l'Estat, la Seguretat Social i el Consell Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Les subvencions que s'hagin de pagar a persones físiques restaran subjectes a la retenció que mana la normativa reguladora de l'impost sobre la renda de les persones físiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12. Justificació de les despeses&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La justificació de les despeses objecte de subvenció (línies A i C) o la declaració responsable sobre despeses indirectes (línia B) s'han de presentar juntament amb la sol·licitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Justificació de despeses per actuacions subvencionades segons les línies A (suport a les confraries) i C (formació professional): de conformitat amb l'article 75 del Reglament de la Llei general de subvencions (RLGS), aquests ajuts es justificaran mitjançant l'aportació d'un compte justificatiu simplificat que contengui:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a)&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;Memòria justificativa del compliment de les condicions imposades en la convocatòria, amb indicació de les activitats realitzades i dels resultats obtinguts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Annex IV. Relació nominativa de les despeses realitzades i pagades i detalls d'altres ingressos i subvencions que hagin finançat l'activitat. Aquestes despeses han de ser factures a nom de l'entitat beneficiària de la subvenció i que reuneixin els requisits i formalitats legals i han de comptar amb els justificants de pagament bancari corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;S'admetran pagaments en efectiu fins a un màxim de 300 €. Per tal de justificar-los, les factures han d'incorporar l'acreditació del cobrament per part del seu emissor o persona responsable de l'empresa amb capacitat de cobrament. A tals efectes ha de quedar consignada a la factura la data de cobrament, la identificació, amb indicació del nom, NIF i signatura del declarant del cobrament de la factura i el segell de l'empresa (aquest darrer és facultatiu en cas que l'emissor sigui una persona física). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tal d'obtenir una evidència raonable sobre l'adequada aplicació de la subvenció, en la fase de comprovació de la despesa realitzada es sol·licitarà la presentació dels justificants que es creguin oportuns. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Les despeses de personal directament implicat amb les activitats de les confraries (línia A) seran justificables fins a un import màxim de 10.000 € per confraria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Justificació de despeses per actuacions subvencionades segons la línia B (suport al sector pesquer): de conformitat amb l'article 12.3 del Decret llei 4/2022, de 30 de març, pel qual s'adopten mesures extraordinàries i urgents per pal·liar la crisi econòmica i social produïda pels efectes de la guerra a Ucraïna, pot permetre's la justificació de les despeses corresponents a subvencions d'import igual o inferior a dotze mil euros mitjançant una declaració responsable de la persona o entitat beneficiària, sens perjudici de les actuacions posteriors de comprovació i control. En aquest sentit, les despeses indirectes definides en la base 4.2 &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, s'entendran justificades mitjançant la presentació del model de declaració responsable a l'efecte (annex V).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. En la fase de comprovació i control, i mitjançant un procediment aleatori, un màxim del 10 % de les entitats beneficiàries de la línia B (suport al sector pesquer) seran requerits perquè presentin els justificants de les despeses indirectes subvencionades. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Si la documentació presentada és incompleta o incorrecta, l'entitat sol·licitant serà requerida per tal que, en el termini improrrogable de deu dies hàbils, la completi o l'esmeni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. El Consell Insular de Menorca podrà inspeccionar les activitats subvencionades, sens perjudici de les competències que puguin correspondre, per normativa legal o reglamentària, a altres organismes o institucions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13. Acceptació de les subvencions i obligacions dels beneficiaris&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La subvenció s'entendrà acceptada tàcitament un cop transcorreguts quinze dies hàbils d'ençà de la publicació al BOIB de la resolució de l'expedient de concessió o denegació dels ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Tanmateix, les persones o entitats beneficiàries s'obliguen a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Proporcionar la informació sobre l'activitat subvencionada que li requereixi el Consell Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Sotmetre's a les actuacions de comprovació que efectuïn el Consell Insular de Menorca i la resta d'organismes competents per fiscalitzar els comptes públics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Deixar constància de la percepció i aplicació de la subvenció en la seva comptabilitat o en els llibres de registre de l'entitat beneficiària o altra documentació que la substitueixi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Conservar els documents justificatius de l'aplicació dels fons percebuts, inclosos els electrònics, en tant puguin ser objecte d'actuacions de comprovació i control.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) Qualsevol actuació esdevinguda després de la publicació de la convocatòria relativa a les actuacions subvencionades, ha d'esmentar el suport econòmic del Consell Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f) Reintegrar els fons percebuts en els supòsits prevists en l'article 37 de l'LGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14. Revocació i reintegrament dels ajuts. Criteris de graduació de possibles incompliments&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En el cas d'incompliment total o parcial de les obligacions dels beneficiaris d'aquests ajuts, s'iniciarà l'expedient de revocació i consegüent reintegrament dels ajuts segons correspongui. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Pel que fa a la revocació i el reintegrament dels ajuts s'aplicaran els art. 43 i 44 del TRLS i la resta de normativa aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En el cas que no sigui procedent la revocació total de l'ajut concedit, es podrà aplicar un percentatge de minoració en funció de la naturalesa de l'esmentat incompliment. Aquest percentatge s'ha de fixar amb l'informe previ de la instrucció i la notificació al beneficiari; en tot cas, s'haurà de valorar el grau d'incompliment, si hi incorren actuacions doloses o negligents, i també si hi hagut bona o mala fe.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Si a la persona o entitat beneficiària li pertoca i no fa constar de manera expressa el suport del Consell Insular de Menorca segons la base 13.2 &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;e&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, l'import de la subvenció correctament justificada es minorarà en un 1 %.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Les quantitats a reintegrar tenen la consideració d'ingressos de dret públic i se'ls pot aplicar la via de constrenyiment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. L'obligació de reintegrament establerta en aquesta base és independent de les sancions que, en el seu cas, siguin exigibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;15. Infraccions i sancions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El règim d'infraccions i sancions administratives aplicables depèn de l'establert en el títol IV de l'LGS i en el títol V del TRLS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. De conformitat amb l'establert a l'art. 69 de la Llei 4/2022, de 28 de juny, de consells insulars, els òrgans competents per imposar les sancions en cas d'infringir aquestes bases o la normativa aplicable en matèria de subvencions, són:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El conseller executiu, si són lleus o greus.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consell Executiu pel cas de les de caràcter molt greu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;16. Altres disposicions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Recursos administratius: els acords del Consell Executiu pels quals s'aproven les bases i les convocatòries, que no exhaureixen la via administrativa, són susceptibles d'interposar-hi recurs d'alçada davant el Ple del Consell Insular de Menorca. De la mateixa manera, contra les resolucions del conseller executiu cap del departament per les quals es concedeixen o deneguen els ajuts, s'hi poden interposar recurs d'alçada davant el Consell Executiu del Consell Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Normativa general aplicable: en tot allò no previst expressament en aquestes bases regeixen les disposicions que siguin aplicables al Consell Insular de Menorca en matèria de subvencions, especialment les contingudes en:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Llei 38/2003, de 17 de novembre, general de subvencions&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Decret legislatiu 2/2005, de 28 de novembre, pel qual s'aprova el Text refós de la Llei de subvencions de la CAIB&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra aquest acord – que no exhaureix la via administrativa – es pot interposar un recurs d'alçada davant el Ple en el termini d'un mes comptador des de l'endemà que s'hagi publicat, d'acord amb l'article 122 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'esmentat recurs s'entendrà desestimat, si no es notifica la resolució corresponent, quan hagin transcorregut tres mesos des de la seva interposició. Contra la desestimació del recurs d'alçada per silenci administratiu podreu interposar recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
