Aprovar les bases i els formularis que han de regir la convocatòria de subvencions ordinàries a esportistes individuals per resultats esportius sense finalitat de lucre per a l'any 2023.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. Ordenar la seva publicació en el BOIB, d'acord amb l'article 17 de la Llei 38/2003, de 17 de novembre, general de subvencions.&gt;&gt;</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Contra aquest acord, que posa fi a la via administrativa, es pot interposar alternativament un recurs de reposició potestatiu davant l'òrgan que l'ha dictat en el termini d'un mes, comptador des de l'endemà de la recepció d'aquesta notificació, de conformitat amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques; o bé interposar directament un recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma en el termini de dos mesos, comptadors des de l'endemà de la recepció d'aquesta notificació, de conformitat amb l'article 46 de la Llei 29/1998, de 13 de juliol, de la jurisdicció contenciosa administrativa. OBJECTE DE LA CONVOCATÒRIA</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'objecte d'aquesta convocatòria és regular les subvencions, dins dels límits establerts en el pressupost municipal i en els termes del Reglament municipal regulador de subvencions, per donar suport econòmic als esportistes del municipi d'Artà que practiquen esports individuals en base als resultats aconseguits en la seva disciplina.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les subvencions a què fan referència aquestes bases són lliurement revocables i reductibles en tot moment per les causes previstes en la llei o en aquestes bases, no generen cap dret a l'obtenció d'altres subvencions en anys posteriors i no es poden al·legar com a precedent.</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. IMPORT I CRÈDIT PRESSUPOSTARI</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Per a les subvencions que regulen aquestes bases es destina un import màxim de 2.000,00 € dels pressuposts municipals de l'any 2023. La partida pressupostària afectada és la 01 3411 48001 01.</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. PERSONES BENEFICIÀRIES</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Poden acollir-se a la convocatòria de subvencions&nbsp;els esportistes individuals que estiguin federats a l'esport olímpic corresponent i que estiguin empadronats al municipi d'Artà, com a mínim, durant els darrers tres anys.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Poden tenir accés a les subvencions tots els esportistes a partir d'edat escolar. En el cas dels menors d'edat, el perceptor de la subvenció ha de ser el seu representant legal.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Queda reduïda un 35&nbsp;% la subvenció final als esportistes que realitzen una activitat esportiva no olímpica.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Els esportistes professionals que obtinguin ingressos de patrocinadors o entitats esportives de manera regular queden exempts d'accedir a les subvencions (annex IV).</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4. ACTUACIONS SUBVENCIONABLES</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Són subvencionables els resultats i les competicions, en les quals hagin participat els esportistes, corresponents a la temporada 2022/2023.</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5. PRESENTACIÓ DE SOL·LICITUDS, JUSTIFICACIÓ I TERMINIS</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les sol·licituds s'han de formalitzar en un únic model formulari facilitat per l'Ajuntament.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:null"><span style="background-color:null">Aquest model formulari figura com a annex d'aquesta convocatòria i es pot recollir a les dependències a l'Oficina d'Atenció Ciutadana de Can Solivelles (carrer de la Rosa, 5, Artà) i a la delegació de la Colònia de Sant Pere (plaça de la Bassa d'en Fasol, s/n). També es pot descarregar de la web de l'Ajuntament (www.arta.cat).</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">&nbsp;</span></span></span></span><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El formulari i la documentació requerida adjunta s'han de presentar en el Registre de l'Ajuntament o en qualsevol dels registres que preveu l'article 38.4 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú, i han d'anar dirigides a la Batlia.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El termini per presentar les sol·licituds s'inicia a partir de l'endemà de la publicació d'aquesta convocatòria en el </span><em><span style="background-color:null">Butlletí Oficial de les Illes Balears</span></em><span style="background-color:null"> i finalitza dia 20 de novembre de 2023. </span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">6. DOCUMENTACIÓ ESPECÍFICA QUE S'HA DE PRESENTAR </span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La documentació que s'ha de presentar és la següent:</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">a) Fotocòpia del DNI de la persona sol·licitant o del representant legal si aquest és menor d'edat.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">b) Fotocòpia del llibre de família en cas que sigui menor d'edat. ESMENA DE DEFICIÈNCIES</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Si la documentació presentada és incorrecta o incompleta, l'Ajuntament ha de requerir la persona interessada perquè rectifiqui o complementi el que sigui necessari, la qual cosa s'ha de fer en el termini de deu dies hàbils, comptadors a partir del requeriment corresponent.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Si en aquest termini la persona interessada no fa la rectificació reclamada o no presenta la documentació requerida, l'Ajuntament considerarà que desisteix de la seva sol·licitud, després d'haver pres la resolució pertinent, d'acord amb l'article 68.1 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">8. PROCEDIMENT DE CONCESSIÓ </span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El procediment de concessió de les subvencions s'ha de tramitar en règim de concurrència competitiva com a repartiment proporcional entre els resultats de les puntuacions de cada sol·licitud que acompleixin els requisits establerts en el barem.</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">9. RESOLUCIÓ</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La Junta de Govern Local s'encarrega d'ordenar, instruir i resoldre el procediment de concessió.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La valoració tècnica de les sol·licituds, la realitza una comissió avaluadora, creada a aquest efecte a partir dels barems establerts. Aquesta Comissió Avaluadora ha d'elaborar un informe previ per a la Junta de Govern Local. Balear: Campionat de Balears.</span></span></span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Per tenir accés a les subvencions la puntuació mínima ha de ser de 100 punts, tot i que després es pugui veure minvada per posició o esport no olímpic.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Només s'ha de puntuar una prova de cada competició i una dels resultats, i s'ha de triar la màxima puntuació de cada un i s'han de sumar. Si s'arriba als mínims establerts es pot tenir accés a la subvenció. Per establir aquesta puntuació s'ha de tenir en compte el següent:</span></span></span></span></p> <ul> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Resultats: a la puntuació màxima de la taula atorgada a la primera posició, s'ha de restar successivament un 10 % dels punts fins a la vuitena posició.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Competició: per poder tenir accés a les subvencions, l'esportista ha d'haver estat seleccionat per la federació corresponent o haver realitzat la mínima exigida per a cada competició.</span></span></span></span></li> </ul> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">11. QUANTIA</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Els esportistes d'esports individuals que acompleixin la puntuació necessària per tenir accés a les subvencions s'han de repartir entre ells el 100 % de la quantia de la partida subvencionable.</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">12. OBLIGACIONS DE LES PERSONES BENEFICIÀRIES</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Són obligacions mínimes de les persones beneficiàries de les subvencions:</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">a) Acceptar la subvenció. En cas que això no sigui possible, han de renunciar-hi expressament i motivadament, en el termini de quinze dies, comptadors a partir de la recepció de la notificació de concessió de la subvenció.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">b) Acreditar davant l'Ajuntament la realització de l'actuació o les actuacions i l'acompliment dels requisits o de les condicions que determini la concessió de la subvenció, i notificar qualsevol modificació que es produeixi.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">c) Comunicar a l'Ajuntament, en qualsevol moment, l'obtenció de subvencions o ajudes per a la mateixa finalitat no previstes en la sol·licitud.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">d) Sotmetre's a les actuacions de comprovació i facilitar les dades que l'Ajuntament requereixi.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">e) Recollir el patrocini de l'Ajuntament en tots els elements publicitaris i divulgadors de l'actuació subvencionada, en un lloc destacat i de manera clara. </span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">13. ABONAMENT DE LES SUBVENCIONS</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El pagament de les subvencions s'ha de fer una vegada notificat l'acord adoptat a les persones interessades. </span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">14. COMPATIBILITAT AMB ALTRES AJUDES</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Aquestes ajudes són compatibles amb altres subvencions, ajudes, ingressos o recursos, per a la mateixa finalitat, procedents de qualssevol administracions o ens públics o privats, nacionals, de la Unió Europea o d'organismes internacionals.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La quantia de la subvenció no pot ser igual o superior, aïlladament o en concurrència amb altres ajudes o subvencions, al cost de l'actuació subvencionada. </span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">15. INCOMPLIMENT, REVOCACIÓ I REINTEGRAMENT</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'incompliment no esmenable de qualsevol requisit establert en aquestes bases o de la finalitat per a la qual es va concedir la subvenció, pot provocar l'anul·lació total o parcial, la qual cosa han d'acordar els òrgans competents de la corporació. En aquest cas, la persona beneficiària està obligada a reintegrar les quantitats rebudes i els interessos de demora que corresponguin, mitjançant la tramitació prèvia del procediment legal corresponent.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La quantia final a percebre per part de la persona beneficiària o, si escau, l'import que hagi de reintegrar s'ha de subjectar al principi de proporcionalitat en relació al grau d'incompliment.</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">&nbsp;</span></span></span></span><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">16. NORMATIVA D'APLICACIÓ</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les subvencions objecte d'aquesta convocatòria es regeixen pel que disposen les bases anteriors; la Llei 38/2003, de 17 de novembre, general de subvencions (BOE núm. 276, de 18/11/2003); el Reglament municipal regulador de subvencions, aprovat pel Ple de l'Ajuntament d'Artà; la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques; i la resta de normativa que hi sigui d'aplicació, així com, en matèria de protecció de dades personals, el Reglament (UE) 2016/679, del Parlament Europeu i del Consell de 27 d'abril de 2016, relatiu a la protecció de les persones físiques pel que fa al tractament de dades personals (RGPD), i la Llei orgànica 3/2018, de 5 de desembre, de protecció de dades i garantia de drets digitals (LOPDGDD).</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">17. PROTECCIÓ DE DADES PERSONALS</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'Ajuntament d'Artà és el responsable del tractament de les dades personals que s'hagin de presentar amb la finalitat de tramitar el procediment de concessió de subvencions a entitats esportives sense ànim de lucre, així com per la seva gestió, pagament i control.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les dades s'han de conservar mentre puguin presentar-se reclamacions o recursos al procediment esmentat i segons els criteris de política documental i d'arxiu de l'Ajuntament d'Artà.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La base de licitud del tractament és l'article 6.1.</span><em><span style="background-color:null">e</span></em><span style="background-color:null"> del RGPD en compliment d'una missió d'interès públic o l'exercici de potestats públiques, segons el que disposa la Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local, Llei 38/2003, de 17 de novembre, general de subvencions, i la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les dades personals podran ser cedides, en compliment d'una obligació legal, a entitats bancàries per realitzar el pagament, agència tributària o organismes de control i fiscalització.
