&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consell Executiu del Consell de Mallorca, en sessió de dia 18 d'octubre de 2023, ha aprovat el següent acord:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;“La Borrasca Juliette va impactar, entre els dies 26 i 28 de febrer de 2023, en la serra de Tramuntana i altres llocs de l'illa de Mallorca, afectant especialment les comarques agràries de Tramuntana, Raiguer, el Pla, Llevant i Migjorn, que van patir els efectes del fenomen meteorològic advers d'acumulació de neu, temperatures mínimes, pluja, vent i fenòmens costaners, que varen ocasionar greus danys materials. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'episodi va deixar sense subministrament elèctric a més de 25.000 persones prop de 48 hores a l'illa de Mallorca. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Nombroses carreteres tallades per la neu van deixar aïllades persones i animals durant uns quatre dies. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'afectació en la vegetació s'estima en unes 14.167,64 hectàrees forestals la majoria concentrades en la Serra de Tramuntana però també en altres llocs de l'illa de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Davant d'aquesta situació gravíssima i excepcional, el Govern de les Illes Balears ha decidit establir ajuts i altres mesures de caràcter urgent a fi de reparar i pal·liar, en allò que sigui possible, les pèrdues sofertes, contribuint així a recuperar amb la màxima celeritat la normalitat de les zones afectades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Així doncs, el Govern de les Illes Balears ha dictat el Decret Llei 3/2023 de 13 de març, pel qual s'estableixen ajuts i altres mesures urgents per reparar les pèrdues i els danys produïts per la borrasca Juliette en la serra de Tramuntana i altres llocs de l'illa de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Concretament, la Disposició addicional primera punt 3 estableix: &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;“d'acord amb els dos apartats anteriors, els municipis de l'illa de Mallorca i el Consell Insular, i també els ens instrumentals o dependents respectius, sense perjudici de l'exercici, en qualsevol moment, de les competències esmentades i de la resta de competències que els són pròpies d'acord amb la normativa local, poden atorgar ajuts o subvencions a les persones o entitats afectades i, en general, acordar totes les accions de foment que estimin pertinents amb la finalitat de coadjuvar a la recuperació econòmica als territoris municipals i insulars afectats”.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Així mateix, d'acord amb l'article 36.2 lletra b de la Llei 7/1985 de 2 d'abril reguladora de les Bases de Règim Local, és competència del Consell Insular assegurar l'accés de la població al conjunt dels serveis mínims de competència municipal i a la major l'eficàcia i economia en la prestació d'aquests mitjançant qualssevol fórmules d'assistència i cooperació municipal, i amb aquesta finalitat es permet al Consell Insular atorgar subvencions i ajuts amb càrrec als seus recursos propis per a la realització i el manteniment d'obres i serveis municipals, que s'instrumentessin a través de plans especials o altres instruments específics. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Decret pel qual s'estableixen les competències dels departaments del Consell de Mallorca, de data 10 de juliol de 2023 (BOIB 106, 29 de juliol de 2023), estableix entre les competències atribuïdes al Departament de Promoció Econòmica i Desenvolupament Local, l'elaboració, a més del Pla Insular d'Obres i Serveis, dels plans especials i altres instruments específics de col·laboració amb els municipis. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per acord del Ple del Consell Insular de Mallorca, de data 9 de març de 2023 es va aprovar la corresponent modificació pressupostària per la qual s'atribueix a aquest departament una partida pressupostària per import de 5.000.000,00 euros en concepte "A ajuntaments subvencions per tempestes”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consell Executiu del Consell Insular de Mallorca, en sessió celebrada dia 26 d'abril de 2023 va acordar, a proposta del conseller executiu d'Hisenda i Funció Pública, la modificació del Pla Estratègic de Subvenciones i es va incloure en la línia de subvenció/programa Cooperació i Administració Local (904310) del Departament de Promoció Econòmica y Desenvolupament Local les ajuts/subvencions destinades a reparar o restituir els danys produïts per la Borrasca Juliette durant els dies 26 a 28 de febrer de 2023 en els béns, infraestructures, equipaments, instal·lacions i serveis dels Ajuntaments de Mallorca per import de 5.000.000 €, dels quals es va decidir destinar l'import de 2.500.000 € directament als Ajuntaments, com a beneficiaris.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;És urgent i està justificat que el Consell de Mallorca, a l'empara del Decret Llei 3/2023 esmentat, actuï davant d'aquesta catàstrofe per ajudar a reparar aquests danys dins dels municipis de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Amb l'aprovació d'aquesta convocatòria s'inicia el procediment de concessió de subvencions urgents i excepcionals&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;per dur a terme la reparació o restitució dels danys produïts en els béns, elements etnològics, infraestructures, equipaments, instal·lacions i serveis de titularitat municipal dels municipis afectats a Mallorca, així com actuacions de neteja d'arbratge i de finques públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Hi ha crèdit adequat i suficient per cobrir la quantitat de dos milions cinc-cents mil euros (2.500.000,00 €) amb càrrec a l'aplicació pressupostària 65.94310.76208 del pressupost de despeses del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El director insular de Desenvolupament Local ha emès la memòria justificativa d'aquesta Convocatòria de subvencions urgents i excepcionals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En data 10 d'octubre de 2023, la cap del Servei de Desenvolupament Local ha emès informe jurídic d'aquesta convocatòria de subvencions urgents i excepcionals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Intervenció Delegada de la Misericòrdia del Consell de Mallorca ha emès, en data 16 d'octubre de 2023, l'informe favorable de fiscalització prèvia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Atès que, en posterioritat a l'informe de fiscalització prèvia, s'ha procedit a modificar el règim de concessió de les subvencions d'aquesta convocatòria, la cap del Servei de Desenvolupament Local, ha emès nou informe jurídic en data 19 d'octubre de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Intervenció Delegada de la Misericòrdia del Consell de Mallorca ha emès l'informe de fiscalització prèvia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Es constata que la convocatòria de subvencions gestionada pel Consorci Serra de Tramuntana Patrimoni Mundial està destinada únicament a persones físiques, agrupacions de persones físiques, entitats sense ànim de lucre, Comunitats de béns, Comunitats de regants i explotacions agràries que siguin propietaris o arrendataris de terrenys ubicats dins de l'àmbit territorial de la Serra de Tramuntana declarat com Patrimoni Mundial, quedant exclosos els ajuntaments de l'esmentada convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consell Executiu és l'òrgan competent per aprovar i resoldre aquesta convocatòria de conformitat amb l'article 28 lletres f) i m) de la Llei 4/2022, de 28 de juny, de consells insulars en relació amb la base 24.4 de les Bases d'execució del pressuposat per al 2023 i amb l'article 36.f) del Reglament orgànic del Consell de Mallorca vigent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tot això, la consellera executiva de Promoció Econòmica i Desenvolupament Local eleva al Consell Executiu la següent proposta de &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ACORD&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primer.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Aprovar la convocatòria que s'adjunta de subvencions urgents i excepcionals per cooperar en la reparació i restitució dels danys produïts per la Borrasca Juliette durant els dies 26 a 28 de febrer de 2023 en els béns, elements etnològics, infraestructures, equipaments, instal·lacions i serveis de titularitat municipal dels Ajuntaments de Mallorca, així com en actuacions de neteja d'arbratge i de finques públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segon.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Autoritzar una despesa per un import total de dos milions cinc-cents mil d'euros (2.500.000,00 €) amb càrrec a l'aplicació pressupostària 65.94310.76208 del pressupost de despeses del Consell de Mallorca amb el document comptable RC validat núm. 2202300006323. La concessió de les subvencions és condicionada a l'existència de crèdit adequat i suficient en el moment de la resolució de la concessió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercer.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Aprovar els models normalitzats següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaració responsable de no trobar-se en la situació prevista a l'article 11 de la Llei 11/2016, de 28 de juliol, d'igualtat de dones i homes (Annex V).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Model de certificat de la possessió i disposició real i plena dels terrenys o béns necessaris per a l'execució de l'obra o servei (Annex VI)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Un certificat del secretari/secretària de l'entitat local d'estar al corrent en el compliment de les obligacions tributàries amb l'Estat, la Seguretat Social i el Consell de Mallorca i els seus organismes autònoms dependents, d'acord amb l'establert a l'article 48.4 de la vigent Ordenança general de subvencions del Consell de Mallorca (Annex IX)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quart. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Publicar aquesta convocatòria al Butlletí Oficial de les Illes Balears (BOIB) i en la Bases de Dades nacional de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;De conformitat amb l'article 44 en relació amb el 46.6 de la Llei 29/1998, de 13 de juliol, reguladora de la Jurisdicció Contenciosa Administrativa, contra aquest acord no es podrà interposar recurs en la via administrativa, si bé es podrà formular potestativament REQUERIMENT per a la seva anul·lació o revocació en el termini de dos mesos comptadors des del dia que es publiqui al Butlletí Oficial de les Illes Balears amb caràcter previ a la interposició de recurs contenciós administratiu.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;El requeriment s'entendrà desestimat si en el termini d'un mes des de la seva presentació no es notifica resolució expressa. El termini per interposar el recurs contenciós administratiu serà de dos mesos comptadors des de l'endemà en aquell en el qual es rebi comunicació de la resolució expressa sobre el requeriment previ o aquest s'entengui desestimat de forma presumpta. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1.- Objecte&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'objecte d'aquesta convocatòria és cooperar amb els Ajuntaments de Mallorca en la reparació o restitució dels danys produïts a Mallorca per la Borrasca Juliette durant els dies 26 a 28 de febrer de 2023 en els béns, elements etnològics, infraestructures, equipaments, instal·lacions i serveis de titularitat municipal dels Ajuntaments de Mallorca, així com en les actuacions de neteja d'arbratge, finques, parcs i jardins públics, a l'empara del Decret Llei 3/2023 de 13 de març, pel qual s'estableixen ajuts i altres mesures urgents per reparar les pèrdues i els danys produïts per la borrasca Juliette en la serra de Tramuntana i altres llocs de l'illa de Mallorca (BOIB núm.. 33 de 15 de març de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Concretament, la Disposició addicional primera punt 3 estableix: &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;“D'acord amb els dos apartats anteriors, els municipis de l'illa de Mallorca i el Consell Insular, i també els ens instrumentals o dependents respectius, sense perjudici de l'exercici, en qualsevol moment, de les competències esmentades i de la resta de competències que els són pròpies d'acord amb la normativa local, poden atorgar ajuts o subvencions a les persones o entitats afectades i, en general, acordar totes les accions de foment que estimin pertinents amb la finalitat de coadjuvar a la recuperació econòmica als territoris municipals i insulars afectats”.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les subvencions d'aquesta convocatòria es podran destinar a sufragar despeses compreses des del dia 26 de febrer de 2023 fins a la data de publicació de la present convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2.- Beneficiaris&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Poden acollir-se a aquesta convocatòria els ajuntaments de Mallorca que han patit danys produïts per la Borrasca Juliette durant els dies 26 a 28 de febrer de 2023 en els seus béns, elements etnològics, infraestructures, equipaments, instal·lacions i serveis.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per acollir-se a aquesta convocatòria els ajuntaments no hauran d'incórrer en alguna de les prohibicions establertes a l'article 8 de l'Ordenança general de subvencions del Consell de Mallorca (BOIB núm.. 21, de 18 de febrer de 2017 i BOIB núm.. 96, de 4 d'agost de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Queda exclòs d'aquesta Convocatòria el municipi de Palma i el seu Ajuntament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3.- Actuacions subvencionables&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Seran actuacions subvencionables aquelles que es duguin a terme sobre qualsevol bé, element etnològic, infraestructura, equipament, instal·lació o servei de titularitat municipal que hagi resultat afectat per la borrasca Juliette dels dies 26 a 28 de febrer de 2023, així com aquelles actuacions destinades a la neteja d'arbratge i de finques públiques afectades a causa de l'esmentat fenomen meteorològic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Concretament podran ser subvencionables les següents actuacions:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Actuacions de neteja d'arbratge, finques, parcs i jardins públics. S'inclou poda, tala i replantació, sempre que sigui possible de la mateixa espècie.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Actuacions de reparació i reconstrucció en edificis, com per exemple teulades, porxos, parets, tancaments, portes i finestres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Actuacions de reparació, restauració, o rehabilitació d'immobles de titularitat municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Actuacions de caràcter etnològic: elements construïts amb materials i tècniques tradicionals, principalment, els vinculats a la captació, conducció, aprofitament, i emmagatzemament de l'aigua, i altres elements que es detallen a continuació: canals, fonts, pous, sínies, claveguerons, sèquies, canaleta, aljubs, basses, bassals i safaretjos, molins d'extracció d'aigua i molins d'aigua, colls de cisterna, abeuradors, torrents, ponts, pedres, pedres passadores, guals empedrats, eres de batre, els miradors, forns de calç, cases de neu, forns de carboner, barraques de carboner (elements de pedra), marges i parets de pedra en sec, marges i parets de pedra en sec de camins, barraques de pedra en sec, molins de vent, etc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Actuacions de reparació i reconstrucció de la infraestructura viària i altres equipaments de titularitat municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Despeses d'honoraris per redacció de projectes i per direcció d'obres, sempre que qui redacti el projecte o dirigeixi l'obra sigui un tècnic extern a la Corporació Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Adquisició d'equips, maquinaria, eines i estris com béns necessaris per poder reparar i restituir danys dins dels béns de propietat municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per raons d'urgència en la seva execució, es presentessin actuacions ja finalitzades sempre que tinguin la causa en la borrasca Juliette de dies 26 a 28 de febrer de 2023. Per a la qual cosa el sol·licitant pot aportar al mateix moment i amb la sol·licitud tota la documentació requerida en la base vuitena d'aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Limitacions o condicions de les actuacions subvencionables:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cap cas no s'admetran actuacions o obres que tingui un resultat diferent del que tenia l'element abans de la catàstrofe meteorològica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No són subvencionables les actuacions dutes a terme en terrenys de caràcter forestal ni a arbratge de tipologia forestal (alzines, pins, etc.) ja que es té previst que des de la Conselleria de Medi Ambient del Govern Balear es tramiti una línia d'ajuts. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;S'exclouen les despeses de personal de les entitats locals, i les obres que hagin obtingut el 100% de finançament d'altres administracions públiques o entitats privades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cap cas l'import de la despesa subvencionable no pot ser superior al valor de mercat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els béns, infraestructures, equipaments, instal·lacions i serveis coberts per sistemes privats de cobertura de danys dels quals puguin ser beneficiàries les entitats afectades queden exclosos d'aquesta Convocatòria de subvencions &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4.- Crèdit pressupostari&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Es destina la quantitat dos milions cinc-cents mil euros (2.500.000,00 €) a càrrec de l'aplicació pressupostària 65.94310.76208, a les subvencions objecte d'aquesta convocatòria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La concessió de les subvencions és condicionada a l'existència de crèdit adequat i suficient en el moment de la resolució de la concessió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5.- Naturalesa de la subvenció i límits&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les subvencions d'aquesta convocatòria són de caràcter voluntari i eventual, i anul·lables, revocables i reintegrables en tot moment per les causes previstes a l'Ordenança general de subvencions i la resta de normativa aplicable. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A més, no generen cap dret a obtenir altres subvencions en anys posteriors i no es poden al·legar com a precedent. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No obstant això, són compatibles amb altres ajuts i subvencions que pugui rebre el beneficiari per al mateix projecte subvencionat sempre que el còmput total dels ajuts o subvencions rebudes no superi el cost de les actuacions que l'entitat beneficiària hagi dut a terme.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6.- Règim de concessió&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Vista la situació greu i excepcional a causa de la borrasca Juliette, la concessió de les subvencions regulades per la present convocatòria pública es durà a terme mitjançant règim de concurrència NO competitiva d'acord amb l'article 17.2 de l'Ordenança General de Subvencions, una vegada els ajuntaments hagin presentat la sol·licitud i la resta de documentació del punt 8 en el registre general del Consell de Mallorca. D'aquesta manera seran subvencionades fins a esgotar el total del crèdit assignat per la convocatòria totes aquelles sol·licituds completes que compleixin els requisits que s'estableixen i, per tant, no és necessària la comparació entre les sol·licituds.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'acord amb el nombre d'actuacions sol·licitades, una vegada finalitzat el termini de presentació de les sol·licituds, el Consell de Mallorca concedirà una subvenció fins al 100% del cost de les obres i honoraris amb un màxim global de fins a dos milions cinc-cents mil d'euros (2.500.000,00 €).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el supòsit que el crèdit pressupostari no arribi per a la satisfacció del 100% de la despesa justificada per part de les entitats sol·licitadores, es realitzarà el sumatori de la totalitat de les esmentades despeses justificades i s'atorgarà a cada municipi la part proporcional corresponent del crèdit pressupostari aprovat (2.500.000,00 €). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el supòsit que el sumatori de la totalitat de les despeses justificades no esgoti el crèdit assignat revertirà a l'aplicació pressupostària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ja que la presentació de la sol·licitud implica la justificació de les despeses de l'actuació objecte de subvenció, aquesta derivarà en el reconeixement de l'obligació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7.- Presentació de sol·licituds&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El termini per presentar la documentació prevista al punt següent serà de quinze (15) dies hàbils comptadors a partir de l'endemà de la publicació d'aquesta convocatòria al Butlletí Oficial de les Illes Balears. Si l'últim dia és inhàbil, s'ha d'entendre prorrogat fins al primer dia hàbil següent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ja que els Ajuntaments estan obligats a relacionar-se a través de mitjans electrònics amb les Administracions Públiques per dur a terme qualsevol tràmit de procediment administratiu, tal com preveu, l'article 14.2 de la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú, la sol·licitud s'haurà de presentar i formalitzar a través del registre electrònic que consta a la seu electrònica del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si la sol·licitud no reuneix les dades d'identificació, tant de la subvenció sol·licitada com de la persona sol·licitadora, o alguns dels requisits previstos a la Llei 39/2015, d'1 d'octubre, del Procediment administratiu comú de les administracions públiques, es requerirà l'entitat sol·licitant, d'acord amb el que estableix l'article 73.2 de la llei abans esmentada, perquè, en un termini de deu dies hàbils, esmeni la falta o acompanyi els documents preceptius amb indicació que, si no ho fa així, es tindrà per desistit el peticionari, amb una resolució expressa prèvia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Juntament amb la sol·licitud s'ha de presentar la documentació detallada en el punt següent d'aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8.- Formalització de sol·licituds&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cada Ajuntament presentarà una única sol·licitud en la qual indicarà les actuacions dutes a terme amb la documentació exigida en la base 8 de la present convocatória.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les sol·licituds s'han de formalitzar mitjançant el model oficial (Annex I) i es declararà que les actuacions sol·licitades no son cobertes per sistemes privats de cobertura de danys. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Amb la sol·licitud s'ha d'adjuntar la següent documentació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Informe d'un tècnic municipal de les actuacions sol·licitades i compreses en la base 3 d'aquesta convocatòria, en què declara que els danys produïts són a conseqüència de la Borrasca Juliette, fent avaluació i valoració dels mateixos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaració responsable de no incórrer en prohibicions per ser beneficiari de subvencions (Annex II).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaració responsable de trobar-se al corrent en el compliment d'obligacions tributàries amb l'Estat i el Consell de Mallorca i amb la Seguretat Social (Annex III).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Autorització de l'interessat perquè una Administració Pública pugui obtenir dades d'estar al corrent en el compliment de les seves obligacions tributàries amb l'Estat, amb la Tresoreria General de la Seguretat Social i amb el Consell de Mallorca.&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;(Annex IV)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaració responsable de no trobar-se en la situació prevista a l'article 11 de la Llei 11/2016, de 28 de juliol, d'igualtat de dones i homes (Annex V).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Certificat de la possessió i disposició real i plena dels terrenys necessaris per a l'execució de l'obra o servei segons el model de l'Annex VI&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Un certificat del secretari/secretària de l'entitat local amb el vistiplau del batle/batlessa que acrediti la realització de l'activitat subvencionada, el compliment de la finalitat de la subvenció i l'aportació de la documentació justificativa que estableix la convocatòria i que l'actuació subvencionada compleix amb tota la normativa vigent i té totes les llicències i permisos necessaris, segons el model que figura com a Annex VII d'aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Un informe, segons el model que figura com a Annex VIII d'aquesta convocatòria, emès per l'interventor/interventora de l'entitat local beneficiària de la subvenció en virtut del qual es faci constar:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La veracitat i la regularitat de la documentació justificativa de la subvenció que obra en poder de l'entitat local en els termes establerts en aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una relació de les factures de l'actuació subvencionada amb les dades identificatives de cada factura. I que el pagament de les factures s'ha realitzat abans de l'acabament del termini de justificació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una relació de les obligacions reconegudes de l'actuació subvencionada d'acord amb el que preveu l'article 48.1, segon apartat, de la vigent Ordenança general de subvencions del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A més, aquest informe per a la justificació de les actuacions subvencionades farà constar:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Que l'Ajuntament no ha obtingut cap altra subvenció d'altres institucions públiques o privades per a l'activitat objecte de la subvenció (o, si és el cas, relació de les concedides, amb indicació dels imports i la seva procedència).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Que els treballs realitzats i facturats objecte de la subvenció s'ajusten als preus de mercat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Que les despeses corresponen sense cap dubte a les actuacions objecte de subvenció. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Que l'Ajuntament no recupera ni compensa o recupera i compensa l'Impost sobre el Valor Afegit (IVA). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Que, si procedeix, respecte a les factures d'honoraris de persones físiques l'Ajuntament ha ingressat les retencions d'IRPF en l'Agència Tributària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Un certificat del secretari/secretària de l'entitat local d'estar al corrent en el compliment de les obligacions tributàries amb l'Estat, la Seguretat Social i el Consell de Mallorca i els seus organismes autònoms dependents, d'acord amb l'establert a l'art. 48.4 de la vigent Ordenança general de subvencions del Consell de Mallorca (Annex IX)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9.- Òrgan instructor i procediment de concessió de les subvencions&lt;/span&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'òrgan instructor és la secretaria tècnica del Departament de Promoció Econòmica i Desenvolupament Local, que ha de dur a terme les actuacions establertes a l'Ordenança general de subvencions, i formular la proposta de resolució. L'òrgan instructor pot requerir a les entitats sol·licitadores els informes o els aclariments que consideri convenients.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Departament de Promoció Econòmica i Desenvolupament Local és el centre gestor responsable del seguiment de les subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En compliment del previst a l'article 19.2 de l'Ordenança general de subvencions, s'enviarà a la base nacional de subvencions informació sobre aquesta convocatòria, i sobre les resolucions de concessió que es derivin, i es publicarà en el BOIB per conducte de la base esmentada, a més de publicar-se a la seu electrònica de Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El termini màxim per resoldre i notificar la resolució del procediment serà de 30 dies. El venciment del termini màxim sense haver-se notificat la resolució, legitima els interessats per entendre desestimada per silenci administratiu la sol·licitud de concessió de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;La concessió es realitzarà a través d'un procediment de concurrència no competitiva en el qual la quantia màxima de la subvenció ve predeterminada en l'apartat sisè d'aquesta convocatòria. Els municipis hauran d'acreditar en presentar la seva sol·licitud l'existència d'una sèrie de despeses relacionades amb les actuacions esmentades en l'apartat 3 d'aquesta convocatòria, realitzades entre el 26 de febrer de 2023 i la publicació d'aquesta, degudament justificades a través de les factures emeses en legal forma.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consell Executiu és l'òrgan competent per aprovar aquesta convocatòria de conformitat amb l'article 28 lletra f) i m) de la Llei 4/2022, de 28 de juny, de consells insulars en relació amb la base 24.4 de les d'execució del pressupost de 2023 i amb l'article 36.f) del Reglament orgànic del Consell de Mallorca vigent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consell Executiu habilitarà la consellera executiva de Promoció Econòmica i Desenvolupament Local com a òrgan competent per resoldre, concedir, modificar i dur a terme qualsevol acte administratiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10.- Pagament de la subvenció&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El termini màxim per ordenar el pagament de la subvenció serà fins al 31 de desembre de 2023. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per a això el beneficiari haurà d'haver acreditat estar al corrent de les obligacions tributàries amb l'Estat, el Consell de Mallorca i la Seguretat Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11.- Obligacions de les entitats beneficiàries&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els ajuntaments als quals se les ha concedit les subvencions estaran obligats a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Comunicar al Departament de Promoció Econòmica i Desenvolupament Local del Consell de Mallorca, en qualsevol moment, l'obtenció de subvencions o ajuts per a la mateixa finalitat i no consignades a la sol·licitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Complir la resta d'obligacions que es preveuen a l'article 9 de la vigent Ordenança general de subvencions del Consell de Mallorca aprovat per acord de ple de dia 23 de desembre de 2016 (BOIB núm.. 21, de dia 18 de febrer de 2017).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12.- Principis generals i criteris objectius que han de regir l'atorgament i quantia de les subvencions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La concessió de les subvencions d'aquesta convocatòria es regeix pels principis de publicitat, objectivitat, igualtat i no discriminació, i s'ha de resoldre segons els següents criteris objectius:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1) l'existència d'unes despeses de reparació o restitució del mobiliari, reparació o rehabilitació d'immobles i infraestructures i neteja de parcs, jardins i finques públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2) que les actuacions s'hagin realitzat entre el 26 de febrer de 2023 i la data de publicació d'aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3) que s'acrediti documentalment que les reparacions coincideixen amb les actuacions descrites en la convocatòria aportant una relació de despeses derivades de les mateixes amb els justificants de pagament corresponents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13.- Revocació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les subvencions són de concessió voluntària, revocables i reductibles per les causes previstes a les lleis i a la vigent Ordenança general de subvencions del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14.- Normativa supletòria&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En tot el que no s'hagi previst en aquesta convocatòria seran d'aplicació la normativa següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la Llei orgànica 2/2012, de 27 d'abril, d'estabilitat pressupostària i sostenibilitat financera;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la Llei 7/1985, de 2 d'abril, reguladora de les bases del règim local; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;el Reial Decret Legislatiu 781/1986, de 18 d'abril, que aprova el text refós de les disposicions legals vigents en matèria de règim local;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la Llei 38/2003, de 17 de novembre, general de subvencions; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;el text refós de la Llei reguladora de les hisendes locals, aprovat pel Reial Decret Legislatiu 2/2004, de 5 de març; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la Llei 9/2017, de 8 de novembre, de contractes del sector públic; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la Llei 4/2022, de 28 de juny, de consells insulars;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;el Decret Llei 3/2023 de 13 de març, pel qual s'estableixen ajuts i altres mesures urgents per reparar les pèrdues i els danys produïts per la borrasca Juliette en la serra de Tramuntana i altres llocs de l'illa de Mallorca;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;el Reial Decret 887/2006, pel qual s'aprova el reglament que desenvolupa la Llei general de subvencions; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;l'Ordenança general de subvencions del Consell de Mallorca aprovada per acord del Ple de 23 de desembre de 2016 (BOIB núm.. 21, de 18/02/2017 i BOIB núm.. 96, de 04/08/2018);&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;el Pla estratègic de subvencions del Consell de Mallorca;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;i la resta de la normativa que sigui d'aplicació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;15.- Recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De conformitat amb l'article 44 en relació amb el 46.6 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa, contra l'acord d'aprovació de la convocatòria de subvencions no es podrà interposar recurs en la via administrativa, si bé es podrà formular potestativament requeriment per a la seva anul·lació o revocació en el termini de dos mesos comptadors des de l'endemà al de la seva publicació al Butlletí Oficial de les Illes Balears (BOIB) amb caràcter previ a la interposició de recurs contenciós administratiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El requeriment s'entendrà desestimat si en el termini d'un mes des de la seva presentació no es notifica resolució expressa. El termini per interposar el recurs contenciós administratiu serà de dos mesos comptadors des de l'endemà en aquell en el qual es rebi comunicació de la resolució expressa sobre el requeriment previ o aquest s'entengui desestimat de forma presumpta. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si no es formula requeriment previ, es podrà interposar directament recurs contenciós administratiu en el termini de dos mesos comptadors des de l'endemà en el de la publicació de l'acord d'aprovació de la convocatòria en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Malgrat l'anterior, es pot interposar, si és el cas, qualsevol altre recurs que s'estimi pertinent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;16.- Publicació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consell de Mallorca, en compliment del previst als articles 17, 18 i 20 de la Llei 38/2003, de 17 de novembre, general de subvencions, remetrà a la base de dades nacional de subvencions informació sobre l'aprovació de la convocatòria de les subvencions i de les resolucions de concessió que es derivin i es publicarà en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Que, d'acord amb l'informe del tècnic municipal, el seu municipi ha patit danys produïts per la Borrasca Juliette i que declara que la/les actuació/ns sol·licitada/es per reparar o restituir aquests danys no està coberts per sistemes privats de cobertura de danys.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Que la Corporació que presideix es vol acollir aquesta convocatòria i, per això, acompanya la documentació prevista al punt 8.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
