&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;«&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;MODIFICACIÓ DEL DECRET DE DELEGACIONS DE COMPETÈNCIES GENÈRIQUES, ESPECIALS I TERRITORIALS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Antecedents&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Constituïda la nova corporació el dia 17.06.2023 i elegit el Batle la necessitat de procedir a establir l'organització de les diferents àrees del consistori, així com les diverses competències que exerceixen, per tal d'assolir un millor funcionament dels serveis municipals, mitjançant el present Decret es procedeix a dur a terme aquesta actuació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Vist el decret de Batlia 2571/2023 (BOIB núm 88 de 29.06.2023 pel qual s'estableixen el règim de les delegacions genèriques, especifiques i territorials realitzades pel Batle als regidors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Vist l'acord de plenari de data 9 d'octubre de 2023 pel qual es modifica el règim de dedicació del Sr. Ferran Montero Sitges.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Considerant la conveniència de procedir a la modificació de les delegacions de competències genèriques, especials i territorials en què es distribueix la gestió dels serveis administratius municipals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tota això, i fent ús de les atribucions que em confereixen els articles 41.2, 43 i 44 del Reial decret 2568/1986, de 28 de novembre, pel qual s'aprova el reglament d'organització, funcionament i règim jurídic de les entitats locals, així com l'article 12 de la Llei 40/2019, d'1 d'octubre, de règim jurídic del sector públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLC&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Aprovar la següent delegació de caràcter territorial:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;
	&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Delegar en el regidor Ferran Montero Sitges, la gestió, atenció i seguiment per a la millora dels serveis públics en els nuclis de Cales de Mallorca, i Cala de Murada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les delegacions especials territorials conferides es circumscriuen a l'estudi i proposta de les matèries relacionades amb l'àmbit d'actuació territorial definit, inclosa la firma de documents de tràmit, així com d'execució, control i seguiment dels actes i acords municipals que tinguin incidència en el concret àmbit territorial, però sense incloure en cap cas la facultat de resoldre mitjançant actes administratius que afectin a tercers. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El règim de la delegació queda sotmès a allò que li resulti d'aplicació del decret de Batlia 2571/2023 .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;De conformitat amb l'article 44.2 del Reglament d'Organització, Funcionament i Règim Jurídic de les Entitats Locals, aprovat per Reial Decret 2568/1986, de 28 de novembre, aquestes delegacions tindran efectes des de l'endemà de la data d'aquesta resolució i seran de caràcter indefinit, sense perjudici de la potestat d'avocació d'aquesta batlia. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cas d'absència, vacant, malaltia o qualsevol altre impediment dels regidors i regidores delegats, assumirà directament i automàticament les seves competències aquesta alcaldia, com a titular de la competència originària, entenent-se a aquests efectes exercitada la potestat d'avocació, en base a la present resolució, sense necessitat d'una nova resolució expressa en aquest sentit.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Donar compte de la present resolució al Ple en la següent sessió que es realitzi i en el tauler d'anuncis de l'ajuntament, en compliment del que disposa l'article 44.2 del Reial Decret 2568/1986 , de 28 de novembre, pel qual s'aprova el Reglament d'Organització, Funcionament i Règim Jurídic de les Entitats Locals, i difondre-la, d'acord amb el principi de transparència, mitjançant la seva publicació actualitzada i permanent a la seu electrònica municipal, en compliment del que disposen els articles 5 i següents de la Llei 19/2013, de 9 de desembre, de Transparència, Accés a la Informació i Bon Govern.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Comunicar aquesta resolució al regidor afectat i als responsables dels diferents serveis municipals, per al seu coneixement i efectes, entenent-se acceptada la delegació de competències de forma tàcita, si dintre del termini de tres dies hàbils comptats des de la notificació de la resolució, el destinatari no fa manifestació expressa davant l'òrgan delegant de que no accepta la delegació, segons el que estableix l'article 114 del ROF».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
