    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.&lt;span style="background-color:null"&gt; &lt;/span&gt;En data de 26 de maig de 2023 la Presidència de l'Institut Mallorquí d'Afers Socials (en endavant IMAS), va dictar Resolució d'aprovació de la convocatòria dels Premis del Consell de Mallorca a la Innovació Social 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'esmentada Resolució va aprovar les Bases per a l'atorgament dels Premis del Consell de Mallorca a la Innovació va ser publicada en la Seu Electrònica del Consell de Mallorca i en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Bulletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; en data de 27 de maig de 2023 (BOIB núm.70, de 27 de maig de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En el punt 13 de les Bases aprovades es preveia que: &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;«L'òrgan competent per resoldre és la Presidència de l'IMAS, d'acord amb els seus Estatuts, així com l'article 18.4 lletra a) de l'Ordenança, si bé conforme a la resolució per la qual s'aproven aquestes bases, l'òrgan competent delega aquestes competències en la Gerència de l'IMAS.».&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No obstant, a l'apartat resolutiu de l'esmentada Resolució no es va fer la delegació expressa de la competència per resoldre en el director gerent de l'IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Per aquest motiu, es adient que es dicti una Resolució complementària a la Resolució de la Presidència de l'IMAS d'aprovació de la convocatòria dels Premis del Consell de Mallorca a la Innovació Social 2023, de dia 26 de maig de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El Servei Juridicoadministratiu ha emès el respectiu informe jurídic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Consideracions Jurídiques&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pel que fa a la competència;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Els Estatuts de l'Institut Mallorquí d'Afers Socials (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;BOIB&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; núm. 67, de 18 de maig de 2019) aprovats per acord del Ple del Consell de Mallorca de data 11 d'abril de 2019, en especial l'establert a l'article 2 d'acord amb el qual l'Institut Mallorquí d'Afers Socials, com a organisme autònom creat pel Consell de Mallorca, adscrit al Departament de Drets Socials del Consell de Mallorca, és l'organisme que exerceix les competències atribuïdes per qualsevol títol al Consell de Mallorca en matèria de serveis socials i protecció de menors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. L'òrgan competent per dictar aquesta Resolució és la Presidència de l'IMAS, d'acord amb l'article 7.2.7 dels Estatuts de l'IMAS (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;BOIB&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; núm. 67, de 18 de maig de 2019). Aquesta competència pot ser delegada en tant no es trobi entre les no delegables, tal com es disposa al punt 7.2.31 dels Estatuts de l'IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Decret de la Presidència del Consell de Mallorca, de 10 de juliol de 2023, pel qual es creen els departaments que n'han d'estructurar el govern (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;BOIB&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; núm. 95, d'11 de juliol de 2023), entre els quals es troba el Departament de Benestar Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Decret de la Presidència del Consell de Mallorca pel qual es nomenen els membres del Consell Executiu de 10 de juliol de 2023 (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;BOIB&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; núm. 95, d'11 de juliol de 2023) pel qual es nomena el Sr. Guillermo Sánchez Cifre conseller executiu de Benestar Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pel que fa al fons;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;Llei 38/2003, de 17 de novembre, general de subvencions(«BOE» núm. 276, de 18 de novembre) indica a la Disposició addicional desena que la regulació dels Premis es desenvolupa reglamentàriament. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El Ple del Consell de Mallorca, en sessió de 23 de desembre de 2016 va aprovar l'Ordenança General de Subvencions (BOIB núm. 21, de 18 de febrer de 2017), modificada per Acord del Ple de 14 de juny de 2018 (BOIB núm. 96, de 4 d'agost de 2018). Ordenança que, d'acord amb al seu article 1, té per objecte regular a la Disposició Addicional Primera de l'Ordenança general de subvencions del Consell Insular de Mallorca, el procediment a seguir per a convocar i concedir Premis per part dels subjectes inclosos dins l'àmbit d'aplicació d'aquesta Ordenança, que són tant el Consell Insular de Mallorca com els organismes autònoms que en depenen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Resolució de la Presidència de dia 26 de maig de 2023 d'aprovació de la convocatòria dels Premis del Consell de Mallorca a la Innovació Social 2023 (BOIB núm.70, de 27 de maig de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pel que fa al procediment;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. L'Ordenança General de Subvencions (BOIB núm. 21, de 18 de febrer de 2017), modificada per Acord del Ple de 14 de juny de 2018 (BOIB núm. 96, de 4 d'agost de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. La Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques (BOE núm. 236, de 2 d'octubre de 2015).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. L'article 214 del Reial Decret Legislatiu 2/2004, de 5 de març, pel qual s'aprova el Text refós de la Llei reguladora de les Hisendes Locals, i atès l'acord d'aprovació del règim de fiscalització i intervenció limitada prèvia de requisits bàsics i presa de raó en ingressos del Consell Insular de Mallorca i de les entitats del seu sector públic subjectes a funció interventora de data 12 de desembre de 2019, l'expedient no ha ser sotmès a la Intervenció delegada de l'IMAS per a l'emissió del preceptiu informe de fiscalització prèvia ( BOE núm. 59 de 9 de març de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En virtut de la competència atribuïda legalment, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Resolc&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primer. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;DELEGAR, de conformitat a l'apartat 13 de les Bases per a la convocatòria dels Premis del Consell de Mallorca a l'Innovació Social 2023, la competència per a la resolució en la Gerència de l'IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segon. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;COMUNICAR aquesta Resolució a la Gerència de l'IMAS i a la Direcció Insular de Persones amb Discapacitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercer. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Publicar aquesta Resolució al Bulletí Oficial de les Illes Balears i a la Seu Electrònica del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquesta resolució no posa fi a la via administrativa i contra ella es pot interposar, d'acord amb l'article 28.1 dels Estatuts de l'IMAS aprovats per Acord del Ple del Consell de Mallorca d'11 d'abril de 2019 (BOIB núm. 67, de 18 de maig de 2019), recurs d'alçada davant el Consell Executiu del Consell Insular de Mallorca, dins el termini d'un mes, comptador a partir del dia següent al de la notificació de la present resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra la desestimació expressa del recurs d'alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en el termini de dos mesos, comptadors a partir del dia següent al de la notificació de la desestimació de l'esmentat recurs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra la desestimació per silenci del recurs d'alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en qualsevol moment a partir del dia següent a la desestimació presumpta (tres mesos des de la interposició del recurs sense que s'hagi notificat la resolució).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No obstant l'anterior, es pot exercitar, si n'és el cas, qualsevol altre recurs que s'estimi pertinent. Tot això de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la Jurisdicció Contenciosa Administrativa, i de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
