&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. A la segona reunió de la Comissió de Cogestió del Pla de Gestió de Pesca Artesanal de les Pitiüses, celebrada a Formentera el dia 14 de març de 2023, es prengué l'acord d'instar la Conselleria d'Agricultura, Pesca i Medi Natural per a la creació del polígon de pesca preferent de la llagosta al llevant de s'Espardell, prèvia presentació d'una proposta conjunta de les confraries d'Eivissa i de Formentera amb la delimitació de l'àrea.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Amb data del 2 de maig de 2023 les confraries de pescadors d'Eivissa i de Formentera van presentar a la Direcció General de Pesca una proposta definitiva de delimitació d'un polígon de pesca preferent de la llagosta a les aigües interiors de les illes Pitiüses.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El 9 de maig de 2023 es va emetre informe del Servei de Recursos Marins, favorable a la creació del polígon de pesca preferent de la llagosta al llevant de s'Espardell i partidari de prohibir-hi la pràctica de la pesca d'arrossegament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonament de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. L'article 9 de l'Ordre del conseller d'Agricultura i Pesca de 23 de març de 2001, per la qual es regula la pesca de la llagosta (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Palinurus spp&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) a les aigües interiors de les Illes Balears, faculta la Direcció General de Pesca, oïdes les confraries de pescadors, per delimitar zones de pesca de la llagosta, tenint en compte la veda dels 50 metres per a les embarcacions d'arrossegament. Dins d'aquestes zones, i sempre dins de la zona de 6 milles nàutiques de distància a la costa, les embarcacions dedicades a la pesca de la llagosta tindran preferència en l'exercici de la seva activitat respecte de les que es dediquen a practicar altres modalitats pesqueres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El Decret 12/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears disposa que la Conselleria d'Agricultura, Pesca i Medi Natural exerceix, entre d'altres, la competència en matèria de recursos marins i de pesca marítima en aigües interiors de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tot això, oïts els organismes i entitats pesqueres afectades, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Resolució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Delimitar un polígon de pesca preferent de la llagosta a les aigües interiors de les illes Pitiüses, definit pels punts que s'indiquen a l'annex d'aquesta Resolució, referits al sistema geodèsic ETRS 89, sistema de coordenades geogràfiques en graus i minuts. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Dins d'aquesta zona la pesca d'arts menors i el marisqueig d'embarcació dirigits a la captura de la llagosta tindran caràcter preferent, i no es podrà practicar la modalitat pesquera professional de l'arrossegament de fons. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Publicar aquesta Resolució al &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra aquesta resolució, que no exhaureix la via administrativa, les persones interessades poden interposar un recurs d'alçada davant el conseller d'Agricultura, Pesca i Medi Natural en el termini d'un mes comptador des de l'endemà de la publicació, d'acord amb el que estableixen els articles 121 i 122 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 58 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
