&lt;p&gt;&lt;em&gt;“(...)&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;15. Proposta del vicepresident primer i conseller executiu del Departament de Territori, Ordenació Turística, Mobilitat, Infraestructures Viàries i Lluita contra l'Intrusisme, per a la delegació d'atribucions del Consell Executiu del Consell Insular d'Eivissa al conseller executiu del Departament en matèria de disciplina urbanística. Exp. 2023/00017848G&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;Havent-se presentat una proposta del tenor següent:&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;“La recent entrada en vigor, el passat 7 d'agost de 2022, de la Llei 4/2022, de 28 de juny de Consells Insulars (BOIB núm. 88, de 7 de juliol de 2022), Llei de consells en endavant, ha suposat un nou règim de competències atribuïdes als diferents òrgans del Consell Insular d'Eivissa, tant en el seu Reglament Orgànic (BOIB núm. 136, de 18/09/2010), com en els decrets de presidència de delegació de competències en els diferents òrgans de la Corporació.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;Concretament, i pel que fa a les competències que aquest Consell Insular ostenta respecte a la disciplina urbanística, l'article 28.1.r) de la Llei de consells estableix, entre les atribucions del consell executiu s'hi inclou la següent:&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;“r) Exercir les atribucions de caràcter executiu que la legislació de l'Estat o de la comunitat autònoma assignin al consell insular sense atribuir-les expressament a altres òrgans, llevat que el reglament orgànic disposi una altra cosa.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;(.../...)”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;El Reglament Orgànic del Consell Insular d'Eivissa, no contempla l'exercici d'atribucions en matèria de disciplina urbanística.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;.../...&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Així doncs, de conformitat amb l'article 3.1 de la Llei 40/2015, de 1 d'octubre, de Règim jurídic del sector públic relatiu als principis generals el qual disposa que les Administracions Públiques serveixen amb objectivitat els interessos generals i actuen d'acord amb els principis d'eficàcia, jerarquia, descentralització, desconcentració i coordinació, amb sotmetiment ple a la Constitució, a la Llei i al Dret, havent de respectar en la seva actuació i relació els següents principis -entre altres-:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a)Servei efectiu als ciutadans.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b)Simplicitat, claredat i proximitat als ciutadans.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;.../...&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d)Racionalització i agilitat dels procediments administratius i de les activitats materials de gestió.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;.../...&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;f)Responsabilitat per la gestió pública.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;g)Planificació i direcció per objectius i control de la gestió i avaluació dels resultats de les polítiques públiques.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;h)Eficàcia en el compliment dels objectius fixats.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;Economia, suficiència i adequació estricta dels mitjans a les finalitats institucionals.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;Vist l'informe-proposta de la lletrada del Servei de Territori de data 15 de setembre de 2023.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;Sobre la base de tot l'anterior, aquest conseller, eleva al Consell Executiu, òrgan competent en virtut de l‘article 28.2 de la Llei 4/2022, de 28 de juny, de consells insulars, la següent:&lt;/em&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;em&gt;PROPOSTA&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;PRIMER.-&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Delegar, amb caràcter general i indefinit, en el conseller executiu del Departament al qual estigui adscrit en cada moment el Servei de Territori del Consell Insular d'Eivissa les següents facultats:&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;- L'adopció de les mesures cautelars.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;- La imposició de multes coercitives.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;- La declaració de caducitat o arxivament del procediment sancionador i/o de restabliment de la legalitat i de la realitat física alterada.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;- La incoació dels expedients corresponents en exercici de les potestats sancionadora i de restabliment de la legalitat i de la realitat física alterada.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;- La imposició de sancions en el cas d'infraccions greus i lleus comeses en matèria de disciplina urbanística, així com l'ordenació del restabliment en el cas d'infraccions greus i lleus.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;SEGON.-&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Publicar l'acord que s'adopti en el Butlletí Oficial de les Illes Balears.”&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;El Consell Executiu fa seua la proposta, i l'aprova per unanimitat dels seus membres.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;(...)"&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
