    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;L'apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 9&amp;nbsp;de juny&amp;nbsp;de 2021 per la qual es convoquen, subvencions per a inversions en la transformació i la comercialització de productes agrícoles, corresponents a&lt;/span&gt;&amp;nbsp;&lt;span style="color:#000000"&gt;l'&amp;nbsp;any 2021, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 27&amp;nbsp;de setembre&amp;nbsp;de 2023, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;Antecedents&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;1. Resolució de&lt;/span&gt;&amp;nbsp;&lt;span style="color:#000000"&gt;la&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;president&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per a&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;l&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;'&amp;nbsp;any 2021, subvencions per a inversions en la transformació i la comercialització de productes agrícoles. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;2. De conformitat amb l'apartat sisè de l'esmentada Resolució, el termini de presentació de sol·licituds va acabar el dia 15/07&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;/20&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;21, i varen tenir entrada en el Registre del Fons de Garantia Agrària i Pesquera de les Illes Balears un total de 54&amp;nbsp;sol·licituds d'ajuda. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;3. Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;4&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;Una vegada avaluad&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;a&amp;nbsp;la&amp;nbsp;sol·licitud d'ajuda pels òrgans gestors, i d'acord amb els criteris d'elegibilitat establerts, els interessats assenyalats a l' Annex I adjunt no compleix amb algun dels requisits prevists a la convocatòria per poder ser beneficiaris de l'ajuda, pels motius indicats a l'esmentat annex.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;5. En data 01/09/2023&amp;nbsp;es s&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;igna &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;la proposta provisional de denegació, i es notifica a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;'&amp;nbsp;interessat, concedint-los un termini de 10 dies per presentar les al·legacions escaients.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;em&gt;6.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;Després del termini establert, l&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;'&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;interessat &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ha presentat al·legacions&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;esmenant algunes de les deficiències notificades a la proposta, però no la totalitat d'algunes deficiències que es consideren elementals. El motiu de la denegació es detalla a l'Annex I.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;2&amp;nbsp;. Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3 . Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4 . Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5 . Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;6&amp;nbsp;. Llei 39/2015, de 1 d'octubre de&amp;nbsp;règim jurídic de les administracions públiques. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;Proposta&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;Per tot això, s'informa &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;des&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;favorablement i es &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;proposa al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.&amp;nbsp;Denegar l'ajuda sol·licitada pels interessats que figuren a l'Annex I , que són un total d'un&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;xpedient “PRODUCTOS MARTIN S.A.”&lt;/em&gt;&lt;/span&gt;&lt;em&gt;, relativa a la línia d'ajudes “Transformació i comercialització de productes agrícoles 2021_1”, per no complir amb algun dels requisits que s'estableixen a la convocatòria i que s'especifiquen a l'esmentat annex.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;2. Declarar conclòs el procediment i procedir a l'arxiu de&lt;/span&gt;&amp;nbsp;&lt;span style="color:#000000"&gt;l'&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;expedient detallat a l' Annex I.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;3. Notificar la resolució a l'&amp;nbsp;interessat.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;Interposició de recursos&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant el&amp;nbsp;conseller&amp;nbsp;d'&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;Agricultura&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;,&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;Pesca&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;i Medi Natural, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i els articles 121 i 122 de la Llei 39/2015del Procediment Administratiu Comú&amp;nbsp;de les administracions públiques.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
