    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El punt 3 de l'apartat Vuitè de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 12&amp;nbsp;d'abril&amp;nbsp;de 2023, per la qual es convoquen ajudes destinades al &amp;nbsp;“pagament compensatori per a zones amb limitacions específiques” i “pagament compensatori en zones de muntanya”&amp;nbsp;per a l'any 2023, &amp;nbsp;especifiquen que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al Butlletí Oficial de les Illes Balears, i es farà d'acord amb els termes que preveu l'article 45.2 de la llei 39/2015, de l'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria de pesca del FOGAIBA, en data 7&amp;nbsp;de setembre&amp;nbsp;de 2023, va signar la següent resolució: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

En data 15 d'abril de 2023 es va publicar, en el BOIB núm. 48, la Resolució de la Presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 12 d'abril de 2023, per la qual s'aprova la convocatòria per a l'any 2023&amp;nbsp;de les ajudes destinades al pagament compensatori per a zones amb limitacions específiques a les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;2. En data 15 d'abril de 2023 es va publicar, en el BOIB núm. 48, la Resolució de la Presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 12 d'abril de 2023, per la qual s'aprova la convocatòria per a l'any 2023&amp;nbsp;de les ajudes destinades al pagament compensatori per a zones de muntanya a les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;3. De conformitat amb els apartats sisè d'ambdues resolucions, i de la Resolució de modificació de la Presidenta del Fogaiba, per a l'any 2023, de determinats ajuts comunitaris directes i al desenvolupament rural a l'Agricultura i a la Ramaderia, de data 25 de maig de 2023, publicada en el BOIB núm.71 de 30 de maig de 2023, el termini de presentació de sol·licituds de les convocatòries va acabar el 30/6/23, i varen tenir entrada en el Registredel Fons de Garantia Agrària i Pesquera de les Illes Balears un total de 1357 sol·licituds d'ajuda de limitacions específiques i 274 d'ajuda de muntanya.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquestes &amp;nbsp;ajudes.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5. Una vegada avaluades les sol·licituds d'ajuda pels òrgans gestors, i d'acord amb els criteris d'elegibilitat establerts, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;els interessats que figuren a l'Annex I &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;no compleix&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;en&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;el requisit previst el punt 1.b) de l'apartat Tercer&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;em&gt;de les convocatòries.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6. En data 14 d'agost de 2023 es notifica, mitjançant publicació a la pàgina web &lt;/em&gt;&lt;u&gt;&lt;u&gt;&lt;em&gt;http:// &lt;/em&gt;&lt;/u&gt;&lt;/u&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;www.caib.es&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;,&lt;/em&gt;&lt;/span&gt;&lt;em&gt;&amp;nbsp;l'informe desfavorable i la proposta provisional de denegació de les ajudes, emesa per Servei d'Ajudes al Desenvolupament Rural als interessats, concedint-los un termini de 10 dies per presentar les al·legacions escaients.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7. Dins el termini establert, els interessats indicats a l'Annex I adjunt no han presentat al·legacions, o han presentat al.legacions que no han demostrat la condició d'agricultor no pluriactiu.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Reglament UE 2021/2115 del Parlament Europeu i del Consell, de 2 de desembre de 2021, pel qual s'estableixen les normes en relació amb l'ajuda als plans estratègics que han d'elaborar els estats membres en el marc de la política agrícola comuna (plans estratègics de la PAC), finançada amb càrrec al Fons Europeu Agrari de Garantia (FEAGA) i al Fons Europeu Agrícola de Desenvolupament Rural (FEADER), i pel qual es deroguen els reglaments (UE) núm. 1305/2013 i (UE) 1307/2013.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;7. Reial Decret 1046/2022, de 27 de desembre, pel qual es regula la governança del Pla Estratègic de la &amp;nbsp;política agrícola comuna a Espanya i dels Fons Europeus FEAGA i FEADER.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8. Reial Decret 1047/2022, de 27 de desembre, pel qual es regula el sistema de gestió i control de les intervencions del Pla Estratègic i altres ajudes de la política agrícola comuna.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

Reial Decret 1049/2022, de 27 de desembre, pel qual s'estableixen les normes per a l'aplicació de la condicionalitat reforçada i de la condicionalitat social que han de complir les persones beneficiàries de les ajudes en el marc de la política agrícola comuna que rebin pagaments&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;directes, determinats pagaments anuals de desenvolupament rural i del Programa d'opcions específiques per la llunyania i la insularitat (POSEI).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;10. Reial Decret 1054/2022, de 27 de desembre, pel qual s' estableix i es regula el Sistema d' informació d' explotacions agrícoles i ramaderes i de la producció agrària, així com el Registre autonòmic d'explotacions agrícoles i el quadern digital de explotació agrícola.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;11. Reial Decret 1051/2022, de 27 de desembre, pel qual s'estableixen unes normes per a la nutrició sostenible als sòls agraris.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;12. Reial Decret 1050/2022, de 27 de desembre, pel qual es modifica el Reial Decret 1311/2012, de 14 de setembre, que estableix el marc d'actuació per a aconseguir un ús sostenible dels productes fitosanitaris.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

Reial Decret 147/2023, de 28 de febrer, pel qual s'estableixen les normes &amp;nbsp;per a l'aplicació de penalitzacions en les intervencions que preveu el Pla estratègic de la política agrícola comuna, i es modifiquen diversos reials decrets pels quals es regulen diferents aspectes relacionats amb l'aplicació a Espanya de la política agrícola comuna per al perídode 2023-2027.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;14. Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Ordre 10/2023 de la consellera d'Agricultura, Pesca i Alimentació, de 5 d'abril de 2023, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc de les intervencions per al desenvolupament rural &amp;nbsp;de les Illes Balears 2023-2027.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;16. La llei 3/2019, de 31 de gener, agrària de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;La resta de normativa de desenvolupament i aplicació.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Proposta &amp;nbsp;de&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;resolució de&amp;nbsp;&amp;nbsp;denegació&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Per tot això, s'informa desfavorablement i propòs al vicepresident en Matèria Agrària del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Denegar les sol·licituds presentades pels interessats relacionats a l'Annex I, per incompliment del requisit indicat&amp;nbsp;d'ambdues ajudes.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. Declarar conclòs el procediment i procedir a l'arxiu dels expedients detallats a l'Annex I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Notificar la resolució als interessats de l'Annex I mitjançant la publicació en el BOIB.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Interposició de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Contra aquesta resolució - que no exhaureix la via administrativa. Es pot interposar recurs d'alçada davant el conseller d'Agricultura, Pesca i Medi Natural, en el termini d'un mes, comptador des de l'endemà de la notificació de la resoluci, d'acord amb els articles 121 i 122 de la Llei 39/2015, de l'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
