    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La situació econòmica, social i pressupostària que es va donar l'any 2012 va obligar les autoritats públiques a prendre mesures de control de la despesa pública, la qual cosa va suposar la proliferació de normativa i d'adaptacions legislatives i/o administratives dirigides a garantir l'estabilitat pressupostària. Aquestes modificacions es van reflectir en el règim jurídic del sistema retributiu del personal inclòs en els diferents règims de la Seguretat Social durant la situació d'incapacitat temporal. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Quant al complement econòmic, la regulació de la prestació per incapacitat temporal va quedar configurada, en aquells moments, per al personal docent de l'ensenyament concertat, per la disposició addicional quarta del Decret llei 5/2012, d'1 de juny, de mesures urgents en matèria de personal i administratives per a la reducció del dèficit públic del sector públic de la Comunitat Autònoma de les Illes Balears i d'altres institucions autonòmiques (BOIB núm. 79, d'1 de juny), modificada per l'article tretzè del Decret llei 10/2012, de 31 d'agost (BOIB núm. 129, d'1 de setembre). Així mateix i pel que fa a les excepcions en què la prestació per incapacitat temporal es podia complementar fins al 100% de les retribucions, cada curs escolar, mitjançant les &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Instruccions sobre la tramitació i gestió del pagament delegat de la nòmina del personal docent dels centres concertats, i del pagament directe del mòdul íntegre del personal docent soci cooperativista dels centres concertats, els titulars dels quals són cooperatives d'ensenyament de treball associat&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, s'aplicà al personal docent de l'ensenyament concertat, l'Acord del Consell de Govern de 9 de novembre de 2012 pel qual es determinen les situacions de caràcter excepcional en les quals es reconeix un complement econòmic de la prestació reconeguda per la Seguretat Social fins a arribar a assolir, com a màxim, el 100 % de les retribucions que corresponguin a les persones afectades en cada cas (BOIB núm. 168, de 13 de novembre) modificat per per l'Acord del Consell de Govern de 30 de setembre de 2016 (BOIB núm. 125, d'1 d'octubre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La millora de la situació econòmica va permetre aprovar mesures de recuperació de drets que afecten els empleats públics, de manera que s'han anat fent efectives aquestes millores progressivament. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Com a conseqüència d'això, el dia 28 de març de 2023 es va publicar al BOIB (núm. 39), l'Acord del Consell de Govern de 27 de març de 2023 pel qual es ratifica l l'Acord de la Mesa Sectorial d'Educació de l'Administració de la Comunitat Autònoma de les Illes Balears de 27 de febrer de 2023 sobre mesures sociolaborals i millores educatives on al punt núm. 24 del mateix es va establir: «&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;eliminació de la penalització retributiva per les absències per malaltia i accidents que donen lloc o no a una baixa laboral de menys de 5 dies, a partir del curs 2023-2024&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.» En aquest sentit, el 29 d'agost de 2023 la Mesa Sectorial d'Educació va adoptar un acord sobre el restabliment del dret a percebre el complement econòmic de la prestació per incapacitat temporal, pel que fa al personal docent de l'ensenyament públic, finalment ratificat per l'Acord del Consell de Govern el dia 8 de setembre (BOIB núm. 125, de 9 de setembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Així, d'acord amb aquesta nova regulació sobre el restabliment del dret a percebre el complement econòmic de la prestació en tots els supòsits d'incapacitat temporal en l'ensenyament públic és necessari traslladar-lo a l'ensenyament privat concertat de la Comunitat Autònoma de les Illes Balears per tal de continuar avançant en millores educatives i sociolaborals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;També s'ha de tenir en compte el que disposen l'article 74 del VII Conveni Col·lectiu d'Empreses d'Ensenyança Privada Sostingudes Total o Parcialment amb Fons Públics; l'article 38 del XII Conveni Col·lectiu d'Àmbit Estatal de Centres d'Assistència i Educació Infantil, i l'article 75 del XV Conveni Col·lectiu General de Centres i Serveis d'Atenció a Persones amb Discapacitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'acord amb tot el que s'ha exposat anteriorment, i amb l'acord de la Mesa de l'Ensenyament Privat Concertat de les Illes Balears de 7 de setembre de 2023, el Consell de Govern a proposta del conseller d'Educació i Universitats, en la sessió de dia 15 de setembre de 2023 adoptà, entre d'altres, l'Acord següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primer&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. Ratificar l'Acord de la Mesa de l'Ensenyament Privat Concertat de les Illes Balears de 7 de setembre de 2023 sobre el restabliment del dret a percebre el complement d'incapacitat temporal, el qual s'adjunta com a annex.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segon.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Es reconeix el dret del personal docent de l'ensenyament privat concertat a percebre un complement econòmic de la prestació reconeguda per la Seguretat Social fins a assolir, com a màxim, el 100% de les retribucions que corresponguin a les persones afectades per qualsevol situació d'incapacitat temporal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercer&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. Aquest acord començarà a vigir el dia següent que es publiqui al &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; l'acord del Consell de Govern que l'aprova. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quart&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. Ordenar que es publiqui íntegrament aquest Acord, que s'annexa, en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les parts ens reconeixem mútuament la capacitat legal necessària per formalitzar aquest acord, segons els següents&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PACTES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primer&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Àmbit d'aplicació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1.1. Àmbit subjectiu&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquest acord és d'aplicació als col·lectius següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. El personal docent afectat pel conveni col·lectiu d'empreses d'ensenyament privat sostingudes totalment o parcialment amb fons públics. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. El personal docent afectat pel conveni col·lectiu general de centres i serveis d'atenció a persones amb discapacitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. El personal docent afectat pel conveni col·lectiu d'àmbit estatal d'assistència a centres d'educació infantil, en els termes que estableix el pacte vuitè d'aquest acord.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d. El personal docent cooperativista de les cooperatives de treball associat, en els termes que estableix el pacte novè d'aquest acord.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e. El personal docent religiós autònom, en els termes que estableix el pacte desè d'aquest acord.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1.2. Àmbit normatiu&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquest acord s'aplicarà sense perjudici de la normativa legal aplicable i dels convenis col·lectius vigent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;-Article 74 del VII Conveni Col·lectiu d'Empreses d'Ensenyança Privada Sostingudes Total o Parcialment amb Fons Públics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;-Article 38 del XII Conveni Col·lectiu d'Àmbit Estatal de Centres d'Assistència i Educació Infantil.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;-Article 75 del XV Conveni Col·lectiu General de Centres i Serveis d'Atenció a&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Persones amb Discapacitat&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segon&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Dret a percebre el complement econòmic de la prestació per incapacitat temporal&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;S'elimina la penalització retributiva per les absències per malaltia i accidents que donen lloc o no a una baixa laboral de menys de 5 dies, a partir del curs 2023-2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercer&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Vigència&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquest Acord és vigent indefinidament, sense perjudici dels pactes sotmesos a vigència determinada i que qualsevol de les parts pugui denunciar-lo amb sis mesos d'antelació. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Durant la vigència d'aquest acord se'n podrà negociar algun aspecte a instància de qualsevol de les parts i, si es considera necessari, modificar-ne algun apartat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les parts signatàries d'aquest Acord es comprometen a complir allò que s'hi ha pactat d'acord amb el principi de bona fe, així com a resoldre de manera amistosa qualsevol discrepància que pugui sorgir en aplicació d'aquest. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quart&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Ratificació i publicitat&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquest acord començarà a vigir el dia següent que es publiqui al &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; l'acord del Consell de Govern que l'aprova. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
