&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'apartat 8.4&amp;nbsp;de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 22&amp;nbsp;de febrer de 2021, per la qual es convoquen subvencions Foment de l'Agricultura Ecològica, especifica que la resolució es notificarà a les persones interessades mitjançant la seva publicació al Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, de l'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'expedient ha estat tramitat pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El vicepresident en matèria de pesca&amp;nbsp;del FOGAIBA, en data 9&amp;nbsp;d'agost&amp;nbsp;de 2023, va signar la següent resolució:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1.En data 26 de febrer de 2015, es va publicar en el BOIB núm. 29 l'Ordre del conseller d'Agricultura, Medi ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2.En data de 27 de febrer de 2021 es va publicar, al BOIB núm. 27, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova la convocatòria per als anys 2021 i 2022 de les ajudes destinades al foment de l'agricultura ecològica.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Aquesta Resolució ha patit dues modificacions, la primera publicada en el BOIB núm. 29, en data 24 de febrer de 2022, per la qual s'incrementa el crèdit i es modifica el finançament de la convocatòria, per als anys 2021 i 2022. I la segona, en data 27 d'abril de 2023, publicada en el BOIB núm. 54, per la qual es modifica l'annex III de la convocatòria dels ajuts destinats al foment de l'agricultura ecològica per als anys 2021 i 2022, referent a la tipificació de l'incompliment del comprmís avaluable de formació.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3.En data 2 de juliol de 2022 es notifica, mitjançant publicació al BOIB núm. 86 la concessió de l'ajuda per al foment de l'agricultura ecològica en favor del beneficiari Jaume Joan Oliver Roca amb DNI ***2872** per un import biennal de 3.283,34 € (període 2021 i 2022), que es correspon amb una superfície compromesa de 4,53 ha de vinya ecològica per vinificació. &lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;4.En data &amp;nbsp;9 de juny de 2022 s'ha realitzat el pagament de l'anualitat 2021 per un import de 1.641,67 € (mil sis-cents quaranta-un euros i seixanta-set cèntims).&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;5.En data 21 de desembre de 2022, es registra a la xarxa SARA la presentació d'una sol·licitud de pròrroga per motius de salut, per poder acreditar el compromís bàsic de formació durant el primer semestre de 2023, un cop finalitzat el període de compromís. Davant aquesta sol·licitud, es va requerir a l'interessat, per que justificàs més minuciosament i explícitament la manca d'acreditació de la formació. Així, el dia 20 de març de 2023 es registra, mitjançant la xarxa SARA, una nova sol·licitud de pròrroga, a la qual s'adjunta un informe clínic del Servei de Psiquiatria de l'HU Son Espases.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;6.Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les so·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda i, tal i com assenyala el punt tretzè d'aquesta convocatòria referent a ajudes no reintegrables, apartat 1, lletra b), es considera que la informació aportada en l'informe clínic com a «llarga incapacitat professional de la persona beneficiària», cas de força major per no reintegrar l'ajuda.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;7.En data 2 de juliol de 2023 es notifica, mitjançant publicació a la pàgina web del FOGAIBA, l'informe i la proposta provisional de revocació parcial de la concessió, emesa pel Servei d'ajudes al Desenvolupament Rural als interessats, concedint un termini de 10 dies per presentar les al·legacions escaients. Durant aquest període, no s'han presentat al·legacions, per tant, s'ha considerat l'Informe/Proposta provisional de resolució, de 26 de juliol de 2023, de revocació parcial de la resolució de concessió de l'expedient &amp;nbsp;04001173/AE22.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;8.Per tot això, s'estima desfavorablement la sol·licitud de pròrroga per acreditar el requisit de formació i es proposa la revocació parcial de la concessió de l'ajuda que es correspon amb l'anualitat 2022.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1.Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 27 de febrer de 2021 per la qual s'aprova la convocatòria per als anys 2021 i 2022 de les ajudes destinades al foment de l'agricultura ecològica&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2.En data 24 de febrer de 2022 es va publicar, en el BOIB núm. 29, una modificació de la Resolució citada anteriorment per la qual s'incrementa el crèdit i es modifica el finançament de la convocatòria, per als anys 2021 i 2022.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3.Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, de 17 de desembre de 2013, relatiu a l'ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER) i pel qual es deroga el Reglament (CE) núm. 1698/2005 del Consell.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;6.Reglament d'execució (UE) núm. 808/2014 de la Comissió, de 17 de juliol de 2014, pel qual s'estableixen disposicions d'aplicació del Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, relatiu a l'ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER).&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;8.Reial decret 1075/2014, de 19 de desembre, sobre l'aplicació a partir del 2015 dels pagaments directes a l'agricultura i a la ramaderia i altres règims d'ajuda, així com sobre la gestió i control dels pagaments directes i dels pagaments al desenvolupament rural.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;9.Reial decret 1078/2014, de 19 de desembre, pel qual s'estableixen les normes de condicionalitat que han de complir els beneficiaris que rebin pagaments directes o determinades primes anuals de desenvolupament rural, o pagaments en virtut dels programes de suport a la reestructuració i reconversió o de suport a la collita en verd, al sector vitivinícola.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Ajudes per al foment de l'agricultura ecològica per als anys 2021 i 2022 del PDR al beneficiari de l'annex I, ja que es desestima la sol·licitud de pròrroga per acreditar el compromís de formació.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2.Estimar favorablement l'informe clínic presentat i que segons l'apartat tretzè, punt ,1 lletra b) de la convocatòria, suposa una causa major per no reintegrar l'ajuda.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3.Notificar la resolució als interessats en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
