CAIB ca ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'apartat 8.4&nbsp;de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 22&nbsp;de febrer de 2021, per la qual es convoquen subvencions Foment de l'Agricultura Ecològica, especifica que la resolució es notificarà a les persones interessades mitjançant la seva publicació al Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, de l'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'expedient ha estat tramitat pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><span style="line-height:114%"><em>2.En data de 27 de febrer de 2021 es va publicar, al BOIB núm. 27, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova la convocatòria per als anys 2021 i 2022 de les ajudes destinades al foment de l'agricultura ecològica.</em></span></em><em><span style="line-height:114%"><em>Aquesta Resolució ha patit dues modificacions, la primera publicada en el BOIB núm. 29, en data 24 de febrer de 2022, per la qual s'incrementa el crèdit i es modifica el finançament de la convocatòria, per als anys 2021 i 2022. I la segona, en data 27 d'abril de 2023, publicada en el BOIB núm. 54, per la qual es modifica l'annex III de la convocatòria dels ajuts destinats al foment de l'agricultura ecològica per als anys 2021 i 2022, referent a la tipificació de l'incompliment del comprmís avaluable de formació.</em></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>3.Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les so·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.</em></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>4.Els interessats assenyalats a l'Annex I adjunt han presentat, dins el termini establert i en la forma escaient, tota la documentació necessària prevista a la convocatòria, però s'ha comprovat que no compleixen amb algun dels requisit de la convocatòria, amb les incidències i motius corresponents que s'assenyalen, segons els motius de reducció de l'Annex II.</em></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>5.En data 27 de febrer de 2023 es notifica, mitjançant publicació a la pàgina web del FOGAIBA, l'informe i la proposta provisional de revocació total de la subvenció, emesa pel Servei d'ajudes al Desenvolupament Rural als interessats de l'annex I que incompleixen amb el punt novè, apartat d) de la convocatòria, referent al compromís bàsic de formació. Posteriorment, en data 24 d'abril de 2023 es notifica, mitjançant publicació a la pàgina web del FOGAIBA, l'informe i la proposta provisional de revocació, en el qual els beneficiaris de l'annex II tambés incomplien aquest compromís bàsic. Finalment, el passat 22 de maig de 2023 es notifica, mitjançant publicació a la pàgina web del FOGAIBA, l'informe i la proposta provisional de revocació total de la subvenció pel mateix motiu d'incumpliment. En tots els casos, s'ha concedit un termini de 10 dies per presentar les al·legacions escaients.</em></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>6.Dins el termini establert, els interessats de l'annex I d'aquesta proposta de resolució no han presentat al·legacions per dur a terme possibles esmenes, o bé si els han presentades, s'han desestimat.</em></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
