&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El 22 de desembre de 2020 es va publicar en el BOIB núm. 212, la convocatòria pública de subvencions per a actuacions de rehabilitació energètica en edificis existents (Programa PREE) dins el Programa Operatiu FEDER 2014-2020, mitjançant la Resolució del vicepresident i conseller de Transició Energètica i Sectors Productius de 14 de desembre de 2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La Direcció General d'Energia i Canvi Climàtic va concedir una subvenció a la persona o entitat que figura en l'annex d'aquesta Resolució en el marc de la convocatòria per a actuacions de rehabilitació energètica en edificis existents (Programa PREE).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La persona o entitat que figura en l'annex va aportar la documentació per a la justificació de la realització de les actuacions subvencionades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El&amp;nbsp; tècnic de la Direcció General d'Energia i Canvi Climàtic va examinar la documentació aportada&amp;nbsp; i va emetre un informe desfavorable a la justificació del expedient descrit en l'annex amb la motivació que figura en aquest annex.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. El 27 de juny de 2023 es va emetre una proposta de resolució de revocació del director general d'Energia i Canvi Climàtic (BOIB núm. 90, de 4 de juliol de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. En data 4 d'agost de 2023 (RE. REGAGE23e00053178632 i GOIBE507318/2023 de data 7 d'agost de 2023) el Sr. Palmer Caldes va presentar un escrit d'al·legacions contra la proposta de resolució del director general d'Energia i Canvi Climàtic (BOIB núm. 90 de 4 de juliol de 2023) en el que manifestava:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;«SEGUNDO.- Se indica que se han emitido facturas y se han realizado pagos con anterioridad a la fecha del registro de la solicitud, siendo este extremo subsanable, y no puede ser causa de denegación de la subvención, toda vez que dichos extremos no se han producido efectivamente, si que es el proceder mercantil normal para poder realizar trabajos, y más en el marco actual de crisis económico, falta de recursos y carencia de profesionales. Además, se debe a un error humano, subsanable como hemos dicho, toda vez que tengo varios proyectos con las empresas participantes en la reforma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por otro lado, se podría detraer dicho importe de la subvención, pero el hecho de denegar el total de la misma, produce un perjuicio brutal y las consecuencias son muy negativas tanto personalmente como profesionalmente, y las consecuencias por dicha inclusión son desmesuradas y arbitrarias.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. En data 30 d'agost de 2023, s'ha emès un informe desfavorable a les al·legacions presentades per Julián Palmer Caldés contra la proposta de resolució del director general d'Energia i Canvi Climàtic de 27 de juny de 2023&amp;nbsp; (BOIB núm.&amp;nbsp; 90 de 4 de juliol de 2023), en l'expedient PREE 44/2020, atès que de la documentació aportada queda acreditat que el Sr. Palmer Caldes ha presentat factures i pagaments a compte de la inversió amb anterioritat a la presentació de la sol·licitud (30/03/21), no acreditant &amp;nbsp;en cap moment, ni amb l'escrit d'al·legacions, que la factura i el seu pagament anteriorment transcrit, corresponen a actuacions preparatòries per presentar la sol·licitud, incomplint l'establert el punt 3.3.3 de les bases de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Reial decret 737/2020, de 4 d'agost, pel qual es regula el programa d'ajudes per a actuacions de rehabilitació energètica en edificis existents i es regula la concessió directa de les ajudes d'aquest programa a les comunitats autònomes i ciutats de Ceuta i Melilla.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Resolució del vicepresident i conseller de Transició Energètica i Sectors Productius de 14 de desembre de 2020 per la qual s'aprova la convocatòria pública de subvencions per a actuacions de rehabilitació energètica en edificis existents (Programa PREE). BOIB núm. 212 de 22 de desembre de 2020&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. L'Ordre de la consellera de Comerç, Indústria i Energia de 15 de maig de 2008 per la qual s'estableixen les bases reguladores per a la concessió de subvencions en matèria d'energia (BOIB núm. 72 de 24 de maig de 2008).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El Sr. Palmer Caldes&amp;nbsp; fonamenta el seu escrit en que&amp;nbsp; la factura abonada amb anterioritat a la data de registre de la sol·licitud de la subvenció és esmenable, i que aquest fet no pot ser causa de denegació de la subvenció. I que en tot cas es podria reduir la part proporcional , però no denegar la subvenció circumstància que causa un greu perjudici.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. BOE núm. 212, de data 6 d'agost de 2020 – RD 737/2020, de 4 d'agost,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;- &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;L'article 13.8 &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;« Dado el carácter incentivador de las ayudas, solo se admitirán actuaciones por parte de los destinatarios últimos de las ayudas iniciadas con posterioridad a la fecha de registro de la solicitud de la ayuda, no considerándose elegible ningún coste relativo a la ejecución de la actuación que haya sido facturado con anterioridad, sin perjuicio de los costes correspondientes a actuaciones preparatorias que sean necesarios para presentar la solicitud o llevar a cabo las correspondientes inversiones, como pueden ser proyecto, memorias técnicas, certificados, etc., que sí podrán ser considerados subvencionables, aun cuando hubieran sido facturados con anterioridad, siempre que, en todo caso, estas actuaciones preparatorias se hubieran iniciado con fecha posterior a la fecha de entrada en vigor del Programa establecida en el artículo 4.»&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. BOIB núm.212, de data&amp;nbsp; 22 de desembre de 2020&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Punt 3.3 «Requisits generals» , apartat 3.3.2, 3.3.3 i 3.3.4 disposa:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3.3.2. Atès el caràcter d'incentiu dels ajuts, la realització de les actuacions no es pot produir abans de la data de registre de la sol·licitud, de manera que la inversió destinada a aquesta adquisició ha d'haver-se efectuat amb posterioritat a la data de registre de la sol·licitud. A aquest efecte, en cas de persones jurídiques públiques, s'ha de prendre com a data de referència per determinar la&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;data d'aquesta adquisició la de la publicació dels plecs de licitació.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3.3.3. Les factures i el pagament de la inversió, inclòs l'abonament de possibles quantitats a compte o sota qualsevol altre concepte, ha de ser posterior a la data del registre de la sol·licitud.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Punt. 10. Pagament i justificació activitats. 6.&lt;em&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/em&gt;&amp;nbsp;La falta de justificació en els termes i els terminis que estableixi la resolució d'atorgament de la subvenció, la modificació del projecte presentat sense que la Conselleria de Transició Energètica i Sectors Productius l'hagi aprovat prèviament, així com la desviació de les subvencions o l'aplicació diferent del que estableix la norma, determinen la revocació de la subvenció.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. Documentació presentada pel Sr. Palmer Caldes :&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;- Factura nº 21-160 de data 19 de març de 2021, concepte «Anticipo 25% (P:21/1/5), import 16.021,30€&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;- Justificant transferència bancària de data 19 de març de 2021, concepte «Pago factura 21-160» per import de 16.021,30€&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De la documentació aportada queda acreditat que el Sr. Palmer Caldes ha presentat factures i pagaments a compte de la inversió amb anterioritat a la presentació de la sol·licitud (30/03/21), no acreditant &amp;nbsp;en cap moment, ni amb l'escrit d'al·legacions, que la factura i el seu pagament anteriorment transcrit, corresponen a actuacions preparatòries per presentar la sol·licitud, incomplint l'establert el punt 3.3.3 de les bases de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Resolució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Revocar la concessió de les subvenció detallada en l'annex i per l'import que en ell s'hi indica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Autoritzar i disposar negativament la despesa a favor dels beneficiaris per l'import detallat en l'annex amb càrrec a la partida pressupostària 2022/G/731A01/77000/00/19701/20105.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Declarar conclòs el procediment i, per tant, arxivar l'expedient indicat en l'annex.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Publicar aquesta Resolució en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d'Empresa, Ocupació i Energia en el termini d'un mes comptador des de l'endemà de la publicació, d'acord amb els articles&amp;nbsp;123 i 124 de la Llei&amp;nbsp;39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article&amp;nbsp;57 de la Llei&amp;nbsp;3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la publicació de la resolució, d'acord amb l'article&amp;nbsp;46 de la Llei&amp;nbsp;29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;
