    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Mitjançant el Decret de la Presidència del Consell Insular de Menorca núm. 95/2023, d'11 de juliol, es determina l'estructura interna dels departaments.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El pressupost del CIM preveu nou llocs de treball de secretari/ària de president o conseller.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per proveir aquests llocs de treball, d'acord amb el que estableix el Catàleg de llocs de feina del Consell Insular de Menorca, el procediment és el de lliure designació, que regula l'article 80 del Reial decret legislatiu 5/2015, de 30 d'octubre, pel qual s'aprova el Text refós de l'EBEP; per l'articles 79 i següents de la Llei de 3/20017, de 27 de març, de la funció pública de la CAIB, i pel Decret 33/1994, de 28 de març, pel qual s'aprova el Reglament de proveïment de llocs de treball i promoció professional dels funcionaris al servei de l'Administració de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A la provisió de llocs de treball hi poden accedir els funcionaris de carrera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;L'article 87 de la Llei 3/2007, de 27 de març, de la funció pública de la CAIB, de comissió de serveis forçosa, estableix que abans de nomenar per aquest sistema: «La comisión de servicios con carácter forzoso es procedente cuando es urgente la provisión de un puesto de trabajo que ha quedado vacante después de una convocatoria de provisión y no existe personal funcionario interino en condiciones de ocuparlo.»&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per la qual cosa, i atès que és urgent proveir aquests llocs de feina, es dona l'oportunitat al personal interí de manifestar la seva disponibilitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Atesa la proposta de la consellera executiva del Departament d'Economia i Serveis Generals i en exercici de les competències atribuïdes a l'article 33 de la Llei 4/2022, de 28 de juny, de consells insulars, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consell Executiu, per unanimitat i en votació ordinària, adopta l'acord següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aprovar les bases i la convocatòria per a la provisió dels llocs de treball de secretari/ària de les conselleries següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les sol·licituds per prendre part en aquesta convocatòria s'han de presentar en el format oficial que el Consell Insular de Menorca posa a l'abast dels candidats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les sol·licituds s'han de presentar únicament telemàticament, segons l'article 14.2&amp;nbsp;&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;e&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, mitjançant DNI electrònic o un certificat digital vàlid. La sol·licitud queda registrada directament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El termini de presentació de sol·licituds és de&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; quinze dies hàbils&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; comptadors a partir l'endemà d'haver-se publicat la convocatòria en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Als efectes informatius, també es publicarà en el web del Consell Insular de Menorca i al tauler d'anuncis.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A la sol·licitud cal consignar amb claredat el lloc o els llocs a què vol optar i, mitjançant un número, si escau, l'ordre de preferència entre ells. S'hi ha d'adjuntar la documentació que acrediti la titulació o les titulacions, el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;curriculum vitae &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;i l'acreditació dels altres requisits exigits en el Catàleg de llocs de feina.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La data de referència per al compliment dels requisits exigits al·legats és el dia que acabi el termini de presentació de sol·licituds.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercer. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Finalitzat el termini de presentació de sol·licituds, la consellera executiva de Serveis Generals, després d'escoltar els consellers dels respectius departaments, dictarà una resolució per la qual aprovarà la llista dels aspirants designats i l'assignació específica dels aspirants seleccionats a cada lloc de treball que ha estat convocat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quart. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;La incorporació al lloc de treball assignat ha de ser immediata, llevat de raons degudament justificades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquesta incorporació suposa la pèrdua del lloc de treball de procedència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La qual cosa us comunic perquè en prengueu coneixement i tengui els efectes que corresponguin, al mateix temps que us faig saber que contra l'acord precedent, que no esgota la via administrativa, podeu interposar, en el termini d'un mes a partir de l'endemà de la data de recepció d'aquesta notificació, recurs d'alçada davant el Ple del Consell Insular, sens perjudici que pugueu utilitzar qualsevol altre recurs que considereu procedent en dret. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'esmentat recurs s'entendrà desestimat si no se us n'ha notificat la resolució quan hagin transcorregut tres mesos des de la seva interposició. Contra la desestimació del recurs d'alçada per silenci administratiu podreu interposar recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
