&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En data 29 de juny de 2023 es publicà en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; la Resolució de la consellera d'Afers Socials i Esports de 26 de juny de 2023 per la qual s'aprova la convocatòria de subvencions destinades a entitats privades sense ànim de lucre que desenvolupen serveis i programes d'acollida residencial de persones refugiades procedents del conflicte d'Ucraïna, per als anys 2023 i 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Dins el termini establert en el punt 7.1 de la convocatòria, les entitats que s'indiquen en l'annex d'aquesta proposta de resolució han presentat una sol·licitud de subvenció per finançar les despeses derivades del funcionament d'equipaments residencials col·lectius destinats a l'acollida de persones beneficiàries de protecció internacional procedents del conflicte d'Ucraïna, per als anys 2023 i 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El personal del Servei de Serveis Socials de la Direcció General d'Afers Socials ha revisat la documentació de les sol·licituds presentades i ha comprovat que s'adapten a l'objecte que disposa el punt 1 de la convocatòria i que les entitats compleixen els requisits que estableix el punt 4.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En data 17 d'agost de 2023 s'ha reunit la Comissió Avaluadora, prevista en el punt 9 de la convocatòria, i ha aprovat l'informe tècnic que fonamenta la proposta de resolució de concessió de subvencions. Aquest informe inclou la llista dels possibles projectes beneficiaris ordenats per puntuació en aplicació dels criteris de valoració establerts en l'apartat 11.3 de la convocatòria, com també la previsió de finançament dels projectes presentats. L'apartat 11.5 de la convocatòria disposa que la puntuació mínima necessària perquè una sol·licitud pugui accedir a la subvenció és de 35 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. D'acord amb el punt 10.4 de la convocatòria i l'informe de la Comissió Avaluadora, l'òrgan instructor del procediment iniciarà el tràmit d'audiència amb la formulació de la proposta de resolució provisional perquè, en el termini màxim de deu dies hàbils comptadors des de l'endemà de la publicació de la primera proposta de resolució provisional en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, les entitats interessades puguin presentar al·legacions a la puntuació obtinguda pel projecte presentat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El punt 10.5 de la convocatòria estableix que una vegada finalitzat el tràmit d'audiència i revisades les al·legacions presentades, l'òrgan instructor del procediment ha de formular, d'acord amb l'informe final de la Comissió Avaluadora, la proposta de resolució definitiva perquè, en el termini de tres dies hàbils des de l'endemà de la publicació de la segona proposta de resolució provisional en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, els interessats comuniquin l'acceptació o la renúncia a la proposta de resolució. En tot cas, es considera que l'entitat beneficiària accepta la proposta de resolució si no manifesta el contrari en el termini de tres dies hàbils comptadors des de l'endemà que s'hagi publicat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. D'acord amb els punt 12.1 de la convocatòria, s'han adjudicat els imports assignant el 100 % del pressupost sol·licitat a cada projecte seguint l'ordre establert fins a exhaurir el crèdit disponible; per tant, s'atorgarà a les entitats el 100&amp;nbsp;% de l'import sol·licitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. D'acord amb l'article 24.4 de la Llei 38/2003, de 17 de novembre, General de Subvencions i atès que l'import de totes subvencions proposades és igual a l'import les sol·licituds presentades, es podrà prescindir del tràmit d'audiència quan no figurin en procediment ni siguin tinguts en compte altres fets ni altres al·legacions i proves que les adduïdes pels interessats. En aquest cas, la proposta de resolució formulada tindrà el caràcter de definitiva. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. S'ha comprovat, de conformitat amb el que disposa el punt 4.1 de la convocatòria de subvencions, en relació amb l'article 11.f del Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions, i l'article 38 del Decret 75/2004, de 27 d'agost, de desplegament de determinats aspectes de la Llei de finances i de les lleis de pressuposts generals de la comunitat autònoma de les Illes Balears, que les entitats proposades per la concessió de la subvenció es troben al corrent del compliment de les obligacions tributàries i amb la Seguretat Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. Els pagaments prevists suposen una bestreta superior al 75 % de l'import màxim establert en aquesta convocatòria i s'eximeix l'entitat beneficiària de presentar cap tipus de garantia de la quantitat que se li anticipa, de conformitat amb l'article 37.2 del Text refós de la Llei de subvencions i l'article 25.3.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; del Decret 75/2004, de 27 d'agost, de desplegament de determinats aspectes de la Llei de finances i de les lleis de pressuposts generals de la Comunitat Autònoma de les Illes Balears, i d'acord amb l'autorització prèvia per l'Acord del Consell de Govern de dia 22 de maig de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La Llei 39/2015, d'1 d'octubre, del procediment administratiu comú.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La Llei 38/2003, de 17 de novembre, General de Subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. El Decret 75/2004, de 27 d'agost, de desplegament de determinats aspectes de la Llei de finances i de les lleis de pressuposts generals de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. La Llei 4/2009, d'11 de juny, de serveis socials de les Illes Balears, que en l'article 3 estableix que els objectius de les polítiques socials són, entre d'altres, prevenir i atendre les situacions de vulnerabilitat de les persones i dels grups en situació d'exclusió social. Així mateix, l'article 4 disposa, entre els principis rectors, el d'universalitat i igualtat, pel qual els serveis públics han de garantir a tothom el dret d'accés als serveis socials i l'ús efectiu en condicions d'igualtat, equitat i justícia distributiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. El Decret 12/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears. Dins aquesta estructura, i sota la direcció del Govern, s'inclou la Conselleria de Famílies i Afers Socials, de la qual depèn la Direcció General d'Afers Socials i li atribueix les competències, entre d'altres, de gestió dels programes de serveis socials i de foment de programes d'inclusió social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. L'Ordre de la consellera d'Afers Socials i Esports de 5 de març de 2021 per la qual s'estableixen les bases reguladores de les subvencions en matèria de serveis socials i de joventut (BOIB núm. 34, d'11 de març).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. La Resolució de la consellera d'Afers Socials i Esports de 26 de juny de 2023 per la qual s'aprova la convocatòria de subvencions destinades a entitats privades sense ànim de lucre que desenvolupen serveis i programes d'acollida residencial de persones refugiades procedents del conflicte d'Ucraïna, per als anys 2023 i 2024 (BOIB núm. 88, de 29 de juny de 2023)).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Proposta de resolució definitiva&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Propòs a la consellera de Famílies i Afers Socials que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Aprovar la concessió de les subvencions sol·licitades a favor de les entitats i pels imports que consten en l'annex d'aquesta proposta de resolució definitiva. El període d'execució de les activitats està comprés entre el dia 1 de maig de 2023 i el 31 de desembre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Autoritzar i disposar una despesa a favor de les entitats i pels imports que consten en l'annex d'aquesta proposta de resolució definitiva per finançar les despeses derivades del funcionament d'equipaments residencials col·lectius destinats a l'acollida de persones beneficiàries de protecció internacional procedents del conflicte d'Ucraïna amb càrrec a la partida pressupostària 17401.313EUK.48000.00 dels pressuposts generals de la Comunitat Autònoma de les Illes Balears per a l'any 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. L'Acord de Consell de Govern de data 22 de maig de 2023 i l'apartat 13 de la convocatòria estableixen que els pagaments que es deriven d'aquest expedient es faran de manera anticipada, eximint les entitats de presentar aval bancari per la quantitat que se li anticipa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Informar les entitats beneficiàries que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Estan obligades al compliment de les obligacions establertes en el punt 5 de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- La justificació de la subvenció concedida s'efectuarà de conformitat amb el que disposen els punts 14 i 15 de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Atorgar a les entitats interessades un termini de tres dies hàbils des de l'endemà de la publicació de la proposta de resolució definitiva en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, per comunicar l'acceptació o la renúncia a la proposta de resolució. En tot cas, es considera que l'entitat beneficiària accepta la proposta de resolució si no manifesta el contrari en el termini de tres dies hàbils comptadors des de l'endemà que s'hagi publicat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Publicar al &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; aquesta proposta de resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
