![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">Ateses les bases que regeixen la concessió d'ajuts a accions per millorar el coneixement, la salvaguarda i la difusió del patrimoni històric de Menorca, inclòs el patrimoni cultural immaterial, i la convocatòria corresponent a l'any 2023, aprovades pel Consell Executiu dia 20 de març de 2023 i publicades en el BOIB núm. 41 d'1 d'abril de 2023.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">Atès que a les bases i a la convocatòria d'aquestes ajudes es diferencien fins a 6 línies de subvenció, les quals han de complir els requisits i les condicions específiques i les comunes sobre les accions subvencionades.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">Atès que la Comissió Avaluadora prevista en el punt 10 de les bases que regeixen la convocatòria es va reunir el dia 27 de juny de 2023.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">Atès que una vegada revisades les sol·licituds presentades i valorats els projectes per part dels instructors, a les línies 1, 3, 5 hi va quedar sense repartir l'import de 33.290,83 € (corresponents a capítol 7) i a la línia 6 hi va quedar sense repartir l'import de 23.979,30 € (corresponents a capítol 4).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">Atès que la convocatòria dels ajuts estableix que: <span style="color:#00000a">«En el cas que per a una línia no s'esgoti la consignació pressupostària, la quantitat sobrant s'assignarà, </span><span style="color:#000000">dins la mateixa línia pressupostaria, </span><span style="color:#00000a">a projectes d'altres línies seguint l'ordre de puntuació atorgada, i </span><span style="color:#000000">tenint en compte totes les línies, s</span><span style="color:#00000a">ense que pugui superar la quantitat sol·licitada ni l'import màxim per sol·licitud establert per a la línia corresponent.»</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">Atès que <span style="color:#00000a">l'import del romanent de la línia 6 (finançat amb una partida del capítol 4 – despesa corrent) no es pot repartir entre els projectes de la resta de línies (finançades amb una partida del capítol 7 – inversions).</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">Atès que e<span style="color:#00000a">l romanent de les línies finançades amb el capítol 7 per import de 33.290,83 €</span> s'ha de repartir entre totes les sol·licituds que no han rebut l'import màxim per sol·licitud establert a la convocatòria (incloent les que ja tenen un ajut per una part de l'import sol·licitat).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">Atès que a l'aplicar aquest criteri els romanents es distribuiexen entre els projectes que tenen més puntuació i incrementen l'import de diverses línies d'acord amb el següent quadre:</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><span style="color:#000000"><strong>ONZÈ</strong></span><strong>. </strong>Donar per desistida de les sol·licituds següents d'ajut a accions de salvaguarda, coneixement i difusió del patrimoni cultural immaterial (línia 6) per a l'any 2023 a l'Associació Soca de Mots (registre d'entrada núm. GE/015823/2023 i GE/015829/2023) per haver renunciat a les mateixes.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><strong>DOTZÈ.</strong> Aprovar les Consideracions generals de la convocatòria d'ajuts a accions per millorar el coneixement, la salvaguarda i la difusió del patrimoni històric de Menorca, inclòs el patrimoni immaterial, corresponent a l'any 2023:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">a) L'import total concedit de les sis línies és de 276.020,70 €.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">b) Totes les ajudes atorgades de les diferents línies queden subjectes a les condicions i els requisits següents: </span></span></span></p>
<p style="margin-left:80px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><strong>Primer</strong>. Per les línies 1 a 5, el termini màxim per realitzar l'activitat subvencionada és d'un any comptador des de la publicació de l'acord de concessió de l'ajut en el <em>Butlletí Oficial de les Illes Balears</em>, i per la línia 6 l<span style="color:#000000">'activitat subvencionada s'ha de realitzar dins la primera anualitat de la convocatòria. T</span>ret que hi hagi causes excepcionals que ho impedeixin i que el beneficiari haurà d'al·legar per escrit. A la vista de l'anterior, el CIM podrà ampliar el termini de realització de l'activitat per un període d'un mes, improrrogable, a comptar a partir de la data de finalització del termini per dur a terme l'activitat.</span></span></span></p>
<p style="margin-left:80px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><strong>Segon</strong>. L'import dels ajuts de les línies 1 a 5 s'aplicarà de la següent manera: un 50% al capítol 7 del programa de Patrimoni Històric del pressupost de 2023 i el restant 50% a una partida del capítol 7 del programa de Patrimoni històric del pressupost de l'any 2024. L'import dels ajuts de la línia 6 s'aplicarà al capítol 4 del programa de Política Lingüística i Patrimoni Cultural Immaterial del pressupost de 2023.</span></span></span></p>
<p style="margin-left:80px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><strong>Tercer</strong>. En cas que la subvenció concedida sigui substancialment inferior a l'import sol·licitat o en cas que no es disposi de finançament per realitzar el projecte presentat, es concedeixen quinze dies hàbils d'ençà que el beneficiari hagi rebut la notificació de la concessió per acceptar o renunciar a l'ajut concedit. Si no es comunica la renúncia en aquest termini, s'entendrà acceptat tàcitament l'import de la subvenció i s'haurà de justificar la totalitat del pressupost de l'activitat que es va presentar a la convocatòria, i no només l'import de l'ajut concedit.</span></span></span></p>
<p style="margin-left:80px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><strong>Quart</strong>. Si la despesa justificada excedeix de l'import del pressupost sol·licitat, la possible desviació pressupostària anirà a càrrec del beneficiari de l'ajut. Si per contra la despesa justificada és inferior a l'import del pressupost sol·licitat i subvencionat es reduirà de forma proporcional la subvenció concedida.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><strong>TRETZÈ. </strong>Remetre a la Base de Dades Nacional de Subvencions l'acord de resolució de l'expedient de concessió o denegació dels ajuts en compliment de l'art. 20.8 de l'LGS i publicar-lo en el <em>Butlletí Oficial de les Illes Balears, </em>fent-hi constar els quadres amb les valoracions dels criteris objectius que s'han tingut en compte per a la seva concessió i que figuren com a annex.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">Contra aquest acord – que no exhaureix la via administrativa – es pot interposar un recurs d'alçada davant el Consell Executiu en el termini d'un mes comptador des de l'endemà que s'hagi publicat, d'acord amb l'article 122 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">L'esmentat recurs s'entendrà desestimat, si no es notifica la resolució corresponent, quan hagin transcorregut tres mesos des de la seva interposició. Contra la desestimació del recurs d'alçada per silenci administratiu podreu interposar recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma.</span></span></span></p>
