    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'apartat 9.3 de la Resolució de el president de el Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 13&amp;nbsp;de desembre de 2019, per la qual es convoquen, per a l'any 2019, subvencions per a inversions en la prevenció dels danys causats en els boscos per incendis forestals, desastres naturals i catàstrofes, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació en el Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, de 1 d'octubre, de procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), en compliment del que disposa l'article 43 de la Llei 30/2015, de 1 d'octubre, de procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El vicepresident&amp;nbsp;en matèria agrària del FOGAIBA, amb data 22 de juny&amp;nbsp;de 2023, va signar la següent resolució:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1. Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 13 de desembre de 2019 publicada en el BOIB 169 de 17 de desembre de 2019 per la qual es convoquen, per a l'any 2019, subvencions per a inversions en la prevenció dels danys causats als boscos per incendis forestals, desastres naturals i catàstrofes.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2. Una vegada analitzada tota la documentació presentada, el vicepresident del FOGAIBA va resoldre favorablement la concessió de l'ajuda a favor dels interessats que figuren en l'annex de la Resolució amb les dades i els imports corresponents.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3. Atesa la Resolució de concessió de l'ajuda esmentada, i d'acord amb el que estableix l'apartat desè de la convocatòria abans esmentada, el beneficiari s'obliga, entre altres, a realitzar les actuacions auxiliades dins el termini establert i a justificar les despeses relacionades amb la inversió per a la recepció dels fons comunitaris en la manera i els terminis determinats en la convocatòria.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;4. Dins el termini legalment establert per a la justificació de les inversions aprovades, les persones beneficiaries que figuren a&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;l'Annex I&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;no han sol.licitat la correrpsonent inspecció final als serveis de gestió forestal ni han presentat la corresponent sol·licitud de pagament. &amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;5.&amp;nbsp;L'article 43 del Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;6.&amp;nbsp;Atès tot això, es proposa fer la revocació total a causa de l'incompliment dels compromisos contrets.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2.Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3.Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Proposta de resolució&amp;nbsp;de revocació total&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Per tot això, s'informa favorablement i propòs al vicepresident en matèria agrària del FOGAIBA que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1. Revocar totalment les resolucions d'ajuda concedides als beneficiaris per l'import i amb les dades detallades en l'annex d'aquesta resolució, que és un total d'7 expedients i que comença amb&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;LUCIA SANCHO DE LA JORDANA LLABRES&amp;nbsp;i acaba amb &lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;ERICE DIRECTORSHIP, SL, que suma un import total de 26.159,00 euros, relativa a la línia d'ajuda “inversions en la prevenció dels danys causats als boscos per incendis forestals, desastres naturals i catàstrofes”.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Interposició de recursos&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant la&amp;nbsp;consellera&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;d&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;'&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Agricultura&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;,&amp;nbsp;Pesca&amp;nbsp;i Alimentació, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears, i els articles 121 i 122 de la Llei 39/2015, de 1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
