&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 8.4. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de&amp;nbsp;22&amp;nbsp;de febrer&amp;nbsp;de 2021 per la qual s'aprova la convocatòria de les ajudes, per al foment de l ‘agricultura&amp;nbsp;ecològica&amp;nbsp;i per el foment de pastures per a l'aprofitament de la ramaderia ecològica, per als anys&amp;nbsp;2021&amp;nbsp;i 2022 (anualitat 2022),&amp;nbsp;especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques . &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 7&amp;nbsp;de juny&amp;nbsp;de 2023, va signar la següent resolució:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7.El dia 1 de juny de 2022 el vicepresident del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) va aprovar l'ajuda corresponent a l'expedient 0400891&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/21&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de la línia d'ajudes destinades al foment de l'agricultura ecològica a favor de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;MARIA ANTONIA BARCELO GARCIA, amb DNI ***2441**&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;un import màxim de 5&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;8&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;6,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;88&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;€ repartits en dues anualitats de 2&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;9&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;3,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;44&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;€, corresponents a una superfície compromesa de 1,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;71&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;ha (BOIB&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;núm&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;86, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;de 2&amp;nbsp;de juliol de 2022).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8.E&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;n data &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;17 de març de 2021&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;es va registrar la sol·licitud d'ajuda a nom &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;de &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;MARIA ANTONIA BARCELO GARCIA, amb DNI ***2441**&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, a l'empara de les resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 22 de febrer de 2021 per la qual s'aprova la convocatòria per als anys 2021 i 2022 de les ajudes destinades al foment de pastures per a l'aprofitament de la ramaderia ecològica.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9.El dia 22 de juliol de 2022 el vicepresident del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) va aprovar l'ajuda corresponent a l'expedient 04000891/21 de la línia d'ajudes destinades al foment de pastures per a &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;l'aprofitament de la ramaderi&lt;/em&gt;&lt;/span&gt;&lt;em&gt;a ecològica a favor &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;de &lt;/em&gt;&lt;/span&gt;&lt;em&gt;MARIA ANTONIA BARCELO GARCIA, amb DNI ***2441** un import màxim de 7.216,00 € repartits en dues anualitats de 3.608,00 € corresponents a una superfície compromesa de 29,74 ha (BOIB núm. 89, de o de juliol de 2022).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;10.En data 22 d'abril de 2023 es publica al BOIB núm. 51 una modificació de la concessió de la beneficiària MARIA ANTONIA BARCELO GARCIA, amb DNI ***2441**, mitjançant la qual s'amplia l'import concedit per la línia d'ajudes destinades al foment de pastures per a &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;l'aprofitament de la ramaderi&lt;/em&gt;&lt;/span&gt;&lt;em&gt;a ecològica fins a 10.330,00 € repartits en dues anualitats de 5.165,00 €.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;11.En data 6 d'abril de 2022 es realitza mitjançant l'aplicació Sistema de Gestió d'Ajudes, una subrogació dels compromisos d'&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ANTONIO SALAS GALMES amb DNI ***1674** &lt;/em&gt;&lt;/span&gt;&lt;em&gt;pels quals es tenia dret a l'ajuda destinades al foment de pastures per a l'aprofitament de la ramaderia ecològica i per al foment de l'agricultura ecològica de l'expedient 04000389/21 a favor de MARIA ANTONIA BARCELO GARCIA, amb DNI ***2441** (expedient 04002269/22).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;12.Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural, han comprovat la informació necessària per efectuar l'avaluació del compliment dels requisits per part del nou titular, per ser beneficiari de les ajudes, tal i com estipula l'apartat desè de la resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 22 de febrer de 2021, per la qual s'aprova la convocatòria per als anys 2021 i 2022 de les ajudes destinades al foment de pastures per a l'aprofitament de la ramaderia ecològica i per al foment de l'agricultura ecològica.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 22 de febrer de 2021 per la qual s'aprova la convocatòria per als anys 2021 i 2022 de les ajudes destinades al foment de pastures per a l'aprofitament de la ramaderia ecològica.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 22 de febrer de 2021 per la qual s'aprova la convocatòria per als anys 2021 i 2022 de les ajudes destinades al foment de l'agricultura ecològica.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.En data 24 de febrer de 2022 es va publicar, en el BOIB núm. 29, una modificació de la Resolució citada anteriorment per la qual s'incrementa el crèdit i es modifica el finançament de la convocatòria, per als anys 2021 i 2022.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, de 17 de desembre de 2013, relatiu a l'ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER) i pel qual es deroga el Reglament (CE) núm. 1698/2005 del Consell.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.Reglament (UE) núm. 1306/2013 del Parlament Europeu i del Consell, de 17 de desembre de 2013, sobre el finançament, gestió i seguiment de la Política Agrícola Comú, pel qual es deroguen els Reglaments (CE) núm. 352/78, (CE) núm. 165/94, (CE) núm. 2799/98, (CE) núm. 814/2000, (CE) núm. 1290/2005 i (CE) núm. 485/2008 del Consell.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.Reglament delegat (UE) núm. 640/2014 de la Comissió, d'11 de març de 2014, pel qual es completa el Reglament (UE) núm. 1306/2013 del Parlament Europeu i del Consell, pel que fa al sistema integrat de gestió i control i a les condicions sobre la denegació o retirada dels pagaments i sobre les sancions administratives aplicables als pagaments directes, a l'ajuda al desenvolupament rural i a la condicionalitat.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7.Reglament d'execució (UE) núm. 808/2014 de la Comissió, de 17 de juliol de 2014, pel qual s'estableixen disposicions d'aplicació del Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, relatiu a l'ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9.Reial decret 1075/2014, de 19 de desembre, sobre l'aplicació a partir del 2015 dels pagaments directes a l'agricultura i a la ramaderia i altres règims d'ajuda, així com sobre la gestió i control dels pagaments directes i dels pagaments al desenvolupament rural.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;10.Reial decret 1078/2014, de 19 de desembre, pel qual s'estableixen les normes de condicionalitat que han de complir els beneficiaris que rebin pagaments directes o determinades primes anuals de desenvolupament rural, o pagaments en virtut dels programes de suport a la reestructuració i reconversió o de suport a la collita en verd, al sector vitivinícola.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;11.Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;17.Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;BOIB núm. 082 de 2007&lt;/em&gt;&lt;/span&gt;&lt;em&gt;; en virtut de l'Ordre de la consellera d'Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l'assumpció de l'execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l'article 1 que el FOGAIBA assumeix l'execució de la política de la Conselleria d'Agricultura i Pesca referent a l'aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l'1 de gener de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;18.Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;19.Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Proposta de resolució de subrogació i&amp;nbsp;concessió&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
