&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;«DECRET DE NOMENAMENT DE TINENTS/TINENTES DE BATLE &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Antecedents&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Constituïda la Corporació Municipal pel període 2023-2027 en el Ple de l'Ajuntament de data 17 de juny de 2023 desprès del procés electoral de les eleccions municipals de dia 28 de maig de 2023, i elegit batle de sa Pobla, Biel Ferragut Mir, es fa necessari procedir a la nova organització municipal, i, més concretament, a la designació de les tinences de batlia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquesta batlia per decret ha resolt designar els membres integrants de la Junta de Govern Local, per això es fa precís la designació de tinents/es de batle entre els seus components.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Articles 21.2 i 23.3 de Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local (LBRL) que disposen que la designació de tinències de batlia és competència d'aquesta batlia, qui haurà de procedir al seu nomenament, mitjançant decret, d'entre els membres de la Junta de Govern Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Article. 20.1 a) de la LBRL i articles 22 i 25 de la Llei 20/2006 (LMRLIB) que estableixen que els tinències de batlia són d'existència obligatòria en tots els municipis. Aquests seran lliurament nomenats i cessats pel batle d'entre els membres de la Junta de Govern Local. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Articles 46 a 48 del RD 2568/86, de 28 de novembre (ROF) que estableix que els nomenaments i cessaments es faran mitjançant resolució del batle, de la que se'n donarà compte al Ple en la primera sessió que se celebri, i es notificarà als designats i es publicarà en el BOIB sense perjudici de la seva efectivitat des de l'endemà de la resolució, si a aquesta no s'estableix altre cosa. El nombre de tinències de batlia no podrà excedir del nombre de membres de la Junta de Govern Local,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLC&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1r. Nomenar tinents i tinentes de batle d'aquest Ajuntament, amb efectes del dia d'avui, als regidors – regidores membres de la Junta de Govern Local que a continuació es relacionen, els quals substituiran a aquesta batlia en els casos de vacant, absència o malaltia i per l'ordre que s'indica:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2a tinenta de batle: Maria Magdalena De La Fuente Ferrà&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5a tinenta de batle: Antoni Caldés Gost&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2n. Establir, als efectes indicats a l'apartat anterior, que quan tingui que absentar-se aquesta batlia del terme municipal, es determinarà mitjançant decret la durada de la seva absència i es designarà a la tinència de batle que hagi d'assumir les seves competències. De no conferir-se aquesta delegació expressament, aquesta alcaldia serà substituïda pel primer tinent de batle, i, en el seu defecte, per qualsevol de les altres tinències de batlia establertes, que es trobin presents, les quals hauran de donar compte d'això a la resta de la Corporació, sense que durant el mateix dia pugui actuar com batle accidental més d'un d'ells.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3r. Establir, als efectes indicats a l'apartat anterior, que les tinències de batlia hauran de mantenir informada a aquesta batlia de l'exercici de les seves atribucions com a batle accidental, i no podran, durant l'esmentat exercici, ni modificar les delegacions efectuades per aquesta alcaldia amb anterioritat, ni atorgar altres noves.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4t. Comunicar aquesta resolució a tots els regidors/es afectats i als caps dels diferents Serveis municipals, per al seu coneixement i efectes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5è. Donar compte d'aquesta resolució al ple a la sessió extraordinària que es convoqui per donar compliment al que preveu l'article 38.d) ROF.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6è. Publicar, de conformitat amb l'article 46.1 ROF aquesta resolució en el Butlletí Oficial de les Illes Balears, sense perjudici de la seva efectivitat des del dia de la resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7è. Difondre el contingut d'aquesta resolució, de conformitat amb el principi de transparència, mitjançant la seva publicació actualitzada i permanent a la seu electrònica municipal, en compliment d'allò que disposen els articles 5 i següents de la Llei 19/2013, de 9 de desembre, de transparència, accés a la informació i bon govern.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
