&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. Les entitats que figuren en l'annex 1 d'aquesta resolució han presentat a la Conselleria d'Afers Socials i Esports una sol·licitud de subvenció per donar suport a &lt;span style="color:#000000"&gt;l'organització d'esdeveniments esportius d'alt nivell per a federacions esportives, delegacions territorials de les federacions esportives espanyoles i clubs esportius de les Illes Balears, any 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2. En data 5 de juny 2023, la Comissió Tècnica va avaluar les sol·licituds presentades d'acord amb els criteris d'avaluació establerts en el punt 10 de la convocatòria i va emetre l'informe tècnic que va servir de base a la Comissió Avaluadora per emetre l'informe que va fonamentar la proposta de resolució de la Direcció General d'Esports.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3. En data 7 de juny de 2023, la Comissió Avaluadora es va reunir per examinar l'informe tècnic i emetre l'informe que va de servir de base al director general d'Esports per dictar la proposta de resolució. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;4. La Proposta de resolució del director general d'Esports de concessió de subvencions a l'empara de la Resolució de la consellera d'Afers Socials i Esports per la qual es convoquen ajuts per a l'organització d'esdeveniments esportius d'alt nivell per a federacions esportives, delegacions territorials de les federacions esportives espanyoles i clubs esportius de les Illes Balears, any 2023, on es proposa la no conformitat amb l'atorgament de la subvenció als sol·licitants que figuren en l'annex 1 a la pàgina web de la Direcció General d'Esports dia 13 de juny de 2023 (https://www.caib.es/seucaib/ca/200/persones/tramites/tramite/5640845)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;5. Les entitats beneficiàries han disposat de 10 dies hàbils per presentar al·legacions, així com comunicar a l'òrgan instructor l'acceptació o renúncia de la proposta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;6. Varen presentar al·legacions a la proposta de resolució la següent entitat: Club Esportiu Xeslka&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;7. En sessió de dia 3&amp;nbsp;de juliol 2023, la comissió tècnica va valorar les al·legacions presentades. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de subvencions (BOIB núm. 196, de 31 de desembre de 2005).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. L'Ordre de la consellera d'Afers Socials i Esports de 12 de febrer de 2021 per la qual s'estableixen les bases reguladores per concedir subvencions en matèria d'esports (BOIB núm. 23, de 16 de febrer de 2021).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El Decret 11/2021, de 15 de febrer, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears, modificat pel Decret 25/2021, de 8 de març, de la presidenta de les Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. La Resolució de la consellera d'Afers Socials i Esports per la qual es convoquen ajuts per a l'organització d'esdeveniments esportius d'alt nivell per a federacions esportives, delegacions territorials de les federacions esportives espanyoles i clubs esportius de les Illes Balears, any 2023 (BOIB Núm. 37, 23 de març de 2023).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. Denegar la concessió d'una subvenció per donar suport a &lt;span style="color:#000000"&gt;l'organització d'esdeveniments esportius d'alt nivell per a federacions esportives, delegacions territorials de les federacions esportives espanyoles i clubs esportius de les Illes Balears, a l'any 2023, &lt;/span&gt;als sol·licitants que figuren en el annex 1 d'aquesta Resolució, pels motius que s'especifiquen. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2. Publicar aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra aquesta Resolució —que exhaureix la via administrativa— es pot interposar un recurs potestatiu de reposició davant la consellera d'Afers Socials i Esports en el termini d'un mes comptador des de l'endemà d'haver-ne rebut la notificació, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, de règim jurídic de les administracions públiques i del procediment administratiu comú i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos des de l'endemà d'haver-se publicat aquesta Resolució, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;
