&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1· &lt;/span&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;D'acord amb el que disposa l'article 11.1 del &lt;/span&gt;&lt;/span&gt;&lt;span style="color:blue"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Decret 23/2020, de 31 de juliol, pel qual s'aprova el Text consolidat del Decret pel qual s'estableixen els &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;requisits mínims dels centres de primer cicle d'educació infantil, en referència a la qualificació dels professionals que presten atenció educativa directa als infants del primer cicle d'educació infantil, «l'elaboració i el seguiment de la proposta pedagògica ha d'estar sota la responsabilitat d'un professional amb el títol de mestre d'educació infantil o títol de grau equivalent».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2· &lt;/span&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;En la disposició transitòria tercera d'aquest Text consolidat, que fa referència als professionals sense titulació suficient, s'especifica que poden prestar serveis amb les funcions previstes per al personal a què es refereix l'article 11.1.a) les persones que en el termini de quatre anys compleixin el requisit d'haver cursat i aprovat un dels cursos convocats per la Conselleria d'Educació i Formació Professional amb aquesta finalitat&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3· &lt;/span&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Per tal d'avançar en el procés d'autorització de centres que atenen infants de zero a tres anys i tenen un expedient obert per ser autoritzats com a centres educatius, i tenint en compte els terminis establerts per les disposicions transitòries del Text consolidat del Decret pel qual s'estableixen els requisits mínims dels centres de primer cicle d'educació infantil, es va convocar el Curs de formació per poder prestar funcions de mestre d'educació infantil a centres de primer cicle d'educació infantil, mitjançant la Resolució del conseller d'Educació i Formació Professional de 2 de desembre de 2021 per la qual es convoca el Curs de formació per poder prestar funcions de mestre d'educació infantil a centres de primer cicle d'educació infantil (BOIB núm. 168, de 7 de desembre de 2021). El curs es va iniciar el 24 de gener de 2022 i va finalitzar el 16 de desembre de 2022. Amb aquesta formació es van atendre 30 sol·licituds d'inscripció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4· Nombroses sol·licituds no van poder ser ateses amb la convocatòria del curs anterior, per la qual cosa va esdevenir&lt;/span&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt; urgent &lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt;convocar-ne una nova edició, que es va fer mitjançant la Resolució del conseller d'Educació i Formació Professional de&amp;nbsp; 22 d'agost de 2022 per la qual es convoca el Curs de formació per poder prestar funcions de mestre d'educació infantil a centres de primer cicle d'educació infantil &lt;/span&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;(BOIB núm. 116, de 3 de setembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5· &lt;/span&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;La convocatòria d'aquest curs respon a les necessitats d'ampliació de l'oferta educativa, la qual, al seu torn, s'emmarca en la convocatòria d'ajuts per a la creació, la consolidació i la reconversió de centres que atenen regularment infants de fins a tres anys.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;6· En l'apartat 2 del punt cinquè de l'annex 2 de la Resolució del conseller d'Educació i Formació Professional de &lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt;22 d'agost de 2022 per la qual es convoca el Curs de formació per poder prestar funcions de mestre d'educació infantil a centres de primer cicle d'educació infantil&lt;/span&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;, s'especifiquen els criteris per a l'avaluació i la certificació del curs i es disposa que els alumnes amb una avaluació positiva obtindran la certificació de la formació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;7· En l'apartat 4 del mateix punt cinquè de l'annex 2 de la Resolució esmentada s'indica que, una vegada superada la formació, la Conselleria d'Educació i Formació Professional ha de publicar, mitjançant una resolució en el Butlletí Oficial de les Illes Balears, la relació de persones autoritzades per prestar funcions de mestre d'educació infantil a centres de primer cicle d'educació infantil.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;8· La relació de persones que han assistit al Curs de formació per poder prestar funcions de mestre d'educació infantil a centres de primer cicle d'educació infantil, convocat mitjançant la Resolució del conseller d'Educació i Formació Professional de &lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt;22 d'agost de 2022, &lt;/span&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;i l'han superat és la que figura en aquesta Resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;9· Segons la documentació que consta en la sol·licitud d'inscripció a la formació, els participants que figuren en aquesta relació compleixen els requisits que estableix la disposició transitòria tercera del Decret 23/2020, de 31 de juliol.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;1· La Llei orgànica 8/1985, de 3 de juliol, reguladora del dret a l'educació (BOE núm.159, de 4 de juliol).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;3· La Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic (BOE núm. 236, de 2 d'octubre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;4· La Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques (BOE núm. 236, 02 d'octubre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;5· El Decret 23/2020, de 31 de juliol, pel qual s'aprova el Text consolidat del Decret pel qual s'estableixen els requisits mínims dels centres de primer cicle d'educació infantil (BOIB núm. 135, d'1 d'agost).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;6· El Decret 30/2020, de 28 de setembre, pel qual s'aprova el Text consolidat del Decret pel qual s'estableix i regula la xarxa d'escoles infantils públiques i els serveis per a l'educació de la primera infància de la Comunitat Autònoma de les Illes Balears i es crea l'Institut per a l'Educació de la Primera Infància (BOIB núm. 167, de 29 de setembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;7· La Resolució del conseller d'Educació i Formació Professional de 22 d'agost de 2022 per la qual es convoca el Curs de formació per poder prestar funcions de mestre d'educació infantil a centres de primer cicle d'educació infantil.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1·Autoritzar les persones que figuren en la relació següent a prestar funcions de mestre d&lt;/span&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;'educació infantil a centres de primer cicle d'educació infantil en els termes prevists en el &lt;/span&gt;&lt;span style="color:blue"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Decret 23/2020, de 31 de juliol, pel qual s'aprova el Text consolidat del Decret pel qual s'estableixen els &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt;requisits mínims dels centres de primer cicle d'educació infantil i, en especial, d'acord amb el que preveu la disposició addicional tercera:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;2· Publicar aquesta Resolució en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3· Notificar aquesta Resolució a les persones interessades i emetre &lt;/span&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;les resolucions individuals pertinents per a cadascuna de les persones que han cursat i aprovat el curs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Interposició de recursos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d'Educació i Formació Professional en el termini d'un mes comptador des de l'endemà de la publicació, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i amb l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la publicació d'aquesta Resolució en el Butlletí Oficial de les Illes Balears, d'acord amb els articles 8 i 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
