    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per la present s'anuncia, per a general coneixement i en compliment del que es disposa en l'art. 44.2 del RD 2568/1986 de 28 de novembre, pel qual s'aprova el Reglament d'Organització, Funcionament i Règim Jurídic de les Entitats Locals, que mitjançant Decret de l'Alcaldia de data 20 de juny de 2023 s'ha adoptat la següent resolució relativa a les delegacions d'Alcaldia:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;“Una vegada constituïda la nova Corporació municipal, en sessió extraordinària celebrada el dia 17 de juny de 2023, procedeix a continuació establir el règim d'organització i funcionament d'aquest Ajuntament de conformitat amb la regulació continguda, fonamentalment, en la Llei 7/1985, de 2 d'abril, Reguladora de les Bases del Règim Local, l'RD 2568/1986 de 28 de novembre pel qual s'aprova el Reglament d'Organització, Funcionament i Règim Jurídic de les Entitats Locals i la Llei autonòmica 20/2006 de 15 de desembre Municipal i de Règim Local de les Illes Balears, i altres disposicions legals d'aplicació en matèria de règim local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquesta Alcaldia ha dissenyat un model d'organització municipal en el qual s'estableixen tres grans àrees d'actuació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;AREA I: ADMINISTRACIÓ LOCAL: ALCALDIA-PRESIDENCIA, SERVEIS GENERALS, TERRITORI I MEDI AMBIENT&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Conservació, manteniment i neteja de col·legis i instal·lacions municipals. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Camins i serveis en zones rurals&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A fi de dotar d'una major celeritat i eficàcia a l'actuació municipal, aquesta Alcaldia ha decidit situar al capdavant de cadascuna de les citades Àrees a diferents membres de l'equip de govern en els quals delegar, amb caràcter general, les atribucions de direcció, gestió, impuls i resolució dels assumptes inclosos en la seva respectiva àrea d'actuació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'ÀMBIT FUNCIONAL de la delegació comprendrà les funcions que, amb caràcter enunciatiu, s'indiquen a continuació: Direcció i gestió de la seva Àrea respectiva; coordinació i control de les activitats dels serveis inclosos en l'Àrea; Coordinació amb les altres àrees d'organització administrativa de l'Ajuntament; Prefectura del personal dels serveis i unitats administratives del seu àmbit d'actuació, sense perjudici de les competències que en aquesta matèria corresponguin a la Prefectura Superior de Personal, pròpia d'Alcaldia i a l'Àrea de Recursos Humans; Elaboració de propostes d'adequació i modificació de l'estructura orgànic-funcional i de l'assignació de recursos del seu àmbit d'actuació en coordinació amb el Servei d'Organització i Recursos Humans; Impulsar el coneixement i canalització de les demandes i necessitats dels ciutadans.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A tenor de tot l'anterior, i sense perjudici d'un aprofundiment en el grau de delegació que pugui desenvolupar-se, aquesta Alcaldia, en virtut de les atribucions que em confereix la legislació sobre règim local, i de conformitat amb el que s'estableix en l'article 21.3 de Llei 7/1985 de 2 d'abril, Reguladora de les Bases del Règim Local,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMER.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Efectuar les següents delegacions, respecte de les àrees municipals que s'especifiquen, a favor dels regidors que a continuació s'indiquen:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;I.- Delegacions de caràcter general de l'Alcalde, comuns als regidors delegats:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Dirigir, inspeccionar i impulsar els serveis corresponents a les àrees respectives.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Dictar Decrets i Resolucions corresponents a la gestió ordinària de l'àrea de delegació fins i tot la resolució de recursos de reposició contra actes dictats per aquest.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- La potestat sancionadora en l'àmbit de la delegació excepte en els casos en què tal facultat sigui atribuïda a altres òrgans.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- La delegació abasta la facultat de resoldre mitjançant actes administratius que afectin tercers, si la mateixa no es troba atribuïda a un altre Òrgan de l'Ajuntament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Disposició de despeses pròpies dels respectius serveis que no superin la quantia de 1.500 €. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Proposar a l'Òrgan competent l'aprovació de despeses en els altres casos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Promoció de campanyes pròpies de l'àrea i/o serveis. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Formular propostes per a contractació d'obres, serveis, subministraments i personal per al millor funcionament dels serveis. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cas de vacant, absència o malaltia el titular de la delegació, exercirà les seves funcions l'Alcaldia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les atribucions dels titulars de les delegacions abasten la facultat de gestionar els serveis corresponents, sense perjudici de la superior direcció de l'Alcaldia i de la junta de Govern Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els regidors i la Junta de Govern Local, quan actuïn per delegació, expressaran aquesta circumstància en les resolucions i altres actes administratius que es dictin i s'entendran dictats per l'òrgan delegant.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'assignació de les regidories i les delegacions especificades, faran efecte des de la data del decret de delegació, sense perjudici de la seva publicació en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

De conformitat amb el que es disposa en l'article 43.5.c) del RD 2568/1986 de 28 de novembre, efectuar les següents delegacions especials sota la coordinació i supervisió de l'Alcaldia, l'objecte de la qual està constituït per les facultats de coneixement previ, preparació i proposta d'acords i gestió de quants serveis i assumptes estiguin relacionats amb cadascuna de les parròquies i barris del municipi, circumscrivint les competències delegades a l'àmbit territorial assignat, incloent-hi la disposició i ordenació de les despeses que siguin precisos a conseqüència de l'exercici de les facultats de gestió ordinària que tenen delegades fins al límit de 1.500 €. Així mateix, ostentaran la representació de l'Ajuntament en les seves respectives parròquies.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;-&amp;nbsp;&amp;nbsp; Regidors delegats en la parròquia de Santa Eulària: Sr. Miguel Tur Rubio, Sra. Antonia Picó Pérez, Sr. Antonio Ramón Marí, Sra. María Sol Ferrer Ferrer, Sra. María Cristina Tur Colomar i Sra. Mónica Madrid García.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'exercici de les facultats delegades s'exercirà de forma coordinada amb els regidors delegats de les diferents àrees d'actuació municipal devent, per a això, comunicar prèviament als mateixos les actuacions i decisions a adoptar, especialment en matèria de disposició i ordenació de despeses ordinàries i contractació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segon.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Delegar de forma indistinta en tots els regidors d'aquest Ajuntament les competències que a aquesta Alcaldia li atorga l'article 51.1 del Codi Civil, en la redacció donada al mateix per la Llei 35/1994 de 23 de desembre, per a autoritzar els matrimonis civils que se celebrin en aquest municipi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercer.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Les facultats delegades s'hauran d'exercir en els termes i dins dels límits de la delegació, no sent susceptibles de ser delegades pels seus titulars en un altre òrgan o regidor. En el text de les resolucions adoptades pels Regidors en virtut de la present delegació, es farà constar aquesta circumstància.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quart.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; En ús de les atribucions que m'atorga l'article 115 del RD 2568/1986 de 28 de novembre, a més de les indicades en el primer dispositiu del present acord, aquesta Alcaldia es reserva les següents facultats en relació a les competències delegades:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a)&amp;nbsp; Rebre informació detallada de la gestió de les atribucions delegades i dels actes dictats en virtut de la delegació&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b)&amp;nbsp; Ser informat prèviament de l'adopció de decisions de transcendència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cinquè.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; De conformitat amb el que es disposa en l'article 44 del RD 2568/1986 de 28 de novembre, aquestes delegacions tindran efecte des de l'endemà a la data de notificació d'aquest Decret als regidors afectats, i seran de caràcter indefinit, sense perjudici de la potestat d'avocació d'aquesta Alcaldia, de conformitat amb el que es disposa en l'article art. 116 ROF i article 10 de la Llei 40/2015, d'1 d'octubre, de Règim Jurídic del Sector Públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cas d'absència, vacant, malaltia o qualsevol altre impediment dels regidors delegats, aquesta Alcaldia assumirà, directa i automàticament, les competències delegades, com a titular de la competència originària, entenent-se a aquest efecte exercitada la potestat d'avocació sobre la base de la present resolució, sense necessitat d'una nova resolució expressa en aquest sentit.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Sisè.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Notifiqui's aquesta resolució als regidors afectats, entenent-se acceptada la competència delegada de forma tàcita si dins del termini de les 24 hores següents no es manifesta res en contra o es fa ús de la delegació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Així mateix, donar compte al Ple d'aquesta Resolució en la primera sessió que tingui lloc, i publiqui's la mateixa en el Butlletí Oficial dels Illes Balears en compliment del que es disposa en l'article 44.2 del RD 2568/1986 de 28 de novembre.”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
