    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Ple del Consell Insular d'Eivissa, en la sessió extraordinària i urgent de data 30 de juny de 2023, va aprovar la següent proposta:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;“Desprès de les eleccions del passat dia 28 de maig de 2023, d'acord amb allò previst a l'article 64.5 de l'Estatut d'autonomia de les Illes Balears (segons la redacció donada per la Llei orgànica 1/2007, de 28 de febrer, que el va reformar; en endavant EAIB) i els articles 16 i 20 de la Llei 4/2022, de 28 de juny, de consells insulars (LCI), el dia 23 de juny de 2023 es va constituir el Consell Insular d'Eivissa i va prendre possessió del seu càrrec el seu president.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A l'EAIB es determina que els consells insulars estableixen la seva organització d'acord amb la Constitució i el propi Estatut (article 62).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Així mateix, la LCI, preveu a l'article 13.1 que els consells insulars, mitjançant els reglaments orgànics respectius i altres normes que els despleguin o completin, estableixen la seua organització d'acord amb l'Estatut d'Autonomia de les Illes Balears i aquesta llei, en el marc del que disposa la legislació bàsica de règim jurídic de les administracions públiques; i preveu a l'article 21. 1, lletra &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;g &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;que correspon al president:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;g) Dictar els decrets de creació i extinció dels departaments insulars en el marc del reglament orgànic, d'acord amb l'article 31 d'aquesta llei.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;I a l'article 36 (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Direccions insulars&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;), apartat 1, estableix que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1. Els directors insulars són òrgans directius per a la gestió d'una o diverses àrees funcionalment homogènies.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;I prèviament, a l'article 34.1, la LCI preveu que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1. Els òrgans directius s'integren en l'estructura dels departaments d'acord amb el que disposa el decret de la presidència corresponent.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;I a l'apartat 4 d'aquest mateix article s'estableix que els titulars dels òrgans de direcció exerceixen el seu càrrec en règim de dedicació exclusiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pel Decret de Presidència núm. 2023000467, de data 28 de juny de 2023 (BOIB núm. 88, de 29-6-2023), s'ha disposat l'estructura del govern de la Corporació i la creació dels diferents departaments, així com la creació de les diferents direccions insulars (nou en total), en què s'estructuren els nous departaments:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Direcció Insular de Medi Rural i Marí&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Direcció Insular d'Esports&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Direcció Insular de Cultura i Patrimoni&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Direcció Insular d'Intrusisme&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Direcció Insular de Transport&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Direcció Insular de Benestar Social, Igualtat i Relacions amb Entitats&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Direcció Insular de Noves Tecnologies i Oficina d'Atenció a la Ciutadania&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Direcció Insular de Recursos Humans i Promoció Econòmica &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'article 38 (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Règim retributiu&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) de la LCI disposa que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Les retribucions de les persones titulars dels òrgans directius es fixen d'acord amb la normativa pressupostària i són públiques en els termes que preveu la Llei 19/2013, de 9 de desembre, de transparència, accés a la informació pública i bon govern.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Per tot l'anterior, de conformitat amb les atribucions que té conferides, aquesta Presidència proposa al Ple l'adopció del següent&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ACORD&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMER- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Establir la retribució anual corresponents per a les persones titulars de cadascuna d'aquestes direccions insulars creades per Decret de Presidència, en la quantitat de 49.845,35 euros, distribuïda en catorze pagues, amb càrrec a les següents aplicacions pressupostàries de l'exercici 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En tot cas, les persones que siguin nomenades directors/ores insulars que tenguin la consideració de funcionaris/àries o personal laboral del Consell Insular d'Eivissa o d'altra Administració pública, conservaran la seua retribució bruta anual en el moment en què siguin nomenades en cas que aquesta fos d'un import superior a l'establert en aquest apartat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEGON- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Tramitar les corresponents modificacions pressupostàries, si escau, que siguin necessàries per fer efectiu aquest acord.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TERCER- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Queden derogades totes les disposicions de rang igual o inferior que s'oposin al que estableix aquest acord.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;QUART- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Publicar el present acord en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, per a general coneixement.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;CINQUÈ- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Publicar el contingut d'aquest acord en la Seu electrònica del Consell Insular d'Eivissa.”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
