    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La batlia presidència a data 23 de juny de 2023, inscripció núm. 2023-2572, ha dictat la resolució que seguidament es transcriu:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;«DECRET ORGANITZATIU DELS SERVEIS ADMINISTRATIUS DE L'AJUNTAMENT DE MANACOR&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Antecedents&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Atès que resulta necessari la configuració de les distintes Àrees o serveis en la que s'estructura l'Ajuntament de Manacor, en ordre a un idoni exercici de competències i prestació de serveis de conformitat amb els criteris de racionalització organitzativa, així com la preceptiva adscripció dels organismes autònoms a determinades Àrees o serveis i regidories.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;De conformitat amb la regulació de les competències dels municipis continguda en els articles 25 a 27 de la LRBRL i fent ús de les atribucions que em confereix l'article 21.1.a) i 85 bis de la Llei 7/1985, de 2 d'abril, reguladora de bases de règim local, i els articles 41.2 del Reglament d'organització, funcionament i règim jurídic de les entitats locals.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Tenint en compte la regulació de &lt;span style="color:#000000"&gt;les competències pròpies que la Llei 7/85 i la Llei 29/2006 assigna els municipis de més de 20.000 habitants, i les competències que l'Ajuntament de Manacor exerceix en qualitat de competència distinta de la pròpia i delegada « impròpia», &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;RESOLC&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;PRIMER-&lt;/strong&gt; Crear i configurar en l'Ajuntament de Manacor, les Àrees de gestió o serveis que a continuació s'especifiquen, amb les competències i mitjans que per cada una es determinen, sota la direcció del batle:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Àrea de Batlia, Urbanisme i Esports&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Àrea d'Hisenda, Economia i Govern Obert&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Àrea de Cohesió Social i Educació&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. Àrea de Promoció Cultural i Econòmica&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5. Àrea d'Espai Públic, Medi Ambient, Interior i Mobilitat&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La titularitat de les àrees abans descrites correspon al batle i als tinents de batle que exerceixin les competències que se'ls hi atribueixin mitjançant l'oportú Decret de Batlia de delegació genèrica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Així mateix, podran ser objecte de delegacions específiques en els regidors que no formin part de la Junta de Govern Local l'atribució de la responsabilitat en la direcció i gestió dels serveis que es determinin mitjançant l'oportú Decret de Batlia de delegació especial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Les atribucions de cada Àrea són, genèricament, les relatives al sector de l'activitat administrativa pròpia d'aquesta àrea de gestió municipal que la legislació vigent assigna als municipis.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;A més d'aquestes atribucions generals, a cada Àrea li correspon a títol indicatiu i no limitatiu, l'exercici de les competències específiques sobre les següents matèries.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La relació de competències específiques assenyalada a cada Àrea podrà ser ampliada i completada mitjançant l'oportú Decret de Batlia de desenvolupament, que també podrà detallar el contingut i la forma de l'exercici d'aquestes atribucions. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1. &lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Competències específiques de l'&lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;Àrea de Batlia, Urbanisme i Esports&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Arxiu&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Memòria democràtica&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Informació i atenció al ciutadà&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Foment i promoció de l'esport&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Instal·lacions esportives&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Relació i cooperació amb organismes i entitats en ordre a la pràctica i foment de l'activitat esportiva&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Disciplina urbanística&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Llicències urbanístiques&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Accés els nuclis de població&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Promoció i gestió de l'habitatge de protecció pública amb criteris de sostenibilitat financera&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Planificació urbanística&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Gestió urbanística&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Responsabilitat Patrimonial&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Patronat Municipal d'Esports de Manacor&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Tot i l'adscripció directa dels departaments de Secretaria i Assessoria Jurídica a l'Àrea de Batlia, Urbanisme i Esports, les funcions dels esmentats departaments s'estenen també a tota la resta d'àrees de gestió municipal atesa la naturalesa transversal de les funcions que duen a terme ambdós departaments municipals.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Sense perjudici del règim d'adscripció descrita, correspon a l'Àrea de Batlia, Urbanisme i Esports, la coordinació de les diferents àrees de govern municipal&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2. &lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Competències específiques de l'&lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;Àrea d'Hisenda, Economia i Govern Obert&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

En caràcter general els departaments adscrits a les àrees que componen l'estructura administrativa de l'Ajuntament de Manacor desenvoluparan la seva activitat sota el principi de cooperació interdepartamental amb l'objectiu de procurar l'eficiència dels serveis municipals que correspon prestar dintre l'estructura organitzativa general de la corporació i dels seus organismes dependents. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;QUART. &lt;/strong&gt;El present decret entrarà en vigor el dia de la seva signatura, sense perjudici de la seva preceptiva publicació en el BOIB conformement amb el disposat a l'article 44.2 del Reglament d'organització, funcionament i règim jurídic de les entitats locals.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;CINQUÈ.&lt;/strong&gt; Difondre el contingut d'aquesta resolució, de conformitat amb el principi de transparència, mitjançant la seva publicació actualitzada i permanent a la seu electrònica municipal, en compliment d'allò que disposen els articles 5 i ss de la Llei 19/2013, de 9 de desembre, de transparència, accés a la informació i bon govern».&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
