&lt;p&gt;&lt;strong&gt;«DECRET DE DELEGACIONS DE COMPETÈNCIES GENÈRIQUES, ESPECIALS I TERRITORIALS&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Antecedents&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Avaluada una vegada constituïda la nova corporació el dia 17.06.2023 i elegit el Batle la necessitat de procedir a establir l'organització de les diferents àrees del consistori, així com les diverses competències que exerceixen, per tal d'assolir un millor funcionament dels serveis municipals, mitjançant el present Decret es procedeix a dur a terme aquesta actuació.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Conseqüentment, resulta ara adient procedir a establir les delegacions de competències genèriques, especials i territorials en què es distribueix la gestió dels serveis administratius municipals.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Per tota això, i fent ús de les atribucions que em confereixen els articles 41.2, 43 i 44 del Reial decret 2568/1986, de 28 de novembre, pel qual s'aprova el reglament d'organització, funcionament i règim jurídic de les entitats locals, així com l'article 12 de la Llei 40/2019, d'1 d'octubre, de règim jurídic del sector públic.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLC:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Aprovar les delegacions genèriques, especials i territorials que queda redactat de la forma següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;I. DELEGACIONS GENÈRIQUES.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Delegar a favor dels membres de la Junta de Govern Local, i tinències de batlia que es relacionen, una delegació general d'atribucions de gestió i resolució dels assumptes de les respectives Àrees d'actuació que s'indiquen, d'acord amb l'atribució funcional de competències de cada Àrea, i amb els camps d'actuació que a títol merament enunciatiu i no limitatiu, es recullen en el Decret de la batlia de 23 de juny de 2023 respecte de cada Àrea, sent les matèries de l'Àrea de Batlia, Urbanisme i Esports competència d'aquesta batlia:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;II. Àrea de Cohesió Social i Educació: Carme Gomila Domínguez&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;III. Àrea de Promoció Cultural i Econòmica: Paula Asegurado Rosso&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;IV. Àrea d'Espai Públic, Medi Ambient, Interior i Mobilitat: Sebastià Llodrà Oliver&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;- Àrea d'Hisenda, Economia i Govern Obert: 1a. Tinent de Batlia, &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;, l'exercici de les atribucions corresponents a la responsabilitat de la direcció de l'àrea d'HISENDA, ECONOMIA I GOVERN OBERT. Les facultats delegades comprenen l'exercici de les competències atribuïdes genèricament a l'esmentada àrea, relatives al sector de l'activitat administrativa pròpia d'aquesta àrea de gestió municipal que la legislació vigent assigna als municipis. A més d'aquestes atribucions generals, li correspon a títol indicatiu i no limitatiu, l'exercici de les competències específiques sobre les matèries següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Gestió del padró municipal d'habitants. Població&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cadastre&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

Les facultats delegades comprenen l'exercici de les competències atribuïdes genèricament a l'esmentada àrea, relatives al sector de l'activitat administrativa pròpia d'aquesta àrea de gestió municipal que la legislació vigent assigna als municipis. Les facultats delegades comprenen l'exercici de les competències atribuïdes genèricament a l'esmentada àrea, relatives al sector de l'activitat administrativa pròpia d'aquesta àrea de gestió municipal que la legislació vigent assigna als municipis. A més d'aquestes atribucions generals, li correspon a títol indicatiu i no limitatiu, l'exercici de les competències específiques sobre les matèries següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;LES DELEGACIONS GENÈRIQUES COMPORTARAN: tant la facultat de dirigir els serveis corresponents inclosos en les respectives àrees, com les de gestionar-los en general, amb inclusió de la facultat de resoldre mitjançant actes administratius que afectin a tercers.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En qualsevol cas, el contingut de la delegació genèrica conferida comprèn l'exercici de les competències generals següents:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;1. Programar les polítiques municipals en les matèries de la seva competència, així com la representació i inspecció de l'àrea de la qual n'és titular.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Exercir l'autoritat respecte del personal de la seva àrea.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. Garantir el compliment de les ordenances, els reglaments, els bans i altres disposicions legals que afectin al municipi, en l'àmbit de les competències de l'àrea.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;4. Ordenar la tramitació dels expedients relatius a la seva àrea delegada i formular les propostes de resolució o acord que corresponguin, així com la resolució de l'expedient mitjançant decret.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;5. Exercir les competències i facultats en matèria de contractació administrativa pública, privada i de caràcter patrimonial que la legislació de contractes de les Administracions Públiques assigna al batle com a òrgan de contractació, incloent l'adjudicació i formalització dels contractes corresponents.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;6.- Sol·licituds de subvencions en matèries relacionades amb cadascuna de les àrees i acceptació de les subvencions atorgades, justificació de les mateixes i si s'escau la interposició de qualsevol recurs derivats dels procediments de reintegraments incoats per l'Administració atorgant de la subvenció.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;7. Exercir la potestat sancionadora de les infraccions a les ordenances en els assumptes que comporten la seva àrea, llevat que es tractin de matèries indelegables per llei o estigui atribuïda a altres òrgans. Aquesta facultat no abasta la resolució dels recursos interposats contra les resolucions adoptades per l'òrgan delegat, que corresponen a la Batlia.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;II. &lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;L'àmbit de la present delegació especial es correspon amb la gestió del serveis municipals assenyalats, i el regidor o regidora que tengui una delegació genèrica tindrà la facultat de supervisar l'actuació dels regidors i regidores amb delegacions especials per assumptes específics inclosos a la seva àrea.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;LES DELEGACIONS ESPECIALS CONFERIDES es circumscriuen a l'estudi, direcció interna i gestió de la matèria relacionada amb l'àmbit d'actuació definit, inclosa la firma de documents de tràmit, però sense incloure en cap cas la facultat de resoldre mitjançant actes administratius que afectin a tercers, tot això sense perjudici de les delegacions de signatures que es puguin conferir.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;III. DELEGACIONS ESPECIALS TERRITORIALS. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Delegar en la regidora Antònia Llodrà Brunet, la gestió, atenció i seguiment per a la millora dels serveis públics en els nuclis de Porto Cristo, Cala Anguila, Cala Magrana, Cala Mendia, s'Estany den Mas, s'Illot i Cala Morlanda,&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Les delegacions especials territorials conferides es circumscriuen a l'estudi i proposta de les matèries relacionades amb l'àmbit d'actuació territorial definit, inclosa la firma de documents de tràmit, així com d'execució, control i seguiment dels actes i acords municipals que tinguin incidència en el concret àmbit territorial, però sense incloure en cap cas la facultat de resoldre mitjançant actes administratius que afectin a tercers.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;PER A TOTES LES DELEGACIONS GENÈRIQUES, ESPECIALS I TERRITORIALS&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;1. Les competències delegades s'exerciran d'acord amb el que preveuen els articles 43 a 45 del ROF i en els termes i dins dels límits d'aquesta delegació, no sent susceptibles de ser delegades pels seus titulars en cap altre òrgan o membre de la corporació. Els delegats i delegades hauran de mantenir informada a la batlia de la gestió de la competència delegada i dels actes o disposicions que ha dut a terme en virtut de la delegació. Igualment hauran de informar a la batlia amb caràcter previ a l'adopció de decisions de transcendència, en els termes de l'article 115 ROF.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Les resolucions que s'adoptin per delegació, que seran immediatament executives i presumptament legítimes, i s'entendran dictades per aquesta batlia com a titular de la competència originària.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. De conformitat amb l'article 44.2 del Reglament d'Organització, Funcionament i Règim Jurídic de les Entitats Locals, aprovat per Reial Decret 2568/1986, de 28 de novembre, aquestes delegacions tindran efectes des de l'endemà de la data d'aquesta resolució i seran de caràcter indefinit, sense perjudici de la potestat d'avocació d'aquesta batlia.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En cas d'absència, vacant, malaltia o qualsevol altre impediment dels regidors i regidores delegats, assumirà directament i automàticament les seves competències aquesta alcaldia, com a titular de la competència originària, entenent-se a aquests efectes exercitada la potestat d'avocació, en base a la present resolució, sense necessitat d'una nova resolució expressa en aquest sentit.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;IV. &lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Donar compte de la present resolució al Ple en la sessió extraordinària que es convoqui de conformitat amb l'article 38 ROF; notificar-la personalment als designats i publicar-la en el Butlletí Oficial de les Illes Balears i en el tauler d'anuncis de l'ajuntament, en compliment del que disposa l'article 44.2 del Reial Decret 2568/1986 , de 28 de novembre, pel qual s'aprova el Reglament d'Organització, Funcionament i Règim Jurídic de les Entitats Locals, i difondre-la, d'acord amb el principi de transparència, mitjançant la seva publicació actualitzada i permanent a la seu electrònica municipal, en compliment del que disposen els articles 5 i següents de la Llei 19/2013, de 9 de desembre, de Transparència, Accés a la Informació i Bon Govern.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;V.&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; Comunicar aquesta resolució a tots els regidors i regidores afectats i als responsables dels diferents serveis municipals, per al seu coneixement i efectes, entenent-se acceptada la delegació de competències de forma tàcita, si dintre del termini de tres dies hàbils comptats des de la notificació de la resolució, el destinatari no fa manifestació expressa davant l'òrgan delegant de que no accepta la delegació, segons el que estableix l'article 114 del ROF».&lt;/span&gt;&lt;/p&gt;
