    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.3 de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen subvencions per a&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;les explotacions a les explotacions agràries, per als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&amp;nbsp;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 2&amp;nbsp;de juny&amp;nbsp;de 2023, signa la següent resolució:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.El 16 de juliol de 2015 es va publicar en el Butlletí Oficial de les Illes Balears núm. 106, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries, modificada mitjançant les resolucions de 17 de desembre de 2015 (BOIB núm. 185), 22 de juny de 2016 (BOIB núm. 81), 26 de juny de 2018 (BOIB núm. 80), 14 de juny de 2019 (BOIB núm. 80), 2 de març de 2020 (BOIB núm. 28), 6 de maig de 2020 (BOIB núm. 77), 22 de juny de 2020 (BOIB núm. 114), 23 de juliol de 2021 (BOIB núm. 101), 19 de novembre de 2021 (BOIB núm. 162), 1 de juliol de 2022 (BOIB núm. 87).&amp;nbsp;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. El 10 de novembre de 2022, &lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;el vicepresident del FOGAIBA, va dictar una Resolució de concessió d'ajudes per a inversions a les explotacions agràries, que es va publicar al Butlletí Oficial de les Illes Balears número 157, de 3 de desembre de 2022, en la qual hi figurava una concessió a favor del beneficiari que apareix en l'annex adjunt, que és 1, i que comença&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;i acaba amb&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;JOAN GELABERT MAYOL&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;, &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;amb &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;NIF ***4054**&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;i número d'expedient INEA2019_1/075.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3.El 22 de maig de 2023, el beneficiari &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;JOAN GELABERT MAYOL&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;, amb DNI ***4054** presenta la sol·licitud de renúncia de l'ajuda concedida amb número de registre GOIBE338374, &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;la qual cosa suposa dur a terme la revocació total de l'ajuda concedida.&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.L'article &lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;21.1 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, estableix l'obligació de l'Administració a dictar resolució expressa i a notificar-la. En el seu paràgraf segon especifica que «En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com la desaparició sobrevinguda de l'objecte del procediment, la resolució consistirà en la declaració de la circumstància que concorri en cada cas, amb la indicació dels fets produïts i les normes&amp;nbsp;aplicables”.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.L'article &lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;43 del Text refós de la Llei de subvencions, aprovat per decret legislatiu 2/2005, de 28 de desembre, disposa que «Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament».&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;6.Atès tot això, es proposa fer la revocació total a causa de la renúncia de l'ajuda concedida pel beneficiari que s'indica en l'annex d'aquesta resolució.&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Resolució de 10 de juliol de 2015 del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Llei 39/2015, d'1 d'octubre, del &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;p&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;rocediment &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;dministratiu comú de les &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;dministracions &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Proposta de resolució &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Per tot això, s'informa favorablement i es proposa al vicepresident en matèria agrària del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Acceptar la renúncia &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a l'ajuda concedida per la &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;Resolució d&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;el vicepresident del FOGAIBA,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;publicada al BOIB número 157, de 3&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;de desembre de 2022, &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;presentada pel beneficiari detallat en l'annex adjunt i que és 1 i &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;que comença i acaba amb JOAN GELABERT MAYOL&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Revocar l'ajuda concedida en la resolució&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;d&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;el vicepresident del FOGAIBA&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;de publicada al BOIB número 157, de 3&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;de desembre de 2022&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;, &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;corresponent &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;a l'interessat assenyalat &lt;/em&gt;&lt;/span&gt;&lt;em&gt;i per l'import indicat en l'annex d'aquesta resolució.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3.Declarar conclòs el procediment i arxivar &amp;nbsp;l'expedient.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Publicar aquesta resolució en el Butlletí Oficial de les Illes Balears. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
