Acta de la Comissió Avaluadora de 15 de juny de 2023, segons la qual la quantia màxima subvencionable per a la Federació Balear d'Atletisme de les Illes Balears per a l'esdeveniment «Miting Internacional d'Atletisme Magaluf» és de 7.822,50€, atès que és el 30% màxim subvencionable del pressupost total d'acord amb el punt 8.1 3) de la Convocatòria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Informe jurídic sobre l'esborrany de la correcció d'errades de la Resolució de concessió de les subvencions per a la creació de producte turístic i per a la promoció turística de Mallorca mitjançant esdeveniments d'interès turístic. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fonaments de dret</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El punt 10.3 de la Convocatòria, diu que la Comissió Avaluadora «emet un informe en què es concreta el resultat de la valoració efectuada, d'acord amb els criteris establerts en la convocatòria, que serveix de fonament a l'òrgan instructor per elaborar la resolució de concessió definitiva. La Comissió pot instar a l'òrgan instructor el requeriment d'informes o aclariments que consideri convenients a les entitats sol·licitants». </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En aquest mateix sentit es pronuncia l'article 18 3 de l'Ordenança general de subvencions del Consell Insular de Mallorca (BOIB núm. 21, de 18 de febrer de 2017), modificada pel Ple del Consell de Mallorca en sessió de dia 14 de juny de 2018 (BOIB núm. 96, de 4 d'agost) quan diu que «en els procediments de concurrència competitiva és preceptiva l'existència d'un òrgan col·legiat que és el que, quan l'òrgan instructor ha avaluat les sol·licituds, ha d'emetre un informe en què es concreta el resultat de l'avaluació efectuada».</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El punt 8.1 3) de la Convocatòria esmentada estableix que la quantia subvencionable no pot superar en cap cas el 30% del pressupost total de l'esdeveniment.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. L'article 16 dels Estatuts de la Fundació Mallorca Turisme diu que és una atribució de la direcció, formalitzar i aprovar tota classe d'actes i contractes (BOIB núm. 24, de 23 de febrer de 2019).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Notificar aquesta Resolució als interessats, publicar-la en el <em>Butlletí Oficial de les Illes Balears </em>i enviar la informació a la Base de Dades Nacional de Subvencions.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Cal Informar els interessats que contra aquesta Resolució, que no exhaureix la via administrativa, es pot interposar un recurs d'alçada davant el Consell executiu del Consell Insular de Mallorca, en el termini d'un mes, a partir de l'endemà de la publicació d'aquesta Resolució en el <em>Butlletí Oficial de les Illes Balears</em>. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra la desestimació expressa del recurs d'alçada es pot interposar un recurs contenciós administratiu davant el jutjat contenciós administratiu de Palma que correspongui, en el termini de dos mesos, a partir de l'endemà de rebre la notificació de la desestimació del recurs.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra la desestimació presumpta, per silenci, del recurs d'alçada es pot interposar un recurs contenciós administratiu davant el jutjat contenciós administratiu que correspongui en el termini de sis mesos, a partir de l'endemà de la desestimació presumpta (tres mesos des de la interposició del recurs sense que s'hagi notificat la resolució).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">No obstant l'anterior, es pot interposar, si s'escau, qualsevol altre recurs que s'estimi pertinent.
