    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, subvencions per a inversions a les explotacions agràries, corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data &amp;nbsp;12&amp;nbsp;de&amp;nbsp;juny&amp;nbsp;de 2023, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. &lt;/em&gt;&lt;/span&gt;&lt;em&gt;El 19 de juny de 2018, el vicepresident del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) va dictar Resolució de concessió (R23) d'ajudes per inversions en les explotacions agràries, publicada en el Butlletí Oficial de les Illes Balears núm. 78, de 26 de juny de 2018, en relació amb l'ajuda concedida a l'empara de la Resolució del president del FOGAIBA de 10 de juliol de 2015, per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries, modificada mitjançant les resolució de 17 de desembre de 2015, 22 de juny de 2016 i 26 de juny de 2018. Entre altres persones beneficiàries hi ha ARISTÓTELES MERCADAL MASCARÓ, amb NIF ***0984**, i núm. d'expedient INEA2016_1/163, amb un termini d'execució de 12 mesos.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. El &lt;/em&gt;&lt;/span&gt;&lt;em&gt;12 de juny de 2019, l'interessat ARISTÓTELES MERCADAL MASCARÓ&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;va presentar una sol·licitud de subrogació, a favor de CICERÓN MERCADAL MASCARÓ&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;amb&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;DNI&amp;nbsp;***0984** dins del termini requerit (RGE 16907) a la Delegació Comarcal de Maó, per el canvi de la titularitat de l'explotació.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3&lt;/em&gt;&lt;/span&gt;&lt;em&gt;. El 12 de juny de 2019, l'interessat CICERÓN MERCADAL MASCARÓ&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;va presentar una sol·licitud de pròrroga del termini d'execució (RGE 16908) a la Delegació Comarcal de Maó, per demores en la concessió de permisos municipals. Es va concedir una primera pròrroga de 12 mesos que finalitza&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;va&amp;nbsp;el 26 de juny de 2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;&lt;em&gt;4.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;El 23 de juny de 2020, CICERÓN MERCADAL MASCARÓ&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;amb&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;NIF &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;***0984**&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;va presentar una sol·licitud de segona pròrroga del termini d'execució (RGE 15408) a la Delegació Comarcal de Maó del FOGAIBA , degut a la demora per part de l'Ajuntament de Maó.&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;Es va concedir la segona pròrroga de 12 mesos que finalitzava el 9 de juliol de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5. L'1 de juliol de 2021, &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;CICERÓN MERCADAL MASCARÓ&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;, &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;amb&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;NIF **&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;***0984**&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;, &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;va presentar una sol·licitud de tercera pròrroga del termini d'execució (RGE L95E272746) a la Delegació Comarcal de Maó del FOGAIBA , degut a la demora per part de l'Ajuntament de Maó. Es va concedir la tercera pròrroga de 6 mesos que finalitza el 9 de gener de 2022.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;6. El 5 de gener de 2022, l'interessat &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;CICERÓN MERCADAL MASCARÓ&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ha presentat una sol·licitud de pròrroga del termini d'execució (RGE GOIE6669), al·legant que no ha pogut realitzar les inversions sol·licitades per &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;demores en la concessió de permisos municipals&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;.&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;7. El 19 de febrer de 2022, es publica al BOIB número 27, al resolució de denegació de la quarta pròrroga.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8. El 8 de maig de 2023, es publica al WEB del FOGAIBA el requeriment de la sol·licitud de pagament de l'ajuda concedida a l'expedient INEA2016_1/163.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9. El 26 de maig de 2023, Juan Antonio Pons Pons, NIF ***0514**, en representació de Cicerón Mercadal Mascaró, presenta la sol·licitud de pagament amb número de registre REGAGE23e00033592799.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;10. El 31 de maig de 2023 es publica al WEB del FOGAIBA la Notificació de deficiències de la sol·licitud de pagament, amb un termini de presentació d'esmenes de 10 dies hàbils, aquest termini acaba dia 14 de juny de 2023.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;11. El 8 de juny de &amp;nbsp;2023, Juan Antonio Pons Pons, NIF ***0514**, en representació de Cicerón Mercadal Mascaró, i dins el termini establert, presenta una sol·licitud de pròrroga del termini de 10 dies per esmenar les deficiències notificades.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;12. El punt 1, de l'article 32 de la Llei 39/2015 del Procediment Administratiu Comú de les Administracions públiques diu: «La Administración, salvo precepto en contrario, podrá conceder de oficio o a petición de los interesados, una ampliación de los plazos establecidos, que no exceda de la mitad de los mismos, si las circunstancias lo aconsejan y con ello no se perjudican derechos de tercero. El acuerdo de ampliación deberá ser notificado a los interesados».&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
