    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En data 6 de juny de 2023, aquest conseller executiu en funcions ha resolt:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;«Atès:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El punt 1 de la disposició addicional segona de la Llei 17/2019, de 8 d'abril, de concessió de crèdits suplementaris per atendre despeses inajornables derivades de sentències judicials pendents de pagament en l'àmbit de la Llei 4/2008, de 14 de maig, de mesures urgents per a un desenvolupament territorial sostenible a les Illes Balears, amb càrrec als pressuposts generals de la comunitat autònoma de les Illes Balears per a l'any 2018, i de modificació del Decret llei 2/2018, de 18 d'octubre, pel qual s'estableixen ajudes i altres mesures urgents per reparar les pèrdues i els danys produïts per les pluges intenses i les inundacions del dia 9 d'octubre de 2018 a la comarca de Llevant de Mallorca, determina que els cossos de bombers de les administracions locals pertanyen a l'escala d'administració especial i que cada administració local classificarà el personal funcionari operatiu dels serveis de prevenció i extinció d'incendis (SPEIS) d'acord amb l'estructura de subescales, classes i categories que preveu, de forma que els/les caporals –les i caporals –les especialistes, els/les bombers –res i bombers –res especialistes i els/les operadors –res de comunicacions resten enquadrats dins el subgrup C1, escala operativa bàsica, subescala de serveis especials i classe d'extinció d'incendis.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el punt 4 de la mateixa disposició addicional es prescriu que les administracions locals, en el termini de cinc anys des de l'entrada en vigor d'aquesta Llei, adaptaran les seves relacions de llocs de treball a allò que disposen els apartats anteriors i que, igualment, en el termini de cinc anys, els funcionaris de l'escala operativa bàsica passaran a integrar-se en el subgrup C1, un cop acreditada la formació i superat el procés selectiu que es determini.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'altra banda, en el punt 5 de la disposició, redactat conforme la disposició final divuitena de la Llei 11/2022, de 28 de desembre, de pressuposts generals de la comunitat autònoma de les Illes Balears per a l'any 2023, s'estableixen les titulacions de les quals ha de disposar el personal per optar a la reclassificació i, en el punt 6, d'acord amb la modificació duta a terme per la disposició final catorzena del Decret llei 6/2022, de 13 de juny, de mesures urgents per reduir la temporalitat en l'ocupació pública de les Illes Balears, s'inclou la previsió relativa a què els funcionaris de l'escala operativa bàsica que en el termini de cinc anys des de l'entrada en vigor de la Llei no aconsegueixin acreditar el requisit de titulació passaran a la situació de «a extingir» en el subgrup C2, excepte que obtinguin la titulació requerida. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'acord amb l'article 14.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, estan obligats a relacionar-se mitjançant medis electrònics amb les Administracions Públiques els empleats de les administracions públiques per als tràmits i actuacions que realitzin amb elles per raó de la seva condició d'empleat públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Correspon al conseller executiu o consellera executiva d'Hisenda i Funció Pública l'adopció de la present resolució, per delegació del Consell Executiu del Consell Insular de Mallorca, segons acord d'aquest òrgan adoptat en sessió ordinària de 28 de setembre de 2022 (BOIB núm. 128, d'1 d'octubre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tot el que s'ha exposat, dict la següent &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Resolució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primer.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Aprovar les bases que han de regir la convocatòria del procés de reclassificació&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; del personal funcionari del Servei de Bombers del&amp;nbsp; Consell Insular de Mallorca amb les categories de bomber –a conductor –a, caporal –a i operador –a de comunicacions, derivat del canvi d'enquadrament d'aquestes places del subgrup C2 al subgrup C1, les quals s'adjunten com a annex I. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segon.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Publicar aquesta Resolució en el Butlletí Oficial de les Illes Balears i al tauler d'anuncis de la Seu electrònica del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra aquesta resolució, que no posa fi a la via administrativa, es pot interposar un recurs d'alçada davant la Comissió de Govern del Consell Insular de Mallorca, en el termini d'un mes, comptador a partir de l'endemà de la publicació en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra la desestimació expressa d'aquest recurs d'alçada es pot interposar el recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma que correspongui en el termini de dos mesos, comptadors a partir de l'endemà de rebre la notificació de la desestimació d'aquest recurs d'alçada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si han transcorregut tres mesos des de la interposició del recurs d'alçada i no s'ha rebut la notificació de resolució expressa, s'entén desestimat per silenci i es pot interposar el recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma que correspongui, sense limitació de temps. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No obstant això, si escau,&amp;nbsp; es pot interposar qualsevol altre recurs que consideri oportú. Tot això de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa i de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.1 L'objecte d'aquestes bases es regular la convocatòria del procés de reclassificació del personal funcionari del Servei de Bombers del&amp;nbsp; Consell Insular de Mallorca&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;amb les categories de bomber –a conductor –a, caporal –a i operador –a de comunicacions, derivat del canvi d'enquadrament d'aquestes places del subgrup C2 al subgrup C1. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.2 El procés de reclassificació es regeix per les regles que preveuen aquestes bases i pel que disposen el Reial decret legislatiu 5/2015, de 30 d'octubre, pel que s'aprova el text refós de la llei de l'Estatut bàsic de l'empleat Públic, la disposició addicional segona de la Llei 17/2019, de 8 d'abril, la Llei 3/2007, de 27 de març, de la funció pública de la comunitat autònoma de les Illes Balears, la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'Acord del Ple del Consell Insular de Mallorca de 13 d'abril de 2023, mitjançant el qual es va ratificar l'acord de la Mesa Sectorial de l'àrea operativa del Servei de Bombers de Mallorca de data 5 d'abril de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Requisits.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.1 Per prendre part en la convocatòria del procés de reclassificació, el personal ha de complir, en la data de finalització del termini de presentació de sol·licituds, els requisits que s'indiquen a continuació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Ser personal funcionari del Consell Insular de Mallorca amb una de les categories següents: bomber –a conductor –a, caporal –a o operador –a de comunicacions i optar a la reclassificació en la mateixa categoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;b) Estar en possessió de la titulació que s'indica a continuació o estar en condicions d'obtenir-la en la data en què acabi el termini de presentació de sol·licituds:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per al personal amb la categoria de bomber –a conductor –a i caporal –a, acreditar les competències professionals, mitjançant certificat de professionalitat de la formació següent: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Títol de tècnic en emergències&amp;nbsp; i protecció civil o acreditació equivalent &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Títol de batxiller o titulació equivalent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per al personal amb la categoria d'operador -a de comunicacions: el títol de batxiller o equivalent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Acreditar el coneixement de la llengua catalana corresponent al nivell B2, mitjançant algun dels documents següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;certificat expedit per l'òrgan competent del Govern de les Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;certificat expedit per l'Escola Balear d'Administració Pública&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;certificat equivalent segons l'Ordre del conseller d'Educació, Cultura i Universitats de 21 de febrer de 2013 (BOIB núm. 34, de 12 de març de 2013).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;certificat homologat per l'òrgan competent del Govern de les Illes Balears. S'ha de disposar de la corresponent resolució d'homologació del certificat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;certificat que acredita que s'han superat les proves d'avaluació del nivell de coneixements de llengua catalana corresponent fetes pel Consell de Mallorca com a conseqüència de les convocatòries dutes a terme pels decrets de la Presidència de 3 de juny de 2004 i de 29 de setembre de 2004.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Acreditar la formació següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per al personal amb la categoria de bomber –a conductor –a i caporal -a: haver superat el curs bàsic d'aptitud per a bombers o bomberes, impartit pels organismes acreditats oficialment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per al personal amb la categoria d'operador –a de comunicacions: haver realitzat més de 300 hores de cursos i accions formatives relacionades amb les funcions del lloc de feina, acreditats amb certificats d'aprofitament i/o assistència, emesos per universitats, centres o organismes oficials i escoles d'administració pública i les accions formatives homologades o promogudes per aquests. També s'han de valorar els cursos fets dins el marc dels acords de formació en l'àmbit de l'Administració pública, els impartits per les organitzacions sindicals en el marc dels acords de formació contínua i els cursos dels col·legis professionals. Únicament es prenen en consideració els certificats amb acreditació del número d'hores i el contingut del curs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) &amp;nbsp;Per al personal amb la categoria d'operador -a de comunicacions, acreditar una antiguitat de&amp;nbsp; 5 anys en la categoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.2 El personal que no pugui acreditar la titulació requerida i/o el coneixement de la llengua catalana corresponent al nivell B2, però que reuneixi la resta dels requisits exigits en la convocatòria, pot prendre part en el procés de reclassificació, però, en cas de superar-lo, restarà en la situació de «a extingir» en el subgrup C2, excepte que obtingui la titulació requerida i/o l'acreditació del coneixement de la llengua catalana, cas en què serà reclassificat de manera automàtica, prèvia la comprovació per part de l'òrgan competent en matèria de funció pública. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Sol·licituds&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.1 La sol·licitud s'ha de complimentar a través del tràmit electrònic que es troba a la Seu electrònica del Consell de Mallorca (http://seu.conselldemallorca.net).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els sistemes d'identificació i firma admesos són els corresponents a persones físiques i empleats públics emesos pels prestadors de serveis electrònics de confiança qualificats segons el Ministeri d'Assumptes Econòmics i Transformació Digital.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A través del tràmit electrònic es realitza:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- la presentació de la sol·licitud amb la documentació acreditativa dels requisits&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- la firma de la sol·licitud&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- el registre electrònic de la sol·licitud&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per a confirmar que la inscripció ha estat correctament registrada, les persones aspirants han de descarregar el justificant de registre de la seva sol·licitud d'admissió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.2. El termini per presentar sol·licituds és de vint dies naturals, comptadors a partir de l'endemà que s'hagi publicat la convocatòria en el Butlletí Oficial de les Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cas de presentar més d'una sol·licitud només es tindrà en compta la darrera presentada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La no presentació de la sol·licitud en temps i/o forma mitjançant el tràmit telemàtic habilitat a l'efecte, suposarà l'exclusió de l'aspirant. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Així mateix, el Consell de Mallorca podrà ampliar els terminis no vençuts com a conseqüència d'incidències tècniques que hagin impossibilitat el funcionament ordinari del sistema o de l'aplicació que correspongui, segons el disposat a l'article 32.4 de la Llei 39/2015, d'1 d'octubre. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.3 En el model oficial de sol·licitud telemàtica, les persones aspirants han de fer menció expressa al fet que reuneixen tots els requisits i les condicions que s'exigeixen en el procés de reclassificació, referits sempre a la data d'acabament del termini assenyalat per a la presentació de sol·licituds. El personal que prengui part en el procés de reclassificació i es trobi inclòs en el supòsit previst a la base 2.2, és a dir, que no reuneixi la titulació requerida i/o l'acreditació del coneixement de la llengua catalana corresponent al nivell B2, ho farà constar expressament en la sol·licitud. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Juntament amb la sol·licitud, les persones interessades han d'adjuntar la documentació acreditativa del compliment dels requisits establerts a la base 2. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No obstant el que disposa l'apartat anterior, d'acord amb el que estableix l'article 28 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, el Consell de Mallorca ha de comprovar d'ofici els documents emesos per les administracions públiques que constin en la plataforma d'intermediació de dades, en altres sistemes habilitats a l'efecte, així com al registre de personal del Consell de Mallorca. D'acord amb l'anterior, la persona interessada que no estigui d'acord amb la comprovació d'ofici per part de l'Administració ha de manifestar, en la sol·licitud d'inscripció, la seva oposició a què es consultin les dades i els documents necessaris per a la tramitació d'aquest procediment i haurà d'aportar-los. Excepcionalment, si l'Administració no pot obtenir aquests documents, podrà sol·licitar a la persona aspirant que els aporti.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.4. Els documents anteriors s'han de presentar mitjançant originals o còpies autèntiques en els termes que estableix l'article 28 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.5. Tota la documentació que es presenta en llengua estrangera ha d'anar acompanyada de la traducció jurada corresponent a la llengua catalana o a la castellana.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.6. Una vegada finalitzat el termini de presentació de sol·licituds, no s'admetrà a tràmit cap sol·licitud per prendre part en el procés selectiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.7 Acceptació tractament de les dades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La presentació de la sol·licitud per participar en el procés selectiu suposa el coneixement i l'acceptació inequívocs de l'aspirant del tractament de les dades de caràcter personal a càrrec de l'òrgan competent i únicament per a les finalitats establertes. El tractament de la informació facilitada en les sol·licituds tindrà en compte les previsions del Reglament (UE) 2016/679 del Parlament Europeu i del Consell, de 27 d'abril de 2016, relatiu a la protecció de les persones físiques pel que fa al tractament de dades personals i a la lliure circulació d'aquestes dades, i de la Llei orgànica 3/2018, de 5 de desembre, de protecció de dades personals i garantia dels drets digitals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. Admissió de les persones aspirants.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Exhaurit el termini de presentació de sol·licituds, el conseller competent en matèria de funció pública dictarà resolució en el termini màxim de 20 dies aprovant la llista provisional de persones admeses i excloses, amb expressió de la causa d'exclusió, si s'escau. A més, també es publicarà una llista amb el personal admès que es trobi inclòs en el supòsit previst a la base 2.2, és a dir, que no reuneixi la titulació requerida i/o l'acreditació del coneixement de la llengua catalana corresponent al nivell B2, i així ho hagi fet constar expressament en la sol·licitud. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La relació de persones admeses i excloses s'exposarà al tauler d'edictes de la Seu electrònica del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En tot cas, amb la finalitat d'evitar errors i, si se'n produeixen, possibilitar-ne l'esmena dins el termini establert i en la forma escaient, les persones interessades han de comprovar no només que no figuren en la relació de persones excloses sinó que, a més, consten en la relació pertinent de persones admeses.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Amb aquesta llista provisional es requerirà a les persones aspirants, si n'és el cas, la presentació dels documents originals o còpies autèntiques d'aquells documents acreditatius dels requisits que s'hagin presentat mitjançant còpia simple.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per esmenar el possible defecte, les persones excloses o omeses disposaran d'un termini de deu dies hàbils, comptadors des de la publicació de la relació indicada en el paràgraf anterior. Si les persones excloses o omeses i les que han estat requerides per presentar la documentació original o còpia autèntica no esmenen el defecte, es consideraran excloses del procediment mitjançant la llista definitiva de persones admeses i excloses a la qual es refereix l'apartat següent. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Transcorregut aquest termini, s'aprovarà la llista definitiva de persones aspirants admeses i excloses, que es publicarà a la Seu electrònica del Consell de Mallorca, en la qual es farà constar les resolucions de les reclamacions presentades, si s'escau. Si no es presenten esmenes a la llista provisional, aquesta esdevindrà definitiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5. Procediment de selecció &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.1 Exercici del procediment de selecció&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El procediment de selecció constarà d'un exercici tipus test. Aquest test s'extraurà d'una bateria de 125 preguntes sobre el temari aprovat i adjunt com a annex a aquestes bases. La bateria de preguntes es publicarà, amb les alternatives de resposta, en les dues llengües oficials de la comunitat autònoma a la Seu electrònica del Consell de Mallorca en el termini màxim d'un mes des de la publicació de la present Resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'exercici que han de realitzar les persones aspirants és de caràcter obligatori i eliminatori. La puntuació màxima que correspon a l'exercici és la que s'indica en aquest apartat i es considerarà que no han superat el procés selectiu les persones aspirants que no arribin a la puntuació mínima que s'assenyala. L'exercici i la forma de puntuació són iguals per a tothom.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'exercici constarà de 30 preguntes amb quatre respostes alternatives de les quals només una és correcta, més 5 preguntes de reserva. Les preguntes de reserva s'han de contestar i tan sols es valoraran en el supòsit d'anul·lació d'alguna pregunta del qüestionari principal. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per qualificar aquest exercici, les preguntes que es contesten correctament tenen una valoració d'un punt, les preguntes no contestades (en blanc o més d'una opció de resposta) i les contestades incorrectament no es valoren ni es penalitzen. Per superar l'exercici s'ha d'obtenir una puntuació mínima de 15 punts. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La durada de l'exercici és de 35 minuts i es durà a terme de forma presencial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.2 Llengua de l'exercici&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les persones aspirants que participen en el procés selectiu poden elegir fer l'exercici en qualsevol de les dues llengües oficials de la comunitat autònoma. A aquest efecte, el Tribunal Qualificador s'ha d'encarregar que l'exercici s'elabori i es lliuri complint les previsions del Decret 49/2018, de 21 de desembre, sobre l'ús de les llengües oficials en l'Administració de la comunitat autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Així mateix, la bateria de 125 preguntes sobre el temari aprovat es publicarà&amp;nbsp; a la Seu del Consell de Mallorca en les dues llengües oficials de la comunitat autònoma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.3 Contingut de la prova i elaboració dels exercicis&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Tribunal Qualificador elaborarà quatre models d'examen tipus test sobre la bateria de 125 preguntes publicades a la Seu del Consell de Mallorca. El Tribunal Qualificador ha de garantir la confidencialitat del contingut dels exercicis fins al moment que es dugui a terme la prova&amp;nbsp; i actuar, en tot moment, amb el sigil degut.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El dia del primer examen es farà un sorteig entre els quatre models d'examen i el dia del segon examen es farà un sorteig entre els tres models restants de cada categoria, davant de tres persones aspirants voluntàries. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.4 Procediment de crida&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les persones aspirants s'han de convocar en dos dies diferents per realitzar l'exercici en crida única per a cada dia. Queden excloses de la prova selectiva les persones que no compareguin el dia que siguin convocats, excepte en els supòsits de força major degudament acreditats per la persona aspirant. En aquests casos, el Tribunal Qualificador ha d'adoptar un acord motivat a aquest efecte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Abans de la realització de l'exercici, els membres del Tribunal Qualificador requeriran a les persones aspirants que acreditin la seva identitat mitjançant l'exhibició del document corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.5 Publicació de les notes de l'exercici&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Tribunal Qualificador farà pública a la Seu electrònica del Consell de Mallorca la llista provisional de puntuacions la qual ha d'incloure nom i llinatges, quatre xifres numèriques aleatòries del DNI i la indicació de la puntuació obtinguda, per ordre de major a menor puntuació. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les persones aspirants poden presentar pel tràmit telemàtic habilitat a aquests efectes les al·legacions o reclamacions oportunes, a partir de l'endemà de la publicació de la llista provisional i durant el termini de tres dies hàbils, les quals seran resoltes pel Tribunal Qualificador dins el termini dels 7 dies hàbils següents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Un cop resoltes les al·legacions i reclamacions presentades per les persones aspirants el Tribunal Qualificador ha d'elevar al conseller competent en matèria de Funció pública la llista definitiva de les persones aspirants que han superat el procés selectiu i l'ordre de prelació segons la puntuació obtinguda perquè en dicti la resolució corresponent, que s'haurà de publicar en el Butlletí Oficial de les Illes Balears i al tauler d'anuncis de la Seu electrònica del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. &lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els membres del Tribunal Qualificador estan obligats a complir el deure de sigil en relació amb les deliberacions, tant pel que fa a la determinació dels exercicis, com a les qualificacions, així com en relació amb qualssevol dades, fets o circumstàncies del procés de selecció el coneixement dels quals adquireixin en virtut de la seva condició, i no poden facilitar cap informació sobre aquestes deliberacions a persones alienes al Tribunal Qualificador al qual pertanyen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.2 Constitució i funcionament&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La constitució i totes les actuacions del Tribunal Qualificador s'han de regir pel que estableixen el Reial decret legislatiu 5/2015, de 30 d'octubre, pel qual s'aprova el text refós de la Llei de l'Estatut bàsic de l'empleat públic; la Llei 3/2007, de 27 de març, de la funció pública de la comunitat autònoma de les Illes Balears, i el Reglament d'ingrés del personal al servei de la comunitat autònoma de les Illes Balears, aprovat pel Decret 27/1994, d'11 de març.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A la sessió de constitució, han d'assistir tots els membres titulars i suplents del Tribunal Qualificador, de manera presencial o bé de manera telemàtica. En defecte d'algun dels titulars, serà substituït pel suplent respectiu. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vegada constituït el Tribunal Qualificador, per actuar vàlidament, és requerirà sempre la&amp;nbsp; presència de les persones designades per a la presidència i la secretaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els acords s'han d'adoptar per majoria de vots dels membres presents i, en cas d'empat,&amp;nbsp; dirimeix el vot de la presidència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.3 Persones assessores i col·laboradores&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Tribunal Qualificador pot sol·licitar a l'òrgan de què depèn la designació de personal&amp;nbsp; col·laborador per a les tasques de vigilància, coordinació o d'altres similars, com també la designació de personal assessor per als aspectes tècnics i jurídics, quan així resulti necessari per al desenvolupament i valoració correcta de la prova selectiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.4 Abstenció i recusació&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els membres del Tribunal Qualificador i el personal assessor s'han d'abstenir d'intervenir en el procés quan concorrin les circumstàncies previstes en l'article 23 de la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic, i han de notificar aquesta circumstància a l'autoritat que els va nomenar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'abstenció i la recusació dels membres del Tribunal Qualificador es regula pels articles 23 i 24 de la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic; pels articles 22 i 23 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i pels articles 13.8, 16, 17 i 18 del Reglament d'ingrés del personal al servei de la comunitat autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.5 Dietes d'assistència&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els membres del Tribunal Qualificador, així com el personal assessor i el personal col·laborador tenen dret a percebre les dietes que els corresponguin per l'assistència a les sessions, d'acord amb el que preveu el capítol IV del Decret 62/2011, de 20 de maig (BOIB núm. 81, de 2 de juny).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7. Personal sense reclassificar&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El personal funcionari del Servei de Bombers del&amp;nbsp; Consell Insular de Mallorca amb les categories de bomber –a conductor –a, caporal –a i operador –a de comunicacions que no&amp;nbsp; participi en la convocatòria i el que hi participi, però no superi el procés selectiu, passarà a la situació de «a extingir» en el subgrup C2.&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
