    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Al no haver-se presentat cap reclamació o suggeriment durant el termini d'exposició al públic, l'acord inicialment adoptat d'aprovació del Reglament d'usos que regula el circuit “Pump track”, s'ha d'entendre definitivament aprovat sense necessitat de nou acord exprés de conformitat amb el que s'estableix en els articles 49 de la Llei 7/1985, de 2 d'abril, Reguladora de les Bases del Règim Local i 102.1.d) de la Llei 20/2006, de 15 de desembre, municipal i de Règim Local de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;El text íntegre del Reglament d'usos que regula el circuit “Pump track”, es fa públic, per al seu general coneixement i en compliment del que es disposa en l'article 70.2 de la Llei 7/1985, de 2 d'abril, Reguladora de les Bases del Règim Local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;REGLAMENT D'USOS DEL CIRCUIT PUMP TRACK DE PALMANYOLA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;EXPOSICIÓ DE MOTIUS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;Amb la posada en funcionament del nou circuit “Pump track” construït al carrer Orquídies, S/N, de Palmanyola, a través de subvenció concedida pel Consell Insular de Mallorca, s'imposa la necessitat d'elaboració i aprovació d'una normativa que reguli els usos, les normes, horaris, responsabilitats i sancions que impedeixin els mals usos de la instal·lació, alhora que regulin la seva conservació, amb el degut respecte a les normes de convivència.&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;CAPÍTOL I&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;DISPOSICIONS GENERALS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Article 1.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;L'objectiu primordial d'aquesta normativa és definir el conjunt de regles, d'obligat compliment, per a totes aquelles persones que lliurement i si així ho desitgen puguin utilitzar les instal·lacions del circuit Pump track de l'Entitat Local Menor de Palmanyola. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Article 2&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;1. Una pista de Pump Track és un circuit tancat, generalment de petites dimensions, el qual es pot recórrer completament amb un monopatí o amb una bicicleta, impulsant-se només mitjançant la inèrcia adquirida en els salts i peralts del circuit i la pròpia habilitat del skater o ciclista.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;2.- L'accés a la pista suposa l'acceptació de la present normativa i el seu estricte compliment.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;CAPÍTOL II&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;NORMES D'ACCÉS I ÚS DEL CIRCUIT&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Article 3. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;1. El circuit de Pump Track és d'accés lliure i gratuït per als ciutadans amb les limitacions determinades en aquestes normes d'ús.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;2. No està permès l'accés i ús d'aquest circuit als menors de 12 anys (tenint en compte l'any de naixement), tret que aquests es trobin sota la supervisió i tutela d'una persona major d'edat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;3. No es permet l'entrada d'animals.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Article 4. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;1. Els equipaments d'aquest circuit estan dissenyats exclusivament per a practicar skate (monopatí), rolling (patins), escúter (patinet) i Bmx o similar (bicicleta). No està permès l'ús de qualsevol tipus de bicicletes (MTB, carretera) o altres elements similars, així com elements motoritzats inclosos els elèctrics.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;2. No està permès portar en les bicicletes estreps i pedals metàl·lics o qualsevol material que pugui danyar la instal·lació. En cap cas està permès derrapar sobre els talls de les rampes i corbes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Article 5.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;És obligatori l'ús del casc per a fer ús del circuit de Pump Track. És molt recomanable utilitzar proteccions articulars, de columna vertebral, com colzeres, canyelleres, guants, genolleres, etc., així com roba i calçat adequat. No està permès l'ús de la instal·lació sense samarreta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Article 6&lt;/strong&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;No està permès utilitzar el circuit quan es troba humit ni en condicions climatològiques adverses com per exemple pluja, vent, etc.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Article 7.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;1. No està permès el consum de cap mena d'aliments o begudes dins del circuit, especialment pipes, cacauets o altres aliments amb closca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;2. Està absolutament prohibida l'entrada i consum de begudes alcohòliques i de substàncies estupefaents.3. Queda totalment prohibit fumar en el recinte.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Article 8.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Queda absolutament prohibit romandre com a espectador enmig de les pistes o entorpint la seva uso.no està permès asseure's, caminar o realitzar un ús no esportiu en el circuit.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Article 9.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;1. No està permès afegir obstacles, modificar els existents o utilitzar elements o materials que puguin danyar les instal·lacions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;2. No està permès introduir ampolles, recipients de vidre o altres elements que es puguin trencar dins del parc.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Article 10.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;La pista es pot usar en tots dos sentits, però només un alhora. S'haurà de respectar el dret d'ús de la resta d'usuaris. Es donarà prioritat sempre a l'usuari de menor edat i als no iniciats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Article 11.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Els usuaris vetllaran pel bon ús i conservació de les instal·lacions posant en coneixement del responsable de la instal·lació qualsevol anomalia que es detecti en la instal·lació o els seus elements.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Article 12.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;L'ús d'aquest circuit suposa un risc que assumeix cada usuari sota la seva pròpia responsabilitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Article 13.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Si observes algun accident, protegeix l'accidentat i posa't en contacte amb el personal de la instal·lació i ,en cas necessari, informa els serveis d'emergències.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Article 14.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Únicament es pot fer ús de les instal·lacions en els horaris fixats a aquest efecte:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;L'Entitat Local Menor de Palmanyola NO ES FA RESPONSABLE d'accidents o danys que puguin sofrir usuaris o espectadors, pel mal ús de la instal·lació, negligència o altres imputables a les persones usuàries, quedant aquests sota la seva completa responsabilitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;CAPÍTOL IV&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;INFRACCIONS I SANCIONS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Article 16.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;1. En tot moment s'haurà de complir amb l'Ordenança de mesures per a fomentar i garantir la convivència ciutadana en l'espai públic dins de l'Àmbit de l'ELM de Palmanyola (BOIB 141 de 8 de novembre de 2016), interposant (si a això pertoqués) les sancions pertinents. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;2. Si la infracció ocasiona deterioració, trencament o desperfecte de les instal·lacions el/la/els infractor/s/s'hauran d'abonar l'import de les reparacions o reposició de materials que s'hagués de fer. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;3. Dels danys ocasionats per menors d'edat seran responsables els pares, mares, tutors o els que els tinguin sota la seva custòdia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;De conformitat amb allò disposat en l'article 103 de la Llei 20/2006, de 15 de desembre, municipal i de règim local de les Illes Balears, el present Reglament entrarà en vigor una vegada que s'hagi publicat el seu text íntegre en el Butlletí Oficial de les Illes Balears i hagi transcorregut el termini a què es refereix l'article 113 de la citada Llei.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Segona.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;Una vegada aprovada definitivament la present norma, l'Entitat Local Menor de Palmanyola, ho exposarà a través de tauler d'anuncis de la pàgina web i en altres xarxes socials de les quals disposa, així com publicar un cartell en el circuit de la pista.»&lt;/p&gt;
