&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;POR EL PRESENTE HAGO CONSTAR&lt;/strong&gt;: Que en los autos del PROCEDIMIENTO ORDINARIO nº 100/21 ha recaído Sentencia número 797/22 de fecha 14/12/2022, cuyo fallo dispone:&lt;/span&gt;&lt;span style="display:block; margin-bottom:0px; margin-top:0px"&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;F A L L A M O S&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1º) Estimar el presente recurso contencioso administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2º) Se declara que el acuerdo del Pleno del Ayuntamiento de Palma, adoptado en sesión ordinaria de 26 de noviembre de 2020, de aprobación definitiva del Plan Especial de Protección del Jonquet, es disconforme a Derecho y se anula, exclusivamente, en cuanto afecta a las determinaciones que comportan la demolición de la parte del inmueble propiedad de la recurrente sito en calle Gambins, 17 (referencia catastral 8902701DD6880B0001AX) para la realización de un Espacio Libre Público (ELP), como se refleja en la ficha de intervención del PEP, ficha F03-001, cuya calificación en el PEP es de EL 26-05b-P y, en su consecuencia, se deja sin efecto dicha ficha y la intervención descrita.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3º) Se imponen las costas procesales a la parte demandada, con el límite de la suma de 2.000 € por todos los conceptos, sin perjuicio de las restantes limitaciones derivadas de la aplicación del art. 139,7º LJCA.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
