    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La directora gerent de l'Escola Balear d'Administració Pública ha formulat la proposta de resolució següent: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fets&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Mitjançant la Resolució de la consellera de Presidència, Funció Pública i Igualtat, de 14 de febrer de 2022, es va publicar la convocatòria del cos facultatiu superior, escala d'arxius, museus, biblioteques i documentació, de l'Administració especial de la Comunitat Autònoma de les Illes Balears, per a l'illa de Mallorca (BOIB núm. 28, de 22 de febrer de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En relació als requisits que han de reunir les persones aspirants amb una discapacitat igual o superior al 33%, la base 4.2.f) de les bases generales, estableix: &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;«f) Les persones aspirants amb discapacitat igual o superior al 33 % han de presentar el certificat que acrediti la condició legal de discapacitat. No obstant això, no cal presentar aquest document si l'aspirant no s'oposa al fet que l'Administració el comprovi d'ofici mitjançant la plataforma d'intermediació de dades o altres sistemes habilitats per a aquest fi.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;A més d'això, aquestes persones han de presentar el justificant d'haver sol·licitat un dictamen dels equips multiprofessionals de la Direcció General de Dependència, o de l'organisme públic equivalent, sobre les condicions personals d'aptitud per exercir les funcions corresponents al cos, escala i/o especialitat de la borsa a la qual la persona candidata aspira, el qual ha d'expressar que està en condicions de complir les tasques fonamentals del cos escala i/o especialitat, mitjançant, si corresponen a judici de l'Administració,les adaptacions necessàries del lloc de treball. No obstant això, si la persona aspirant no s'hi oposa, l'EBAP recaptarà d'ofici aquest dictamen».&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En data 2 de març de 2022, el Sr. Palou Santandreu, Jaume va presentar sol·licitud per participar a l'esmentada borsa. A la sol·licitud va adjuntar un certificat del grau de discapacitat igual o superior al 33%, però no hi va adjuntar el dictamen dels equips multiprofessionals de l'organisme públic corresponent, acreditatiu que el Sr. Jaume Palou Santandreu és apte per exercir les funcions corresponents al cos facultatiu superior, escala d'arxius, museus, biblioteques i documentació, objecte d'aquesta borsa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En data de 11 de maig de 2023 (BOIB núm. 60) es va publicar la Resolució de la consellera de Presidència, Funció Pública i Igualtat, per la qual s'aproven les llistes definitives de persones aspirants admeses i excloses de la borsa esmentada. En aquesta Resolució figurau amb una &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;«admissió condicional informe discapacitat».&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. En data 19 de maig de 2023, es va notificar al Sr. Jaume Palou Santandreu el tràmit d'audiència i se li va concedir 5 dies hàbils per al·legar i presentar els documents i les justificacions que considerés pertinents en relació a l'informe d'aptitud, previ a la Resolució d'exclusió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. En data 29 de maig de 2023, s'entén desistit de la seva sol·licitud al Sr. Jaume Palou Santandreu, atès el rebuig de notificació per caducitat de l'esmentat aspirant.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El Decret 30/2009, de 22 de maig, pel qual s'aprova el procediment de selecció de personal funcionari interí al servei de l'administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La Resolució de la consellera de Presidència, Funció Pública i Igualtat de 14 de febrer de 2022, a proposta de la directora gerent de Funció Pública, per la qual es convoca un concurs per constituir una borsa extraordinària per cobrir, amb caràcter d'interinitat, places vacants del cos facultatiu superior, escala d'arxius, museus, biblioteques i documentació, de l'Administració especial de la Comunitat Autònoma de les Illes Balears, per a l'illa de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Proposta de resolució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Propòs a la consellera de Presidència, Funció Pública i Igualtat que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Excloure al Sr. Jaume Palou Santandreu del concurs per constituir una borsa extraordinària per cobrir, amb caràcter d'interinitat, places vacants del cos facultatiu superior, escala d'arxius, museus, biblioteques i documentació, de l'Administració especial de la Comunitat Autònoma de les Illes Balears, per a lilla de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Declarar desistida de la seva sol·licitud al Sr. Jaume Palou Santandreu, atès que no ha presentat cap al·legació durant el termini establert al tràmit d'audiència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;3. Publicar la Resolució en el Butlletí Oficial de les Illes Balears, a la seu electrònica de la Administració de la Comunitat Autònoma de les Illes Balears i en el web&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt; &amp;lt;http://oposicions.caib.es&amp;gt;. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Resolució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Manifestar la conformitat amb la proposta de resolució i dictar-ne resolució en els mateixos termes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el mateix òrgan que la dicta en el termini d'un mes comptador a partir de l'endemà d'haver-ne rebut la notificació, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;També es pot interposar directament un recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma en el termini de dos mesos comptadors des de l'endemà d'haver rebut la notificació de la resolució, d'acord amb els articles 8.2 i 46.1 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
