&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;1. Mitjançant la Resolució del conseller d'Educació, Universitat i Recerca de 23 de març de 2020 (BOIB núm. 58 de 18 d'abril), s'autoritzà l'obertura i el funcionament del centre privat d'educació infantil de primer cicle CEI Coletinas Palmanova, del municipi de Calvià.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;2. A la Secció d'Autoritzacions i Registre de Centres es va tenir coneixement que actualment aquest centre no estava obert al públic i per això, el 21 de febrer de 2022 es va demanar al Departament d'Inspecció Educativa un informe per tal de poder procedir a formular la proposta de resolució sobre la revocació de l'autorització concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;3. El 18 de maig de 2023, el Departament d'Inspecció Educativa va emetre un informe sobre el tancament del CEI Coletinas Palmanova, amb el codi de centre 07015446, mitjançant el qual informava que el centre estava tancat i no oferia cap tipus de servei educatiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;4. El 19 de maig de 2023, la cap del Departament de Planificació i Centres va emetre un informe favorable sobre l'extinció de l'autorització i el cessament de l'activitat com a centre docent del centre privat d'educació infantil de primer cicle CEI Coletinas Palmanova, amb codi 07015446.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;5. El 22 de maig de 2023, el director general de Planificació, Ordenació i Centres va proposar l'extinció de l'autorització i el cessament de l'activitat com a centre docent del centre privat d'educació infantil de primer cicle CEI Coletinas Palmanova, amb codi 07015446.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;1. El Reial decret 332/1992, de 3 d'abril, sobre autoritzacions de centres docents privats per impartir ensenyaments de règim general no universitari, modificat pel Reial decret 131/2010, de 12 de febrer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;2. La disposició transitòria quarta, referent a la normativa de matèries transferides, de la Llei orgànica 1/2007, de 28 de febrer, de reforma de l'Estatut d'autonomia de les Illes Balears (BOIB núm. 32 ext., d'1 de març de 2007, amb correcció d'errades en el BOIB núm. 29, de 28 de febrer de 2008).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;3. La Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques (BOE núm. 236, de 2 d'octubre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;Per tot això, i d'acord amb la proposta formulada per la Direcció General de Planificació, Ordenació i Centres amb data de 22 de maig de 2023, dict la següent &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Resolució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;1. Extingir l'autorització i el cessament de l'activitat com a centre docent, del centre privat d'educació infantil de primer cicle CEI Coletinas Palmanova, amb codi 07015446, de titularitat Ceima Educación, SL, amb CIF núm. B57267395, atès que la seva activitat ha cessat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;2. Ordenar al titular del centre que retiri la placa que indica que el centre està autoritzat per la Conselleria d'Educació i Formació Professional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;3. Notificar aquesta Resolució al titular del centre, de conformitat amb el que estableixen els punts 1 i 2 de l'article 40 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;4. Comunicar aquesta Resolució al Departament d'Inspecció Educativa (DIE) &amp;nbsp;i a l'Institut per a l'Educació de la Primera Infància (IEPI) d'aquesta Conselleria, perquè en prenguin coneixement.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;5. Ordenar la inscripció d'aquesta Resolució en el Registre de Centres Docents no Universitaris (RCD)&amp;nbsp; del Ministeri d'Educació i Formació Professional i en el Repositori General de Centres Docents de la Direcció General de Planificació, Ordenació i Centres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;6. Publicar aquesta Resolució en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d'Educació i Formació Professional en el termini d'un mes comptador des de l'endemà de la publicació, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;També s'hi pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la publicació, d'acord amb els articles 10 i 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
