El 11 de gener de 2023, Francisca Xamena Nadal, en representació de la Comissió Negociadora, sol·licità el registre, el dipòsit i la publicació de l'Acord esmentat.</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Fonaments de dret</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. ÀMBIT PERSONAL I FUNCIONAL.</span></strong><span style="background-color:null"> </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El contingut del present pacte és d'aplicació al funcionariat de carrera i al personal contractat en règim administratiu de l'Ajuntament de Felanitx, i a tot aquell personal que, mantenint una relació amb l'Ajuntament de Felanitx, romanin en l'àmbit d'aplicació del Reial Decret legislatiu 5/2015, de 30 d'octubre, pel que s'aprova el text refós de la Llei de l'estatut bàsic de l'empleat públic, en endavant (EBEP). </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Són parts concertants del pacte, per part empleadora els representants designats en virtut d'acord plenari per l'Ajuntament de Felanitx i per part treballadora els membres de la Junta de Personal.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 2. VIGÈNCIA I DENÚNCIA.</span></strong><span style="background-color:null"> </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El pacte entrarà en vigor el dia de la seva firma per la Comissió negociadora, sense perjudici de la seva publicació en el Butlletí oficial. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El pacte vigent serà actualitzat anualment quant a les quanties retributives establertes en ell, d'acord amb les variacions previstes en els Pressuposts generals de l'Estat, seguint les prescripcions marc d'obligat compliment establertes a dits pressupostos. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Finalitzat el període de vigència general, el pacte s'entendrà prorrogat d'any en any, llevat de si es produeix denúncia per qualsevol de les parts afectades. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">S'estableix que la denúncia en el seu cas, haurà de produir-se durant el mes de setembre de l'any 2025, o dins dels mesos de setembre de qualsevol dels eventuals anys de pròrroga, mitjançant comunicació escrita que s'haurà d'enviar a la part interessada.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les millores funcionarials que s'hagin acordat al llarg de la vigència d'aquest pacte i totes aquelles millores que, sent d'aplicació directa o indirecta als treballadors o treballadores inclosos en l'àmbit d'aplicació del present pacte, es puguin acordar en un futur entre els sindicats de treballadors i l'Ajuntament de Felanitx; el Govern central; el Govern de les Illes Balears; o el Consell de Mallorca; hi quedaran automàticament incorporades. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 3. NATURALESA DE LES CONDICIONS PACTADES.</span></strong><span style="background-color:null"> </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El present pacte negociat és vinculant i d'obligat compliment per a les parts signants, una vegada aprovat pel Ple de l'Ajuntament, i forma un tot orgànic i indivisible a efectes de la seva aplicació, per la qual cosa en el cas que s'anul.làs o es proposàs la modificació d'alguna de les estipulacions, qualsevol de les parts afectades podria sol.licitar la reconsideració global o parcial del seu contingut.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 4. INTERPRETACIÓ I VIGILÀNCIA.</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Dins el mes següent al de l'aprovació del present Pacte pel Ple de l'Ajuntament es constituirà una Comissió mixta paritària integrada per tres representants de cada part firmant d'aquest acord. La representació de l'Ajuntament de Felanitx es designarà per part de l'Ajuntament de Felanitx mitjançant Decret de Batlia.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">D'entre ells, formaran sempre el batle o batlessa i el regidor delegat o regidora delegada en matèria de personal. Quant a la representació de la part sindical, els seus representants seran designats de forma proporcional a la seva representació per part de la junta de personal. Es designaran els representants titulars, i els corresponents suplents. La Comissió mixta paritària tendirà a la paritat de gènere, en la mesura del possible, d'acord amb la normativa vigent.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Es nomenarà personal responsable de l'aplicació de la transversalitat de gènere i de mesures per promoure la igualtat en el si de les administracions, atès que permet assegurar el compromís de l'administració pública desenvolupat en els articles 24, 25 i 43 de la Llei 11/2016, de 28 de juliol, d'igualtat de dones i homes, relatius a la capacitació del personal al servei de les administracions públiques i a l'ocupació en el sector públic, així com també en els objectius desenvolupats en el V Pla Estratègic d'Igualtat entre dones i homes 2021-2023 de les Illes Balears.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les persones integrants de la Comissió incorporaran la perspectiva de gènere en les funcions pròpies d'aquesta i en l'anàlisi, l'estudi i les actuacions que es proposin en l'àmbit laboral vinculat al personal funcionari. S'han de recollir les dades separades per sexe en els informes i diagnosis que es proposin, de tal manera que les actuacions que es derivin de les seves funcions puguin tenir una repercussió positiva en matèria d'igualtat.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Qualsevol discrepància sobre la interpretació del clausulat del Pacte s'haurà de sotmetre amb caràcter previ i obligatori a la Comissió mixta paritària, sense perjudici del dret posterior d'acudir a les pertinents instàncies judicials o administratives.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Aquesta comissió es reunirà a petició de les parts, de qualsevol d'elles, i quan se sol·liciti amb una antelació mínima de 10 dies hàbils. Les seves funcions seran:</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">a) Vigilància del compliment del Pacte i interpretació i arbitratge del seu contingut. Els seus informes se sotmetran, en el seu cas, a l'acord de l'òrgan competent, mentre no s'estableixin altres instruments legals.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">b) Totes aquelles que el present Pacte hagi previst la seva intervenció.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 5è.- DRETS GENERALS.</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El funcionariat afectat pel present pacte tendran els drets generals que legalment se li reconeixen per la normativa d'aplicació als funcionaris públics, i, en particular, al Reial Decret legislatiu 5/2015, de 30 d'octubre, pel que s'aprova el text refós de la Llei del estatut bàsic de l'empleat públic (EBEP) i a la Llei orgànica 11/1985, de 2 d'agost, de llibertat sindical (en endavant, LOLS).</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 6è.- LLIURE SINDICACIÓ I ASSOCIACIÓ.</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Cap funcionari o funcionària podrà ser obligat a sindicar-se o associar-se, ni ser discriminat per aquesta raó.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El funcionariat que ostenti càrrecs electius a nivell autonòmic o estatal en les organitzacions sindicals més representatives o que tenguin representació entre els representants de personal o en el seu cas a la Junta de personal, podran passar a la situació de serveis especials en els termes previstos en la Llei orgànica de llibertat sindical. Al funcionariat en tal situació se'ls computarà el temps que hi estiguin a efectes d'ascensos, triennis i drets passius i tendran dret a la reserva de plaça i destí que ocupassin, tot allò de conformitat a l'establert a la Llei. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 7è.- DRET DE REUNIÓ.</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Els funcionaris o funcionàries podran exercir el seu dret a reunir-se a les dependències municipals amb els requisits i condicions que més a sota s'indiquen. </span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">a)&nbsp;S'entén per reunió la concurrència d'una part del funcionariat per un determinat motiu.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">b) Es considera assemblea la reunió de la totalitat del funcionariat. Els funcionaris o funcionàries exercitaran el dret de reunió o assemblea a les dependències municipals segons les condicions següents:</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">c) Estan legitimats per convocar una reunió o assemblea de funcionaris:</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">i) La Junta de Personal.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">ii) Els representants de les organitzacions sindicals o professionals.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">iii) Un grup de funcionaris o funcionàries de l'Ajuntament, sempre que el nombre sigui superior al 20% de la plantilla.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">d) Per poder celebrar qualsevol tipus de reunió o assemblea, cal donar compliments als requisits següents:</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">i) Formular la sol·licitud amb una antelació mínima de 48 hores davant de la Batlia amb assenyalament de lloc, dia i hora i presentació de l'ordre del dia.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">ii) Si quan falten 24 hores per a la celebració de la reunió o assemblea, la Batlia no s'ha manifestat en contra, se celebrarà l'assemblea d'acord amb allò previst a la sol·licitud.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">iii) En cas d'expressar la seva negativa, la Batlia fixarà, d'acord amb la Junta de Personal, nou dia i hora de celebració, que no podrà representar una demora de més de 72 hores de la data prevista amb anterioritat. La Batlia només podrà ajornar la reunió o assemblea una sola vegada per convocatòria.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px; text-align:left"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">e) Les reunions o assemblees podran celebrar-se durant la jornada laboral, i s'usaran les dependències municipals per a aquest efecte. En cas de celebrar-se durant la jornada laboral, es podrà fer ús d'un màxim de 10 hores mensuals (en aquest màxim es calculen les hores de reunió i assemblea). Es poden acumular les hores disponibles per a aquests efectes durant cada trimestre natural.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px; text-align:left"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">f) Durant les assemblees del personal d'oficines, es garantiran els serveis de l'Ajuntament.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 8è.- DRET DE VAGA.</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Mentre no existeixi el dret de vaga específicament contemplat per al funcionariat públic, serà d'aplicació el previst en el Reial Decret de 17/1977 de 4 de març i la Sentència del Tribunal Constitucional de 8 d'abril de 1981, amb estricte subjecció, en tot cas, a les particularitats establertes o a les que s'estableixin per a la funció públic en aquesta matèria.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 9è.- REPRESENTANTS DE PERSONAL I/O JUNTA DE PERSONAL.</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La composició, competències, facultats, drets i garanties dels delegats o delegades de personal són les establertes i reconegudes a la normativa vigent, sense perjudici de les que es relacionen en els articles següents.</span></span></span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 10è.- COMPETÈNCIES I FACULTATS DELS REPRESENTANTS DE PERSONAL.</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les competències i facultats dels representants de personal vindran determinades per la normativa vigent, i, en especial, la Llei 9/1987, de 12 de juny, d'òrgans de representació, determinació de les condicions de treball i participació del personal al servei de les administracions públiques. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">A més a més, s'ìnclou el dret específic dels representants de personal a ser informats prèviament dels canvis de destí que legalment es decretin per la Corporació, i els Membres de la Junta de Personal podran manifestar les consideracions que considerin necessàries a dits canvis.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 11è.- GARANTIES DELS MEMBRES DE LA JUNTA DE PERSONAL.</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Els membres de la Junta de Personal com a representants legals del funcionariat, tindran les garanties que els hi són reconegudes per part de la normativa bàsica estatal, i, en especial, per la Llei 9/1987, de 12 de juny, d'òrgans de representació, determinació de les condicions de treball i participació del personal al servei de les administracions públiques. A més a més, tendran les següents garanties:</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">a) No poder ser discriminats en la seva promoció econòmica o professional en raó, precisament, de l'exercici de la seva representació, durant el seu mandat ni dins de l'any següent a la seva finalització.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">b) Quan s'hagi d'organitzar un trasllat o canvi de torn per necessitats del servei, que afecti un dels membres de la Junta de Personal, aquest, salvada la seva voluntat, serà l'últim en ser traslladat o canviat de torn.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">c) Audiència en els supòsits de seguir-se expedient disciplinari a uns dels representants de personal, sense perjudici de la de persona interessada que es regula en el procediment disciplinari.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">d) Els representants de les seccions sindicals o associacions professionals tendran dret a ser informats de les propostes d'acord en matèria de personal.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">e) No serà considerada abandó de servei la interrupció de funcions o obligacions en la feina encomanades als represenants de personal, quan sigui per causa de l'exercici de l'activitat sindical.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les seccions sindicals i els selegats sindicals, pel cas que n'hi hagués, ostentaran els drets que els hi són conferits per la Llei orgànica 11/1985, de 2 d'agost, de llibertat sindical. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 12è.- EXPEDIENTS DISCIPLINARIS.</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El règim disciplinari del personal empleat públic de l'Ajuntament de Felanitx vindrà regulat pel que es preveu en el Reial Decret legislatiu 5/2015, de 30 d'octubre, pel que se aprova el text refós de la Llei del sstatut bàsic de l'mpleat públic (EBEP). Per tot allò que no vingui regulat a l'EBEP, serà d'aplicació de forma subsidiària el contingut de la Llei 3/2007, de 27 de març de la funció pública de la comunitat autònoma de les Illes Balears i el Decret 32/2020, de 5 d'octubre, pel qual es regula el règim disciplinari de la funció pública de l'Administració de la comunitat autònoma de les Illes Balears.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Articles 13è.- JORNADA LABORAL.</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">a) La jornada laboral del personal de l'Ajuntament de Felanitx subjecte al present pacte vindrà determinada per la normativa bàsica de l'Estat, així com pels acords establerts en el marc de la negociació col·lectiva entre els representants dels treballadors i treballadores i l'Ajuntament. Tot el personal al servei de l'Ajuntament de Felanitx haurà de complir la jornada de treball, en còmput anual, que s'estableixi per part de la normativa bàsica estatal. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">b) La realització d'hores extraordinàries es regularà pel convingut entre les parts i el legalment establert. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 14è- HORARI DE TREBALL.</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Els horaris del personal de l'Ajuntament de Felanitx subjecte al present pacte, vendran determinats pels acords presos en el marc negociació col·lectiva, en especial quant a la implementació del teletreball i la formació; així com les particularitats horàries pròpies acordades amb el cos de la Policia Local de Felanitx. L'horari del personal de l'Ajuntament de Felanitx subjecte al present pacte vindrà determinat pels acords que es prenguin per la Mesa general de l'Ajuntament, que s'hauran d'aprovar posteriorment en sessió plenària de la Corporació. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 15è.- VACANCES I PERMISOS.</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">a) El personal de l'Ajuntament de Felanitx subjecte al present pacte tindrà dret a gaudir del període de vacances i permisos que s'estableixi per part de la normativa bàsica de l'Estat, així com pels acords arribats en el marc de la negociació col·lectiva entre els representants dels treballadors i l'Ajuntament de Felanitx. </span></span></span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">b) Les vacances es gaudiran, després d'autorització prèvia i sempre que sigui compatible amb les necessitats dels servei, dins de l'any natural i fins al 31 de gener de l'any següent, en períodes mínims de cinc dies hàbils consecutius. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">c) S'establiran per part de l'Ajuntament dos plans de vacances el mes d'abril i octubre de cada any, als efectes de poder planificar les vacances d'estiu i Nadal en funció de les necessitats del servei. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">d) Els personal de l'Ajuntament de Felanitx subjecte al present pacte tindrà dret a gaudir de fins a quatre dies addicionals de vacances, en funció dels temps de servei prestat com a personal funcionari públic, en els termes que es preveu en la resolució de 16 de setembre de 2015, de la Secretaria d'estat d'administracions públiques, per la que es modifica la de 28 de desembre de 2012, per la que es dicten instruccions sobre jornada i horaris de treball del personal al servei de l'Administració general de l'Estat, així com la resta de garanties en matèria de vacances i permisos que es reconeixen al funcionariat de l'Administració general de l'Estat en dita resolució. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">e) Pel que fa als dies addicionals de permisos per assumptes particulars, el personal empleat públic de l'Ajuntament de Felanitx tendrà dret a gaudir de dos dies addicionals de permís per assumptes particulars des del dia següent al del compliment del sisè trienni, i s'incrementarà en un dia addicional per cada trienni complit a partir del vuitè. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El personal de l'Ajuntament de Felanitx sotmès a jornada i horari especial els serà d'aplicació les adaptacions oportunes que prevegi la normativa vigent.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 16. LLICÈNCIES.</span></strong><span style="background-color:null"> </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El personal de l'Ajuntament de Felanitx subjecte al present Pacte, després d'avís previ i justificació, podrà absentar-se amb dret a remuneració, en els termes previstos en els articles 48 i 49 de la Llei del estatut bàsic de l'empleat públic (EBEP) i en el Decret 7/2020, de 31 de gener, pel qual es regulen els permisos, les llicències, les vacances i altres mesures de conciliació de la vida personal, familiar i laboral del personal funcionari al servei de l'Administració de la comunitat autònoma de les Illes Balears (BOIB de dia 1 de febrer).</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 17. AJUTS SOCIALS.</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El personal de l'Ajuntament de Felanitx subjecte al present pacte tindrà dret als ajuts socials en els termes que s'estableixen a l'ANNEX 1 del present Pacte. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 18. INCAPACITAT TEMPORAL I DIES D'ABSÈNCIA PER MALALTIA O ACCIDENT DEL PERSONAL DE L'AJUNTAMENT DE FELANITX.</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">a) El personal al servei de l'Ajuntament de Felanitx subjecte al present pacte rebrà un complement retributiu des del primer dia en situació d'incapacitat temporal o llicència per malaltia en quantia tal que, sumat a la prestació del Règim general de la Seguretat Social, arribi el cent per cent de les seves retribucions ordinàries del mes d'inici de la incapacitat temporal.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">b) L'absència del personal per causa de malaltia que doni lloc a una incapacitat temporal s'haurà de justificar amb la presentació del corresponent butlletí de baixa des del primer dia d'absència.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">c) El designen els o les caps dels diferents departaments com a encarregats de controlar l'absentisme del personal del seu departament, que haurà de ser comunicat al Servei de Prevenció de l'Ajuntament o mútua corresponent en els casos en què es detecti una situació de baixa mèdica de llarga durada o en cas de baixes continuades d'un/a treballador/a.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">d) Es concedeix al personal de l'Ajuntament de Felanitx un màxim de 4 dies dins l'any natural d'absència a la feina sense deducció de les retribucions, sempre que estiguin motivats per malaltia o accident i que no donin lloc a incapacitat temporal. Aquestes absències hauran d'estar degudament justificades amb el corresponent justificant mèdic, i només tres dels quatre dies d'absència podran ser consecutius. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">e) Es publicarà semestralment a través del Portal de Transparència de l'Ajuntament de Felanitx les dades d'absentisme del personal classificades per la seva causa.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 19. AVANÇAMENT DE NÒMINA.</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'Ajuntament de Felanitx podrà concedir com a bestreta ordinària l'import de fins a dues mensualitats líquides.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Aquestes bestretes hauran de ser reintegrades per desenes parts iguals que seran mensualment retingudes a la nòmina i no meritaran, aquestes bestretes, cap interès.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El personal en situació de maternitat o paternitat, podrà sol·licitar una bestreta addicional a l'anterior de fins a 2 mensualitats líquides addicionals, les quals seran reintegrades a partir de la reincorporació i per quartes parts, que seran mensualment retingudes. Per accedir a aquesta bestreta el personal que ho sol·liciti s'haurà de comprometre a la reincorporació immediata, una vegada finalitzat el període legal de maternitat, i, en el cas de no reincorporació, al reintegrament immediat de la bestreta.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 20.</span></strong><span style="background-color:null"> </span><strong><span style="background-color:null">QUILOMETRATGE.</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Quan per necessitats del Servei l'Ajuntament ordenàs la prestació d'un determinat desplaçament que implicàs la utilització de vehicle propi, s'establirà una indemnització per quilometratge que es considerarà des del lloc de treball fins al punt on hagi de prestar el servei.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Aquesta indemnització serà de 0,57 euros quilòmetre.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Dita quantitat serà anualment revisada a l'alça o la baixa en funció del preu dels combustibles, en els límits establerts per la normativa pressupostària bàsica estatal, d'acord amb el percentatge d'increment de retribucions establert a les successives lleis de pressupostos generals de l'Estat. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 22.- DRET DE FORMACIÓ.</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'Ajuntament reconeix al seu funcionariat el dret de formació permanent en els termes establerts per la normativa vigent. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">S'estableixen els següents criteris en matèria de formació del personal subjecte al present pacte: </span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">a) Tots els cursos que se celebrin, i que l'Ajuntament n'estigui assabentat, es difondran adequadament entre tot el personal i amb l'antelació́ suficient. </span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">b) L'Ajuntament, una vegada coneguts els cursos que se celebrin, ha d'assabentar el personal al que li pugui interessar per motiu de la seva feina, de la celebració d'aquest, i donar-li l'oportunitat de poder assistir-hi.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">c) L'Ajuntament de Felanitx posarà en disposició del personal un crèdit de 60 hores (o la part proporcional quan la duració de la situació d'actiu és inferior a l'any) anuals per treballador/a per assistir a accions formatives relacionades amb el seu lloc de treball, sempre que aquests coneixements adquirits estiguin destinats a millorar l'eficàcia i l'eficiència del treballador/a, i que siguin necessaris per exercir correctament les funcions corresponents al lloc de treball. Aquest crèdit horari inclou el temps necessari de desplaçament. Formació impartida fora de l'horari laboral: es compensaran les hores rebudes de formació i el temps de desplaçament, una vegada s'hagi presentat el certificat d'assistència o aprofitament.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">d) L'Ajuntament de Felanitx assumirà, si n'hi hagués, les despeses d'inscripció corresponents.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">e) L'Ajuntament de Felanitx dotarà suficientment anualment una partida per poder fer front a les despeses de formació de personal que es puguin preveure en un any i, en el seu cas, a incrementar el seu crèdit inicial per tal poder atendre les despeses de formació que puguin sorgir i que sobrepassin l'import inicialment previst.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">f) S'entendran com a cursos i activitats formatives:</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">a. Els impartits per l'Escola Balear d'Administració Pública (EBAP), per institucions públiques de l'Estat espanyol, o que tinguin la condició de concertats o homologats per aquestes.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">b. Els impartits per universitats de l'àmbit de la Unió Europea.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">c. Cursos d'altres entitats de formació contínua sempre que estiguin impartits o homologats per l'EBAP o per les universitats de l'àmbit de la Unió Europea, i l'efectuada dins dels plans de formació contínua tots ells relacionats amb el lloc de feina.</span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">g) El procediment per poder participar en els cursos abans relacionats serà el següent:</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">a. El personal que estigui interessat en l'assistència a un curs, prèviament a la realització de l'acció formativa, haurà de sol·licitar a través del Registre d'entrada l'informe al corresponent cap d'àrea i regidor/a, i adjuntar el programa del curs/seminari.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">b. El o la cap de negociat/àrea/servei, juntament amb la regidoria corresponent, emetran el corresponent informe sobre la relació de la matèria impartida i la necessitat per exercir correctament les funcions corresponents al lloc de treball. Amb l'informe s'autoritzarà, si pertoca, tant l'assistència al curs com el pagament de la inscripció, dietes i desplaçaments, si escau.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">c. Un cop realitzada la formació, la persona interessada sol·licitarà mitjançant el Registre d'entrada la compensació́ d'hores (formació impartida fora de l'horari laboral) o la validació del nombre d'hores disposades del crèdit horari anual (formació impartida dintre de l'horari laboral), així com el pagament del cost d'inscripció a aquesta, si escau, al qual s'haurà d'adjuntar: </span></span></span></span></p> <p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">i. Informe favorable emès anteriorment. </span></span></span></span></p> <p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">ii. Certificat d'aprofitament o assistència. </span></span></span></span></p> <p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">iii. Justificants de pagament de la inscripció, dietes i desplaçaments, si escau. </span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">d. La compensació o validació d'hores, així com el pagament dels costos inherents a l'acció formativa, si escau, s'haurà d'acordar per la Junta de Govern Local. </span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">e. L'Ajuntament de Felanitx aprovarà un model estandaritzat de formulari per tramitar la participació en els cursos de formació. </span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">h) Les hores de formació a l'àmbit de la Policia Local només es podran aplicar als torns als que no sigui d'aplicació el factor corrector horària. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 23.- LA NOCTURNITAT I FESTIVITAT.</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La nocturnitat i festivitat serà regulada i retribuïda en els termes establerts per la normativa vigent i la relació de llocs de treball de l'Ajuntament de Felanitx. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 24- RECLASSIFICACIÓ DELS LLOCS DE TREBALL.</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Qualsevol procés de reclassificació professional s'haurà de dur a terme d'acord amb el contingut de relació de llocs de treball aprovada per l'Ajuntament de Felanitx. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En tant no sigui aprovada la relació de llocs de treball de l'Ajuntament de Felanitx, s'aplicarà el document de plantilla aprovat anualment. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 25.- UNIFORMITAT I VESTIMENTA.</span></strong><span style="background-color:null"> </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Serà la que s'estableix a l'annex II del present Pacte.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Després d'acord previ amb els membres de la Junta de Personal, es podrà modificar la periodicitat, suplir els períodes de carència o canviar els tipus de les peces de roba de treball.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 26.- AJUTS ASSISTENCIALS</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">S'estableixen els dret del personal sotmès al present pacte als ajuts assistencials que s'inclouen al ANNEX 3 del present pacte. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La percepció dels esmentats ajuts assistencials vindrà sotmès a les següents limitacions:</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">a) No es podrà gaudir del 100% de l'import dels ajuts fins que no es compti amb una antiguitat de 4 anys dins un període de 6 anys, comptats des de l'alta corresponent a l'Ajuntament de Felanitx.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">b) El personal nou (entenent com a nou els que entri a treballar a l'Ajuntament amb la corresponent alta) tendrà dret a percebre la part proporcional que pertoqui, comptant l'antiguitat des de la data d'alta a la Seguretat Social, i fins al a data de la baixa, si escau, computant els anys i mesos sencers. </span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">c) Les factures s'hauran de presentar en el mateix any de la seva expedició, i l'antiguitat a aquests efectes es comptarà agafant de referència la data de la factura.. </span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">d) Els ajuts assistencials estaran sotmesos al règim fiscal que els pertoqui d'acord amb la normativa vigent. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El personal també tendrà dret a percebre aquests ajuts pels seus fills o filles, o descendents solters o solteres menors de 25 anys, o de més de 25 anys si són discapacitats o discapacitades, que conviuen amb el personal de l'Ajuntament i que no tenen rendes anuals superiors a 8.000,00 €. A partir del dia que es compleixen els 25 anys, ja queden exclosos dels ajuts, amb l'excepció dels discapacitats o discapacitades.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les quantitats establertes a dit ANNEX 3 seran actualitzades anualment en els límits establerts per les disposicions pressupostàries vigents. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">ARTICLE 27 DISPOSICIÓ DEROGATÒRIA. </span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Queda derogat qualsevol acord o norma d'igual o inferior rang que contradigui o se oposi al que disposa en aquest Pacte. </span></span></span></span></p> <p style="text-align:center"> </p> <p style="text-align:center"> </p> <p style="text-align:center"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">ANNEX 1</span></strong></span></span></span><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null"><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>AJUTS SOCIALS</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 1.- AJUT PER ESCOLARITAT.-</span></strong><span style="background-color:null"> </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">S'estableix una ajuda de 43,16 euros mensuals per escolaritat per a cada fill o filla comprès entre els 0 i els 21 anys. A partir dels 16 anys del fill o filla s'haurà d'acreditar l'efectiva escolarització del menor pel cobrament de l'ajut per escolaritat. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 2.- AJUT PER EDUCACIÓ ESPECIAL.-</span></strong><span style="background-color:null"> </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El personal de l'Ajuntament de Felanitx subjecte al present pacte que tengui al seu càrrec fills o filles amb diversitat funcional física o psíquica superior amb un grau de discapacitat superior al 33% pel cas que el fill o filla sigui menor d'edat, i del 65% pel cas de que el fill o filla sigui major d'edat, tendrà dret a un plus mensual de 280,54 euros mensuals per cada fill o filla en tals condicions. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 3.- AJUT EN CAS D'ACCIDENTS DE CIRCULACIÓ.-</span></strong><span style="background-color:null"> </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En cas que el personal de l'Ajuntament de Felanitx subjecte al present pacte conduint vehicles de propietat particular al servei de l'Ajuntament, sofrís un accident de circulació durant la jornada laboral in itinere, d'acord amb la normativa vigent, l'Ajuntament garantirà les següents cobertures:</span></span></span></span></p> <ol class="lower-alpha" start="1"> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La d'assumir la defensa lletrada davant jutjats, tribunals o altres organismes, en cas que la precisàs.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Prestar fiança carcerària que pogués assenyalar-se i abonar les costes judicials i els honoraris professionals que en poguessin originar-se, pèrits inclosos. Ambdós epígrafs en cas de no trobar-se cobertes aquestes contingències per les pòlisses d'assegurances dels propis vehicles implicats en l'accident.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'Ajuntament es farà càrrec de les possibles indemnitzacions a les víctimes de l'accident en cas que no es faci càrrec de dites indemnitzacions per part les pòlisses d'assegurances dels propis vehicles implicats en l'accident.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Durant el període en què el personal de l'Ajuntament de Felanitx subjecte al present pacte pogués estar privat del permís de conduir, l'Ajuntament podrà destinar-lo a altres tasques alienes a la seva categoria o funció.</span></span></span></span></li> </ol> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Al funcionariat que, en l'exercici de les seves funcions i amb motiu de la prestació d'un servei, sofrís un accident de circulació i de resultes d'aquest fossin condemnats per sentència ferma per imprudència temerària, els seran d'aplicació tots els apartats del paràgraf primer del present article, llevat que succeïssin les circumstàncies de conducció sota l'influx de begudes alcohòliques o estupefaents.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 4.- ASSISTÈNCIA JURÍDICA.-</span></strong><span style="background-color:null"> </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El personal de l'Ajuntament de Felanitx subjecte al present pacte que sigui investigat o processat judicialment, com a conseqüència de l'exercici de les seves funcions que les siguin encomanades, podrà lliurement nomenar advocat i procurador d'entre els que habitualment exerceixen a les Balears, a l'objecte de defensa dels seus interessos i responsabilitats penals i civils en què hagués pogut incórrer.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Els honoraris de lletrat i procurador/a, les despeses de fiança, costes judicials i responsabilitats civils, seran abonades per l'Ajuntament, i seran deduïdes les quantitats que fossin cobertes per la pòlissa d'assegurances del personal de l'Ajuntament de Felanitx subjecte al present pacte que en l'exercici de la seva funció tingués concertades.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Quedarà exclosa de la cobertura del pagament de despeses i honoraris pel cas que el personal de l'Ajuntament de Felanitx subjecte al present pacte sigui finalment condemnat penalment en sentència ferma per la comissió d'un delicte dolós. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En el cas del personal al servei de l'Ajuntament de Felanitx subjecte al present pacte que, en l'exercici de les seves funcions, sigui víctima de la comissió d'un fet delictiu, tindrà dret que l'Ajuntament de Felanitx dugui a terme la seva defensa jurídica com a víctima en el procediment penal que se'n derivi de la denúncia o querella interposada, i l'Ajuntament de Felanitx sufragarà, després de l'oportú nomenament per part de l'Ajuntament de l'advocat i procurador responsables, les costes judicials que se'n derivin. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 5.- PERSONAL AMB CAPACITAT LABORAL DISMINUÏDA.-</span></strong><span style="background-color:null"> </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'Ajuntament i els membres de la Junta de Personal són conscients de la situació moral i econòmica en què puguin quedar el personal de l'Ajuntament de Felanitx subjecte al present Pacte que per, qualsevol causa, veuen disminuïdes la seva capacitat física o psíquica per al normal desenvolupament de les funcions pròpies del seu lloc de treball. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">A tal fí, l'Ajuntament, per pròpia iniciativa o a petició dels membres de la Junta de Personal, acceptarà adaptar al personal la capacitat dels quals hagi disminuït, per raó d'edat, estat de salut, accident, etc., a treballs adequats a les seves condicions, sempre que arribàs el cas que ho permetin les disposicions vigents en la matèria, i, en especial, s'adequarà el procés d'adaptació a la normativa en matèria de prevenció de riscos laborals.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El personal que hagués sofert un accident de treball o malaltia professional, tendrà preferència absoluta per a la seva readaptació, i en el futur mantindrà els drets que experimenti la seva antiga categoria, a no ser que ocupi altra plaça distinta a la que ostenti en propietat.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 6.- </span></strong></span></span></span><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Adaptació per matèria d'edat</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La Corporació adoptarà les previsions oportunes d'acord amb la normativa en matèria de prevenció de riscos laborals, a fi que el personal de l'Ajuntament de Felanitx subjecte al present Pacte, que per edat o altra raó tenguin disminuïda la seva capacitat, siguin destinats a llocs de treball adequats a la seva capacitat disminuïda i sempre que conservin l'aptitud suficient per a l'exercici del seu lloc de treball; així, a ser possible, dins del mateix servei al qual estiguin adscrits.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les persones majors de 45 anys que realitzin el seu treball en torn de nit podran passar a efectuar-lo en torn de dia, sempre que se substitueixin per voluntaris o voluntàries. A tal lloc deixaran de percebre automàticament les quantitats que per nocturnitat tinguessin assignades. Sempre que sigui factible, no es destinaran al torn de nit les persones majors de 45 anys, llevat que voluntàriament ho sol.licitin, tot essent reservada l'adequada cobertura de tots els torns.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">S'estudiarà conjuntament amb els membres de la Junta de Personal, la Regidoria de Recursos Humans de l'Ajuntament, i la Comandància de Policia, la fórmula idònia per a l'ocupació dels/les policies locals majors de 55 anys de manera que els seus destins coincideixin amb els menys conflictius del Cos.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">ARTICLE 7.-&nbsp;</span></strong></span></span></span><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
