&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En data 18 d'abril de 2023 té entrada per correu electrònic a la Subdirecció de Pressuposts i Control de la Despesa la sol·licitud de l'Hospital Universitari Son Espases per tramitar la cessió gratuïta de Boston Scientific Ibérica, SA, d'una taula de suport quirúrgica, valorada en 13.800 €, a favor del Servei de Salut de les Illes Balears i amb destinació al Servei de Cardiologia de l'Hospital Universitari Son Espases. La documentació aportada és la següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Informe de necessitat emès per el Servei de Cardiologia de HUSE en data 13 de març de 2023. Disposa que la incorporació de la taula de suport quirúrgica millora la qualitat i seguretat en la realització dels procediments percutanis en cardiologia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El equipo que se cede no necesita fungible. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La cesión no supone gasto para el Servicio de Salud de Illes Balears ni para el HUSE. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La duración de la cesión comenzará el día en que el Hospital reciba el equipo y firme el acta de instalación y será de 2 años. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Queda entendido, que BSC, en ningún caso, es propietaria del Equipo y que éste será suministrado, entregado y puesto a disposición del Hospital por el Proveedor, que es Endocore S.L. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;BSC cederá al Hospital el uso del Equipo, al ostentar la posesión de éste como arrendataria, de conformidad con el contrato de arrendamiento (en adelante el Contrato de Arrendamiento) que tiene previsto suscribir con la entidad Siemens Renting (en los sucesivo, la "Arrendadora"). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta cesión se hace efectiva con carácter extraordinario y en ningún caso beneficia a ningún profesional sanitario ni constituye un incentivo para la recomendación, prescripción, compra, suministro, venta o administración de productos de marca determinada […]&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En l'expedient consta la documentació referida al donant i la seva representació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.&amp;nbsp;El 15 de maig de 2023, el director general del Servei de Salut de les Illes Balears signa la Resolució d'inici per acceptar la cessió temporal, pel termini de vint-i-quatre mesos, per part de Boston Scientific Ibérica, SA, d'una taula de suport quirúrgica, valorada en 13.800 €, a favor del Servei de Salut de les Illes Balears i amb destinació al Servei de Cardiologia de l'Hospital Universitari Son Espases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En data 16 de maig de 2023 el subdirector de Pressuposts i Control de la Despesa emeté un informe favorable a la cessió temporal i gratuïta d'ús, pel termini de vint-i-quatre mesos, per part de Boston Scientific Ibérica, SA, d'una taula de suport quirúrgica, valorada en 13.800 €, a favor del Servei de Salut de les Illes Balears i destinació al Servei de Cardiologia de l'Hospital Universitari Son Espases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El Codi civil, aprovat pel Reial decret de 24 de juliol de 1889.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
