    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;Atès que el Consell Executiu d'aquest Consell Insular, en sessió de caràcter ordinari de 14 de novembre de 2022, va aprovar la convocatòria dels d'ajuts de minimis per a la creació en arts visuals i projectes audiovisuals per a l'any 2022 (BOIB núm. 158, de 6 de desembre de 2022).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Vist que el termini de presentació de sol·licituds va finalitzar dia 31 de gener de 2023.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Atès que un cop revisada la documentació dels sol·licitants per l'instructor de la convocatòria, s'han convocat les dues comissions avaluadores previstes en la convocatòria. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Vista l'acta de la comissió avaluadora de les línies 1 a 4, reunida el 2 de maig de 2023.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Vista l'acta de la comissió avaluadora de la línia 5, reunida el 4 de maig de 2023.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Atès que la convocatòria preveu un pressupost de 10.000€ per a les línies 1, 2 i 4, de 15.000€ per a la línia 3 i de 40.000€ per a la línia 5.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;En el cas que no s'esgoti la consignació pressupostària d'una línia, la quantitat sobrant s'assignarà a una de les altres línies d'ajuts per l'ordre de preferència següent:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;1. Investigació 2. Formació 3. Producció d'obra 4. Producció d'exposicions i 5. Projectes audiovisuals.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Atès que no es van presentar sol·licituds en la línia 2 i hi va haver un romanent de 2.500€ en la línia 1, amb la qual cosa es va traspassar aquests dos imports a la línia 3. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Vist que la senyora Azahara Moyano Arcos va presentar la sol·licitud en termini per la línia 5, i consta en l'expedient una comunicació en què manifestava que estava en vies de constituir una societat limitada i sol·licitava la concessió de l'ajut a l'empresa. El 7 de maig de 2023, amb registre d'entrada GE/017130/2023, ha presentat la documentació definitiva de constitució de l'empresa, amb la qual cosa es concedeix aquesta subvenció a La Moyano Films, SL.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Vista la proposta de l'instructor de la convocatòria que consta en l'expedient.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Atès que l'interventor ha fiscalitzat favorablement la concessió dels ajuts, mitjançant signatura de la proposta de l'instructor.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Atès que l'article 33.2.K de la Llei 4/2022, de 28 de juny, de consells insulars, estableix com a atribució dels consellers executius resoldre les convocatòries d'ajudes i subvencions.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Com a titular del Departament de Cultura, Educació, Joventut i Esports, en exercici de les competències atribuïdes per l'article 33 de la Llei 4/2022, de 28 de juny, de consells insulars, pel Decret de presidència núm. 275/2022, de 6 de setembre de 2022, relatiu a la delegació de competències de la Presidència en els consellers executius (BOIB núm. 118 de 8 de setembre de 2022), l'acord del Consell executiu de 5 de setembre de 2022, relatiu a la delegació de competències del Consell Executiu en la presidenta i en els consellers i conselleres executives (BOIB núm. 118 de 8 de setembre de 2022), tot l'anterior en relació amb el Decret de presidència núm. 421/2019 de 9 de juliol, de creació dels departaments (BOIB núm. 93 ext. &lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Tercer&lt;/strong&gt;: No concedir cap ajut relatiu a formació en arts visuals (línia 2) perquè no s'ha presentat cap sol·licitud. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Resten, per tant, 10.000€ de romanent. D'acord amb la convocatòria la quantitat sobrant s'assignarà a una de les altres línies d'ajuts per l'ordre de preferència següent:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;L'import total concedit de la línia 3 és de 27.500€, dels quals 15.000€ es corresponen amb els previstos per aquesta línia en la convocatòria i, els 12.500€ restants, s'incorporen del romanent de les línies 1 i 2. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Sisè&lt;/strong&gt;: concedir els ajuts a les següents sol·licituds per producció d'exposicions (línia 4):&lt;/span&gt;&lt;/p&gt;

La resolució de l'expedient de concessió o denegació dels ajuts es remetrà a la Base de Dades Nacional de Subvenciones, en compliment de l'art. 20.8 b de l'LGS i es publicarà en el Butlletí Oficial de les Illes Balears i en el web del Consell Insular de Menorca www.cime.es, i hi figuraran les dades identificatives de les persones interessades. La publicació en el BOIB té els efectes de notificació d'acord amb l'art. 45.1 b de l'LPACAP.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Contra aquest acord – que no exhaureix la via administrativa – es pot interposar un recurs d'alçada davant el Consell Executiu en el termini d'un mes comptador des de l'endemà que s'hagi publicat, d'acord amb l'article 122 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;L'esmentat recurs s'entendrà desestimat, si no es notifica la resolució corresponent, quan hagin transcorregut tres mesos des de la seva interposició. Contra la desestimació del recurs d'alçada per silenci administratiu podreu interposar recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma.&lt;/span&gt;&lt;/p&gt;
