L' 11 de setembre de 2021 es va publicar la convocatòria pública de subvencions per &lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;a la realització d'instal·lacions d'autoconsum amb fonts d'energia renovable&lt;/span&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; &lt;/strong&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;mitjançant la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 6 de setembre de 2021&lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Les persones o entitats que figuren en l'annex d'aquesta Resolució varen presentar&amp;nbsp; a la conselleria de &lt;/span&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Transició Energètica, Sectors Productius i Memòria Democràtica&lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; una sol·licitud de subvenció en el marc de la convocatòria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. Els titulars dels expedients que apareixen a l'annex han presentat un escrit en el que indiquen que desisteixen de la sol·licitud de subvenció esmentada.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Fonaments de dret&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. El conseller de Transició Energètica, Sectors Productius i Memòria Democràtica és l'òrgan competent per resoldre aquest procediment atesa l'estructura orgànica del Govern de les Illes Balears i d'acord amb l'Ordre de la consellera de Comerç, Indústria i Energia de 15 de maig de 2008 per la qual s'estableixen les bases reguladores per a la concessió de subvencions en matèria d'energia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. La Llei 38/2003, de 17 de novembre, General de Subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. El Decret legislatiu&amp;nbsp;2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions (BOIB núm.&amp;nbsp;196, de 31 de desembre de 2005).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. L'article 94, de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, preveu que l'Administració, en el supòsit de renúncia de la persona interessada als seus drets, acceptarà la renúncia completament i resoldrà el procediment declarant aquesta circumstància, amb indicació dels fets produïts i les normes aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;5. La Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 6 de setembre de 2021 per la qual s'aprova la convocatòria pública de subvencions per a la realització d'instal·lacions d'autoconsum amb fonts d'energia renovable, amb o sense emmagatzematge, i la incorporació d'emmagatzematge en instal·lacions d'autoconsum amb fonts d'energia ja existents, en el sector residencial, les administracions públiques i el tercer sector, en el marc del Pla de Recuperació, Transformació i Resiliència europeu (BOIB núm. 125, d'11 de setembre de 2021).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Per tot això, dict la següent,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;span style="color:black"&gt;Resolució&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. Acceptar el desistiment de la sol·licitud de subvenció presentada pels beneficiaris dels expedients que apareixen a l'annex.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Declarar conclòs el procediment i per tant, arxivar l'expedient.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. &lt;p&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs de reposició davant el conseller de Transició Energètica, Sectors Productius i Memòria Democràtica, en el termini d'1 mes comptador des de l'endemà d'haver-ne rebut la notificació, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú i de les administracions públiques i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà d'haver rebut la notificació de la Resolució, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;
