Fonament i règim jurídic</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Fent ús de les facultats contengudes en els articles 133.2 i 142 de la Constitució, l'article 84.1 de la Llei 7/1985, de 2 d'abril, reguladora de les bases del règim local, i de conformitat amb el que disposa l'article 20.6 en relació amb els articles 15 a 19 del text refós de la Llei reguladora de les hisendes locals aprovat pel Reial decret legislatiu 2/2004, de 5 de març, i la disposició addicional primera de la Llei 58/2003, de 17 de desembre, general tributària, aquest Ajuntament estableix la prestació patrimonial no tributària per la prestació de serveis al Palau de Congressos.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">ARTICLE 2. Pressupòsit de fet</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Constitueix el pressupòsit de fet de la prestació patrimonial de caràcter públic no tributari, del qual sorgeix l'obligació de pagament, la prestació dels serveis següents:</span></span></span></span></p> <ul> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Lloguer de la infraestructura del Palau de Congressos</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Lloguer de sales</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Prestació d'altres serveis: personal tècnic/manteniment i materials</span></span></span></span></li> </ul> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">ARTICLE 3. Obligats al pagament</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Estan obligades al pagament les persones físiques i jurídiques així com les entitats a què fa referència l'article 35.4 de la LGT que sol·licitin o resultin beneficiades o afectades pels serveis o utilitzin les instal·lacions esmentades.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">ARTICLE 4. Responsables</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En relació amb la responsabilitat solidària i subsidiària de les prestacions patrimonials, ha d'atenir-se al que estableixen els articles 41, 42 i 43 de la Llei 58/2003, de 17 de desembre, general tributària, d'acord amb la remissió a aquesta norma efectuada per l'article 10 de la Llei 47/2003, de 26 de novembre, general pressupostària.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">ARTICLE 5. Els materials propietat del Palau seran cedits sense cap cost. Els serveis exteriors de qualsevol tipus que el consistori necessiti li seran igualment pressupostats sense que aquests tenguin cap descompte.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Als òrgans de govern de l'Ajuntament, els seus departaments i els ens dependents, amb l'autorització prèvia d'Alcaldia, se'ls exonerarà de les quotes d'utilització dels espais del Palau de Congressos.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'aplicació (als espais cotitzats) de descomptes i preus especials variarà d'acord amb la trajectòria, importància o singularitat de l'esdeveniment en qüestió, impacte en l'activitat socioeconòmica del municipi i casos excepcionals, i podran ser autoritzats per l'empresa concessionària/ contractista dels serveis de gestió i explotació del Palau de Congressos.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">ARTICLE 6. Obligació de pagament</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. L'obligació de pagament de la tarifa regulada en aquesta normativa neix des que s'autoritza la prestació del servei o la utilització o aprofitament de les instal·lacions i els béns del Palau de Congressos.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. Quan l'ús o aprofitament de les instal·lacions n'ocasioni la destrucció o deteriorament o de béns del Palau de Congressos, a més del pagament de la tarifa establida s'estarà obligat al reintegrament del cost total de les despeses de reparació o construcció i al depòsit previ de l'import. Si els danys fossin irreparables, l'entitat serà indemnitzada per un valor igual que el dels béns destruïts o l'import del deteriorament del que s'ha danyat.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. Es pot requerir, amb caràcter previ a la prestació del servei o la celebració de l'esdeveniment, la constitució d'una fiança per garantir el cobrament de la indemnització per danys que es puguin haver ocasionat, i de serveis extraordinaris no liquidats.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">ARTICLE 7. Administració i cobrança</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'administració i cobrança de les tarifes es realitzarà per l'empresa concessionària/contractista dels serveis de gestió i explotació del Palau de Congressos.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">ARTICLE 8. Normes de gestió</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La prestació del servei, així com els drets i les obligacions bàsiques entre l'entitat prestadora del servei i els usuaris del Palau de Congressos i en general totes les normes de gestió de les prestacions patrimonials de caràcter públic no tributari, s'ajustaran al que estableixi el corresponent reglament del servei i els plecs de condicions del contracte.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">ARTICLE 9.
