&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Fa vint-i-cinc anys va néixer l'associació Jazz Obert Associació Al·ligàtors (Jazz Obert) a Ciutadella de Menorca amb la intenció de posar en valor i donar a conèixer el jazz com a gènere musical.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Jazz Obert &lt;/span&gt;és una associació sense afany de lucre legalment constituïda, la finalitat de la qual és ampliar l'oferta musical de Menorca, difondre el jazz així com el seu foment entre la gent jove. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;L'objectiu dels actes a celebrar amb motiu de l'aniversari és la commemoració de l'efemèride posant en valor el festival, la seva història i el seu paper en la societat menorquina.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Un dels objectius del Consell Insular de Menorca és donar suport a entitats que celebren commemoracions especials i que duen a terme una funció social en pro del benestar social i la qualitat de vida dels menorquins i les menorquines. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Vists aquests antecedents,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Atesa la proposta de la presidenta del Consell Insular de Menorca,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El Consell Executiu, per unanimitat dels set membres presents &lt;/span&gt;(senyora Mora Humbert, senyor Maria Ballester, senyora Torrent Bagur, senyor Pastrana Huguet, senyora Gomila Carretero, senyor Juaneda Mercadal i senyora Gómez Estévez) &lt;span style="color:#000000"&gt;i en votació ordinària, adopta els acords següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primer.&lt;/strong&gt; Aprovar el Conveni de col·laboració entre el Consell Insular de Menorca i Jazz Obert Associació Al·ligàtors per a la commemoració del 25è aniversari del Menorca Jazz Festival. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segon.&lt;/strong&gt; Comunicar-ho a la Base de Dades Nacional de Subvencions prèviament a la seva publicació en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; (BOIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;ANNEX I&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Conveni entre el Consell Insular de Menorca i Jazz Obert Associació d'Al·ligàtors per la commemoració del 25è aniversari del Menorca Jazz Festival&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Parts&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;D'una part la senyora Susana Mora Humbert, en la representació que exerceix com a presidenta del Consell Insular de Menorca, d'acord amb l'atribució que resulta de l'article 21.1 &lt;em&gt;k &lt;/em&gt;de la Llei 4/2022, de 28 de juny, de consells insulars, i d'acord amb l'article 34.1 &lt;em&gt;b &lt;/em&gt;de la Llei 7/1985, de 2 d'abril, que regula les bases del règim local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;I d'altra part Bernat Casasnovas Benejam, president de Jazz Obert Associació d'Al·ligàtors, amb CIF núm. G07931439.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Totes les parts intervenen en virtut de la representació que per raó dels seus respectius càrrecs assumeixen i es reconeixen mútuament poders i facultats suficients per formalitzar aquest conveni. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Antecedents&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Fa vint-i-cinc anys va néixer Jazz Obert Associació d'Al·ligàtors (d'ara en endavant Jazz Obert) a Ciutadella de Menorca amb la intenció de posar en valor i donar a conèixer el jazz com a gènere musical.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;L'objectiu dels actes a celebrar amb motiu de l'aniversari és la commemoració de l'efemèride posant en valor el festival, la seva història i el seu paper en la societat menorquina en atracar aquest gènere musical a la pluralitat de la població i impulsar la producció dels concerts de la Big Band sorgida dels alumnes de l'Escola de Música de Ciutadella. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Un dels objectius del Consell Insular de Menorca és donar suport a entitats que celebren commemoracions especials i que duen a terme una funció social en benefici del benestar social i la qualitat de vida dels menorquins i les menorquines. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;Ateses les actuals circumstàncies i d'acord amb les competències i interessos&lt;span style="color:#000009"&gt; &lt;/span&gt;concurrents de les entitats que hi participam, manifestam la voluntat de signar&lt;span style="color:#000009"&gt; &lt;/span&gt;aquest conveni d'acord&lt;span style="color:#000009"&gt; &lt;/span&gt;amb els&lt;span style="color:#000009"&gt; &lt;/span&gt;següents&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;Pactes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;Primer.&lt;span style="color:#000009"&gt; &lt;/span&gt;Objecte&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;L'objecte del present conveni és donar suport a Jazz Obert, per un import màxim de 10.000 €, per a la producció del concert de la Big Band sorgida de l'Escola de Música de Ciutadella i la celebració d'un gran concert el 20 de juliol de 2023 a càrrec d'Avishai Cohen, que es durà terme amb motiu del 25è aniversari del Menorca Jazz Festival. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;Segon.&lt;span style="color:#000009"&gt; &lt;/span&gt;Obligacions&lt;span style="color:#000009"&gt; &lt;/span&gt;de&lt;span style="color:#000009"&gt; &lt;/span&gt;les&lt;span style="color:#000009"&gt; &lt;/span&gt;parts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;El Consell Insular de Menorca aportarà a Jazz Obert fins a 10.000 €, amb càrrec a la partida 1-91200-4890016 (Subvencions a entitats menorquines), i efectuarà el pagament al compte corrent a nom de Jazz Obert. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Perquè el pagament de la subvenció es faci efectiu és imprescindible que el beneficiari presenti prèviament els documents justificatius de la realització de l'activitat objecte d'ajut, sense perjudici que es pugui fer un pagament anticipat fins a un import màxim de 3.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;L'ajut del Consell Insular de Menorca és compatible amb altres subvencions públiques o privades que pugui rebre Jazz Obert&lt;span style="color:#000009"&gt;, sempre que la suma de les ajudes percebudes en cap cas superi el cost total de l'activitat subvencionada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;Conformement amb el que preveu l'article 48.5 de la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic, el compromís financer que assumeix el CIM amb aquest conveni és financerament sostenible, perquè la despesa compromesa és a&lt;/span&gt;&lt;span style="color:#000009"&gt;mb&lt;/span&gt;&lt;span style="color:#000009"&gt; càrrec &lt;/span&gt;&lt;span style="color:#000009"&gt;a&lt;/span&gt;&lt;span style="color:#000009"&gt;l &lt;/span&gt;&lt;span style="color:#000009"&gt;P&lt;/span&gt;&lt;span style="color:#000009"&gt;ressupost general de CIM per als 2023, emparada amb crèdit adequat i suficient a la partida 1-91200-4890016.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;&lt;strong&gt;Tercer. Obligacions de l'Associació Jazz Obert&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Jazz Obert&lt;/span&gt;&lt;span style="color:#000009"&gt; es compromet a organitzar les actuacions objecte d'aquest conveni: la producció del concert de la Big Band de l'Escola de Música de Ciutadella i &lt;/span&gt;&lt;span style="color:#000000"&gt;celebració d'un gran concert a càrrec d'Avishai Cohen &lt;/span&gt;&lt;span style="color:#000009"&gt;durant l'any 2023. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;El pressupost de Jazz Obert per a l'organització d'aquestes actuacions és de 28.700 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;L'Associació Jazz Obert assumeix, així mateix, els compromisos següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;a) Fer constar, de manera expressa, el suport del Consell Insular de Menorca, en la realització de les activitats subvencionades. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;b) Proporcionar la informació sobre l'activitat subvencionada que li demani el Consell Insular de Menorca. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;c) Sotmetre's a les actuacions de comprovació que efectuïn el Consell Insular de Menorca i la resta d'organismes competents per a la fiscalització dels comptes públics. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;d) Comunicar al Consell Insular de Menorca la sol·licitud i l'obtenció de subvencions i ajudes per a la mateixa finalitat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;e) Comunicar immediatament al Consell Insular de Menorca qualsevol eventualitat que alteri o que dificulti greument el desenvolupament del projecte subvencionat, en particular si se'n poden derivar retards en l'execució o si poden afectar el cost total, i sol·licitar l'autorització prèvia i expressa del consell insular per fer qualsevol modificació substancial del projecte objecte d'ajuda. Les sol·licituds de modificació han de ser motivades, s'han de formular immediatament a l'aparició de les circumstàncies que la justifiquin i han d'especificar les repercussions pressupostàries que impliquin. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;f) Acreditar, quan el Consell Insular de Menorca li ho sol·liciti, que es troba al corrent de les obligacions tributàries i amb la Seguretat Social. L'acreditació d'estar al corrent de les obligacions tributàries no serà necessària en el cas que s'hagi autoritzat expressament el Consell insular a consultar aquestes dades a través de l'Agència Tributària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;g) Acreditar que no està sotmesa a cap de les circumstàncies que es recullen en l'article 13.2 de la Llei 38/2003, de 17 de novembre, general de subvencions (BOE 276, de 18 de novembre de 2003), i en l'article 10 del Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de subvencions (BOIB núm. 196,d e 31 de desembre de 2005), que determinen la impossibilitat d'obtenir la condició de beneficiari o entitat col·laboradora de les subvencions públiques regulades en l'esmentada llei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;Quart.&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;Justificació del conveni&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;L'Associació Jazz Obert&lt;span style="color:#000009"&gt; es compromet a justificar, en finalitzar les accions emmarcades en aquest conveni i abans del 30 de novembre de 2023, les despeses efectuades amb càrrec a l'ajut rebut, per a la qual cosa ha de presentar al Consell Insular de Menorca un compte justificatiu simplificat que inclogui la informació o la documentació acreditativa següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;- Una memòria d'actuació en què es justifiqui el compliment de les condicions imposades en la concessió de la subvenció, amb indicació de les activitats realitzades i dels resultats obtinguts. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;- Relació de despeses realitzades, amb identificació del creditor, document, import, data d'emissió i data de pagament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;En el cas d'obtenir ingressos o subvencions que hagin finançat l'activitat subvencionada, procedents de qualsevol administració o d'ens públics o privats, el beneficiari ho ha de comunicar al Consell Insular de Menorca, tot fent constar l'import i la seva procedència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Si la documentació presentada és incompleta o incorrecta, el servei responsable demanarà al beneficiari que en faci la rectificació oportuna en el termini improrrogable de deu dies hàbils.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Si la despesa justificada supera l'import concedit, la possible desviació pressupostària anirà a càrrec de l'entitat subvencionada. Si, pel contrari, la despesa justificada és inferior a l'import del pressupost sol·licitat i subvencionat es reduirà proporcionalment la subvenció concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;El Consell Insular de Menorca podrà fer un seguiment de l'ajut concedit i fer les comprovacions que estimi oportunes, que permetin obtenir evidència raonable sobre l'adequada aplicació de l'ajut. A aquest fi podrà requerir al beneficiari que li remeti els justificants de despesa que consideri oportuns. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;Si, un cop transcorregut el termini establert per a la justificació, aquesta no s'ha presentat, s'ha de requerir el beneficiari perquè la presenti en un termini improrrogable de 15 dies. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Cinquè. Seguiment, vigilància, control i execució del conveni.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;Per seguir, vigilar i controlar aquest conveni, i resoldre'n possibles conflictes, cada part designarà un representant. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;Quan les controvèrsies no es resolguin de mutu acord, les qüestions litigioses se sotmetran al coneixement i decisió de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Sisè. Règim de modificació&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;La modificació del contingut del conveni requerirà l'acord unànime de les parts. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Setè. Causes d'extinció del conveni&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Aquest conveni s'extingirà pel compliment de les actuacions que constitueixin el seu objecte o per incórrer en alguna de les causes de resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Són causes de resolució:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;L'acord unànime de tots els signants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;L'incompliment de les obligacions i els compromisos assumits per part d'algun dels signants. &lt;span style="color:#000009"&gt;En aquest cas, qualsevol de les parts pot notificar a la part incomplidora un&lt;span style="color:#000009"&gt; &lt;/span&gt;requeriment perquè compleixi en un termini determinat les obligacions o els&lt;span style="color:#000009"&gt; &lt;/span&gt;compromisos que es consideren incomplerts. Aquest requeriment s'ha de&lt;span style="color:#000009"&gt; &lt;/span&gt;comunicar al responsable del mecanisme de seguiment, vigilància i control&lt;span style="color:#000009"&gt; &lt;/span&gt;de&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;l'execució&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;del&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;conveni&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;i&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;a&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;les&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;altres&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;parts&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;signants.&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;Si,&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;un&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;cop&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;transcorregut el termini indicat en el requeriment, l'incompliment persisteix,&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;la part que va adreçar ha de notificar a les parts signants la concurrència de&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;la&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;causa&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;de&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;resolució&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;i&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;el&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;conveni&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;s'entén&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;resolt.&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;La&lt;/span&gt;&lt;span style="color:#000009"&gt; &lt;/span&gt;&lt;span style="color:#000009"&gt;resolució&lt;span style="color:#000009"&gt; &lt;/span&gt;del&lt;span style="color:#000009"&gt; &lt;/span&gt;conveni&lt;span style="color:#000009"&gt; &lt;/span&gt;per aquesta causa pot comportar la indemnització dels perjudicis causats si&lt;span style="color:#000009"&gt; &lt;/span&gt;així s'ha previst.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Per decisió judicial declaratòria de la nul·litat del conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;La impossibilitat sobrevinguda legal o material de poder dur a terme l'objecte del conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Per denúncia expressa de qualsevol de les parts per a separar-se de forma unilateral del conveni. En aquest cas, s'ha de comunicar per escrit a les altres parts amb una antelació mínima de tres mesos; en qualsevol cas, les parts es comprometen a finalitzar el desenvolupament de les accions ja indicades en el moment de la notificació de la denúncia. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Per qualsevol altra causa distinta prevista en el conveni o en altres lleis. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Vuitè. Revocació i reintegrament&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;1. Pel que fa a la revocació i el reintegrament de les subvencions, s'ha d'aplicar el que disposa la Llei 38/2003, de 17 de novembre, general de subvencions, i la resta de normativa que hi sigui aplicable. En cas d'incompliment, s'haurà de reintegrar la quantia rebuda mitjançant l'aplicació d'un percentatge de minoració en funció de la naturalesa de l'incompliment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Aquest percentatge s'ha de fixar amb l'informe previ del tècnic i s'ha de notificar al beneficiari. Les causes de reintegrament i el procediment per a la seva exigència han de ser regides per l'establert a l'article 44 del DLEG 2/2005,d e 28 de desembre, pel qual s'aprova el Text refòs de la Llei de Subvencions. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;2. S'haurà de valorar, en tot cas, el grau d'incompliment, si aquest s'ha degut a actuacions doloses o negligents, i si hi ha hagut bona o mala fe. La gradació del reintegrament serà major quan l'incompliment sigui total o molt alt i hi hagin incorregut causes doloses i mala fe, i en canvi serà menor si el grau de compliment del projecte subvencionat és parcial i quan hagi estat causat per actuacions negligents i amb bona fe. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;3. En el cas que la causa del reintegrament determini la invalidesa de la resolució de concessió, s'ha de revisar prèviament aquesta resolució en els termes establerts en l'article 25 del DLEG 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions, i en la resta de disposicions aplicades. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Si el beneficiari no fa constar, de manera expressa, el suport del CIM, es minorarà en un 1 % l'import de la subvenció correctament justificada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;4. Les quantitats que s'hagin de reintegrar tenen la consideració d'ingressos de dret públic i els és aplicable la via de constrenyiment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;5. L'obligació de reintegrament que s'estableix en aquest pacte és independent de les sancions que si escau siguin exigibles. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Novè. Règim d'infraccions i sancions administratives&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;1. El règim aplicable és el que s'estableix en el títol V del Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de subvencions. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;2. L'òrgan competent per imposar les sancions que es derivin d'infraccions de l'establert en aquestes bases i de la normativa aplicable en matèria de subvencions és la Presidència del Consell Insular de Menorca, de conformitat amb el que estableix l'art. 21.1 &lt;em&gt;k&lt;/em&gt;&lt;em&gt; &lt;/em&gt;de la Llei 4/2022, de 28 de juny, de consells insulars&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Desè. Liquidació del conveni&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;1. L'incompliment i la resolució del conveni donaran lloc a la seva liquidació a fi de determinar les obligacions i els compromisos de cadascuna de les parts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;2. En el supòsit de convenis dels quals derivin compromisos financers, s'entenen acomplerts quan el seu objecte s'hagi realitzat en els termes i a satisfacció de totes dues parts, d'acord amb les seves competències respectives, tenint en compte les regles següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;a) Si de la liquidació resulta que l'import de les actuacions executades per alguna de les parts és inferior als fons que aquesta hagi rebut de la resta de parts del conveni per finançar l'execució esmentada, aquella ha de reintegrar a aquestes l'excés que correspongui a cada una, en el termini màxim d'un mes des que s'hagi aprovat la liquidació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Si, un cop transcorregut el termini màxim d'un mes esmentat en el paràgraf anterior, no s'ha produït el reintegrament, s'ha d'abonar a les parts esmentades, també en el termini d'un mes comptador d'aquest moment, l'interès de demora aplicable al reintegrament esmentat, que en tot cas és el que resulti de les disposicions de caràcter general reguladores de la despesa&amp;nbsp;pública i de l'activitat economicofinancera del sector públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;b) Si és superior, la resta de parts del conveni, en el termini d'un mes des de l'aprovació de la liquidació, han d'abonar a la part de què es tracti la diferència que correspongui a cadascuna, amb el límit màxim de les quantitats que cadascuna s'hagi compromès a aportar en virtut del conveni. En cap cas les parts del conveni tenen dret a exigir a la resta cap quantia que superi els límits màxims esmentats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;3. No obstant això, si quan hi concorri qualsevol de les causes de resolució del conveni hi ha actuacions en curs d'execució, les parts, a proposta de la comissió de seguiment, vigilància i control del conveni o, si no n'hi ha, del responsable del mecanisme a què fa referència la lletra &lt;em&gt;f &lt;/em&gt;de l'article 49, poden acordar la continuació i l'acabament de les actuacions en curs que considerin oportunes, i establir un termini improrrogable per al seu final, un cop transcorregut el qual se n'ha d'efectuar la liquidació en els termes que estableix l'apartat anterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Onzè. Règim jurídic&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;El règim jurídic aplicable a la present convocatòria és el que queda establert en la normativa següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;- Llei 38/2003, de 17 de novembre, general de subvencions&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;- Decret legislatiu 2/2005, de 28 de novembre, pel qual s'aprova el text refòs de la Llei de subvencions de la comunitat autònoma de les Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;- Reglament de la Llei general de subvencions (Reial decret 887/2006, de 21 de juliol).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;- Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Dotzè. Vigència i pròrroga&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000009"&gt;El present conveni té efectes des del dia que se signi, i estendrà&lt;span style="color:#000009"&gt; &lt;/span&gt;la&lt;span style="color:#000009"&gt; &lt;/span&gt;seva&lt;span style="color:#000009"&gt; &lt;/span&gt;vigència fins al 31 de desembre de 2023 o una vegada acomplertes les obligacions contretes per les parts en aquest document.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Tretzè. Qüestions litigioses i jurisdicció competent&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Les controvèrsies que puguin sorgir en la interpretació i aplicació dels pactes d'aquest conveni les ha de resoldre l'ordre jurisdiccional contenciós administratiu, de conformitat amb el que preveu Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa. No obstant això, les controvèrsies que es puguin plantejar sobre la interpretació i execució del conveni, s'han de dirimir amb caràcter previ pels responsables del seguiment, vigilància i control del conveni designats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;Aquest conveni de col·laboració té naturalesa administrativa i queda exclòs de l'àmbit d'aplicació de la normativa de contractes del sector públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
