    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Al no haver-se presentat cap al·legació durant el termini d'exposició pública contra l'aprovació inicial de reglament d´`us i béns materials de l'Ajuntament d'Estellencs , adoptat pel ple de l'Ajuntament d'Estellencs en sessió ordinària del 11 de gener del 2023, han quedat elevats a definitius l'esmentat acord en idèntics termes que en l'aprovació inicial i en compliment en l'article 17.4 del Text Refós de la Llei Reguladora de les Hisendes Locals, aprovat pel Reial decret legislatiu 2/2004, de 5 de març. &lt;/span&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;REGLAMENT GENERAL D'ÚS D'ESPAIS I BÉNS MATERIALS DE L'AJUNTAMENT D'ESTELLENCS&lt;/span&gt;&lt;/em&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Article 1.- Naturalesa, objecte i àmbit d'aplicació&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;L' objecte d'aquest reglament és l'ordenació dels espais i béns material que ofereix l'Ajuntament d'Estellencs, dins l'àmbit del municipi. &lt;/span&gt;&lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;L'Ajuntament d'Estellencs ofereix espais i material a grups, entitats, associacions, particulars i empreses pel desenvolupament de les seves activitats i projectes. Les activitats a realitzar en els espais de titularitat municipal i l´ús del material s'hauran d'ajustar a la normativa vigent i poden ser de caràcter cultural, esportiu, divulgatiu, de lleure o de reunió sense que en cap cas pugui tractar-se d'activitats que atemptin contra els valors fonamentals d'igualtat, llibertat, tolerància, convivència i democràcia. &lt;/span&gt;&lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;També hauran de ser respectuosos amb la sostenibilitat mediambiental que pretén assolir aquest Ajuntament i amb la normativa europea, estatal i autonòmica en matèria de reducció en la generació de residus. &lt;/span&gt;&lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Article 2.- Normativa aplicable&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;La Llei 7/1985, de 2 d'abril, Reguladora de les Bases de Règim Local, atribueix al municipi la potestat normativa per dictar ordenances dins l'àmbit de les seves competències, i la Llei 20/2006 de 15 de desembre, municipal i de règim local de les Illes Balears, atribueix la potestat reglamentària. &lt;/span&gt;&lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;La utilització dels espais i béns material s'ajustarà al que estableix aquest reglament, sense perjudici de la normativa de caràcter estatal, autonòmica o municipal sobre la matèria, així com les disposicions de les administracions competents, segons l'ordre jeràrquic corresponent i dins les seves respectives competències.&lt;/span&gt;&lt;/em&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Article 3.- Utilització dels espais i béns material municipals &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;3.1 &lt;/strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;La utilització dels espais i béns material disponibles comporta el compliment d'uns requisits mínims i el pagament d'unes taxes i/o fiances aprovades pel ple de l'Ajuntament d'Estellencs. L'import de les tarifes del servei es realitzarà com a mínim, tres dies hàbils abans de celebrar-se l'activitat. No es formalitzarà la reserva sense aquest requisit. El pagament, si no s'especifica una altra cosa, es realitzarà a la tresoreria de l'Ajuntament. A l'hora de recollir el material o les claus de l'espai caldrà facilitar una còpia del pagament realitzat.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;3.2 &lt;/strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;La petició d'espais, així com d'infraestructures, i material, es realitzarà per escrit a l'Ajuntament, emplenant el formulari que es facilitarà. La sol·licitud haurà de cursar-se, com a norma general, amb un mínim de 7 dies hàbils d'antelació. Qualsevol petició suposarà l'acceptació de les condicions mediambientals de reducció, selecció i reciclatge. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;3.3 &lt;/strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;L'Ajuntament donarà resposta a la petició en aproximadament 3 dies hàbils, sempre que sigui possible. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;En els casos que es consideri pertinent per la naturalesa de l'activitat, l'Ajuntament podrà exigir la signatura d'un conveni que reguli amb detall els drets i obligacions d'ambdues parts així com les circumstàncies concretes de la utilització de l'espai i/o material. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;En el cas d'anul·lació d'una reserva o canvi de data, s'haurà de comunicar el més aviat possible. Es retornarà l'import abonat si l'anul·lació es produeix fins a tres dies hàbils abans de l'acte. En cas que s'hagin contractat serveis addicionals i no es puguin retornar, aquests aniran a càrrec del sol·licitant.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;El criteri de prioritat per cedir espai i/o béns material és el d'ordre de registre d'entrada. En el cas de rebre més d'una sol·licitud i que coincideixi en la data i hora de realització de l'acte i/o activitat, es prioritzaran les peticions que procedeixin de l'Ajuntament d'Estellencs i de les entitats del municipi d'Estellencs, que tinguin caire públic, sobre les de particulars. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;3.4 &lt;/strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;El/la sol·licitant indicarà en el full de sol·licitud l'hora exacta d'inici i acabament de l'activitat, i s'inclourà dins el mateix horari el temps dedicat al muntatge i desmuntatge de l'acte, en cas que sigui necessari.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;3.5 &lt;/strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;La cessió d'espais i béns materials per activitats està supeditat a una taxa recollida a l'Ordenança municipal pertinent i en vigor.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;3.6 &lt;/strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;No es permetrà l'ocupació d'un espai o utilització del material per part d'un sol·licitant diferent del que consta en el full de sol·licitud, ni la realització d'una activitat diferent de la descrita en la sol·licitud.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;3.7 &lt;/strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;La cessió d'espais a una mateixa entitat, encara que tingui caràcter periòdic, no suposarà en cap cas la possibilitat d'establir la seu social de l'entitat o grup al centre cedit.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;La reserva de l'espai caldrà ser renovada anualment, mitjançant la sol·licitud establerta.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;El/la sol·licitant d'espais i/o béns materials municipals es compromet a entregar-lo tal i com el va rebre. El/la sol·licitant, doncs, assumeix la responsabilitat de l'acte i dels danys que es puguin ocasionar, tant a les instal·lacions, mobiliari, material i/o persones. L'Ajuntament no es farà càrrec, en cap cas, de les possibles pèrdues d'objectes personals que el sol·licitant pugui patir. Si un espai disposa de material propi, com puguin ser taules o cadires, no farà falta sol·licitar-lo, ja que s'entén que es pot fer ús d'aquest material juntament amb la cessió de l'espai&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;El/la sol·licitant es compromet a respectar la funcionalitat del material autoritzat i fer-ne l'ús al qual estan destinats. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;El/la sol·licitant es compromet a informar de les normes en gestió mediambiental al públic de l'acte. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;3.8 &lt;/strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;En el cas que el/la sol·licitant editi material de difusió de l'acte, no hi podrà aparèixer el logotip ni la imatge institucional de l'Ajuntament d' Estellencs sense la seva autorització prèvia.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;El/la sol·licitant en el cas d'editar material de difusió de l'acte, l'acompanyarà a la sol·licitud de reserva d'espai i es farà responsable de la seva distribució i de l'acompliment de la normativa municipal.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;3.9 &lt;/strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;La durada de la cessió en cap cas serà indefinida; es concretarà l'espai cedit i/o material i el termini de cessió, l'horari d'utilització i l'activitat a realitzar. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Les eventuals pròrrogues s'hauran de convenir entre les parts i es sol·licitaran com a mínim amb deu dies hàbils d'antelació a la finalització del termini de cessió i en cap cas tindran lloc amb caràcter automàtic. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;L'autorització d'ús d'un espai de manera continuada no crearà cap dret, precedent, avantatge o reserva per a anys o usos posteriors a la seva finalització.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;Un mateix espai podrà ser compartit per diversos usuaris, i en aquest cas, l'autorització contemplarà les condicions a complir pel correcte desenvolupament del seu ús pels mateixos.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;3.10 &lt;/strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;En cas de utilització de les instal·lacions per parts d'entitats, clubs o associacions hauran d'estar en possessió de les preceptives assegurances de responsabilitat civil per a aquestes activitats.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;3.11 &lt;/strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;La cessió d'usos d'espais municipals haurà de complir amb les següents condicions mediambientals,&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;- No es podran emprar coberts, tassons o vaixelles d'un sol ús.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;- Es col·locaran les papereres per fraccions i es gestionaran per part de la persona interessada. Les papereres es retiraran de l'espai municipal quan acabi l'acte per la persona que va realitzar la sol·licitud. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;- En acabar l'activitat s'apagaran els llums i els aparells de climatització emprats.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;3.12 &lt;/strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Per a qualsevol supòsit que pugui sorgir i que no quedi recollit al present Reglament, serà resolt d'ofici pel Batlle o persona en qui delegui per la gestió dels espais i material.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;L'Ajuntament podrà reconduir les peticions d'espais cap a altres més idonis.&lt;/span&gt;&lt;/em&gt; &lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Article 4.- Sol·licitud &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;La sol·licitud haurà de cursar-se, com a norma general, amb un mínim de 7 dies hàbils d'antelació i es portarà a terme mitjançant el model normalitzat que estarà a disposició dels interessats en les oficines municipals i en la pàgina web de l'Ajuntament.&lt;/span&gt;&lt;/em&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;S'haurà de fer constar necessàriament: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- &lt;/span&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Identificació del sol·licitant. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- &lt;/span&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Entitat a la qual representa (en el seu cas). &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- &lt;/span&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;En cas de sol·licitar la cessió d'un espai: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;· &lt;em&gt;&lt;span style="line-height:115%"&gt;Espai concret que sol·liciten. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;· &lt;em&gt;&lt;span style="line-height:115%"&gt;Activitat que es realitzarà en l'espai cedit.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;· &lt;em&gt;&lt;span style="line-height:115%"&gt;Horari d'utilització (que inclourà temps de muntatge i desmuntatge de l'acte, en cas que sigui necessari). &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;· &lt;em&gt;&lt;span style="line-height:115%"&gt;Destinataris de l'activitat . &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;· &lt;em&gt;&lt;span style="line-height:115%"&gt;Material extra del que està present a l'espai sol·licitat, en cas que sigui necessari. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- &lt;/span&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;En cas de sol·licitar la cessió de béns material: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;· &lt;em&gt;&lt;span style="line-height:115%"&gt;Material concret que sol·liciten &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;•&lt;em&gt; &lt;/em&gt;Les cessions són per activitats regulars i/o puntuals. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;•Els horaris concedits inclouen el temps necessari per preparar l'activitat i muntar/desmuntar el material si escau.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;•&lt;em&gt; &lt;/em&gt;El servei de cessió d'espai està supeditat a la disponibilitat horària de l'espai.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;•&lt;em&gt; &lt;/em&gt;El/la responsable de la activitat és el/la responsable de la sala, essent l'encarregat/da d'obrir, tancar, apagar llums, de tenir cura del material i de deixar la sala en el mateix estat en què estava. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;•&lt;em&gt; &lt;/em&gt;A l'hora de recollir les escombraries s'ha de separar les deixalles per al seu posterior reciclatge. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- &lt;/span&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Tot usuari te dret a l'ús de les instal·lacions i del material esportiu. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- &lt;/span&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;La inscripció serà personal e intransferible. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- &lt;/span&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;En acabar, es obligatori deixar el material al seu lloc d'origen. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- &lt;/span&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Dins el gimnàs, es obligatori roba i calçat esportiu. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- &lt;/span&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Hauran de fer ús correcte del material i equipament així com de les instal·lacions. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- &lt;/span&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Qualsevol deteriorament per ús inadequat del mateix haurà de ser abonat per la persona que l'ha causat. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- &lt;/span&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;No es permet fumar ni cap substancia estupefaent dins el gimnàs.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- &lt;/span&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;L'usuari es el responsable d'obrir, tancar, apagar llums, tenir cura del material i de deixar la sala en el mateix estat en què estava. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- &lt;/span&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;No cedir a tercers, total o parcialment, de fet o per qualsevol forma admesa en dret, l'ús dels espais cedits i/o bens material.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;· &lt;em&gt;&lt;span style="line-height:115%"&gt;El servei de cessió d'aquest espai està supeditat a l'abonament d'una fiança i/o preu segons Ordenança fiscal reguladora d'ús d'espais i material, que s'haurà d'abonar a l'Ajuntament a l'hora de formalitzar el servei. Aquesta fiança serà retornada, sempre que l'espai es deixi en les mateixes condicions d'ordre i neteja en què es va deixar i una vegada s'hagi comprovat per un treballador municipal i havent complit les condicions mediambientals. &lt;/span&gt;&lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;•&lt;em&gt; &lt;/em&gt;Per casos o situacions concretes es podran cedir altres espais municipals; la cessió s'acompanyarà de la signatura d'un compromís entre l'Ajuntament i la part interessada. L'ocupació sempre serà temporal, prefixada, no suposarà responsabilitat a l'Ajuntament, ni activitats perilloses. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;•&lt;em&gt; &lt;/em&gt;El servei de cessió d'aquests espais estarà supeditat a l'abonament d'una fiança i/o preu segons Ordenança fiscal reguladora d'ús d'espais i material, que s'haurà d'abonar a l'Ajuntament a l'hora de formalitzar el servei. Aquesta fiança serà retornada, sempre que l'espai es deixi en les mateixes condicions d'ordre i neteja en què es va deixar i una vegada s'hagi comprovat que tot és correcte, havent complit les condicions mediambientals. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;•&lt;em&gt; &lt;/em&gt;En concret, en el cas de les bústies ubicades dins l' edifici de la Casa Consistorial, només es podrà accedir a l'horari de l'atenció de l'oficina municipal ( Dilluns a Divendres de 9h a 14h). En cas que es produeixi la pèrdua de la clau de la bústia o algun dany del mateix a causa d'un mal ús per part de l'usuari, aquest haurà d'assumir-ne els costos derivats del mateixos. &lt;/span&gt;&lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Article 6.- Disposicions específiques per a la cessió de béns materials&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&amp;nbsp;• Aquest material s'ha d'usar en funció de les seves característiques. No es pot fer un mal ús de l'equip o fer-lo servir per a una finalitat diferent per la qual està dissenyat.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&amp;nbsp;• Per tal de recollir i retornar l'equip de so, el sol·licitant s'ha de coordinar amb l'Ajuntament. Per això, s'establiran uns horaris de lliurament i recollida que es detallaran en el full d'autorització de recollida de material. Aquest full s'haurà de facilitar a la persona que custodia el material. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;• Sempre que no es compleixin aquests horaris per causa no justificada, s'aplicarà una sanció lleu a l'entitat usuària. En cas de reiteració de sancions lleus, es privarà d'aquest servei en futures ocasions, tal com preveu el règim disciplinari d'aquest Reglament. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&amp;nbsp;• Aquest material s'ha d'usar en funció de les seves característiques. No se'n pot fer un mal ús o fer-lo servir per a una finalitat diferent per la qual està dissenyat. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&amp;nbsp;• S'ha de retornar el material en bon estat de conservació i neteja.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&amp;nbsp;• Els horaris i lloc de recollida i retorn de les carpes es detallaran en el full d'autorització de recollida de material. Aquest full s'haurà de facilitar a la persona que custodia el material.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&amp;nbsp;• Sempre que no es compleixin aquests horaris per causa no justificada, s'aplicarà una sanció lleu a l'entitat usuària. En cas de reiteració de sancions lleus, es privarà d'aquest servei en futures ocasions, tal com preveu el règim disciplinari d'aquest Reglament.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&amp;nbsp;• El servei de cessió temporal d'aquest material està supeditat a l'abonament d'una fiança i/o preu segons Ordenança fiscal reguladora d'ús d'espais i material, que s'haurà d'abonar a l'Ajuntament a l'hora de formalitzar el servei. Aquesta fiança serà retornada, sempre que el material es retorni en les mateixes condicions en què es va deixar i una vegada s'hagi provat pel treballador municipal que el seu funcionament és correcte.&lt;/span&gt;&lt;/em&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;f) Cadafal (escenari) &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;A respectar l'horari fixat per l'Ajuntament en la resolució de cessió.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;A destinar l'espai cedit i/o béns material a les finalitats autoritzades en la resolució de cessió. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;A respectar les quotes o preus autoritzats per l'Ajuntament.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;A respectar la finalitat i destinació dels espais d'ús i el material. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;A no causar molèsties als veïnats ni pertorbar la tranquil·litat de la zona durant els horaris d'utilització adoptant les mesures adients. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;A realitzar la neteja i manteniment de l'espai d'ús cedit i/o bens materials, per tal de tornar l'espai i/o els bens a l'estat previ de la cessió. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;A custodiar les claus de l'espai cedit i tancar-lo quan sigui l'últim en usar-lo, i en cas de pèrdua de les claus, anirà al càrrec del usuari/a la seva reposició. Respecte als béns materials, en cas de disposar de accessoris (comandaments, claus, etç) també hauran de custodiar-los, i en cas de pèrdua, anirà al càrrec del sol·licitant la seva reposició. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;A custodiar les claus d'accés als diferents espais a què tinguin dret i tancar-los. En cas de pèrdua de les claus, anirà a càrrec del usuari/a la seva reposició. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;A no fer còpies de les claus dels accessos i/o de l'espai cedit. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;A vetllar pel bon ús dels espais cedits apagant els llums i aparells electrònics quan no facin servei, tancant finestres i possibles accessos des de l'exterior per raons de seguretat. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;No cedir a tercers, total o parcialment, de fet o per qualsevol forma admesa en dret, sigui o no membre de l'entitat, l'ús dels espais cedits i/o bens material llevat que disposi de l'autorització de l'Ajuntament.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;Quan es tracti de activitats obertes al públic, a no impedir l'entrada de persones per raó de la seva naixença, raça, sexe, religió, opinió o qualsevol altra condició o circumstància personal o social. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;A comunicar a l'Ajuntament qualsevol anomalia, incidència o problema que pugui sorgir i fer-ho amb caràcter immediat en supòsits d'urgència. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;A reintegrar a l'Ajuntament, resolta la cessió i en els terminis establerts la possessió dels espais i béns materials objecte de la cessió en el mateix estat en què es van rebre. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;A permetre en tot moment a l'Ajuntament l'exercici de les facultats de tutela i inspecció, tant pel que fa a l'ús com les activitats que es desenvolupin, facilitant l'accés als diferents espais, proporcionant la informació i documentació que se li requereixi i col·laborant en tot allò que se li sol·liciti. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;En cas d'utilització d'instal·lacions per part d'entitats, clubs o associacions, estar en possessió de les preceptives assegurances de responsabilitat civil per a aquestes activitats.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;A complir les decisions que adopti vàlidament l'Ajuntament &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;A respectar l'aforament de l'espai cedit. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;A complir les disposicions vigents en matèria fiscal, administrativa, laboral, de seguretat social i de prevenció dels riscos laborals, així com altra normativa sectorial d'aplicació i a acreditar-ne el compliment a requeriment municipal. Serà d'obligació dels sol·licitants l'obtenció de les autoritzacions administratives.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;No es permetrà l'ocupació d'un espai ni utilització dels bens materials per part d'un usuari/a diferent al que consta en el full de sol·licitud, ni la realització d'una activitat diferent a la autoritzada. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Per a qualsevol supòsit que pugui sorgir i que no reculli el present Reglament, serà resolt d'ofici per Batllia o per la persona en qui delegui per la gestió dels espais i material.&lt;/span&gt;&lt;/em&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Article 8. Facultats i obligacions de l'Ajuntament&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;L'Ajuntament podrà exercir en qualsevol moment les seves potestats de tutela i inspecció adoptant les decisions que s'escaiguin, essent aquestes d'obligat compliment. L'Ajuntament té les següents obligacions: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;- Conservar en òptimes condicions de salubritat i higiene els espais d'ús comú de cada centre i els béns.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;Efectuar la neteja general de les instal·lacions i béns. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;Efectuar les actuacions pertinents pel manteniment de les instal·lacions i béns. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;Interrompre o suspendre les activitats que infringeixen les normes d'ús establertes en aquest reglament sense cap dret a la devolució de les taxes abonades, en el seu cas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;L'Ajuntament no es farà càrrec en cap cas de les possibles pèrdues d'objectes personals que el sol·licitant pugui patir.&lt;/span&gt;&lt;/em&gt; &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Article 9. Extinció&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;En acabar el seu termini de duració inicial o, si s'escau, les pròrrogues &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;Per mutu acord entre les parts &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;Per desistiment o renúncia del usuari. S'entendrà que s'ha produït el desistiment o renúncia tàcita per la manca d'ús de l'espai i/o material cedit. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;Per incompliment del usuari de les obligacions establertes en aquest reglament &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;−&lt;em&gt; &lt;/em&gt;Per revocació de l'autorització d'ús, que pot acordar en qualsevol moment la Corporació per modificació de les circumstàncies existents en el moment de la concessió o per l'aparició de noves circumstàncies que facin aconsellable la revocació, per l'incompliment dels deures i obligacions establertes en aquest reglament, per raons d'interès públic o per necessitats del propi Ajuntament. &lt;/span&gt;&lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Amb caràcter general la possessió de l'espai i/o bens materials cedits es retornaran a l'Ajuntament el primer dia hàbil següent a la finalització del termini de cessió excepte que l'autorització estableixi una altra cosa. En el cas concret de cessió d'un espai, es retornarà la possessió de l'espai mitjançant l'entrega de claus. En cas contrari el sol·licitant serà responsable dels danys i perjudicis que la demora pugui ocasionar així com les despeses que aquesta comporti a l'Ajuntament que seran de càrrec de la fiança dipositada, en el seu cas.&lt;/span&gt;&lt;/em&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Article 10. Òrgan competent &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;L'Alcalde serà l'òrgan competent per iniciar els procediments sancionadors i imposar les sancions corresponents; la instrucció de l'expedient correspondrà a la persona que estigui al càrrec del servei, departament o unitat que gestiona l'expedient. &lt;/span&gt;&lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Article 11. Responsabilitats&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Seran responsables directes de les infraccions les persones autores materials, sigui per acció o per omissió i seran responsables subsidiaris els sol·licitants dels espais i/o béns cedits en els que s'hagi portat a terme la conducta infractora en cas de no identificar-se la persona autora material. En cas que els infractors siguin menors d'edat o concorri alguna causa d'inimputabilitat respondran pels danys els pares o tutors legals. La declaració de responsabilitat per infracció i la imposició de la sanció corresponent son compatibles amb l'obligació d'indemnitzar els danys i perjudicis causats.&lt;/span&gt;&lt;/em&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Article 12.- Règim disciplinari &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Correspon a la Batllia exercir les activitats de control i adoptar les mesures complementàries, cautelars o correctores que siguin necessàries, així com incoar i resoldre els expedients sancionadors que provinguin d'infraccions al present Reglament.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Els expedients sancionadors es tramitaran d'acord amb el Reglament del règim jurídic del procediment general.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Les infraccions es classifiquen, per la seva entitat, en lleus, greus i molt greus.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) &lt;em&gt;Son infraccions lleus:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;em&gt;Es considerarà lleu, l'incompliment d'algunes de les obligacions dels usuaris, quan la seva conseqüència no doni lloc a la qualificació de greu. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;em&gt;El tracte incorrecte a qualsevol usuari/a, personal, tècnics, etc.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;em&gt;Causar danys lleus de forma involuntària a la instal·lació, material o equipament de les mateixes. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;em&gt;Incompliment d'horaris per causa no justificada.&lt;/em&gt; &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) &lt;em&gt;Son infraccions greus:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;em&gt;La reincidència en incompliments qualificats de lleus. Als efectes d'aquest article, existeix reincidència quan el/la responsable hagi estat sancionat/da per haver comès més d'una infracció lleu en el termini d'un any i les sancions siguin fermes.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;em&gt;El mal tracte de paraula o obra a altres usuaris/es, espectadors/es, professorat, tècnics, empleats/des de la instal·lació, etç.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Causar danys greus de forma voluntària a la instal·lació, material o equipament de les mateixes.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;em&gt;Deixar els llums, aire condicionat, etc en funcionament.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;em&gt;L'abandonament, abocament, vessament o eliminació incontrolats de qualsevol tipus de residus.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;em&gt;Originar per imprudència o negligència accidents greus a un mateix o a altres persones i/o bens.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;em&gt;Superar l'aforament màxim permès a la sala o conjunt de sales autoritzades. &lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;c. Son infraccions molt greus: &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;em&gt;Falsejar intencionadament les dades relatives a la identitat, característiques de l'acte i la suplantació d'identitat.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;em&gt;Cedir a tercers, total o parcialment, de fet o per qualsevol forma admesa en dret, sigui o no membre de l'entitat, l'ús dels espais cedits i/o bens material sense l'autorització de l'Ajuntament.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;em&gt;La reincidència en infraccions greus. Als efectes d'aquest article, existeix reincidència quan el/la responsable hagi estat sancionat/da per haver comès més d'una infracció greu en el termini d'un any i les sancions siguin fermes.&lt;/em&gt; &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Article 13.- Sancions&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La comissió de les infraccions tipificades en l'article anterior serà sancionada de la següent forma:&lt;/em&gt; &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;a) Infraccions lleus: Els incompliments lleus se sancionaran amb prevenció per escrit i/o la pèrdua de la condició usuari/a per un període de 5 a 30 dies i pèrdua de la fiança en el seu cas. &lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;b) Infraccions greus: Els incompliments greus se sancionaran amb la pèrdua de la condició usuari/a per un període comprès entre 30 dies i 6 mesos, i pèrdua de la fiança en el seu cas. &lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;C) Infraccions molt greus: Els incompliments greus se sancionaran amb la pèrdua de la condició usuari/a per un període comprès entre 6 mesos i 2 anys, si la gravetat del mateix ho fes necessari, i pèrdua de la fiança en el seu cas. &lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Es tindran en consideració com a circumstàncies modificadores de la responsabilitat a efectes de la graduació de les sancions les següents: &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&amp;nbsp;a) Transcendència social.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;b) Comportament abusiu de l'infractor.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;c) Quantia global de l'operació que ha estat objecte de la infracció.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;d) Quantia de possible benefici il·lícit.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;e) La reincidència.&lt;/em&gt; &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;DISPOSICIÓ DEROGATÒRIA &lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Queden derogats tots els textos de les ordenances municipals contraris al nou text.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;DISPOSICIÓ FINAL&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;La present ordenança entrarà en vigor el dia següent de la seva publicació en el Butlletí Oficial de la Comunitat Autònoma de les Illes Balears, estant en vigor fins a la seva modificació o derogació expressa.&lt;/span&gt;&lt;/em&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra el present Acord es podrà interposar recurs contenciós administratiu, davant la Sala contenciosa administrativa del Tribunal Superior de Justícia, en el termini de dos mesos a comptar des de l'endemà en la publicació del present anunci, de conformitat amb l'article 46 de la Llei 29/1998, de 13 de juliol, de la Jurisdicció contenciosa administrativa. &amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
