text/html CAIB CAIB 673401 450 2023-05-13 ![CDATA[Resolució del director general de Política Industrial, a proposta del cap del Servei de la UDIT, ITV i Registre Industrial, per la qual s’estableixen les tarifes que han de percebre els laboratoris autoritzats i el laboratori oficial de les Illes Balears per a l’anàlisi i la contrastació d’objectes fabricats amb metalls preciosos corresponents a l’any 2023]] ca ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">En data 5 de maig de 2023, el cap del Servei de la UDIT, ITV i Registre Industrial ha formulat la proposta de resolució següent:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Fets</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1. Les tarifes vigents l'any 2022 que varen percebre els laboratoris autoritzats i el laboratori oficial de les Illes Balears per a l'anàlisi i la contrastació d'objectes fabricats amb metalls preciosos són les aprovades mitjançant la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica publicada en el BOIB número 24, de data 18 de febrer de 2021.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">2. L'article 8 del Decret 86/2009, d'1 de juliol, que desplega el Reglament de la Llei d'objectes fabricats amb metalls preciosos, estableix que és necessari actualitzar anualment aquestes tarifes.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">3. L'article 39 de la Llei 11/2022, de 28 de desembre, de pressuposts generals de la Comunitat Autònoma de les Illes Balears per a l'any 2023, estableix que les quotes fixes de les taxes de la Comunitat Autònoma de les Illes Balears establertes per normes de rang legal s'han de mantenir en la mateixa quantia vigent l'any 2022. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">4. En data 01/12/2022 el Servei de Registre Industrial va sol·licitar al laboratori oficial de les Illes Balears per a l'anàlisi i la contrastació d'objectes fabricats amb metalls preciosos, ITEB, i al Gremi de Joiers i Rellotgers, representats per Quimiotest, un informe sobre les tarifes vigents que perceben els laboratoris de metalls preciosos en altres comunitats autònomes. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">5. En data 10/01/2023 l'ITEB aportà l'informe sol·licitat, número de registre d'entrada GOIBE25267/2023.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">6. En data 30/03/2023, QUIMIOTEST, en nom del Gremi de Joiers i Rellotgers, aportà el seu informe, en mà, a la cap de secció III del Registre Industrial.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Consideracions jurídiques</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1. La Llei 17/1985, d'1 de juliol, sobre objectes fabricats amb metalls preciosos.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">2. El Reial decret 197/1988, de 22 de febrer, pel qual s'aprova el Reglament de la Llei d'objectes fabricats amb metalls preciosos.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">3. El Decret 86/2009, de 27 de novembre, que desplega el Reglament de la Llei d'objectes fabricats amb metalls preciosos. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">4. La Llei 11/2022, de 28 de desembre, de pressuposts generals de la Comunitat Autònoma de les Illes Balears per a l'any 2023.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">5. Els laboratoris autoritzats i el laboratori oficial de les Illes Balears per a la contrastació i el marcatge d'objectes fabricats amb metalls preciosos (en endavant, els laboratoris) han reivindicat en diverses ocasions un increment de l'import en les tarifes a percebre per la seva feina i que l'Administració ha d'autoritzar anualment, en aplicació del Decret 86/2009, de 27 de novembre, de desplegament de la Llei 17/1985, d'1 de juliol, sobre objectes fabricats amb metalls preciosos. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">6. Quan va ser el moment, la Llei 5/2021, de 28 de desembre, de pressuposts generals de la Comunitat Autònoma de les Illes Balears per a l'any 2022, exposà en l'article 39 que les tarifes s'havien de mantenir en la mateixa quantia que l'any 2022, i la Direcció General de Política Industrial va resoldre no incrementar les tarifes dels laboratoris. Anteriorment, la Llei 3/2020, de 29 de desembre, de pressuposts generals de la Comunitat Autònoma de les Illes Balears per a l'any 2021, també havia establert en l'article 39 que les tarifes s'havien de mantenir en la mateixa quantia que l'any 2021, i aquesta Direcció General va resoldre el manteniment dels preus per a anàlisi. Enguany, per tercera vegada consecutiva, la Llei d'aprovació dels pressuposts per a l'any 2023, congela les taxes i, davant això, els laboratoris han traslladat al Servei de Registre Industrial la seva dificultat per a dur a terme la seva feina.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">7. En aquest sentit, els laboratoris assenyalen que tots els costs relacionats amb els processos de l'anàlisi de les peces d'or, plata i platí s'han modificat a l'alça: preu de l'energia i dels equips requerits, així com el seu manteniment dins les exigències de la normativa de metrologia i calibratge vigents, personal qualificat amb titulació acadèmica específica per a les tasques de laboratoris, reactius i material de referència per a proves i valoracions, etc. Atès això, l'import a percebre pel laboratori per la realització de les seves tasques és molt inferior al cost que aquestes tasques originen i les taxes congelades els obliguen a treballar en una situació de pèrdua. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">8. Cal afegir que els preus per les anàlisis en els laboratoris de les Illes Balears són inferiors als de la resta de les comunitats autònomes, tal com es mostra en la taula següent:</span></span></p> <table border="1" class="Table" style="border:solid black 1.0pt; En data 01/12/2022, el Servei de Registre Industrial va requerir dels laboratoris un informe relatiu als costos relacionats amb l'anàlisi i la contrastació d'objectes fabricats amb metalls preciosos. L'informe presentat per l'ITEB en relació amb aquestes qüestions proposa un increment de tarifes per fer sostenible la seva activitat i per equiparar-la amb altres comunitats autònomes. Es troba, per tant, oportú i necessari l'increment dels preus de les tarifes que han de percebre els laboratoris de les Illes Balears en relació amb les seves tasques d'anàlisi de peces d'or i plata en la manera que s'indica en l'annex I d'aquesta proposta.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">10. Quant al platí i als serveis d'assistència a laboratoris i empreses i d'assistència a la intervenció, no està prevista cap modificació.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">11. Així, amb la informació i la documentació rebudes, es proposa l'increment de tarifes a percebre pels laboratoris en les seves tasques d'anàlisi i contrastació segons queda indicat en l'annex I d'aquesta proposta.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Proposta de Resolució</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Propòs al director general de Política Industrial que dicti una resolució en els termes següents:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1. Aprovar les tarifes que consten en l'annex I com a tarifes a percebre pels laboratoris autoritzats i el laboratori oficial de les Illes Balears per l'anàlisi i la contrastació d'objectes fabricats amb metalls preciosos.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">2. Incloure en la resolució la llista de laboratoris autoritzats per a l'anàlisi i la contrastació d'objectes fabricats amb metalls preciosos, així com el laboratori oficial de les Illes Balears, per tal de complir l'article 21 del Decret 86/2009, segons l'annex II d'aquesta proposta.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">3.
