ca CAIB CAIB text/html CAIB ca 460 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>1.</strong> L'Oficina de Prevenció i Lluita contra la Corrupció a les Illes Balears -a partir d'ara "l'Oficina"- va ser creada per la Llei 16/2016, de 9 de desembre. L'article 22.5 de l'esmentada llei estableix que el personal al servei de l'Oficina es regirà pel que disposa aquesta llei i el reglament de règim interior. En tot el que no es prevegi, li és aplicable supletòriament la legislació sobre funció pública del personal al servei de la comunitat autònoma de les Illes Balears. Al seu torn el Reglament de funcionament i règim interior de l'Oficina de Prevenció i Lluita contra la Corrupció a les Illes Balears, aprovat per la Comissió d'Assumptes Institucionals i Generals del Parlament de les Illes Balears, en sessió de dia 21-11-2018 (BOIB núm. 156, de 13-12-2018) estableix en el seu article 63 que el personal al servei de l'Oficina es regeix pel que disposa la Llei 16/2016,&nbsp; de 9 de desembre, per aquest reglament i, en allò no previst, li serà aplicable el règim establert amb caràcter general per al personal al servei de la Sindicatura de Comptes de les Illes Balears.&nbsp; Al seu torn l'article 63.2 del Reglament estableix que la llei autonòmica de funció pública i l'Estatut bàsic de l'empleat públic s'aplicaran supletòriament.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>2.</strong> L'article 16 i següents del Text refós de la Llei de l'Estatut bàsic de l'empleat públic, aprovat pel Reial decret legislatiu 5/2015, de 30 d'octubre —a partir d'ara EBEP—, estableix la carrera professional com el conjunt ordenat d'oportunitats d'ascens i expectatives de progrés professional conforme als principis d'igualtat, mèrit i capacitat.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>3.</strong> Per altra banda, l'avaluació de l'acompliment es fonamenta en l'article 20 de l'EBEP, el qual estableix l'obligació que les administracions públiques estableixin sistemes que permetin avaluar l'acompliment dels seus empleats. Així mateix, l'article 39 de la Llei 3/2007, de 27 de març, de la funció pública de la Comunitat Autònoma de les Illes Balears, disposa l'obligatorietat que les administracions de les Illes Balears implantin progressivament sistemes d'avaluació de l'acompliment del personal al seu servei, com a instrument per a la millora de la motivació, del rendiment i de la qualitat dels serveis públics.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">4.</span></strong><span style="line-height:115%"> El Director de l'Oficina va resoldre en data 20 de juny de 2019 aprovar amb caràcter provisional el sistema de carrera professional horitzontal i l'avaluació del compliment del personal funcionari de carrera de l'Oficina.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>5.</strong>&nbsp; Mitjançant Resolució del Director de l'Oficina, de data 14 de desembre de 2020, es va regular el sistema de carrera professional horitzontal i l'avaluació del compliment del personal funcionari de carrera que hi presta serveis (BOIB núm. 210, de 17-12-2020) en els mateixos termes que l'Acord sobre el model de carrera professional del personal funcionari i laboral al servei dels Serveis Generals de&nbsp; la Comunitat Autònoma de les Illes Balears, així com les seves possibles modificacions i adaptacions. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>6.</strong> Mitjançant Resolució de 30-12-2020 el director de l'Oficina va dictar Resolució per la qual s'aprova la convocatòria ordinària per accedir als diferents nivells que integren la carrera professional horitzontal amb el personal funcionari de l'Oficina (publicada en el <em>Butlletí Oficial de les Illes Balears </em>núm. 216<em> </em>de 31-12-2020), posteriorment modificada per Resolució de 15 de gener de 2021 (publicada en el <em>Butlletí Oficial de les Illes Balears</em> núm. 8, de dia 19-1-2021). En la convocatòria es concreta el sistema d'avaluació de competències professionals centrat en l'avaluació d'objectius, l'avaluació de competències professionals i l'avaluació de desenvolupament personal.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>7.</strong> En data 3-8-2022 es va constituir la Mesa de Negociació de l'Oficina.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>8.</strong>&nbsp; Mitjançant Resolució del director de 8-8-2022 (publicada en el <em>Butlletí Oficial de les Illes Balears</em> núm. 105, de dia 9-8-2022) es va ratificar l'acord de la Mesa de Negociació de l'Oficina, de dia 4-8-2022, pel qual es va aprovar el règim de carrera professional dels funcionaris de l'Oficina en els termes de l'Acord sobre el model de carrera professional horitzontal del personal funcionari i laboral al servei dels Serveis Generals de la Comunitat Autònoma de les Illes Balears, així com les seves possibles modificacions i adaptacions.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>9.</strong> Per completar l'acord anterior cal aprovar el sistema d'avaluació de competències professionals de l'Oficina i regular, als efectes de la carrera professional, els criteris de valoració de les convocatòries ordinàries del procediment d'accés als diferents nivells de carrera professional.</span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>10.</strong> A la Mesa de Negociació de l'Oficina de dia 13-3-2023, prèvia convocatòria de les organitzacions sindicals amb representació a la Mesa de Negociació es va aprovar el sistema d'avaluació de competències professionals que s'ha d'aplicar al personal funcionari de l'Oficina i les bases generals que regiran les convocatòries ordinàries de carrera professional.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>11.</strong> D'acord amb l'article 38 de l'EBEP, els acords s'han de ratificar per l'Administració corresponent. Avaluació de competències professionals</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">L'avaluació de les competències es fonamenta en l'avaluació de les conductes professionals relacionades amb les competències necessàries per desenvolupar les funcions assignades al lloc de treball.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">La definició d'aquestes competències ha de permetre identificar els coneixements, habilitats, actituds i valors necessaris per desenvolupar la feina amb un grau d'eficàcia i eficiència òptim.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Bloc II. font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En aquest apartat es valora la participació en accions formatives encaminades al manteniment, l'actualització i el perfeccionament professional, que imparteix l'Oficina o impartits o homologats per escoles d'administració pública o homologats per aquestes escoles, així com els cursos realitzats en el marc dels acords de formació contínua i per a l'ocupació de les administracions públiques, promoguts per qualsevol administració pública o sindicat.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Així mateix, l'assistència a la formació que realitza el Servei de Prevenció de Riscos Laborals de la Comunitat Autònoma de les Illes Balears també es valora com assistència d'acord amb el nombre d'hores certificat.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">4.7.</span></strong><span style="line-height:115%"> Composició i funcionament del Comitè de Valoració</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El Comitè de Valoració estarà format per tres funcionaris, preferentment caps d'Àrea, i el delegat o delegada de personal, el qual no tindrà dret a vot.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">4.8.</span></strong><span style="line-height:115%"> Llistes provisionals</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Un cop vençut el termini per presentar sol·licituds, es publicarà, a la pàgina web i al tauler d'anuncis de l'Oficina la Resolució del Director, que contindrà les llistes provisionals de persones admeses, de les que han d'esmenar les deficiències de la sol·licitud i de les excloses juntament amb la causa d'exclusió.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Les persones interessades disposaran del termini de deu dies hàbils, a comptar de l'endemà de la publicació de la resolució que conté les llistes provisionals per a esmenar les deficiències i per formular les al·legacions que considerin oportunes contra l'exclusió.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">4.9.</span></strong><span style="line-height:115%"> Llistes definitives</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Resoltes les esmenes i les al·legacions, el director ha de dictar les corresponents resolucions, que contindran les llistes definitives de persones admeses i excloses, especificant la causa de l'exclusió.
