En data &nbsp;</em><em>27</em><em>&nbsp;de </em><em>febrer </em><em>de 20</em><em>2</em><em>1 es va publicar, en el BOIB núm. </em><em>27</em><em>, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova la convocatòria per al</em><em>s </em><em>any</em><em>s</em><em>&nbsp;20</em><em>2</em><em>1</em><em>i 2022</em><em>&nbsp;de les ajudes destinades al </em><em>f</em><em>oment de l'</em><em>a</em><em>gricultura </em><em>e</em><em>cològica.</em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>3.&nbsp;</em><span style="color:#000000"><em>En data 24 de febrer de 2022 es va publicar, en el BOIB núm. 29, una modificació de la Resolució citada anteriorment per la qual s'incrementa el crèdit i es modifica el finançament de la convocatòria, per als anys 2021 i 2022.</em></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>4.&nbsp;</em><span style="color:#000000"><em>En data 2 de juliol de 2022 es va publicar al BOIB núm. 86 la Resolució de concessió de l'ajuda destinada al </em></span></em><em><span style="color:#000000"><em>foment de l'agricultura ecològica.</em></span></em><strong><em>&nbsp;</em></strong><em><span style="color:#000000"><em>Els interessats assenyalats a l'annex adjunt a aquesta Resolució varen presentar, dins el termini establert i en la forma escaient, tota la documentació necessària prevista a la convocatòria, i es va comprovar que complien amb els requisits i d'acord amb els criteris d'elegibilitat de la convocatòria, a aquests beneficiaris els hi corresponia una ajuda màxima detallada a l'annex.</em></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>5.&nbsp;</em><span style="color:#000000"><em>Els òrgans gestors han detectat errors en la concessió de l'ajuda i per tant escau la revisió i s'estima oportú promoure d'ofici la modificació parcial de la resolució de concessió abans esmentada. A l'annex I de la present resolució es detallen els beneficiaris amb la concessió incial de juliol de 2022.</em></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>6.&nbsp;</em><span style="color:#000000"><em>Segons el punt cinquè de la resolució de la presidenta del FOGAIBA, del 25 de febrer de 2021, per la qual s'aprova la convocatòria de l'ajuda al foment de l'agricultura ecològica, la prima màxima anual aplicable al cultiu d'herbacis de regadiu és de 255,60€/ha, mentre que els expedients esmentats al punt anterior tan sols es va aplicar un import de 225,60€/ha. Per tant, l'import concedit als beneficiaris s'ha d'incrementar 30€/ha. A l'annex II apareix l'import anual compromès total i per grup de pagament correcte, així com tots els imports de cofinançament.</em></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>7.&nbsp;</em><span style="color:#000000"><em>L'article 109.2 de la llei 39/2015, d'1 d'octubre de procediment administratiu comú de les administracions públiques, estableix que les administracions públiques, podran, així mateix, rectificar en qualsevol moment, d'ofici o a instància dels interessats, els errors materials, de fet o aritmètics o existents en els seus actes.</em></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>8.&nbsp;</em><span style="color:#000000"><em>Tenint en compte que, a dia d'avui, existeix disponibilitat de crèdit, és possible resoldre aquests expedients sense afectar el que disposa l'apartat setè de la Resolució de la Convocatòria.</em></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>9.&nbsp;</em><span style="color:#000000"><em>Atès tot això, i per tal d'esmenar les errades detectades, es modifica parcialment la resolució de concessió als beneficiaris de les ajudes, de data 2 de juliol de 2022</em></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em>Fonaments jurídics</em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em>1.
