&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. Mitjançant la Resolució de la consellera de Presidència, Funció Pública i Igualtat de 22 de desembre de 2022, es va aprovar la convocatòria, les bases, els exercicis i temari, i el barem de mèrits, i es va designar el Tribunal Qualificador de les proves selectives pel torn lliure i pel torn de promoció interna del personal laboral de Serveis Ferroviaris de Mallorca (BOIB número 167, de 24 de desembre).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2. En data 24 de març de 2023 es va rebre al registre de Serveis Ferroviaris de Mallorca, escrit de la Secretaria General de la Conselleria de Mobilitat i Habitatge on es sol·licitava una redistribució de la composició dels Tribunals de selecció de Serveis Ferroviaris de Mallorca ja que hi havia titulars que figuraven a diferents Tribunals amb la finalitat que només fossin nomenats a un Tribunal per evitar que Departaments de la Conselleria de Mobilitat es veiessin perjudicats per aquest motiu.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;En aquests moments, Serveis Ferroviaris de Mallorca es troba immers en el procés d'estabilització del personal laboral i a causa de la falta de tècnics fixes de l'entitat per formar part dels diferents tribunals, la majoria dels membres dels diferents tribunals ja són funcionaris de la Conselleria d'Adscripció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;A partir de la informació facilitada per la Conselleria de Mobilitat, s'ha procedit a assignar novament a nous funcionaris als diferents Tribunals, substituint aquells funcionaris que han comunicat la impossibilitat de participar en més d'un Tribunal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Així mateix, revisant els membres dels Tribunals que es varen publicar el 24 de desembre de 2022, hi ha diferents motius pels quals s'ha de modificar el nomenament: baixes IT llarga durada, treballadors que es presenten als diferents processos, membres comitè empresa, familiars que estan a la llista d'admesos, personal en situació de jubilació parcial, total o que té a prop (2-3 mesos) la jubilació total o amb algun motiu justificat per no poder formar part el dia de la constitució.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Per la qual cosa s'ha procedit, el dia 31 de març de 2023 a les 9'00h amb la presència d'un membre del Comitè d'Empresa, el departament de Recursos Humans i dos testimonis del departament d'Infraestructures, a realitzar sorteig entre el personal laboral fix, una vegada eliminats aquells treballadors que estan en algunes de les situacions anteriorment esmentades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;En el Butlletí Oficial de les llles Balears de 6 d'abril de 2023 es va publicar una modificació de membres dels Tribunals Qualificadors dels llocs de feina de Responsable d'Àrea, Responsable de material mòbil, Supervisor/a equip Material Mòbil quant al torn de promoció interna. Referent al torn lliure ha afectat a membres del Tribunal Qualificador d'Administratiu.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;En la mateixa resolució es va publicar, així mateix, la composició de la resta dels Tribunals Qualificadors, ja nomenats en la resolució de la convocatòria les proves.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Atesos els motius exposats anteriorment, també es fa necessari modificar la composició d'alguns membres dels Tribunals Qualificadors dels llocs de feina d'Unitat de Supervisió i Intervenció, Inspector d'Operacions, Maquinista, Cap de Maquinistes i Gestor/a d'estacions en el torn de promoció interna, en els termes que es detallen en l'annex 2&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Referent al torn lliure d'aquests processos, el canvi s'ha fet en membres dels Tribunals Qualificadors dels llocs de feina d'Unitat de Supervisió i Intervenció, Gestor/a d'estacions i Maquinistes, en els termes que es detallen en l'annex 1.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. L'article 10 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears, en relació amb l'article 6.3 c) de la Llei 3/2007, de 27 de març, de la funció pública de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2. La Resolució de la consellera de Presidència, Funció Pública i Igualtat per la qual s'aproven la convocatòria, les bases, els exercicis i temari, i el barem de mèrits, i es designa el Tribunal Qualificador de les proves selectives pel torn lliure i pel torn de promoció interna del personal laboral de Serveis Ferroviaris de Mallorca (BOIB núm. 167, de 24 de desembre).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3. El Conveni de col·laboració entre la Conselleria de Presidència, Funció Pública i Igualtat, l'Escola Balear d'Administració Pública (EBAP) i l'entitat Serveis Ferroviaris de Mallorca (SFM) de delegació de la competència per a la convocatòria i la gestió del procés per a la cobertura de places de les ofertes públiques d'ocupació dels anys 2019 i 2020 d'aquest ens públic (BOIB número 167, de 24 de desembre).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Per tot això, i fent ús de les competències que m'atorga de l'article 6.3.&lt;em&gt;c) &lt;/em&gt;de la Llei 3/2007, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. Modificar la composició dels Tribunals Qualificadors de les proves selectives pel torn lliure de les categories de la Unitat de Supervisió i Intervenció, Gestor/a d'estacions i Maquinistes i pel torn de promoció interna de les categories de la Unitat de Supervisió i Intervenció, Inspector d'Operacions, Maquinista, Cap de Maquinistes i Gestor/a d'estacions, del personal laboral de Serveis Ferroviaris de Mallorca convocades per Resolució de la consellera de Presidència, Funció Pública i Igualtat de 22 de desembre de 2022 (BOIB número 167, de 24 de desembre), i designar-ne els nous membres en els termes establerts en els annexos 1 i 2 d'aquesta Resolució. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2. Publicar aquesta Resolució en el Butlletí Oficial de les Illes Balears, &lt;span style="color:#000000"&gt;en el web&lt;/span&gt;&lt;/span&gt; &amp;lt;http://oposicions.caib.es&amp;gt;&lt;span style="line-height:100%"&gt; i a la Seu Electrònica de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant la consellera de Presidència, Funció Pública i Igualtat, en el termini d'un mes comptador a partir de l'endemà que s'hagi publicat la Resolució en el Butlletí Oficial de les Illes Balears, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;També es pot interposar demanda davant la jurisdicció social de Palma en el termini de dos mesos des de la publicació, d'acord amb l'article 10.4 a) i concordants de la Llei 36/2011, de 10 d'octubre, reguladora de la jurisdicció social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
