font-size:12px"><span style="color:black">El Ple de l'Ajuntament de Santa Eulària des Riu, en sessió ordinària<em> </em>de<em> </em>dia 30 de març de 2023, va acordar l'aprovació provisional de l'ordenança reguladora de la prestació patrimonial de caràcter públic no tributari del servei de pàrquing subterrani, amb la redacció que a continuació es recull:</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>“ORDENANÇA REGULADORA DE LA PRESTACIÓ PATRIMONIAL DE CARÀCTER PÚBLIC NO TRIBUTARI DEL SERVEI DE PÀRQUING SUBTERRANI</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTICLE 1. <span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>Fonament i règim jurídic</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fent ús de les facultats contengudes en els articles 133.2 i 142 de la Constitució, l'article 84.1 de la Llei 7/1985, de 2 d'abril, reguladora de les bases del règim local, i de conformitat amb el que disposa l'article 20.6 en relació amb els articles 15 a 19 del text refós de la Llei reguladora de les hisendes locals aprovat pel Reial decret legislatiu 2/2004, de 5 de març, i la disposició addicional primera de la Llei 58/2003, de 17 de desembre, general tributària, aquest Ajuntament estableix la prestació patrimonial no tributària per la prestació de serveis al pàrquing subterrani.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTICLE 2. <span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>Pressupòsit de fet</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Constitueix el pressupòsit de fet de la prestació patrimonial de caràcter públic no tributari, del qual sorgeix l'obligació de pagament, la prestació dels serveis següents:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">-&nbsp;Estada horària per a cotxes i motocicletes tarifada per minut: és la denominada estada per rotació.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">-&nbsp;Estades de durada determinada: són serveis d'aparcament, denominats comercialment abonaments de rotació que permeten l'ús sense limitacions del pàrquing en el període que estableixi el tipus d'abonament.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">-&nbsp;Estacionament de vehicles per a estades de curt/mitjà termini.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">-&nbsp;Servei de rentador.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">-&nbsp;Servei d'aspiració.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">-&nbsp;Servei de verificació de pressió de pneumàtics i inflament.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">-&nbsp;Servei de càrrega de vehicles elèctrics.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">-&nbsp;Equip arrencador de bateries per a cotxes.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">-&nbsp;Servei de lloguer de trasters.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">-&nbsp;Altres serveis. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTICLE 3. <span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>Obligats al pagament</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Estan obligades al pagament les persones físiques i jurídiques així com les entitats a què fa referència l'article 35.4 de la LGT que sol·licitin o resultin beneficiades o afectades pels serveis o utilitzin les instal·lacions esmentades.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTICLE 4. <span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>Responsables</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En relació amb la responsabilitat solidària i subsidiària de les prestacions patrimonials, ha d'atenir-se al que estableixen els articles 41, 42 i 43 de la Llei 58/2003, de 17 de desembre, general tributària, d'acord amb la remissió a aquesta norma efectuada per l'article 10 de la Llei 47/2003, de 26 de novembre, general pressupostària.</span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La prestació del servei, així com els drets i les obligacions bàsiques entre l'entitat prestadora del servei i els usuaris de l'aparcament subterrani i en general totes les normes de gestió de les prestacions patrimonials de caràcter públic no tributari de l'aparcament, s'ajustaran al que estableixi el reglament corresponent del servei i els plecs de condicions del contracte o l'encàrrec de gestió.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTICLE 9. <span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>Recaptació en període executiu</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Finalitzat el termini de pagament de les tarifes en període voluntari sense que hagin estat abonades, s'iniciarà el període executiu, i seran exigides pel procediment de constrenyiment, declaració per a la qual es formalitzarà l'expedient oportú d'acord amb el que preveu el Reglament General de Recaptació vigent.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
