    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El Consell Executiu del Consell Insular d'Eivissa, en sessió ordinària de data 24&lt;span style="color:#000000"&gt; de &lt;/span&gt;&lt;span style="color:#000000"&gt;març&lt;/span&gt;&lt;span style="color:#000000"&gt; de 202&lt;/span&gt;&lt;span style="color:#000000"&gt;3&lt;/span&gt;, va aprovar per unanimitat, l'acord següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;(...)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;PROPOSTA D'ACORD:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;PRIMER.&lt;/strong&gt; &lt;strong&gt;APROVAR i SUBSCRIURE&lt;/strong&gt; el Conveni de col·laboració interadministratiu entre el Consell Insular d'Eivissa i l'Ajuntament d'Eivissa regulador de les condicions que han de regir l'aplicació dels fons que es transferiran, per import &lt;span style="color:#000000"&gt;d'&lt;/span&gt;&lt;span style="color:#000000"&gt;un&lt;/span&gt;&lt;span style="color:#000000"&gt; milió cinc-cents mil euros (&lt;/span&gt;&lt;span style="color:#000000"&gt;1.500.000 €&lt;/span&gt;&lt;span style="color:#000000"&gt;) &lt;/span&gt;&lt;span style="color:#000000"&gt;corresponents a l'anualitat&lt;/span&gt;&lt;span style="color:#000000"&gt; 2022&lt;/span&gt; en el marc dels objectius determinats en el si del Consell de Capitalitat, que es concreten en les següents actuacions: l&lt;span style="color:#000000"&gt;a contractació dels serveis d'una assistència tècnica per &lt;/span&gt;&lt;span style="color:#000000"&gt;a &lt;/span&gt;&lt;span style="color:#000000"&gt;la redacció de l'avantprojecte i l'elaboració del full de ruta dels treballs necessaris per poder portar a terme la reforma de la carretera E-10 completa &lt;/span&gt;&lt;span style="color:#000000"&gt;(&lt;/span&gt;&lt;span style="color:#000000"&gt;100.000 €) i &lt;/span&gt;&lt;span style="color:#000000"&gt;l&lt;/span&gt;&lt;span style="color:#000000"&gt;a construcció d'un Mini-Estadi &lt;/span&gt;&lt;span style="color:#000000"&gt;de&lt;/span&gt;&lt;span style="color:#000000"&gt; Futbol &lt;/span&gt;&lt;span style="color:#000000"&gt;a &lt;/span&gt;&lt;span style="color:#000000"&gt;"&lt;/span&gt;&lt;span style="color:#000000"&gt;Es Puxet&lt;/span&gt;&lt;span style="color:#000000"&gt;"&lt;/span&gt;&lt;span style="color:#000000"&gt;, a la zona de Can Escandell Eivissa (1.400.000€)(csv 14161355200731341134).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;SEGON. APROVAR I DISPOSAR &lt;/strong&gt;la despesa màxima&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;d'&lt;/span&gt;&lt;span style="color:#000000"&gt;un&lt;/span&gt;&lt;span style="color:#000000"&gt; milió cinc-cents mil euros &lt;/span&gt;&lt;span style="color:#000000"&gt;(&lt;/span&gt;&lt;span style="color:#000000"&gt;1.500.000&lt;/span&gt;&lt;span style="color:#000000"&gt; €&lt;/span&gt;&lt;span style="color:#000000"&gt;)&lt;/span&gt;&lt;span style="color:#000000"&gt; en concepte de&lt;/span&gt;&lt;span style="color:#000000"&gt; transferència a &lt;/span&gt;&lt;span style="color:#000000"&gt;l'A&lt;/span&gt;&lt;span style="color:#000000"&gt;juntament d'Eivissa amb NIF P0702600H, en compliment de la &lt;/span&gt;&lt;span style="color:#000000"&gt;L&lt;/span&gt;&lt;span style="color:#000000"&gt;lei &lt;/span&gt;&lt;span style="color:#00000a"&gt;16/2019, de 8 d'abril, de l'&lt;/span&gt;&lt;span style="color:#00000a"&gt;E&lt;/span&gt;&lt;span style="color:#00000a"&gt;statut especial de la capitalitat de la ciutat d'&lt;/span&gt;&lt;span style="color:#00000a"&gt;E&lt;/span&gt;&lt;span style="color:#00000a"&gt;ivissa &lt;/span&gt;&lt;span style="color:#00000a"&gt;anualitat 2022&lt;/span&gt;&lt;span style="color:#00000a"&gt;,&lt;/span&gt;&lt;span style="color:#000000"&gt; amb càrrec a la partida 9420 7620002 &lt;/span&gt;&lt;span style="color:#000000"&gt;amb retenció de crèdit núm. 2/2023000001032 &lt;/span&gt;&lt;span style="color:#000000"&gt;de 3 de març de 2023&lt;span style="color:#000000"&gt; &lt;/span&gt;del pressupost de l'exercici corrent, de conformitat amb la clàusula tercera del conveni. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;TERCER. APROVAR&lt;/strong&gt; la despesa&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;anticipada, a &lt;/span&gt;&lt;span style="color:#000000"&gt;favor de l'Ajuntament d'Eivissa per un import màxim &lt;/span&gt;&lt;span style="color:#000000"&gt;d'un milió cinc-cents mil euros&lt;/span&gt;&lt;span style="color:#000000"&gt; (&lt;/span&gt;&lt;span style="color:#000000"&gt;1.500.000&lt;/span&gt;&lt;span style="color:#000000"&gt; €),&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;corresponent al 100% de l'import de la &lt;/span&gt;&lt;span style="color:#000000"&gt;transferència de conformitat amb la clàusula tercera del conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;QUART. DELEGAR&lt;/strong&gt; en la consellera executiva del Departament de Promoció Econòmica i Empresarial, i Cooperació Municipal, &lt;/span&gt;&lt;span style="color:#000000"&gt;l'aprovació de l&lt;/span&gt;&lt;span style="color:#000000"&gt;es&lt;/span&gt;&lt;span style="color:#000000"&gt; justificaci&lt;/span&gt;&lt;span style="color:#000000"&gt;ons que derivin de l'execució de les actuacions previstes en el conveni de referència,&lt;/span&gt;&lt;span style="color:#000000"&gt; de &lt;/span&gt;&lt;span style="color:#000000"&gt;les quals en donarà compte al Consell Executiu. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;D'una banda, el senyor Vicent Marí Torres, president del Consell Insular d'Eivissa per nomenament del Ple reunit en sessió extraordinària de 5 de juliol de 2019, en nom i representació d'aquesta entitat, en virtut de les atribucions que li confereixen l'article 9 de la Llei 8/2000, de 25 d'octubre de consells insulars; els articles 34 i 41.3 de la Llei 7/1985, de 2 d'abril, que regula les bases de règim local, i l'art. 52 del Reglament orgànic d'aquesta corporació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;De l'altra, el senyor Rafael Ruiz González, alcalde de l'Ajuntament d'Eivissa per nomenament del Ple de 15 de juny de 2019, en nom i representació d'aquesta entitat, actuant en virtut de les facultats previstes a l'article 21.1.b) de la Llei 7/85, de 2 d'abril, reguladora de les bases de règim local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;ANTECEDENTS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1. &lt;/strong&gt;El dia 26 de març del 2019, el Parlament de les Illes Balears, va aprovar la Llei 16/2019, de 8 d'abril, de l'estatut especial de la capitalitat de la ciutat d'Eivissa, que es va publicar en el Butlletí Oficial de les Illes Balears (BOIB núm. 48, de 13 d'abril de 2019).&lt;span style="color:#000000"&gt; El 14 d'abril de 2019 va entrar en vigor amb l'objectiu de reconèixer i regular l'estatut de capitalitat de la ciutat d'Eivissa, com a seu de les principals institucions insulars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;A l'exposició de motius de la Llei abans referida es reconeix que la ciutat d'Eivissa suporta una sèrie d'obligacions, és a dir, que la particular posició d'Eivissa a l'illa fa que la pressió sobre el pressupost municipal sigui incomparablement superior a la d'altres municipis de població similar que no han d'assumir determinades obligacions que Eivissa sí suporta, i, per això, la Llei té per objecte reconèixer i regular l'estatut especial de capitalitat de la ciutat d'Eivissa, com a seu de les principals institucions insulars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Així mateix, l'article 7 de l'esmentada Llei, disposa la creació d'un Consell de Capitalitat i assenyala el següent:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;«1. Es crea el Consell de Capitalitat com a òrgan col·legiat de caràcter permanent, l'objecte del qual és la coordinació entre el Govern de les Illes Balears, el Consell Insular d'Eivissa i l'Ajuntament d'Eivissa en allò que n'afecta les competències i responsabilitats derivades del fet de la capitalitat de l'illa d'Eivissa, com també les competències que s'estimin d'interès concurrent entre les tres administracions.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;2. Correspondrà al Consell de Capitalitat l'estudi i la proposta de criteris de finançament i, si s'escau, de mesures financeres».&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En relació amb el finançament, l'article 12 de la Llei esmentada disposa:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;«1. Sense perjudici dels recursos que integren la hisenda municipal d'Eivissa, s'estableix un mecanisme especial de finançament destinat a garantir la cobertura dels costos econòmics i socials derivats de la condició de capitalitat d'Eivissa.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. Els pressuposts generals de la comunitat autònoma i els del Consell Insular d'Eivissa hauran d'incloure una consignació específica per a inversions territorialitzades en el municipi d'Eivissa. La quantitat total de la inversió anual es determinarà conforme a l'estudi i la valoració de costs esmentada a l'article 10.b) anterior, i s'aplicarà segons els objectius que es determinin en el si del Consell de Capitalitat».&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.&lt;/strong&gt;&lt;/span&gt; &lt;span style="color:#000000"&gt;En&lt;/span&gt; la sessió de data 20 de novembre de 2019&lt;span style="color:#000000"&gt;, el Consell de Capitalitat, en compliment d'allò establert &lt;/span&gt;&lt;span style="color:#000000"&gt;en&lt;/span&gt;&lt;span style="color:#000000"&gt; la disposició addicional primera de la Llei 16/2019, de 8 d'abril, de l'&lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#000000"&gt;statut &lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#000000"&gt;special de la &lt;/span&gt;&lt;span style="color:#000000"&gt;C&lt;/span&gt;&lt;span style="color:#000000"&gt;apitalitat de la ciutat d'Eivissa, va aprovar, per unanimitat, “(...) &lt;/span&gt;&lt;span style="color:#000000"&gt;no elaborar ara el nou estudi econòmic previst a la disposició addicional única de la Llei, donant-se per vàlid l'estudi econòmic que es va utilitzar per a l'elaboració de la Llei, i la quantia de 5 milions d'euros anuals que consta &lt;/span&gt;&lt;span style="color:#000000"&gt;en&lt;/span&gt;&lt;span style="color:#000000"&gt; la disposició transitòria única de la mateixa fins a l'any 2022&lt;/span&gt;, acordant-se que a principis de l'any 2022, el Consell de Capitalitat haurà d'elaborar un nou estudi d'avaluació de costs.”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3.&lt;/strong&gt; La Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local, en el seu article 36, estableix que és competència de les diputacions o entitats equivalents, com és el cas dels Consells Insulars d'acord amb l'article 41 de l'esmentada llei, l'assistència i la cooperació jurídica, econòmica i tècnica als municipis, així com la cooperació en el foment del desenvolupament econòmic i social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4.&lt;/strong&gt; La Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic, estableix en el seu article 47.1 que són convenis els acords amb efectes jurídics adoptats per les administracions públiques, els organismes públics i entitats de dret públic vinculats o dependents o les universitats públiques entre si o amb subjectes de dret privat per a una finalitat comuna.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5.&lt;/strong&gt; Altrament, en el marc dels principis generals que han de regir les relacions entre les diferents administracions públiques de la dita Llei 40/2015, d'1 d'octubre, es disposa a l'article 3 que les administracions públiques, en les seues relacions, es regeixen pels principis de cooperació, col·laboració i coordinació, i en la seua actuació, pels criteris d'eficàcia i servei efectiu als ciutadans.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6. &lt;/strong&gt;La Llei 4/2022, de 28 de juny, de consells insulars(BOIB núm. 88 de 7 de juliol de 2022), en l'article 102 de la &lt;em&gt;Secció 3ª Competències pròpies en relació amb els municipis i altres entitats locals, del TÍTOL VII, &lt;/em&gt;estableix com a competències pròpies dels consells insulars, entre d'altres:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;«b) L'assistència i la cooperació jurídica, econòmica i tècnica, especialment als de menor capacitat econòmica i de gestió (...)&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;e) La col·laboració en el desenvolupament econòmic i social dels municipis, així com la planificació municipal».&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Així mateix, la llei 4/2022, de 28 de juny, de consells insulars, en el seu article 117, sobre «Relacions Interadministratives», preveu que, els consells insulars es relacionin amb la resta d'administracions públiques d'acord amb els principis establerts en la legislació bàsica de l'Estat, i especialment els de lleialtat institucional, respecte a l'autonomia, col·laboració, cooperació i coordinació. Per altra banda, l'article 120, estableix en el seu apartat 1, que d'acord amb la legislació bàsica del l'Estat, els consells insulars i les seves entitats instrumentals poden subscriure convenis amb subjectes de dret públic i privat, sense que això impliqui cessió de la titularitat de la competència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;Atesos els acords adoptats pel Consell de la capitalitat els dies 8 d'abril i 20 d'octubre del 2022 i a&lt;/span&gt;&lt;span style="color:#00000a"&gt; &lt;/span&gt;&lt;span style="color:#00000a"&gt;la sol·licitud de l'Ajuntament d'Eivissa de data &lt;/span&gt;&lt;span style="color:#00000a"&gt;14 &lt;/span&gt;&lt;span style="color:#00000a"&gt;de &lt;/span&gt;&lt;span style="color:#00000a"&gt;novembre &lt;/span&gt;&lt;span style="color:#00000a"&gt;de 2022&lt;/span&gt;&lt;span style="color:#00000a"&gt;,&lt;/span&gt;&lt;span style="color:#00000a"&gt; &lt;/span&gt;&lt;span style="color:#00000a"&gt;la consellera &lt;/span&gt;&lt;span style="color:#00000a"&gt;executiva de&lt;/span&gt;&lt;span style="color:#00000a"&gt;l Departament de&lt;/span&gt;&lt;span style="color:#00000a"&gt; Promoció Econòmica i Empresarial, i Cooperació Municipal,&lt;/span&gt;&lt;span style="color:#00000a"&gt; &lt;/span&gt;&lt;span style="color:#00000a"&gt;va &lt;/span&gt;&lt;span style="color:#00000a"&gt;dicta&lt;/span&gt;&lt;span style="color:#00000a"&gt;r&lt;/span&gt;&lt;span style="color:#00000a"&gt; &lt;/span&gt;&lt;span style="color:#00000a"&gt;una &lt;/span&gt;&lt;span style="color:#00000a"&gt;providència &lt;/span&gt;&lt;span style="color:#00000a"&gt;disposant&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;l&lt;/span&gt;&lt;span style="color:#000000"&gt;'inici de l'expedient administratiu &lt;/span&gt;&lt;span style="color:#000000"&gt;per a la celebració d'un&lt;/span&gt;&lt;span style="color:#000000"&gt; conveni &lt;/span&gt;&lt;span style="color:#000000"&gt;de col·laboració &lt;/span&gt;&lt;span style="color:#000000"&gt;interadministratiu,&lt;/span&gt;&lt;span style="color:#000000"&gt; per a la &lt;/span&gt;&lt;span style="color:#000000"&gt;t&lt;/span&gt;&lt;span style="color:#000000"&gt;ransferència a l'Ajuntament d'Eivissa &lt;/span&gt;&lt;span style="color:#000000"&gt;d'&lt;/span&gt;&lt;span style="color:#000000"&gt;un milió cinc-cents mil euros&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;(&lt;/span&gt;&lt;span style="color:#000000"&gt;1.500.000 €&lt;/span&gt;&lt;span style="color:#000000"&gt;)&lt;/span&gt;&lt;span style="color:#000000"&gt;, per mor de la Llei 16/2019, de 8 d'abril, de l'&lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#000000"&gt;statut especial de capitalitat de la ciutat d'Eivissa &lt;/span&gt;&lt;span style="color:#000000"&gt;per a l'any 202&lt;/span&gt;&lt;span style="color:#000000"&gt;2&lt;/span&gt;&lt;span style="color:#000000"&gt;, &lt;/span&gt;&lt;span style="color:#000000"&gt;i&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;per &lt;/span&gt;&lt;span style="color:#000000"&gt;a&lt;/span&gt;&lt;span style="color:#000000"&gt;l finançament &lt;/span&gt;&lt;span style="color:#000000"&gt;de &lt;/span&gt;&lt;span style="color:#000000"&gt;les següents actuacions&lt;/span&gt;&lt;span style="color:#000000"&gt;: &lt;/span&gt;&lt;span style="color:#000000"&gt;«&lt;/span&gt;&lt;span style="color:#000000"&gt;La contractació dels serveis d'una assistència tècnica per la redacció del avantprojecte i la elaboració de la fulla de ruta dels treballs necessaris per poder portar a terme la reforma de la carretera E-10 completa &lt;/span&gt;&lt;span style="color:#000000"&gt;(&lt;/span&gt;&lt;span style="color:#000000"&gt;100.000€) i per a &lt;/span&gt;&lt;span style="color:#000000"&gt;La construcció d'un Mini-Estadi &lt;/span&gt;&lt;span style="color:#000000"&gt;de &lt;/span&gt;&lt;span style="color:#000000"&gt;Futbol &lt;/span&gt;&lt;span style="color:#000000"&gt;a &lt;/span&gt;&lt;span style="color:#000000"&gt;«&lt;/span&gt;&lt;span style="color:#000000"&gt;Es Puxet&lt;/span&gt;&lt;span style="color:#000000"&gt;», a la zona de Can Escandell Eivissa (1.400.000 €)».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7.&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;Pel que fa a la competència per aprovar aquest Conveni, de conformitat amb l'establert al Decret de Presidència núm. 2019000484, de data 16-7-2019, de determinació de les atribucions corresponents als diferents òrgans del Consell Insular d'Eivissa (BOIB núm. 98 EXT., de 17-7-2020; modificacions al BOIB núm. 175, de 31-12-2019, BOIB núm. 101, de 4-6-2020 i al BOIB núm. 153, de 5 de setembre de 2020), correspon al Consell Executiu «Aprovar els convenis amb altres entitats públiques o privades la quantia dels quals superi els quinze mil euros (15.000 €)».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Tenint en compte tot l'anterior i, en observació dels principis de cooperació, col·laboració i coordinació, i en la seua actuació pels criteris d'eficàcia i servei efectiu als ciutadans, que han de regir les relacions de les administracions públiques, ambdues administracions, de comú acord i en observació de la imposició de la Llei 16/19, de 8 d'abril, de l'estatut de capitalitat de la ciutat d'Eivissa, acorden regular les condicions que han de regir l'aplicació dels fons a percebre per l'Ajuntament d'Eivissa, provinents del Consell Insular d'Eivissa a les actuacions que conformen l'objecte del present conveni de col·laboració.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Les parts es reconeixen mútuament la capacitat necessària per formalitzar aquest Conveni de conformitat amb els següents&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;​​​​​​​&lt;/strong&gt;&lt;strong&gt;CLÀUSULES&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1.- OBJECTE DEL CONVENI&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L'objecte del present conveni és regular les condicions que han de regir l'aplicació dels fons a percebre per l'Ajuntament d'Eivissa, provinents del Consell Insular d'Eivissa a les actuacions que es descriuen a continuació, en el marc dels objectius determinats en el si del Consell de Capitalitat, que es concreten en:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;- La contractació dels serveis d'una assistència tècnica per a la redacció del avantprojecte i la elaboració de la fulla de ruta dels treballs necessaris per poder portar a terme la reforma de la carretera E-10 completa, per import de 100.000 €.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;2.- PERÍODE DE VIGÈNCIA&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La vigència d'aquest conveni serà fins l'exhauriment de les actuacions que conformen el seu objecte així com la seua justificació, amb una vigència màxima de quatre anys des de la seua formalització.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3.- OBLIGACIONS DE LES PARTS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Les parts ens comprometem amb caràcter general a executar els compromisos que seguidament s'estableixen, de conformitat amb els principis de bona administració, bona fe i de conformitat amb la normativa vigent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;3.1.&lt;strong&gt; OBLIGACIONS DE L'AJUNTAMENT&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;a) L'Ajuntament haurà de dur a terme les actuacions, contractacions i obres descrites en l'objecte del present conveni (clàusula 1) i que foren determinades en el si del Consell de Capitalitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;b) Justificar davant el Consell Insular d'Eivissa la realització efectiva de les actuacions i contractacions així com l'execució de les obres objecte del present conveni, en la forma establerta en la clàusula cinquena del present document.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3.2.&lt;/span&gt;&lt;strong&gt; OBLIGACIONS DEL CONSELL&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El Consell Insular d'Eivissa es compromet a realitzar l'aportació econòmica d'un milió cinc-cents mil euros (1.500.000 €), que tendrà caràcter de màxima, a favor de l'Ajuntament d'Eivissa, amb càrrec a l'aplicació pressupostària 9420.7620002 corresponent a l'exercici pressupostari 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3.3. &lt;/span&gt;&lt;strong&gt;P&lt;span style="color:#00000a"&gt;AGAMENT I JUSTIFICACIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;El pagament es formalitzarà de forma anticipada en un 100% de l'import màxim, tal i com es detalla a continuació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#00000a; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El pagament d'1.500.000 € es realitzarà una vegada signat el conveni i realitzades les actuacions administratives corresponents per efectuar el dit pagament.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4.- MECANISMES DE SEGUIMENT DE L'EXECUCIÓ I COMPLIMENT DELS COMPROMISOS DE LES PARTS. COMISSIÓ TÈCNICA I DE SEGUIMENT&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;D'acord amb l'article 49, apartat f), de la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic, el seguiment, vigilància i control de l'execució d'aquest conveni de col·laboració així com la resolució dels problemes d'interpretació i compliment que puguin plantejar-se, es realitzarà per part d'una comissió tècnica i de seguiment. En aquest sentit, qualsevol de les parts podrà promoure una reunió de la comissió quan així s'estimi oportú.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La Comissió estarà integrada per dos representants de cadascuna de les entitats que signen el conveni, sent un dels representants del Consell Insular el/la president/a de la mateixa, amb el corresponent vot de qualitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Correspon a la Comissió de seguiment la valoració de les accions derivades del conveni, així com la resolució dels problemes d'interpretació i de compliment que poguessin plantejar-se.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#00000a; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El funcionament d'aquesta Comissió es regirà pel que es disposa en aquest conveni i per les normes aplicables als òrgans col·legiats de les administracions públiques en la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;La Comissió es reunirà per realitzar el seguiment de les actuacions dutes a terme per cadascuna de les parts i determinarà els possibles incompliments que puguin derivar en la resolució del conveni respecte a la part incomplidora realitzant els requeriments que s'estimin pertinents. Així mateix, la Comissió podrà recavar assessorament extern en cas de considerar-ho necessari.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;De les celebracions d'aquesta Comissió s'estendrà un acta on s'hi farà constar el resultat motivat de les seues valoracions.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Conformaran aquesta Comissió tècnica i de seguiment els membres següents:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Per part del Consell Insular d'Eivissa:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- María Fajarnés Costa, consellera executiva del Departament de Promoció Econòmica i Empresarial, i Cooperació Municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Concepción Rebollo Laserna, cap de Servei de Presidència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#1c1c1c"&gt;Per part de l'Ajuntament d'Eivissa:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;- Rafael Ruiz González, alcalde.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#333333"&gt;- &lt;/span&gt;Elena López Bonet, primera tinent d'alcalde.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Les parts que subscriuen aquest conveni de col·laboració es comprometen a intentar resoldre en comú les diferències que puguin sorgir en l'aplicació i la interpretació del mateix i a resoldre de manera amistosa qualsevol desacord que pugui sorgir en el seu desenvolupament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Si això no és possible, les qüestions litigioses que puguin afectar la interpretació i l'execució d'aquest conveni han de ser del coneixement i de la competència de l'ordre jurisdiccional contenciós administratiu.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;5.- JUSTIFICACIÓ&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L'Ajuntament haurà de justificar les actuacions, contractacions, obres i inversions executades. La justificació de les despeses imputades es realitzarà mitjançant informe de l'interventor/a, certificat pel secretari/ària de l'Ajuntament, acreditant de manera detallada, les despeses realitzades i incloent tota la documentació relativa a les actuacions dutes a terme i, en qualsevol cas, abans de la finalització de la vigència del present conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6.- REVISIÓ I MODIFICACIÓ DEL CONVENI&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Els termes d'aquest conveni podran ser revisats i qualsevol modificació dels termes del present conveni, haurà de ser aprovada per les parts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;La substitució de les actuacions, contractacions i obres incloses en el present conveni per unes altres haurà de ser acordada en el si del Consell de Capitalitat i sotmesa a la valoració i autorització expressa, si pertoca, per part del Consell Insular d'Eivissa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7.- RESOLUCIÓ I EXTINCIÓ DEL CONVENI&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Seran causes de resolució del conveni, a més de la determinada per la seua vigència, les següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- El compliment del mateix.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Transcurs del temps previst com a durada màxima del present conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Denúncia del conveni per qualsevol de les parts feta amb un mínim de tres mesos d'anticipació a&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;la data prevista d'extinció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Per acord de les parts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Per les causes generals establertes per la legislació vigent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L'incompliment de qualsevol de les parts de les obligacions establertes en aquest conveni podrà ser causa de resolució del mateix.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En el cas de divergència sobre la interpretació i/o execució de les clàusules d'aquest conveni marc, les parts, renunciant al seu fur propi, si en tinguessin, es sotmeten a la competència dels Jutjats i Tribunals de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8.- REINTEGRAMENT I REVOCACIÓ DE L'AJUDA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;8.1. En el supòsit de l'incompliment de l'obligació de justificar la finalitat de l'aportació econòmica rebuda a la que es refereix el present conveni en la forma i els terminis establerts a tal efecte, el &lt;span style="color:#000000"&gt;la&lt;/span&gt; &lt;span style="color:#000000"&gt;Comissió de seguiment&lt;/span&gt; determinarà el grau d'incompliment material i iniciarà el corresponent procediment de reintegrament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;8.2. En cas de reintegrament total o parcial pertocarà aplicar els interessos de demora que correspongui, d'acord amb la normativa aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El reintegrament es realitzarà pel procediment regulat per les disposicions generals sobre procediments administratius contingudes en el títol IV de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, en el qual s'ha de garantir l'audiència a les entitats interessades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;9.- RÈGIM JURÍDIC&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El present conveni no té caràcter contractual sinó que articula col·laboració interadministrativa, i s'ha de regir per les seues clàusules, i en tot allò no previst en el present Conveni, per la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic, la Llei lei 16/2019, de 8 d'abril, de l'estatut especial de capitalitat de la ciutat d'Eivissa (BOIB núm.48 de 13 d'abril de 2019), i la resta de normativa que li resulti d'aplicació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;10.- PUBLICITAT DEL CONVENI&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El present Conveni es publicarà en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; i al Portal de Transparència del Consell &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;(http://transparencia.conselldeivissa.info)&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;, de conformitat amb l'establert als articles 5.4 i 8.1 de la Llei 19/2013, de 9 de desembre, de transparència, accés a la informació pública i bon govern.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Com a mostra de conformitat, ambdues parts signen aquest conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
