![CDATA[<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El gerent de Patronat Municipal de l'Habitatge i de la Rehabilitació Integral de Barris, &nbsp;per decret número HAB202300071 de data 23 de març &nbsp;de 2023,&nbsp; ha resolt &nbsp;el següent:</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Primer.- </strong>Aprovar la llista provisional de persones admeses i excloses per prendre part a la convocatòria del procés excepcional d'estabilització per a la cobertura d'1 plaça de Tècnic/a Superior en Economia com a personal laboral del Patronat Municipal de l'Habitatge i Rehabilitació Integral de Barri pel sistema de selecció de concurs, dotada pressupostàriament i&nbsp; corresponent a l'oferta&nbsp; pública d'estabilització&nbsp; de l'any 2021, publicada al BOIB núm.&nbsp; 50 de data 14 d'abril de 2022, en els termes establerts a <strong>l'Annex I </strong>i<strong> l'Annex II.</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Segon.- </strong>Per esmenar el possible defecte o presentar els documents que siguin preceptius, les persones excloses o omeses disposen d'un termini de 7 dies hàbils, comptats des de l'endemà de la publicació de la relació de persones admeses i excloses al BOIB.&nbsp; El Patronat considerarà que desisteixen de la sol·licitud si no compleixen el requeriment.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si no es presenten esmenes a la llista, aquesta esdevé definitiva.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Tercer.- </strong>Publicar la present resolució al Bolletí Oficial de les Illes Balears (BOIB) i a l'apartat d'oferta pública de feina de la pàgina web del PMHRIBA.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra aquesta resolució, que exhaureix la via administrativa, es pot interposar recurs de reposició davant el mateix òrgan que l'ha dictada, conformement al que disposa l'article 123 de la Llei 39/2015, de 1 d'octubre, de procediment administratiu comú de les administracions públiques. El termini per interposar-lo és d'un mes comptat des de l'endemà de rebre la present notificació. En aquest cas no es podrà interposar recurs contenciós administratiu fins que s'hagi resolt el de reposició. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El recurs de reposició potestatiu s'ha de presentar al registre general d'aquest Patronat o a les dependències a què es refereix l'article 16.4 de la Llei 39/2015, de 1 d'octubre, abans esmentada, i es considerarà desestimat quan no s'hagi resolt ni notificat la resolució, en el termini d'un mes, comptat des de l'endemà de la seva interposició. En aquest cas queda expedita la via contenciosa administrativa.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si no s'utilitza el recurs potestatiu de reposició, es pot interposar directament recurs contenciós administratiu, conformement al que estableix l'article esmentat anteriorment, i els 45 i següents de la llei 29/98, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa, davant el Jutjat Contenciós Administratiu, en el termini de dos mesos comptats des de l'endemà de rebre la present notificació.
