    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'apartat 9.3 de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen subvencions per a les explotacions agràries, per als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació en el Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresident en matèria agrària del FOGAIBA, en data de 8&amp;nbsp;de març&amp;nbsp;de 2023, signa la següent resolució:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes &lt;/em&gt;&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions en les explotacions agràries. La Resolució esmentada es va modificar e&lt;/em&gt;&lt;/span&gt;&lt;em&gt;n data 17 de desembre de 2015 (BOIB núm. 185), en data 22 de juny de 2016 (BOIB núm. 81) i en data 26 de juny de 2018 (BOIB núm. 80). &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.&lt;/em&gt;&amp;nbsp;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;Una vegada analitzada tota la documentació presentada, el vicepresident del FOGAIBA va resoldre favorablement la concessió de l'ajuda a favor de MORVEDRA VELL SRM, entre d'altres,&amp;nbsp;que figuren en l'annex de la Resolució de concessió, R1 de 10 de setembre de 2020, (BOIB núm. 161, de 17 de setembre de 2020) amb les dades i els imports corresponents&amp;nbsp;(amb una inversió aprovada de 38.626,46 € i un import concedit de 21.244,46 €).&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;3. A la resolució de concessió ocupa el nº191 d'ordre amb dret a ajuda. De la seva puntuació es desprèn que obté 25 punt per titular d'explotació prioritària. Essent el total de la puntuació obtinguda de 57 punts. Els beneficiaris que no varen obtenir dret a ajuda tenien una puntuació de 43 punts.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;4. El dia 15 de desembre de 2022 es denega per part del director gererent del FOGAIBA la sol·licitud de Ratificació, i es dona de Baixa a l'explotació MORVEDRA VELL SRM amb CIF J 57846586, expedient de RIA 18496 , del Catàleg d'Explotacions Agràries Prioritàries de les Illes Balears al no complir amb els requisits establerts a l'article 5 de la Llei 19/1995, de 4 de juliol, de modernització de les explotacions agràries.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;5. Atès el punt anterior, no manté la puntuació obtinguda a la concurrència, essent actualment de 32 punts, per la qual cosa no te dret a ajuda.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;6. L'article 43 del Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;7. El 9 de febrer de 2023 es notifica la persona interessada, mitjançant la publicació al web del FOGAIBA, l'Informe proposta provisional de resolució de revocació total de 7 de febrer de 2023 a causa de l'incompliment total de les obligacions o els compromisos contres als quals està condicionada l'eficàcia de l'acta de concessió de la subvenció, a l'efecte de complir amb el tràmit d'audiència per dur a terme les al·legacions. Una vegada transcorreguts els 10 dies hàbils, la persona interessada no ha presentat cap al·legació.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;8.&amp;nbsp;S'ha considerat l'Informe/proposta provisional de resolució de revocació total de 7 de febrer de 2023 de l'ajuda concedida a MORVEDRA VELL SRM, amb NIF J57846586.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;2.&amp;nbsp;Finalitzar el procediment i arxivar l'expedient INEA2018_1/114.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;3. Notificar aquesta resolució a la beneficiària mitjançant la publicació al Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
