    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El Pla Estratègic de Subvencions de l'any 2023 estableix com a un dels objectius generals del Departament de Cultura, Educació, Joventut i Esports impulsar polítiques de foment i suport de les entitats culturals. L'objectiu específic d'aquesta convocatòria és donar suport a la realització de projectes culturals desenvolupats en l'àmbit de Menorca per les entitats culturals de l'illa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Com a efectes previstos d'aquesta convocatòria es preveu oferir durant tot l'any activitats culturals arreu de Menorca i potenciar els projectes de les entitats sense ànim de lucre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Atès que en el pressupost del Consell Insular per l'any 2023 es preveu que el Departament de Cultura, Educació, Joventut i Esports realitzi aquesta convocatòria destinada a les entitats culturals;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Vist que el termini de justificació dels ajuts sol·licitats en la convocatòria d'entitats culturals de l'any 2022 finalitza el 31 de març de 2023 i en aquests moments n'hi ha pendents de justificar;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Vist l'informe favorable sobre l'oportunitat i la necessitat de la convocatòria que consta en l'expedient;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Ateses les competències pròpies que sobre aquesta matèria té el Consell Insular de Menorca &lt;/span&gt;d'acord amb els articles 70.18 i 73 de l'Estatut d'autonomia de les Illes Balears i la Llei 6/1994, de 13 de desembre, d'atribució de competències als consells insulars en matèria de patrimoni històric, de promoció sociocultural, d'animació sociocultural, de dipòsit legal de &lt;span style="color:#000000"&gt;llibres i d'esports;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Vista la normativa bàsica aplicable al Consell Insular de Menorca en matèria de subvencions i &lt;/span&gt;en el marc d'allò que estableixen les Bases d'execució del pressupost d'aquesta administració;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Atesa la proposta del conseller executiu del Departament de Cultura, Educació, Joventut i Esports, en exercici de les competències atribuïdes pel Decret 275/2022, de 6 de setembre (BOIB núm. 118 de 8 de setembre);&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El Consell Executiu, per unanimitat dels cinc membres presents &lt;/span&gt;(senyor Maria Ballester, senyora Torrent Bagur, senyor Pastrana Huguet, senyor Juaneda Mercadal i senyora Gómez Estévez) &lt;span style="color:#000000"&gt;i en votació ordinària, adopta els acords següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primer.&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;Aprovar la convocatòria corresponent a l'any 2023, que es &lt;/span&gt;&lt;span style="color:#000000"&gt;regeix &lt;/span&gt;&lt;span style="color:#000000"&gt;per les bases i els annexos aprovats pel Consell Executiu del Consell Insular de Menorca en &lt;/span&gt;&lt;span style="color:#000000"&gt;la &lt;/span&gt;&lt;span style="color:#000000"&gt;sessió &lt;/span&gt;&lt;span style="color:#000000"&gt;de caràcter &lt;/span&gt;&lt;span style="color:#000000"&gt;ordinari de 18 de març del 2019 (BOIB núm. 48 de 13 d'abril de 2019), d'acord amb les condicions següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;a) Es modifiquen les bases abans esmentades amb les actualitzacions següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#1b1b1b"&gt;Es modifiquen les base 8.5, 14 i 15 per adaptar-les a la nova Llei de consells insulars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#1b1b1b"&gt;S'afegeix el model de memòria econòmica en l'annex de documents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#1b1b1b"&gt;S'afegeix a la normativa general aplicable el Decret legislatiu 2/2005, de 28 de novembre, pel qual s'aprova el text refós de la Llei de subvencions de la comunitat autònoma de les Illes Balears (BOIB núm. 196 de 31 de desembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#1b1b1b"&gt;Es modifica la base primera, per afegir que «A les convocatòries corresponents a les ajudes objecte d'aquestes bases es farà constar la justificació de la seva previsió al Pla Estratègic de Subvencions del Consell Insular de Menorca en vigor, assenyalant, si escau, de quina manera contribueixen a l'acompliment dels &lt;/span&gt;seus objectius&lt;span style="color:#1b1b1b"&gt;».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;S&lt;/span&gt;'adjunten les bases modificades en l'annex a efectes informatius.&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;b) Els ajuts concedits s'atendran amb càrrec a la partida pressupostària i amb l'import màxim que s'indiquen més avall:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;L'import màxim a què es destina la convocatòria únicament podrà ampliar-se, sense necessitat de nova publicació, en el supòsit d'aportacions expresses de tercers per a contribuir al finançament de l'objecte de la convocatòria i que s'hagin concretat posteriorment a la seva aprovació. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;c) El termini de presentació de sol·licituds per acollir-se a aquests ajuts és de 30 dies naturals a partir de l'endemà d'haver-se publicat en el BOIB. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segon. &lt;/strong&gt;La instrucció d'aquest procediment correspondrà al tècnic de gestió cultural del Departament de Cultura, David Andreu Capó.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercer. &lt;/strong&gt;Aprovar, així mateix, la constitució de la comissió avaluadora per a la concessió de les sol·licituds presentades, la qual estarà composta pels membres següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;President: -El conseller de Cultura, Educació, Joventut i Esports, Miquel Àngel Maria &lt;span style="color:#000000"&gt; &lt;/span&gt;Ballester.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;- L'administratiu del Departament de Cultura, Educació, Joventut i Esports Jordi Torrent Torroja, que actuarà com a secretari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Quart.&lt;/strong&gt; Comunicar aquests acords a la Base de Dades Nacional de Subvencions prèviament a la publicació de la convocatòria en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; (BOIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;ANNEX&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;Bases que regulen la concessió d'ajuts del Consell Insular de Menorca destinats a entitats culturals&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1. Objecte i finalitat dels ajuts&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Els presents ajuts s'emmarquen en l'exercici de l'activitat de foment que correspon al Consell Insular en matèria de cultura, de conformitat amb l'Estatut d'autonomia de les Illes Balears (articles 70.18 i 73) i la Llei 6/1994, d'atribució de competències als consells insulars en matèria de patrimoni històric, promoció sociocultural, dipòsit legal de llibres i esports. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'objecte dels ajuts és promoure i donar suport a la realització de projectes culturals desenvolupats en l'àmbit de Menorca per part de les entitats culturals de l'illa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La finalitat dels ajuts d'aquesta convocatòria és oferir durant tot l'any activitats culturals arreu de Menorca potenciant els projectes de les entitats sense ànim de lucre, convocatòria que per tant també comporta un vessant social significativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Queden excloses d'aquesta convocatòria les activitats consistents en l'ensenyament de les diferents arts plàstiques i escèniques. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;A les convocatòries corresponents a les ajudes objecte d'aquestes bases es farà constar la justificació de la seva previsió al Pla Estratègic de Subvencions del Consell Insular de Menorca en vigor, assenyalant, si escau, de quina manera contribueixen a l'acompliment dels seus objectius. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2. Finançament i import màxim&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'import màxim i les partides a les quals s'aplicaran els ajuts atorgats en el marc d'aquestes bases són els que s'estableixin en la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Quan l'import de les sol·licituds d'ajuts sigui superior a la quantitat màxima fixada en la convocatòria, es prioritzaran les sol·licituds en funció dels criteris objectius per a la concessió dels ajuts establerts en aquestes bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El percentatge de la subvenció sobre la despesa final de l'activitat o projecte serà, com a màxim, del 5 0%. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Així mateix, cap ajut no podrà superar individualment més del 20 % del total de la quantitat destinada a la present convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3. Activitat subvencionada i requisits dels projectes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El Consell Insular de Menorca subvenciona l'execució de projectes que tinguin lloc durant l'any natural de la convocatòria, que presentin un interès cultural i artístic, que siguin viables tècnicament i econòmicament i que vagin dirigits a un públic eminentment local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;No se subvencionen les activitats de caràcter intern dirigides als socis de l'entitat, així com l'adquisició d'equipaments o les obres d'adequació i millora de les instal·lacions de les entitats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4. Beneficiaris&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4.1 Es poden acollir a aquesta convocatòria d'ajuts les associacions culturals sense ànim de lucre, legalment constituïdes i inscrites en el Registre d'Associacions de les Illes Balears, i les associacions de veïns (només activitats que organitzin de caràcter cultural) l'àmbit d'actuació de les quals sigui l'illa de Menorca. També poden participar-hi les associacions l'àmbit d'actuació de les quals sigui les Illes Balears sempre que disposin d'una delegació o establiment a l'illa de Menorca. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4.2. En el cas d'associacions que tenguin diverses seccions en el seu si, la sol·licitud s'ha de fer pel total dels projectes del conjunt de seccions que la componen. Per aquest motiu, en queden excloses les sol·licituds directes de seccions que formin part d'entitats o associacions culturals més àmplies.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4.3. Queden excloses d'aquesta convocatòria, com a beneficiàries: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a)&lt;/em&gt; Entitats esportives.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b) &lt;/em&gt;Entitats educatives, centres educatius i APA.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c)&lt;/em&gt; Entitats juvenils o que promoguin activitats per a la joventut.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d)&lt;/em&gt; Associacions de gent gran o grups vinculats a aquestes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;e)&lt;/em&gt; Grups folklòrics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;f)&lt;/em&gt; Fundacions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;g) &lt;/em&gt;Entitats que obtinguin un ajut nominatiu en el pressupost anual del Departament de Cultura, Educació, Joventut i Esports del Consell Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4.4. En qualsevol cas, no poden ser-ne beneficiàries les persones o entitats en les quals concorri alguna de les prohibicions establertes en l'art. 13 de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5. Règim de compatibilitat amb altres ajuts&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5.1. Els ajuts que s'atorguin de conformitat amb aquestes bases són compatibles amb la concessió d'altres ajuts, sens perjudici de l'obligació de les entitats beneficiàries de comunicar-ho al Consell Insular de la forma establerta en aquestes bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5.2. L'import de les que es concedeixin no pot superar, en cap cas, de manera aïllada o amb concurrència amb altres ajuts o ingressos (patrocinadors, taquilla...), el cost de l'activitat subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6. Presentació de les sol·licituds&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6.1. Les sol·licituds s'han de formalitzar mitjançant el model normalitzat que s'adjunta com a annex I d'aquestes bases i que es pot descarregar a la seu electrònica del CIM.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El model de sol·licitud inclou, entre d'altres, els aspectes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a)&lt;/em&gt; Memòria del projecte ja executat o projecte que es pensa desenvolupar d'acord amb el model annex, en el qual s'ha d'especificar el nom de l'activitat, una descripció d'aquesta, la localitat, el públic destinatari, el nombre de participants, els recursos humans i materials necessaris i aquells amb què es compta, la durada, el lloc i les dates de realització de l'activitat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b) &lt;/em&gt;Pressupost de despeses, amb indicació del seu objecte i diferenciant-les: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Despeses de personal de l'entitat per dur a terme totes les activitats projectades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;. Despeses de gestió i per al sosteniment de l'entitat per dur a terme les activitats projectades. En queden excloses les despeses d'inversió i amortització de préstecs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Despeses de les activitats culturals projectades. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c)&lt;/em&gt; Pressupost d'ingressos prevists per a l'execució de les activitats, especificant: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Ingressos generats pel mateix projecte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Aportació de la mateixa entitat sol·licitant.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Ingressos prevists per aportació d'altres entitats privades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Ingressos prevists per aportacions d'institucions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6.2. A la sol·licitud s'ha d'adjuntar la documentació administrativa general següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a)&lt;/em&gt; Còpia dels estatuts de l'associació actualitzats acompanyats d'un certificat que acrediti la inscripció de l'associació en el Registre d'Associacions de la CAIB. Si fos necessari de conformitat amb els seus estatuts, cal aportar un certificat de l'acord adoptat per l'òrgan de govern de l'entitat per sol·licitar l'ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b)&lt;/em&gt; Certificat que acrediti les facultats o els poders de la persona que actuï en representació de l'associació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c) &lt;/em&gt;Certificat en què consti que està al corrent de les obligacions tributàries i amb la Seguretat Social davant l'Administració de l'Estat, el qual es pot substituir per una declaració responsable de la persona sol·licitant quan es tracti de subvencions de quantia igual o inferior a 3.000 euros. Els sol·licitants poden autoritzar el Consell Insular de Menorca a comprovar el compliment de les obligacions tributàries i de la Seguretat Social davant l'Administració de l'Estat (aquesta declaració es pot fer emplenant l'apartat corresponent del model de sol·licitud recollit en l'annex 1).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d)&lt;/em&gt; Còpia del document d'identificació fiscal del sol·licitant (NIF o CIF) i del representant.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;e)&lt;/em&gt; Declaració responsable signada pel sol·licitant o pel seu representant legal de no estar sotmès a cap de les circumstàncies que determinen la impossibilitat d'obtenir la condició de beneficiari o entitat col·laboradora de les subvencions públiques recollides en l'art. 13.2 de la Llei 28/2003, de 17 de novembre, general de subvencions (BOE núm. 276, de 18 de novembre de 2003), el model de la qual s'adjunta com a annex 2 d'aquestes bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;f) &lt;/em&gt;Declaració responsable signada pel sol·licitant o pel seu representant legal relativa a les subvencions o ajudes obtingudes o sol·licitades d'altres institucions, públiques o privades, per realitzar la mateixa activitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;g)&lt;/em&gt; Document de designació de compte bancari de l'entitat o del seu representant segons model facilitat pel Consell Insular de Menorca, llevat que ja constin a la Tresoreria General del CIM, la qual cosa s'ha de fer constar expressament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;S'eximeix de presentar la documentació a què fan referència les lletres &lt;em&gt;a, b, d&lt;/em&gt; i &lt;em&gt;g&lt;/em&gt; quan aquesta ja figuri en els arxius del Consell Insular; en aquest cas s'ha de fer constar expressament en la sol·licitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6.3. D'acord amb l'article 28.3 i 53&lt;em&gt; c&lt;/em&gt; de la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú de les administracions públiques, les persones interessades no tenen l'obligació de presentar documents originals, llevat que, amb caràcter excepcional, la normativa reguladora aplicable exigeixi el contrari. En qualsevol cas, les persones interessades són responsables de la veracitat dels documents que presenten (art. 28.7 de la Llei 39/2015).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;D'acord amb l'art. 28.5 de l'LPACAP, excepcionalment, quan la rellevància d'un document de l'expedient aportat per l'interessat ho exigeixi, o hi hagi dubtes derivats de la qualitat de la còpia, el CIM pot sol·licitar de manera motivada la compulsa o autenticació de les còpies aportades per la persona interessada, per la qual cosa pot requerir l'exhibició del document o de la informació original.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6.4. Pel fet de presentar-se a aquesta convocatòria la persona interessada presta al CIM els consentiments següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a)&lt;/em&gt; Per consultar i comprovar la veracitat de la documentació i de les dades presentades per l'interessat que tenguin en el seu poder altres administracions públiques, principalment mitjançant les plataformes d'interoperabilitat, les xarxes corporatives o altres sistemes electrònics habilitats a aquest efecte i als quals el CIM tengui accés.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b) &lt;/em&gt;Per consultar l'existència i la veracitat de la documentació i de les dades que eventualment l'interessat hagi considerat oportú no presentar acollint-se al dret de no fer-ho pel fet que hagin estat elaborades per les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Els esmentats consentiments només es consideraran atorgats quan no consti en l'expedient l'oposició expressa a l'esmentada consulta o quan la llei especial que sigui aplicable al cas en requereixi el consentiment exprés, en aquest darrer cas serà obligatori que l'Administració el requereixi i que l'interessat el presti. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6.5. Les sol·licituds i tota la documentació transcrita en els apartats anteriors s'han de presentar, dins el termini establert en la convocatòria, al registre electrònic del Consell Insular de Menorca (www.cime.es) o a qualsevol altre registre electrònic dels establerts en l'article 16.4 de l'esmentada llei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Si algun dels subjectes obligats als quals fa referència l'art. 14, apartats 2 i 3 de l'LPACAP, presenta la sol·licitud presencialment, se'l requerirà per tal que l'esmeni mitjançant la seva presentació electrònica. A aquests efectes, i d'acord amb el que estableix l'article 68.4 de la mateixa llei, es considerarà com a data de presentació de la sol·licitud aquella en què hagi tingut lloc l'esmena.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6.6. Si la sol·licitud o la documentació fossin incorrectes o incompletes, el Consell Insular de Menorca en requerirà la rectificació o el complement necessaris. Si en el termini de deu dies hàbils, comptats des de l'endemà del dia que es rebi el requeriment d'esmena de la sol·licitud, la persona interessada no fa la rectificació reclamada o no presenta la documentació requerida, s'entendrà que ha desistit de la seva petició de conformitat amb l'article 68 de l'LPACAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7. Criteris objectius que es tindran en compte per a la determinació de l'import de l'ajut&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;7.1. Poden ser beneficiàries d'aquestes ajudes totes les entitats que compleixin els requisits de la base quarta i els projectes de les quals compleixin el que estableix la base tercera (projectes que tenguin lloc durant l'any de la convocatòria, que presentin un interès cultural i artístic, que siguin viables tècnicament i econòmica, i que vagin dirigits a un públic eminentment local).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;7.2. Un 50 % de l'import global màxim dels ajuts de la convocatòria es repartirà d'acord amb els criteris de valoració que s'indiquen a l'apartat 2.1, l'altre 50 % segons el pressupost de despeses de l'activitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;7.2.1. &lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;D'acord amb l'article 31.9 LGS i 40.9 del TRLS (DL 2/2005), les despeses de personal i de gestió i sosteniment de l'entitat (costos indirectes a l'activitat subvencionada) només es poden imputar “en la part que raonablement correspongui d'acord amb els principis i les normes de comptabilitat generalment admeses, en tot cas, en la mesura que aquests costos corresponguin al període en què efectivament es duu a terme l'activitat”. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;7.3. L'import dels ajuts es determinarà de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El primer 50% de l'import global màxim dels ajuts, corresponent als criteris prevists en l'apartat 7.2.1, es calcularà de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d)&lt;/em&gt; La quantitat que correspon a cada sol·licitud és la multiplicació del valor de cada punt pels punts obtinguts pel sol·licitant.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'altre 50 % de l'import global màxim dels ajuts, corresponent al criteri del pressupost, es repartirà proporcionalment a l'import de les despeses subvencionables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En cas que la suma dels dos apartats anteriors sigui superior a l'ajuda sol·licitada o a l'import màxim per sol·licitud que estableixi la convocatòria, el romanent que hi pugui quedar a conseqüència d'aquesta correcció es repartirà amb el mateix sistema proporcional entre la resta de sol·licitants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;7.4. Cap sol·licitant podrà rebre en concepte de subvenció més del 50% del pressupost de les despeses originades per a dur a terme l'activitat. Així mateix, cap ajut no podrà superar individualment més del 20% del total de la quantitat destinada a la present convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8. Procediment i òrgans competents per a la concessió dels ajuts&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8.1. Els ajuts es concediran, d'acord amb els principis d'objectivitat, transparència, igualtat, no discriminació i publicitat, per mitjà del procediment de concurrència competitiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8.2. L'inici de l'expedient s'efectua per mitjà de l'aprovació de la convocatòria corresponent. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El text de la convocatòria i la resta de documentació que es requereixi s'han de comunicar a la Base de Dades Nacional de Subvencions (d'ara en endavant BDNS) i se n'ha de publicar l'extracte en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;, en compliment de l'art. 20.8 de la Llei general de subvencions. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8.3. La instrucció correspon al tècnic de gestió del Departament de Cultura, que ha de realitzar d'ofici totes les actuacions necessàries per a la determinació, el coneixement i la comprovació de les dades en virtut de les quals s'ha de dictar resolució sobre la concessió dels ajuts. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8.4. Totes les sol·licituds presentades dins el termini establert en la convocatòria se sotmetran a l'examen de l'instructor de l'expedient o de la comissió avaluadora, en el cas que sigui obligatori constituir-la.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8.5. &lt;span style="color:#000000"&gt;Una vegada examinades les sol·licituds per l'instructor o la comissió avaluadora corresponent, i després que aquesta hagi emès el seu informe, el conseller executiu cap del Departament competent en matèria de Cultura dictarà resolució sobre la concessió o la denegació dels ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8.6. Reformulació de sol·licituds: quan la quantia de l'ajut proposat per l'òrgan instructor o la comissió avaluadora sigui substancialment inferior al sol·licitat, es podrà instar el beneficiari a reformular la seva sol·licitud a fi d'ajustar els compromisos i les condicions de la subvenció atorgable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8.7. La resolució de l'expedient d'atorgament de les subvencions ha de ser expressa i motivada, i ha de fixar, amb caràcter definitiu, la quantia específica de cada una de les subvencions concedides.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8.8. Si la subvenció implica una despesa pluriennal, la resolució de concessió ha de determinar el nombre d'exercicis a què s'aplicarà la despesa i la quantitat màxima que s'ha d'aplicar a cada exercici.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8.9. El termini màxim per dictar i notificar la resolució expressa de concessió de subvenció és de sis mesos comptats des de la data d'acabament del termini de presentació de sol·licituds. Això no obstant, aquest termini es pot reduir si s'estableix expressament en la convocatòria dels ajuts. El silenci administratiu té caràcter desestimatori.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8.10. La resolució de l'expedient de concessió o denegació dels ajuts s'ha de remetre a la BDNS en compliment de l'art. 20.8 de l'LGS, i s'ha de publicar en el &lt;em&gt;Butlletí&lt;/em&gt; &lt;em&gt;Oficial de les Illes Balears&lt;/em&gt;, sens perjudici de notificar-la individualment a les persones interessades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8.11. La concessió de l'ajut es pot instrumentar mitjançant la formalització d'un conveni de col·laboració amb l'entitat beneficiària en què es determinin els drets i les obligacions de les parts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9. Comissió avaluadora&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;9.1. La comissió avaluadora és l'òrgan col·legiat a qui correspon examinar les sol·licituds presentades i emetre'n l'informe que ha de servir de base per a l'elaboració de la proposta de resolució que ha de formular l'òrgan instructor competent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;9.2. La comissió avaluadora estarà formada pels membres següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;President: conseller de Cultura, Educació, Joventut i Esports.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Vocals: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Directora insular de Cultura i Patrimoni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Un tècnic del Departament de Cultura, Educació, Joventut i Esports.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Un administratiu del Departament de Cultura, Educació, Joventut i Esports, que actuarà de secretari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;9.3. La comissió avaluadora s'ha de constituir obligatòriament i preceptivament en les convocatòries quan l'import global dels fons públics prevists en la convocatòria sigui superior als 50.000 euros, o quan l'import individual màxim de la subvenció sigui superior a 7.000 euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;9.4. Quan no sigui preceptiva la seva constitució, l'existència de la comissió avaluadora només serà necessària si es preveu en la resolució de la convocatòria corresponent, en la qual s'ha de fixar en tot cas quin és l'òrgan que ha d'examinar les sol·licituds i ha d'emetre l'informe que ha de servir de base per a l'elaboració de la proposta de resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;10. Abonament dels ajuts&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;10.1. El pagament de l'ajut es tramitarà una vegada justificada la realització de l'activitat subvencionada. L'abonament dels ajuts per part del Consell Insular es realitzarà en un termini de 60 dies a partir de la data de justificació de l'activitat i sempre que la disponibilitat de tresoreria ho permeti.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;10.2. L'interès cultural de les actuacions finançades justifica que, d'acord amb l'art. 37 del TRLS i concordants, es pugui sol·licitar una bestreta de l'ajut concedit, amb la presentació, si escau, de les garanties adients. Es podrà sol·licitar una bestreta fins a un màxim del 100 % de l'ajut concedit, depenent de si és una entitat que desenvolupi activitats tot l'any i demostri una llarga trajectòria cultural dins Menorca, o si és una entitat que dugui a terme una activitat puntual, en aquest cas, l'entitat rebria fins a un màxim del 75 %. El 25 % restant s'abonarà una vegada justificada l'activitat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;10.3. En els supòsits de concessió de bestreta, d'acord amb l'article 37 TRLSIB, els beneficiaris estan exempts de constituir garantia quan, d'acord amb la legislació vigent, gaudeixin del privilegi d'exempció de constitució de garanties davant els òrgans jurisdiccionals i en la resta de supòsits prevists a l'article 42 de l'RLGS. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;10.4. En qualsevol cas, queden exonerats de prestar garantia els beneficiaris de subvencions concedides per import inferior a 3.000 €, d'acord amb l'art. 43 de l'RLGS, i les entitats que, d'acord amb la legislació vigent, gaudeixin del privilegi d'exempció de constitució de garanties davant els òrgans administratius (com les associacions declarades d'utilitat pública), d'acord amb l'art. 37 TRLS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;11. Justificació de les despeses&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;11.1. Les entitats beneficiàries resten obligades a justificar les despeses efectuades amb càrrec a l'ajut econòmic concedit abans de 31 de març de l'any següent al de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;11.2. La documentació acreditativa per justificar les despeses és la següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Compte justificatiu simplificat, previst a l'article 75 del Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de subvencions, integrat per la documentació següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a)&lt;/em&gt; Una memòria breu de les actuacions dutes a terme, amb indicació de les activitats realitzades i dels resultats obtinguts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b)&lt;/em&gt; Una relació de despeses realitzades amb indicació del creditor i les dades de la factura o altre document justificatiu de la despesa, i en el seu cas la data de pagament, amb indicació de les desviacions produïdes respecte del pressupost inicialment presentat. En la justificació s'admetrà com a màxim una desviació del 10% del pressupost inicial subvencionable sense que doni lloc a la revocació parcial de l'ajut.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c)&lt;/em&gt; Una relació d'ingressos o subvencions (inclosos patrocinadors, taquilla...) que hagin finançat les actuacions, amb indicació de l'import i de la seva procedència&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'import de les subvencions o ajuts que es concedeixin no pot superar, en cap cas, de manera aïllada o amb concurrència amb altres ajuts o ingressos (patrocinadors, taquilla...), el cost de l'activitat subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d)&lt;/em&gt; Un exemplar de la publicitat escrita i gràfica relativa a l'activitat subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Es comprovaran, a través de tècniques de mostreig, els justificants que s'estimin oportuns i que permetin obtenir evidència raonable sobre l'adequada aplicació de la subvenció, per la qual cosa es podrà requerir al beneficiari que remeti els justificants de despesa seleccionats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Si la documentació presentada és incompleta o incorrecta, el servei responsable demanarà al beneficiari que en faci la rectificació oportuna en el termini improrrogable de deu dies hàbils. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;11.3. Si la despesa justificada excedeix de l'import concedit, la possible desviació pressupostària anirà a càrrec de l'entitat subvencionada. Si, per contra, la despesa justificada és inferior a l'import del pressupost sol·licitat i subvencionat, es reduirà de forma proporcional la subvenció concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;11.4. El Consell Insular de Menorca podrà inspeccionar els projectes subvencionats, sens perjudici de les competències que puguin correspondre, per normativa legal o reglamentària, a altres organismes o institucions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;11.5. L'incompliment de l'obligació de justificació podrà motivar la incoació d'un procediment sancionador i el responsable arribar a ser sancionat amb la pèrdua de la possibilitat d'obtenir subvencions en els termes prevists a la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;12. Obligacions dels beneficiaris&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Són obligacions dels beneficiaris:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a)&lt;/em&gt; Comunicar al CIM l'acceptació de la subvenció en els termes en què aquesta es concedeixi. En qualsevol cas la subvenció s'entendrà acceptada tàcitament un cop transcorreguts quinze dies hàbils d'ençà que el beneficiari hagi rebut la notificació de la concessió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b)&lt;/em&gt; Dur a terme l'activitat objecte de subvenció de gener a desembre de l'any de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c)&lt;/em&gt; Dur a terme els projectes que fonamenten la concessió dels ajuts, i justificar la seva realització en els terminis i en les condicions establertes en aquestes bases i en la resolució de concessió dels ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d)&lt;/em&gt; Proporcionar la informació sobre l'activitat subvencionada que li demani el Consell Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;e)&lt;/em&gt; Sotmetre's a les actuacions de comprovació que efectuïn el Consell Insular de Menorca i la resta d'organismes competents per a la fiscalització dels comptes públics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;f)&lt;/em&gt; Comunicar al Consell Insular de Menorca la sol·licitud i l'obtenció de subvencions i ajudes per a la mateixa finalitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;g)&lt;/em&gt; Fer constar, de manera expressa, el suport del Consell Insular de Menorca en la publicitat dels projectes subvencionats. En aquest sentit, la difusió s'ha de fer a través dels mitjans que siguin adequats d'acord amb la naturalesa del projecte. Si es fan fullets, cartells o qualsevol altre material imprès, s'hi ha de fer constar, de manera expressa, el suport del Departament de Cultura i Patrimoni del Consell Insular Menorca, així com el web www.cime.es en la realització de les activitats subvencionades (en cas d'actuacions que tenguin lloc després de la convocatòria) i el logotip de la candidatura de la cultura talaiòtica de Menorca per ser reconeguda com a patrimoni mundial per la Unesco.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;h)&lt;/em&gt; Comunicar immediatament al Consell Insular de Menorca qualsevol eventualitat que alteri o que dificulti greument el desenvolupament del projecte subvencionat, en particular si se'n poden derivar retards en l'execució o si poden afectar-ne el cost total, i sol·licitar l'autorització prèvia i expressa del Consell Insular per fer qualsevol modificació substancial del projecte objecte d'ajuda. Les sol·licituds de modificació han de ser motivades, s'han de formular immediatament a l'aparició de les circumstàncies que la justifiquin i s'hi han d'especificar les repercussions pressupostàries que impliquin.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;i)&lt;/em&gt; Les entitats es comprometen a incloure elles mateixes les activitats que realitzin amb una antelació de 15 dies al web http://www.agendamenorca.org/.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;j)&lt;/em&gt; Acreditar, quan el Consell Insular ho sol·liciti, que es troba al corrent de les obligacions tributàries i amb la seguretat social. L'acreditació d'estar al corrent de les obligacions tributàries no serà necessària en el cas que s'hagi autoritzat expressament el Consell Insular a consultar aquestes dades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;13. Revocació i reintegrament dels ajuts. Criteris de gradació de possibles incompliments&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;13.1. En el cas d'incompliment total o parcial de les obligacions dels beneficiaris d'aquests ajuts s'iniciarà el corresponent expedient de revocació i consegüent reintegrament, si correspon. Pel que fa a la revocació i el reintegrament dels ajuts s'aplicaran els articles 24, 43 i 44 del TRLS i la resta de normativa que sigui aplicable. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;13.2. Pels casos que preveu l'art. 44 del TRLS, en què no correspongui la revocació total de l'ajut concedit, es podrà aplicar un percentatge de minoració en funció de l'incompliment. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Aquest percentatge s'ha de fixar amb l'informe previ de l'instructor i la notificació al beneficiari. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;13.3. Si s'haguessin fet uns pagaments anticipats, la persona beneficiària ha de reintegrar les quantitats que hagin esdevingut indegudes més l'interès de demora, comptador des que el pagament es va fer efectiu fins a la data de la resolució mitjançant la qual s'acordi el reintegrament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;13.4. Les quantitats que s'hagin de reintegrar tindran la consideració d'ingressos de dret públic i els hi és aplicable la via de constrenyiment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;13.5. L'obligació de reintegrament establerta en aquest article és independent de les sancions que per la naturalesa de l'incompliment puguin en el seu cas ser exigibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;14. Infraccions i sancions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;14.1. El règim d'infraccions i sancions administratives aplicables és el que estableix el títol IV de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;14.2. &lt;span style="color:#000000"&gt;L'&lt;/span&gt;òrgan competent per imposar les sancions que es derivin d'infraccions de l'establert en aquestes bases i de la normativa aplicable en matèria de subvencions és el conseller executiu competent pel que fa a infraccions lleus i greus, pel que fa a infraccions molt greus serà el Consell Executiu, d'acord amb el que estableix l'article 69 de la Llei 4/2022, de 28 de juny, de consells insulars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;15. Altres disposicions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Recursos administratius&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Els acords del Consell Executiu pels quals s'aproven les bases i la convocatòria no exhaureixen la via administrativa i són susceptibles de rebre recurs d'alçada davant el Ple del Consell Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Els acords dels consellers executius pels quals es concedeixen o deneguen els ajuts, no exhaureixen la via administrativa i són susceptibles de rebre recurs d'alçada davant el Consell Executiu del Consell Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Normativa general aplicable&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En tot el que no preveuen expressament aquestes bases regeixen les disposicions que siguin d'aplicació al Consell Insular de Menorca en matèria de subvencions, especialment les contingudes en la norma següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Llei 38/2003, de 17 de novembre, general de subvencions&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;- Reglament de la Llei general de subvencions (Reial decret 887/2006, de 21 de juliol)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Decret legislatiu 2/2005, de 28 de novembre, pel qual s'aprova el text refós de la Llei de subvencions de la comunitat autònoma de les Illes Balears (BOIB núm. 196 de 31 de desembre de 2005)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;ANNEX 1: Model normalitzat de sol·licitud &lt;/strong&gt;(consta en l'expedient)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;ANNEX 2: Model declaració responsable &lt;/strong&gt;(consta en l'expedient)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;ANNEX 3: Model fitxa del projecte &lt;/strong&gt;(consta en l'expedient)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;ANNEX 4: Model de memòria econòmica &lt;/strong&gt;(consta en l'expedient)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra aquest acord – que no exhaureix la via administrativa – es pot interposar un recurs d'alçada davant el Ple en el termini d'un mes comptador des de l'endemà que s'hagi publicat, d'acord amb l'article 122 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'esmentat recurs s'entendrà desestimat, si no es notifica la resolució corresponent, quan hagin transcorregut tres mesos des de la seva interposició. Contra la desestimació del recurs d'alçada per silenci administratiu podreu interposar recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
